What are we learning now about the victims this morning and what can you tell us about where this investigation stands . Reporter still a very dynamic investigation and overnight we heard an unfortunate update in that the shooting has now claimed five lives. Well explain more on those victims in just a second the Crime Scene Tape has come down overnight here around Old National Bank and this is where Authorities Say it was around 8 30 yesterday when this gunman now identified as 25yearold Connor Sturgeon walked inside, armed with what has now been described as an ar15 type rifle and opened fire, wounding nine people two of those, Bullet Wounds went to Police Officers we know one of those injured, ana, is 26yearold nickolas wilt, he had just been sworn in two weeks ago, and as a result of that, were told that his wounds had to have Emergency Brain Surgery done hes in critical but stable condition right now. But, of course, all hearts go to those five lives lost. Id like to share their names with you right now they are jim tut, josh barrick, juliana farmer, and overnight deana eckert, also Tommy Elliott, and mr. Elliott was acknowledged yesterday by governor andy beshear, who said he was a very close friend and he added these words take a listen. Tommy elliott helped me build my law career. Helped me become governor. Gave me advice on being a good dad. It is one of the people i talked to most in the world and very rarely were we talking about my job. He was an incredible friend. Reporter and as of right now, we do know some of those nine injured have been released from area hospitals. But two victims still remain in critical condition, ana. I found out this morning that the brother of that injured officer, nickolas wilt, is following in his footsteps hes about halfway through louisvilles Police Academy program. Ana . Ken, youve been digging into kentuckys gun laws. What have you learned . Well, ana, like a lot of red states, kentucky has been repealing gun laws in recent years. In 2019, the Legislature Took away what had been a mandate to get a license if you wanted to carry a concealed weapon in kentucky basically, there are no rules other than the federal requirement that you cant buy a gun if you have a Felony Conviction there is no state rule against someone with Mental Illness or Domestic Violence conviction or violent misdemeanor conviction from acquiring a gun in kentucky more than that, just a few weeks ago, the a bill became law in kentucky, known as the Second Amendment sanctuary law, which essentially makes it a crime for kentucky officials to enforce certain federal gun regulations. In this case, regulations passed after 2021 now, a lot of scholars believe these kinds of laws are unconstitutional, but right now this is on the books in kentucky the governor didnt sign it, he cant veto it because it passed with vetoproof measures another example of how antigun regulation a majority of at least the State Legislature in kentucky is. A lot to learn still about the shooting we are anticipating an 11 30 News Conference where we should get more Information Morgan and ken, thank you, both. For more now, i want to bring in congressman morgan mcgarvey, a democrat from kentucky who represents the louisville area first, i want to tell you how sorry i am for your loss and what your community is having to go through right now i understand you also knew Tommy Elliott, the same person governor andy beshear and even florida senator rick scott knew. Im wondering if you could just talk about him, your relationship, what he meant to you. Yeah. Thank you. This is so hard. Louisville is a special place. We call it louis village, the smallest big city in america Everybody Knows everybody. Were really one degree of separation when we ask you here what school did you go to, we mean high school ive known Tommy Elliott for 15 years or so. A guy who really loved life, who loved being in the mix, who loved getting things done, who loved helping people out because it is louisville and everybody is one degree of separation, my wife worked with his wife for a time, his daughter, claire elliott, was the scheduler for my predecessor and john yarmuth, who held this seat and all the people who worked for him who still work for me in this office, their friend, their coworker flew home to louisville last night, her hometown, where she no longer has a dad. This is tragic it is really hurting our community. I went to the vigil last night for josh barrick, a guy who is about my age, and, you know, he has two children under 10 years old. Hes leaving a wife and two small children behind, just because he went to work yesterday. This is something that is going to hurt us for a long time were going to be working to try and heal and then, of course, you know, i think its also while were grieving, having the conversation about how we make sure this doesnt happen again and i want to thank you for just walking us through what you know about these victims because i think it is so important to shine light on their lives that were taken way, way, way too early and clearly it sounds like your friend, tommy, is somebody who had a huge impact on you and so many others you talk about what solutions are out there to try to prevent more gun violence. You put out a statement after yesterdays shooting and i read it here, today serves as a stark reminder that we need to address gun violence at the national level, so no other family loses a son, a daughter, and a loved one. I know just ten days ago you were there on the house floor, talking about gun reform, you called for universal Background Checks, for banning Assault Weapons. What specific Legislation Realis real realistically could you see republicans compromising on, if any . I think we have to take the acknowledgement that we cant say theres nothing we can do when were doing nothing and this is not this shouldnt be the politics, this should be about peoples lives, public safety, it should be about putting people over guns, about putting kids over guns, about coming together and saying 90 of the American Public supports universal Background Checks we can do this as a congress we can ban these Assault Weapons that are weapons of war. And were still finding out and Morgan Chesky said it is a dynamic investigation. But we know an ar15 rifle was used to go into a his workplace and, i mean, terrorize people, end lives. You talked about the officer, he was on his fourth shift ever when he ran into gunfire and was shot in the head with an ar15 rifle. We can ban these weapons of war from our streets and we should lets also recognize there are Mental Health problems in this country that laws like ive introduced in the Kentucky State Senate before getting to congress that the crisis aversion rights will take away firearms from people in crisis really could keep people alive and give us the tools to deal with this uniquely american epidemic it is 146 Mass Shootings this year and were 100 days into this year. More Mass Shootings per day, it is awful i know some of your republican colleagues prefer to let states make the laws and we were just showing a graphic with kentuckys gun laws specifically yes, they have certain child access prevention laws, but if we could put that graphic back up, look at what that gun law is lacking. Universal Background Checks, gun owner licensing, extreme Risk Protection orders, Domestic Violence gun laws, the list goes on and on and on and yet when you look nationally, a gallup poll from just thispast february finds 63 of americans are dissatisfied with u. S. Gun laws at all levels. 34 say theyre satisfied. If you break it down by party, you can see 54 of republicans are satisfied. 14 of democrats are but why . Why is it so hard to find agreement on gun reform when americans agree the current gun laws arent working . We have to stop putting in political terms, right this is about public safety. It is about peoples lives and for those who talk about the states, look, i got elected to congress in november, for ten years prior to that, i served in the Kentucky State Senate, Minority Leader for the last four years fighting against a lot of the kentucky measures on the floor of the state senate. The reason we need stronger federal laws is im sitting in my District Office right now in louisville, kentucky, the easiest place i could probably go buy a gun now is clarksville, indiana, just across the river if kentucky banned assault rifles, thats a good step, but we need to do it on a federal level. So that, you know, when yo have states like ours which are so close to other states, that everyone is protected. So these are conversations that i think we need to have honestly we need to listen honestly and say, why do we need these weapons . The other member of the Tennessee Three expelled, Justin Pearson, could be sent back to the capitol as soon as tomorrow. Lets get the latest with nbcs catie beck with us from nashville. What was jones return like and what is next for him and Justin Pearson . Reporter yeah, ana, as you saw, it was a triumphant return yesterday, starting at the city council meeting, hundreds of supporters following that and then actually marching over here to the Tennessee State capitol where that formal vote and you heard the cheering, you heard the Loud Celebration Inside the State Capitol as he was reinstated hes saying there is still a long way to go, but this is a step 2in the right direction and democracy has to be celebrated in this. Thats what he said on the floor and what he said to supporters afte afterwards here is a little bit of what he said reporter now, mondays decision is just one step of the process for jones. This was a temporary reappointment, which means that he will have to face a special election in coming months. That is also the same for his colleague, Justin Pearson. His fate will be decided tomorrow by the Shelby County commission in memphis. If he is reappointed as well, he, too, will face a special election in coming months. So, still a lot to be determined, ana. Okay, catie beck, thank you with the latest from nashville for us joining us now is tonya hancock, a Nashville Metro Council member who voted for jones reinstatement. That vote was unanimous, all 36 of you voted to reinstate him. What message did you want to send well, really the people sent the message. We received over 2,000 emails, almost all of them in support of representative jones i think i received nine emails that were resistant to sending him immediately back and 2,266 emails in support. It is the most we have gotten on any one issue our entire four years this term. One of the attorneys advising justin jones as well as Justin Pearson, we learned is former Attorney General eric holder he wrote a letter yesterday, warning not to take away any further, you know, benefits or powers given to these members and not to take any retribution against jones or pearson are you worried about any further action that this gop Super Majority could take . I am not worried now. I was worried yesterday. I was concerned that even though we unanimously voted for his appointment, and we immediately had a second meeting to approve the minutes of the first meeting, i was worried that he would not be activated with his credentials. I was worried he wouldnt be introduced to the house in time for the meeting monday night, but he was and im so proud of our legislators for putting the politics behind them and putting the voice of the people first. A grand jury in virginia now indicted the mother of a 6yearold boy who shot and seriously wounded his first grade teacher in her classroom the mother is facing charges of Child Neglect and failing to secure her handgun Nbc News National Correspondent Miguel Almaguer has more reporter that mother is now facing a felony and misdemeanor count after her 6yearold son shot his teacher while she plans to turn herself in this week, the commonwealths Attorney Says this case is still open and additional indictments and charges could follow i have a report of a teacher shot. Reporter more than three months after Abigail Zwerner was shot by her 6yearold student in class, the mother of that young boy has now been criminally charged a newport news grand jury indicting 25yearold deja taylor of Felony Neglect and one count of recklessly leaving a loaded firearm so as to endanger a child. Who would be prepared for a 6yearold to bring a loaded weapon to School Reporter after authorities announced the 6yearold would not be charged with a crime, the commonwealths attorney said every criminal case is unique in its facts, and these facts support these charges, but our investigation into the shooting continues. I just will never forget the look on his face that he gave me while he pointed the gun directly at me thats something that i will never forget reporter the boys family also said he suffers from an acute disability and he was under a care plan at the school that includes his parents accompanying him to class every day. But according to a statement from the family, the week of the shooting was the first week when they were not in class with him. Zwerners civil suit also alleging that the parents did not disagree for him to be placed into Special Education classrooms zwerners Attorney Says the new indictment addresses one failure, but School Leaders are also accountable at that point in time, you have a ticking time bomb in the school, and the school failed to do anything about it reporter while questions still remain over how the 6yearold was able to access the gun, the family said the weapon was secured and they always have been committed to keeping firearms out of the reach of children. The doj has now officially appealed the decision by a texas judge to block fda approval of the drug mifepristone. His order is set to go into effect Early Saturday Morning if the Appeals Court doesnt step in the doj is asking the Appeals Court to essentially further halt the judges ruling as they take a closer look at this case. Now, the Justice Department also says it is prepared to take this issue all the way to the Supreme Court. This comes as more than 200 Drugmakers Led by pfizer have signed an open letter now condemning the decision by this one texas federal judge. And joining us now is nbcs dasha burns, who has been Follfollow Ing Every Development in this legal fight. What is the doj asking for here and if the Appeals Court doesnt make a ruling, what does that mean does that mean the texas judges order goes into effect it is a great question. And there has been a lot of chaos and confusion here because nothing about this is simple look, number one priority for the doj right now is to stop that Ticking Clome Pressure Tha leading up to that saturday deadline at which point theoretically the texas judges decision would go into effect. So the doej is asking the court of appeals to put a pause on that, to remove that saturday deadline so the case has a chance, everyone has their chance to make their arguments and the case can go through the Appeals Court. The doj has asked for the Appeals Court to lift that deadline to take action, but they dont necessarily have to we dont know what is going to happen so it is possible that the doj will then take it to the Supreme Court. If the Appeals Court rules in favor of the doj, it is possible that the plaintiffs could also take it to the Supreme Court so there are a number of ways it could get there. And on top of that, ana, you have this case in Washington State by another federal judge with equal authority that has given a totall ruling here, telling the fda to maintain access to mifepristone in the 17 states and washington, d. C. That brought that lawsuit now, of course, those states cannot comply with both of those orders so the doj has also asked the judge in that case to clarify what they mean, what theyre supposed to do here. So, a lot of confusion in the meantime, and for clinics, for providers and for women right now trying to figure out what to do, this is a tough time. There are so many moving parts here and as you point out, so much more to be determined. Thank you for staying on top of it for us, dasha, great to see you. I want to bring in dr. Jennifer desenso, an obgyn who works in the d. C. Area doctor, thank you for being here you heard dashdashas report it is a lot to figure out. Youve been prescribing this drug for years how important is it for care thank you so much for having me and i think that dasha set this conversation up well in confusing us in terms of what is actually going on. I think the most important point right now is that regardless of this opinion, mifepristone remains extraordinarily safe we have decades of data to suggest it is a very, very safe medication and is essential to healthcare for people who need Abortion Care as well as other healthcare like Miscarriage Management this ruling which is filled with bias and very politically motivated language is incredibly upsetting and is really impacting the way that physicians are able to care for their patients yesterday, today, and probably for the rest of the week until we understand a little bit more about whats going on. What is your plan if fda approval of this ends up blocked, what will you do . So, i think that we will follow the guidance of both the fda, hopefully they will give us some robust information about how to continue caring for patients well follow the guidance of the American College of obstetricians and gynecologists and we know there are other drugs that can be used mifepristone is used in combination with another drug c call Ed Misoprostol you can use the second medication alone it doesnt work as well. But it is very, very safe. And so we may end upneeding to turn to a onedrug regiment using misoprostol if mifepristone is no longer available to us. Im sure there is a lot of concern and confusion right now. What are you hearing from them this week . So, patients are incredibly confused and doctors are incredibly confused i received a flurry of Text Messages friday evening when this opinion dropped and everyone was having various levels of concern and some anger, but there is one that sticks out to me, it comes from a dear friend of mine, still in clinic at 6 30 at night taking care of her patients and texted me and said, so can i give mifepristone to the next patient i have or am i not allowed to do that that is the level of chaos, confusion, and power that this decision has whether or not this judge has the ability to make this determination about the fda drug is a legal question i cant answer im just a physician but what i can tell you is that this decision has had a significant Chilling Effect on the way that physicians are able to take care of their patients and think about this incredibly safe medication that is part of Essential Healthcare with access to mifepristone in question, we know at least three states, california, massachusetts and washington that have started Gathering Stockpiles of this pill. I wonder if the drug is pulled, do you worry doctors and patients will even be able to access these stockpiles . I think thats a significant concern. This morning, nbc news can report that congressional leaders are finally getting answers about those classified documents and the probes into former President Trump, President Biden and former Vice President pence having those documents in their possession. The gang of eight, the bipartisan leaders of the house and senate, and the heads of the intel committees have gotten access to those documents recovered from trump, pence and bidens homes and offices. The lawmakers getting new insight into that investigation as trump is now moving to block pence from testifying in the Special Counsels probe into january 6th. Joining us now, nbc news senior Legal Correspondent laura jarrett, also with us former u. S. Attorney and former senior fbi official Chuck Rosenberg great to have you both here. Lets start with trumps efforts to block pence from testifying in the Special Counsel probe tell us more about that and are these efforts working . So we know pence is willing to testify hes willing to tell his story and produce documents, but his former boss doesnt want him to say anything and his former boss, trump, is trying to cite executive privilege, basically to say all the conversations should be shielded that argument hasnt done so well in the d. C. Court of appeals. Hes done it before to try to block most of his senior aides from testifying. The d. C. Circuit has not gone for that argument. Remains to be seen if theyll have a different outcome when it comes to pence we have seen now on the docket the Briefing Schedule for this goes way out into may. So we may not see an actual decision on whether pence has to testify for a little bit often we know part of the maneuverings is to delay the case, try to extend it out okay laura, thank you for that update let me pivot here with you, chuck, to the gang of eight, now receiving these classified documents that were recovered from maralago, among other places, including the Vice President s residence and the former Vice President as well as President Biden. The Justice Department had initially pushed back on giving Congress Access to these, saying they were part of an active investigation, they couldnt be shared, why do you suspect access is being granted now and could it compromise or hinder the Special Counsels probes in any way . I imagine, ana, it is being given as an accommodation. I understand the reflex of the Justice Department when youre conducting an active investigation, you just dont want to share documents broadly. Even with this number of members of congress who are cleared to see it it doesnt help the investigation. But there is a reason to accommodate congress because the Justice Department, the executive branch more broadly, has to deal with those folks all the time so, it shouldnt undermine the investigation. If it is confined to a small group of people and you mentioned the gang of eight, if it is confined to those folks, and it is only for the purpose of showing them what sorts of Classified Information was at stake in the investigations, it shouldnt undermine the investigation. Nevertheless, if i were prosecuting it, i wouldnt want to share my stuff with anybody until i was prepared to talk about it in open court there are so many investigations so im going to throw a question at you about another probe that trump fines himself in the middle of. He is expected back here in new york this week for a deposition into the civil probe of his real estate business practices. I just wonder will this case at all play into how the criminal investigations against trump shape up i dont think so, ana you mentioned really important distinction, the case in which he may be deposed later this week in new york is a civil case being brought by the new York State Attorney general and theyre examining whether trump and others who work for him and the Trump Organization sort of misled lenders and Financial Institutions with respect to the value of their assets. The last time mr. Trump was deposed in a similar civil setting, he invoked his fifth amendment privilege against selfincrimination several hundred times. Number one, i imagine he may very well do that again. Number two, if he invokes his privilege against selfincrimination, ana, thats not something that can be used against him in a criminal case and, number three, it is a separate investigation and so i dont really see much spillover between this thing that may happen later in new york, this week, and the ongoing criminal investigations. What questions will they be asking what answers will they want . The revelations from those documents to me were not really revelations. We have done the briefing here, you know, at 30 rock for months. Most of that i think was known it is most publicly available war we have ever seen. What the senators will want to know is how did the document get out there . This is a time where the most important part of this fight is really keeping support for ukraine. How did support for ukraine, you know, wane, when you have divisions between all the team members of nato and the eu, between the u. S. And ukraine when you have those sorts of divisions, those fractures are not helpful. Thats where most of the focus will be. You believe a lot of that information was already out there. And yet yesterday at one of the briefings by officials of of the briefings, they said these documents have the potential to spread disinformation is that a concern of yours for sure. I think thats mostly what happened last week it seems like from the tracing out in the public of those documents, it came from a discourt server a month ago, and last week you saw pro Russia Telegrams showing parts that had been doctored. If you look at all the documents over social media right now, some say one thing and some say another. Any observer would not know what the original was, and it allows party to pursue any objective they want, so anybody can take any document they want and use it to sow chaos. That part has been confirmed, they were altered what does that potentially tell you, as a former investigator, about the origin of this leak . Does it tell you anything . Yeah, so in terms of the origin, it doesnt tell me much. I do think in terms of the origin, they will figure out where that leak came from and they are photographs and lots of Background Details in terms of the disinformation and altering documents, there are digital forgeries we see all the time, and they can pick out where the modifications have been and that tells you a lot about how somebody would want to alter the facts to their advantage, and if they do, it gives you insight on how the Russian Military and how poorly they performed in the recent months as well thank you so much for offering your insights and expertise.
