Captioning sponsored by cbs good morning again, we are starting today with a situation in ferguson, missouri, where there have been a handful of arrests in the last few days as Community Awaits what grand jury action, many others have appealed for calm and peaceful protests but the community is very much on edge. Mark strassmann is outside the courthouse in clayton, missouri. Last three months this grand jury has been looking at Darren Wilson to see side whether he should be criminally charged for shooting Michael Brown on august 9. Grand jury has been given a case as though criminal case has been presented to them and they have to decide should he be charged with murder, voluntary or Involuntary Manslaughter or not be charged at all. The stakes are enormous here. A great deal of an prehenk, security has been ramped up, governor declared state of emergency, you have security barriers in all the potential hot spots where protesters might gather and increased Police Presence as you look around you see Police Officers are guarding parking lots, building, trying to give sense of calm here. Everybody has pleaded for peace from attorney general alec holder to Michael Browns parents but depending what the grand jury decides, of course, anything could happen here and that is what has put this community on edge. Schieffer Mark Strassmann in clayton, missouri. Joining me in the studio the president of the naacp, Cornell Williams brooks. Thank you so much for coming. What do you think is going to happen once this grand jury announces its decision . I believe that the citizens of missouri and ferguson and the country will respond and call for systemic change. Michael browns death is more than individual tragedy. Feels like generational assault of young people. So where we have lowest crime rate in 20 years, we yet have generation of young people who per receive they are in the midst of pandemic of police misconduct. People will call for systemic response and legislation. Reforms in policing. Police departments that are accountable. And that engage the community and dont profile and prey upon the community. Schieffer governor has already declared a state of emergency, theyre preparing for the worst, i would suppose. Are you concerned about that . I am very concerned. The governors response to this as though it were a security crisis as opposed to a social justice crisis. I believe that his actions with respect to the guard and state of emergency are presumptuous as to intent of demonstrators are young practitioners of democracy. And presumptuous. We can go in to this expecting nonviolence, civil disobedience. I believe that the government should respond systemically in terms of what hes going to do, or call upon his state to do. The task force is a great thought, much more needs to be done. Schieffer as you well know, this grand jury may well not return an indictment here. They may take no action and what im hearing its going to be a very hard case for the prosecutors probably to prove. Are you concerned about if that happens what the community, what the reaction of the community will be . Do you think it will be violent . I am concerned. I am concerned because we have a prosecutor who had five complaints filed with the Justice Department concerning his Police Department by naacp. This is before mike brown. They conduct grand jury a process where dumps evidence in to the lapse of the grand jury. But were more concerned about the failure of the grand jury given the direct as is typically the case and concerned about the family and outraged community. We want justice for them first and foremost but want to that is the issue here. Schieffer are you urging people in the community not to commit violence here, are you saying to them, look, this is not going to help . In fact it can hurt our cause or what are you telling them . Absolutely. The naacp is always good for civil disobedience, nonviolent protest. Weve done that over our history and do so now. Were calling upon our members, members of the community to respond to this decision in a nonviolent fashion. Everyone has a right to express their right under the constitution. Fact an obligation. We need to be clear. There is asymmetry of responsibility. The police have the greatest responsibility to keep peace and order and to behave in fashion that encourages nonviolence, not to agitate the situation. We believe that 99 of demonstrators and protesters will be nonviolent. Certainly Justice Department and others are responding to the possibility of violence and again its just a possibility. Schieffer theres a huge Media Presence there. Does it concern you that so much attention to being focused here that this in fact could provoke something . I believe the media in many ways helps because they are helping us focus how to prevent future tragedies. Consider this, over a hundred years ago, the naacp, almost a hundred years ago served antilynching law which would prevent the kind of racial profiling that we see today. The point being here is we long against this kind of violence, we dont want violence, dont want violent protests done in the name of a violent attack, we dont want that. Schieffer well tush now to the weeks other big story the president s desection to take executive akron immigration on friday, signed orders to protect five million of the 11 Million Immigrants here illegally from deportation. And allows them work permits they will have to pay a Registration Fee and future taxes, talk about this were going to talk first to republican mike mccaul, the chairman of house homeland Security Committee in austin this morning. Mr. Mccaul, what now . It seems to me that the president has drawn a line in the sand or whatever you want to call it here is that going to help or hurt the situation . I think it hurts the situation. It poisons the well. Going in to new congress, people have spoken in the election and this he says that members of congress question why Legal Authority to do this where he himself said 22 times that did he not have the Legal Authority to do this. That is not how democracy works. He said. I think this is bit of threat to our democracy, regardless of where you stand on this issue, i understand its emotional issue but right way to do this and wrong way to do it. I think the right way is work with congress to get real results and solutions. Schieffer well lets say he has said what he has said. What will republicans do, are you planning on getting legislation together and sending it to the white house or will you just try to block some people are saying hold up every nomination that he sends up to the congress. The other people, theres even some talk of maybe impeachment might be something to think about. What do you think republicans ought to do next . I think impeachment, the constitutionality issue will be determined by the courts. There are various lawsuits, my state now governor, attorney general, filing a lawsuit against this. The courts will decide that issue. I want to make one thing very clear. Were not going to shut the government down. But we are going to shut down this president and his actions as it pertains to granting amnesty to five Million People. Were looking at various options including the power of the purse, things to do to stop this in the short term. In the long term, i think its incumbent upon republicans to come up with our own agenda, positive, constructive agenda which will read, i believe, with my committees bill that will be the Border Security bill. We have to get that security piece done to have intelligent Immigration Reform, that is not being done right now. Last thing, biggest concern i have, because of this talk of am necessity and reform were inviting whole other wave of Illegal Immigrants that we saw in 1986 when amnesty was granted and the executive action. There is cause and affect it did result in people crossing the rio grand sector in my state. We want to do this methodically, smart, starting with Border Security then looking at Immigration Reform measures. Schieffer do you think anything can get done in this lame duck session or will all this come next year . I think the agenda, in the short term with the lame duck we have to figure out how were going to keep the government open. And not shut it down and at the same time deal with this executive action which i think overwhelmingly the American People are rejecting because of the way it was done. He circumvented the congress, the will of the American People, that has short to make laws, i believe hes failed in that responsibility. Schieffer is there unity among republicans . I hear what youre saying this morning, you sound very much taking the position that john boehner and mitch mcconnell, the leaders of the congress and senate are taking, but you know as well as i do there are others that have different ideas here. How close are you to getting the republicans and house together on unified plan . Well, this has to be done sequentially. The more confidence we have in the security piece being done. You can reform the laws, as long as people continue to understand the country thats not very intelligent. We need security bill then Immigration Reform piece. Were going to have divisions, but most of us understand that we have now been given mandate to govern to pass things out of congress to deal with the challenges that are out there. This is one of the big e challenges and probably most difficult ones to fix but there are leaders in our congress what are willing to fix a broken system. Schieffer mr. Chairman, thank you so much for being with us. Well get the view from the other side of the aisle now, the number two democrat in the senate leadership, dick durbin of illinois. Senator, you just heard congressman, why did the president take this tact . He had no choice. I listen toed response. It is clear that they can complain, they can threaten, they can talk about lawsuits, cutting off funding, shutting down the government in the extreme even impeachment but the real question is, can they govern. Can they govern . Its been 51 days since we sent the bipartisan comprehensive Immigration Reform bill from the senate which passed with 68 votes to the house of representatives. They have never called the bill. They never had a hearing on the bill. They never taken up any part of it. Now they complain because the president stepped in said we need accountability when it comes to immigration. They have to step up and govern. You asked the key question, do you among the republicans, mr. Mccaul have your act together, do you know what you want . At this point its not clear. They want to continue with current broken down system which is de facto amnesty . Do they want to sponsor massive deportation. I hope not. Or work with schieffer let me ask you this. Why, im just asking, id be interested in what your reaction. Why didnt the president talk about that bill say, look, you guys have been saying you want to do something, send me a bill up here. Ill either sign it or veto or maybe once you send it up here ill say couple things i dont like, can you change this. Why didnt dough that instead of what they say just sticking them in the eye with a stick. Let me try to recall back in july when Speaker Boehner was promising the president he was going to send him a bill. At that point the president waited as he said strategic patience, whatever they send me ill work with them. It never happened. The president said, i have this choice. What hes stepping forward to do now what most americans want to see, make sure that if youre living in this country undocumented youve been a drug dealer or gang banger youre gone, no ifs, ands or buts, put this criminal background check. Make sure that those who are working here are paying taxes to our government we want to strengthen the border. The president wants to focus our resources make sure we have more security on the border to make certain that we are deporing those who are truly a threat to our communities. Republicans talk about cutting the funding for the president s program, cutting funding for border enforcement and for deporting those who are dangerous to our country. Schieffer let us just quote what some republicans are saying to me, look, hes not trying to get anything done here what hes trying to do is force us in to doing Something Like shutting down the government which he thinks will hurt us and hurt republicans in jeopardy for 2016. What would your ex plaintiff nation for that or answer for that . I hope, i believe that the republicans learned a lesson when senator ted cruz of texas shut down the government over Affordable Care act. It was a political disaster which they should never repeat. But the what the president is doing is saying im going to do what i can in my power to have accountability in immigration. Now its your responsibility. They had almost 20 days left this year to call the bipartisan bill from the senate. They could do that instantly. The week after thanksgiving. I hope that they will. That will really be an opportunity to see if the will is there in the house to pass it. Schieffer you talk about leader slip amongst republicans and are they together, are democrats together here . We know that in the senate what we know of at least five democrats voted against harry reid. We know that his top aide is sitting here making disparaging statements about the president , blaming him for losing the mid terms. How does the president get along with democrats these days . Very well. But i think theres reality. In the states the president did not carry, some of the states where there were dissass truss results, its clear that some democrats are putting distance between themselves and the president. Thats not unusual in american politics. But i believe that there is an overwhelming majority within the sebate Democratic Caucus for what the president is doing. We stood up on a bipartisan basis created a good bill to deal with immigration. We know now that the house has that same responsibility. I think all Democratic Senators stand behind the president try to make this a safer nation with this accountability also make certain that those who are working here with the temporary work permit will pay their fair share. Schieffer why do you think the democrats did so poorly . Historically off year elections, secondly there isnt a lot of happiness with washington, d. C. And as consequence a lot of people have given up on the front that washington can improve their lives. That accounts for the fall off in turn out in many states. I think we have the restore some hope and confidence. Schieffer do you see anything changing . I think it can. Your earlier guest from the naacp talked about some of the issues facing us with race and crime. Im working on a bill with cory booker and rand paul, also ted cruz to deal with smarter sentencing guidelines. Theres an opportunity here, i hope that we seize it to do some bipartisan activities to move this country forward. Schieffer i think most people would say they hope you succeed. And other world powers are making what they think is generous offer to iran which is gradually lift sanctions if that country agrees to further slow nuclear program. But iran is rejecting that at least so far. They want an immediate suspension of all sanctions which badly damage their economy and they havent agreed to completely give up all of the components that could be used to build a weapon. Secretary kerry and irans top negotiator met again today they have until midnight tomorrow to find some common ground. Schieffer what happens if theres no deal by tomorrow . The most likely outcome is extension of the current agreement which was reached last november and temporarily freezes Irans Nuclear program for some sanction relief. That would let negotiators keep on talking, but its hardly a victory. Iranian hardliners are likely to say that talking is a waste of time and president obama can really wanted this as major Foreign Policy win going to face increased pressure from the newly Republican Led Congress and mid east allies like israel and saudi arabia. Well peck up on discussion abut president s decision on Immigration Reform were joined by two hispanic members of the House Republican Raul Labrador joins us from boise his home state of idaho in the studio illinois democrat Luis Gutierrez. Congressman labrador seems to me the president put the ball in the republican court. What do you think what he did or was illegal or legal, whatever you think about it what are republicans going to do about it or what are you going to do now . Several things we need to do. Number one it was illegal for the president to do this. He has been saying the last three years that he did not have the authority to do it now he changed his mind. I think its also unfortunate because right after the election he looked in to the camera disagreed that his policies were rejected. He looked in to the camera tolded American People that this election was about working together with congress. Specifically working together with the republican party. This is what he does right after the elections instead of uniting us like he promised seven years ago that he was going to do hes dividing the nation in every single area. What we should do lot of different things. Number one we should i think its unfortunate that he did this, i think we need to layout clearly why this is unlawful. We need to pass a funding bill that separates Homeland Security from that funding bill. And i think we also should writer the president of the United States to go through a comment period, just like we have to do for regulations under the administrative procedures act. And finally, i think this is most important part, we cant take the bait from the democrats. We isnt we were not going to do Immigration Reform. Tell the American People what were for. We need to show them the step by step that we have been doing in the house. Its unfortunate to hear the president and other democrats say we havent done anything. We have passed legislation out of the house and democrats have refused to work with us on that legislation bob are you going to try to pass some sort of legislation during this lame duck or let it go to next year . If it was my decision i would start passing legislation. In fact i asked our leadership to start passing legislation two weeks ago. We need to start with the Border Security bill. We need to show the American People that were serious about Border Security. I think we can do Something Like we already passed out of the house the hitech immigration. Schieffer what did your leaders say, did they give any indication that theyre going to . I think were going to start doing things. As you know i serve on House Judiciary Committee and immigration subcommittee. I think were going to pass legislation. But not going to be legislation that the president is asking for. We have rejected the legislation the president has been asking for. We as republicans do not any you should give am necessary fee first and talk about security late cher is what the senate bill did. We think security, Border Security foremost in our mind and in the minds of the American People we need to do that first then need to do step by step approach where we reform the entire immigration system that is completely broken. And we can then do what the American People want us to do. Let me go to Luis Gutierrez from the democratic side of the aisle. What is your response to that and where do you think this a couple of things. Surprise, surprise, surprise. The president of the United States to listen to him anybody would think that the president of the United States when he gave state of the Union Address last january took the gavel away from the speaker of the house at the state of the Union Address. He said to the nation, if you do not act, i will use the power that i have as president of the United States to begin to fix the broken immigration system. He repeated that. Speaker boehner called him at the end of june said, mr. President , notwithstanding all your good efforts, notwithstanding all my good efforts, the house will not act on Immigration Reform. What did he say . I called my cabinet together i will act on immigration. Seems to me that the argument is now were going to start legislating. Its 2 months in to the legislative session. They control the house of representatives. They dont need a single vote from the democrats, we could have been in conference right now. I am no the saying to my friend Raul Labrador, he necessary that i never said this, i said lets passion a house bill. Make sure when they said, we didnt walk away from it. Said there was no path to citizenship. We didnt walk away. When we gave them 30,000 more border p pa troll agents we found way the finance that. I think the problem here if you listen to mr. Mccaul they mix things up, they want Border Security, Border Security. Comprehensive Immigration Reform secures the border you cannot secure the border because they keep talking about a border. Between mexico and United States. Let me suggest to the American People that there are other borders called lax, called kennedy, called right here washington dulles, airports all over this country millions of undocumented workers that came through those borders. If you want a bill, you truly want to secure our community the president , bob, was forced. Think about it they want to censure the president. Im inviting millions of people to come forward, go through background check, criminal background check at their own expense, pay the taxes that they oh, go back and work and raise their american citizens children. I think children are special and theyre special no matter what immigration condition of the parent that they have. Schieffer let me just ask you this. Some people are already saying that the president taking this action is just going to cause more immigrants to. Do in now because they want to come in get in on this deal. You want to know something, great question. Number one, let me say the following theres no path to citizenship that the president is offering. They cant get a single benefit from the government. They can pay all the taxes that you and i, im sure you feel better i feel better that theyre paying taxes. We feel better they have gone to the background check. What the president said, i dont want to break up families. Were going to put more Border Patrol agents. You know that under the president s program the Border Patrol is going to be able to get increase in their pay. Why . Because commensurate with their new responsibility they should get paid. The president was very clear in his message. He said, if youre a criminal in the United States it just got worse for you because were coming after you. Guess who were not going after, the kids, families, in the deporting a thousand people every day who do not present a threat to america. Schieffer both of you have come the this with considerable passion. Congressman labrador ill let each much you, 0 seconds, tell me what is the most important thing that the American People need to know about this right now. You go first. Most important thing they need to know is that we need to follow the law. If the president wasnt foreking the law we wouldnt have the problem that we have right now at the border. We are going to have a flood of people coming to the border i think same thing that happened with the amnesty of 1986, same thing that happened just couple of years ago with the docket decision thats unfortunate. The last thing we need to pass Immigration Reform. It has to be conservative Immigration Reform. American people would like to do something about 12 Million People that are here, most important responsibility that we have as members of congress to protect both borders. I have the border at the door. Has the boarder with canada were concerned about that as well not just southern border. All right. Check the tape. First time any border has been spoken about that isnt border between mexican and United States thats in the right direction. My friend waited the last 2 months, we could be in conference right now passing a bill benefitting the American People. Bob, they have 180 days starting january 1 before first person place for work permit under the executive authority. Roll up your sleeves, you are sent to washington to govern you have majority in the senate, majority in the house and i am ready to sit down and fix the problems in america. So much energy in this discussion about immigration ive got to start there. Susan, what is going to happen . I think president obama has done an amazing thing. Hes put republicans on the spot, using a different tone from the republicans, no government shut down, we dont want to take the bait and overreact maybe they will actually sit down work on immigration legislation. That is an amazing thing. What we heard from republicans their concerns how are they going to looking forward to 2016. Schieffer clarence, have republicans come up with how theyre going to reas a matter of fact we heard john boehner right after the morning after the president s speech. He talked about being emperor or king. He didnt say what they machine to do. He didnt. What we do know that House Republicans have been divided up to now. President obama pulled them together as he often does in their mutual disdain for him. A great opening for them, because he has taken action on the part of reform that democrats like, which is bringing people out of the shadows and keeping families unified. The Border Security part which congressman labrador brought up to the republicans. They will push back with i predict with legislation of their own which calls for the stronger Border Security without disrupting too much the family unification and those types of issues that democrats care about. Schieffer mark, you are kind of an expert on hypocrisy in washington after the book called our town and seeing beneath the surface, seeing things that may look one way and somehow turn out to be another. What is your sense of why the president chose to this route. I think obviously, people look at the political i think, from what people have told me, that he was upset that he didnt do anything before the election. He feels like hes been not played, but does not like doing things that are so negatively political. The timing of that was seen that way, he would probably admit to that now. Im struck by the tone also in the republicans, especially last few days. What theyre trying to do is let this play out in a nongrandstanding kind of way. That could be a president ial context. Someone like ted cruz or rand paul or someone more conservative governors like rick perry taking this issue. They have strong legislative hand now. Something could actually work in way that might not have before. Do you think so, mike . Were seeing that the leadership now has some leverage. We had congress that was controlled by people who were extremely in the past, right now leaders are in charge of their strategy, trying to determine what they do. Dont want to do much in the mid term rather wait until they have both houses in congress. They do have a resolution, have to do something whether to prevent something worse from being proposed. There is every lakely hood that the republicans will come back and pass something, try to put the president on the spot. That is the approach that disagrees with the skew testify order but embraces comprehensive reform which is with a republican cant date will have to do. Schieffer what do you think, david, youve been watching washington for a long time as i have. Do you see any chance that things are going to change around here . I see a little more possibility of that after this mornings discussion, like susan i was struck by the two republicans that you talked to, each saying they want legislation and talking about the parameters of it. We have a system thats broken. And its broken, unable to deal with an issue immigration that public cares about. President acts unilaterally to deal with that. He said, give me legislation, we heard today the republicans are going to give him legislation that will start a process of bargaining, where they will send something up, hell have to decide, question expect this, do they have to come back with something closer to what i want to do. I hate to say it but broken system that may be the only way forward. Schieffer its not just i am breaks system thats broken its our whole political system thats broken. As far as im concerned. The fact that congress is in gridlock seems to me just a symptom of the real cause thats our whole political apparatus here just sort of as we saw in this election. 37 of the American People voted. Thats the lowest voter turn out since world war ii as i just remarked. I was stunned when i found that out. Thats alarming far our system to have so few people voting. But not to be too pollyanish, but when there was talk about bipartisan effort on sentencing reform thats the kind of issue where there is bipartisan agreement. No willingness to step forward on things that you might agree. Maybe there is, the incredible frustration that americans have expressed which is reflected in the fact that so many people didnt turn out to vote. Maybe that is beginning to have some kind of affect here. Schieffer do you all think that the mid terms will actually have any impact on 2016 . I hear, mid terms are mid terms. They really dont affect what happens. They will have impact, landscape has already changed, president obamas poach, that says patch things up after mid term. No, hes provoking the system and as we heard this morning produce legislation as a result. People like ted cruz and dick durbin that normally dont Work Together have been for months. Sentencing reform was is coming together were going to see some kind of trade deal now, republicans will give president obama more trade authority because they want the president to have that. And i think were going to see some things change after the mid term. I think first of all if you look at the three leaders, Speaker Boehner, mr. Mccontinental and president have less to lose. Hes not running again. Hes internalized that we can see that at work in his actions. Mcconnell is not going to be up for reelection and Speaker Boehner dont her a lot about his position being precarious. These are all institutional, they might be much more position to deal on things like tax reform. Maybe we are being pollyanish, but why not. You wrote a piece on chris christie, i take it hes running. I think he is. Hes doing everything he can that would be putting things in play. What hes not doing is talking about anything of any substance. Hes been completely silent on Immigration Reform where as governor bush, two people with might run have been vocal especially taking more moderate position. He seems to be doing Everything Else politically that would suggest. Schieffer i think kasick is the dark horse. I think he might run, might do well. Hes got ohio. Hes pretty well respected in the party. Hes had great cycle. I think lot of people are looking still looking at jeb bush. Hes making some statements that this is a possibility. I think if he doesnt get in the race there will be serious look at the tier below him. John kasic, blue collar appeal, appeals to religious conservative. 25 of the African American votes in ohio in his reelect. Admittedly weak opponent but serious win. This is the swingest of the swing state. Give serious consideration. I would degree, other things jeb bush for less couple of years, has not at the top but Tea Party Still out there thats what gets in the way of john kasick and web jeb bush. Schieffer i did not think he was go tg run until i talked to his brother, george w. Bush, who he says, its 5050. But i just sensed that the family now beginning to think he is going to run. When i interviewed injury on his book, sounds like Family Campaign to get him to run. He says, yeah, i think there is. I also wonder if the family would get out there as far as they have without thinking that jeb bush wants to be encouraged to get in the race. Schieffer we need to talk about whats going on in vienna. But right now both sides seem to be positioning themselves for an inability to reach a comprehensive agreement. Then question is, will they seek to extend bargaining that they have perhaps pocketing the areas of the agreement that have emerged over the last year and setting those aside saying weve made enough progress this were going to work on these areas where were still fairly wide apart. Ive been struck by the way which iranians are trying to signal, this isnt our fault. Weve been reasonable as if theyre getting ready for the day after they dont want to be blamed. Schieffer were talking of course about how to find way to put limits and stop iran from stretch the time that iran is required to build a nuclear weapon. Thats president obamas goal. Schieffer israelis say they should shut down everything they wont be satisfied with any kind of deal unless just said, everything stops. Is that possible . Its probably not possible, would have been possible five year ago. But series of hurdles have been crossed in that time period. I think the danger is that if an agreement is reached that iran can enrich uranium, other nations in the region starting with saudi arabia will insist on the same thing. Then the nightmare of proliferation of Nuclear Technology in the whole region will be a set rate that should scare everyone. Schieffer will israelis allow that to happen . I think there are lot of isry lease say, an ugly deal that is safer than wed be without one thats deal he wasnt seeking. Would be preferable to taking the action. They probably dont have the weapons to be able to take out the nuclear program. Im see pressure on the u. S. To do the thing.
