Justice lives here in Montgomery County. We came here looking for an acquittal but like that Rolling Stone song says you dont always get what you want. Sometimes you get what you need. Its too early to celebrate mr. Cosby. Round two may be just around the corner and this time justice may prevail. Good evening everyone, im natasha brown. Thank you so much for joining us. Hopelessly deadlocked thats how the jury for the bill cosby trial described the ending of more than 50 hours of deliberations this morning and in the end the judge was forced to declare a mistrial in the Sexual Assault case against bill cosby. We do have Team Coverage this evening for you. Cleve bryan is outside of the courthouse in Norristown Montgomery county but we begin with alexandria hoff live at the ritzcarlton in philadelphia tonight where she just spoke to one of cosbys attorneys and his spokesperson. Alex. Reporter yeah, well, natasha this mistrial means mr. Cosby is a free man. Sitting down with his team they say that he is now enjoying his time and his fathers day weekend with his wife here in the philadelphia area. Now, we learned some interesting things about this trial as a whole in sitting down with him just a few minutes ago one of them being that each day started early at 5 00 a. M. At mr. Cosbys Montgomery County home. That is where he would tell old stories about richard pryor, sami davis junior anything else that would keep his mind at ease. A spokesperson tells us that when he asked when he was coming in and out of court to walk slowly because he wanted to greet his fans and show them the presence that they had been waiting for all ways it seems that he was coping with what they call stress that no human could bear. Now, another interesting thing they told me was that there is a Conference Room inside of this courthouse that they use for down time during deliberations or breaks during the trial and that room mr. Cosby called his dressing room. Obviously flashback to his show business days. Now, the prosecution has promised a retrial but spokesperson andrew wyatt sees that as a desperate move on the half of District Attorney steel. We hope that the prosecutor changes his mind and that he doesnt proceed forward. We think its time for these claims to be cast aside. I just feel like this d. A. Steel is going a little bit too far. Its too personal and he is trying to really make a name for himself off of mr. Cosbys name and it should just go away. He got the opportunity and he has the bragging rights to say that he brought bill cosby to trial. And he got that shot and i think hes taken his shot and he needs to let it go. Reporter now, Something Else that i thought was interest being out there in Montgomery County for this trial. On the occasion that mr. Cosby would exit the building and the kind of outburst like greetings that he would give. At one point he was singing one evening, another night he was using that fat albert voice, that hey, hey, hey. I asked him was this a result of exhaustion on behalf of mr. Cosby, was this a way for him to greet his fans and they simply told me that humor is a way that he deals with stress and that is the way he simply reverted on those very stressful evenings. Reporting live in center city, alexandria hoff cbs3 Eyewitness News. Alex thank you so much. Now we have been at the Montgomery County courthouse since the beginning of this trial and of course that is where all of this unfolded earlier this morning. Eyewitness news News Reporter cleve bryan is live at the courthouse in norristown with a look at how the trial finally came to a close. Cleve. Reporter natasha, by their own admission the cosby jury was hopelessly deadlocked. Now, the judge said that they were courageous attempting for more than 50 hours to reach a consensus but he also says sometimes a mistrial is how the Justice System works. For the sixth morning 79yearold actor and Comedian Bill Cosby entered the Montgomery County courthouse waiting for a jury to decide his fate. Unlike the long days of questions and deadlocked deliberations up until now things happened fast. By 10 15 the jury announced they couldnt reach a unanimous verdict so the judge declared a mistrial. Some cheers for cosby. The judge is right. Justice is real. It lifts here in Montgomery County. Im proud to have been able to represent mr. Cosby. We came here looking for an acquittal but like that Rolling Stone song says you dont always get what you want, sometimes you get what you needment cosbys spokesman raised his fists in victory. For his part cosby kept quiet leaving court he only paused to wave to his supporters. Prosecutors say the legal battle is at a are star from over immediately declaring their intentions for a retrial. We will take a hard look at everything involved and then we will retry it. Reporter District Attorney kevin steele says his team will be ready to meet the judges direction of retrying the Sexual Assault case within four months. And he has little doubt alleged victim Andrea Constand will testify against cosby again. She is entitled to a verdict in this case and the citizens of Montgomery County where this crime occurred are entitled to a verdict in this case and we will push forward to try to get that done. Reporter we asked the District Attorney if he knows the break down how many jurors wanted to convict cosby. He says hes not aware at this time. He also says this is the first time hes had a mistrial in about 25 years. But the last time, he won the retrial. In norristown, im cleve bryan cbs3 Eyewitness News. All right, cleve, thank you so much for that update from the courthouse. Now, earlier bill cosbys wife camille released a family statement about the trial praising the attorneys who represented bill cosby and blasting the Montgomery County District Attorney and presiding judge Steven Oneill accusing them of arrogantly collaborating. The statement says in part im grateful to any of the jurors who tenaciously fought to review the evidence which is the rightful way to make a sound decision. Ultimately that is a manifestation of justice. Based on facts not lies. The jury of seven men and five women from Allegany County in pittsburgh were seen leaving their Double Tree Hotel in Plymouth Meeting this morning. The jurors deliberated more than 52 hours over six days before telling a judge this morning they could not reach a unanimous decision. Jurors who were sequestered in the hotel began their deliberations on monday evening. Now not long after the Court Announced the mistrial representative of Andrea Constand released their own statement about the trial thanking the District Attorneys office and other members of the prosecution as well saying we are confident that these proceedings have given a voice to the many victims who felt powerless and silenced. We commend those prosecutors who raised awareness that one of the hall marks of drug related Sexual Assaults is the affect the drug has on the victims memory. Additionally Linda Kirkpatrick and Jewel Allison joined civil rights lawyer Gloria Allred on the podium in norristown the pod yum and they also reacted to the verdict. He thought he could bury us. He didnt know we were seeds. Were sprouting up looking for reform uncovering the rape culture in this country where victims are blamed and shamed. We are continuing looking for more reform to represent all victims of and Sexual Assault male or female. In the words of the late, great reverend Martin Luther king jr. , he said we must accept finite disappointment but never lose infinite hope. It is time for rape and violence, thats the end of the quote. It is time for rape and violence to stop. Well, a lot of folks with many different opinions, lots of reactions and many speculating on the next move in this case. Will there actually be a retrial . If so, can we expect a different outcome. Here to help us sort these issues out linda dale papa with dillworth paxon. Thanks for joining us. We appreciate it. Youre very welcome. First of all your reaction. This was marathon deliberation session for these jurors over the course of six days or so. 52 hours. Were you expecting a mistrial at some point. I think when there wasnt a verdict on friday i was expecting a mistrial at that point. Yeah. So, they were clearly grappling with something. There were lots of questions and they seemed to be very engaged in the process. Absolutely. But we dont know yet what the division of the vote was. We dont know if there were more people for acquittal or more people for a conviction. Tell us how. That hasnt been shared. The d. A. Has already said almost immediately that he will be retrying this case. Yes, he announced there will be a retrial and it has to be a retrial if the District Attorney announces that i understand within 120 days. But i dont know whether or not the District Attorney knew knows what the break down was with these jurors. More for conviction or more for acquittal. We dont know. Yeah. And weve heard Gloria Allred who is representing some other victims. Just talk a little bit about mr. Cosby slow down dont celebrate just yet, its not over yet. Shes hoping that other accusers will at least have their voices heard if there is indeed a retrial. Do you see that possibly happening and could that affect everything. There is the possibility that the judge could reconsider this decision about allowing other victims alleged victims to testify so that they could the prosecution could establish a modus operandi by the defendant. The judge ruled that only one victim alleged victim could testify and the prosecution had asked that the admission of 12 victims. To testify. Now, it is possible that the prosecution could come in and ask the judge please reconsider that decision. Well, and that could make all the difference. It could. All right. Thank you so much linda, we do that appreciate your time and your expertise today. Thank you. My pleasure. Eyewitness news will continue to follow the cosby case as it develops.
