Ask the to define without her knowledge. Now, the judge could not make a definition on that, he said he could reread the charging instructions on the thirds counseled every indecent Sexual Assault that goes to basically consent. The jury passed on that. And left without further explanation. What is happening behind me is bill cosbys publicist just giving a news conference, attempt to go derail some of the claims made from the witness stand saying that bill cosby has received unfair trial, but we have to footnote all of this in saying really nothing that is happening out here matters, the only thing that matters right now is what is going on inside Conference Room at the Montgomery County courthouse. After 12 hours of rest the jury back at it continuing deliberations in the trial of bill cosby. The 12 member panel of seven men, five women, could deliver a guilty verdict, that would land the actor and comedian in jail for the rest of his life. Jurors asked the judge to reread testimony from a 2005 deposition, where cosby acknowledged a sexual encounter where he says he gave Andrea Constand three pills. He called them her friends and said they would help her relax. He said they were benadryl. Constand, a woman cosby had been mentoring, told markedly different story explaining cosby a periods with the three pills and she says he described them as herbal or natural. She testified she became incapacitated and claimed when she regained consciousness, cosby was performing a sex act on her. Cosbys defense team has hammered at constands version of the 2004 night, pouncing on inconsistency with dates and recommendations. The prosecution has written that off telling jurors those inconsistencies were minor. Legal expert have said the trial boiles down to the question of con send. Under the influence Andrea Constand being able consent to sexual activity, prosecutors say no, but cosbys team says that night was the thirds romantic encounter that the two had shared, and say constand was a willing participant. Once again this entire trial, the matter against bill cosby, and the commonwealth of pennsylvania, boiles down to that element of consent. The jury just now crossing the fivehour mark in its deliberations, theyve had two questions, and one request of the judge, of course, it is a busy afternoon here at the Montgomery County courthouse, youre going to want to keep it with cbs3 Eyewitness News for all of the latest lots to talk about of course a lot going on and we have you covered. And the power of Mother Nature still ahead on Eyewitness News, apparent tornado rips apart a barn in a matter of seconds. What part of the country was rock by this dangerous weather, meisha . Cant predict when adversity will come upon our lives, nor determine when we will be called by someone else. In todays love it meeting few heroes in the right place at exactly the right time. Thats coming up. Katie . Meisha after what had been such fantastic weekends past, were locking ahead to granted another temperature rebound, so some warmth, but that unsettled pattern is scheduled to return. So clouds, some showers, if not a rumble every thunder expected, both weekend days. Those those arent the only days that feature wet weather. We will walk you through the entire forecast right after the break. Miss hoffman gets us there safe every time. To make a good school day. Takes a lot of people mrs. Migliaccio teaches us all about fractions and haikus and the erie canal miss reeves makes us sound amazing. And miss santoro always takes time to see how were doing. Miss simpkins keeps our school looking great. Recess wouldnt be recess without miss basile. And mrs. Mccarthy always has tons of good books to read. Which makes for a pretty good day at school. Apparent twitter rips apart a barn, as we can see here, all caught on video, tornado temped down near the february rays can boards err yesterday. Matter of second. You see pieces of the barn spiral through the air. No word this afternoon on any injuries. Back here at home, not necessarily talking about a twitter. No. Looks like the heat is sticking around. Certainly, thats the severe kind of part of the forecast, you know, really just going to be oppressive out there the rest of the afternoon, very, very steamy already. So anybody, i mean, hats off to the landscapers, postal workers, the ppa, anybody that has to be out, yes, it is part of the job. Yes, take care of yourself for sure. But looks as though there is some relief on the way at least as you look forward in the next couple of daysment expect to go see specifically tomorrow, already, those temperatures get scaled back, at least, and theyre actually cooler than average to wrap up the week. So this pattern change is taking place courtesy of what we call back door cold front. Only reason we call it that because it is coming from location thats a little atypical from the northeast, as opposed to from the west, as they typically do. But, we will take you outside. Show you whats happening. Right now im not shock by. This take a look, live shot, you know, funny, because i called for this camera before we went on the air, what, half hour ago, i said lets just take the fountain shot here at logan square. And sure enough it looks like day camp or something, maybe soccer team. Hallahan. Thats right, floor director di, thats right, thats right, the tradition of the hallahan kids jumping in the fountain. Man, this was meant to be. I love it. Well it looks like theyre having a blast, what better day for it, right . So hot out there already, we hit 90. As of 11 00 a. M. , theyre having a blast, i just want to walk down there and jump in them after the news show, just walking or sitting distance from the program. Yes, it is hot obviously. And so far, for the month of june, where you have three days including today, now, sin weve already hit 90, we through that in the mix, three days this month so far at zero nine or above. In may we had three. Season so far obviously doing the math, had six. Average is 23 days that hit at least 09 degrees, so on our way at least. Now, there is also an air quality alert we have to mention here, good portion of the Delaware Valley is included in this. That does mean it is unhealthy for you to be out in this for very long, if you fall into the sensitive category, any lung disease, or asthma, or if youre, you know, little kids or the elderly respect just not great to be out in this kind of heat for very long. So please take it easy out there. Looking at storm scan, couple of showers, thunderstorms have gun to pop here, back through part of the midwest. We, how much, as i mention at the desk, will see front drop in here t really is not looking to me like it will produce much, perhaps you see spotty shower, thunderstorm late today, tonight, maybe even as light as early tomorrow morning. But thats it. The big legacy that front leaves behind is the temperature drop. Now, were switching gears and talking about really cool event going on later on tonight. It has been hell off multiple times. But there is rocket launch going on at wawa island tonight. As it takes off, there could be some really cool views, in the sky. Im told that there are about ten different chemical canisters being released once this launches. So between 9 09 and 9 19 tonight, look up to the sky. You might be able to see almost like an artificial, with these loom necessary end clouds that will take shape. Cool stuff. I have to set my alarm, because i know were all asleep by that point. Meanwhile outside, at the cove haven in the poconos, i love this shot, if you look real closely looks like the set up for a wedding here, couple of white chairs, some decorations on this scene here, beautiful, great excuse to hit the beach if you are lucky enough to have the afternoon off, close enough, rehoboth certainly is packed right now. It has been every day in recent days here through the course of the weekend. Heres how it feels, folks. As we hit high noon, more so toward triple digit territory in dover. Youre now scaled back to 98. Youll holy father nerve that zone through the next couple of hours here. It feels like 98 even in reading, here in the city specifically at the area port, feels like 93. Brutal stuff. So please take it easy. But this is last day like it before this pattern really changes. And we turn it on hereby thursday it is less humid, it is very pleasant, we dont break out of the 70s, and that will last us through friday in fact. Now saturday and sunday, some more showers, some more thunderstorms start to arrive here. We rebound at least but turn for the worse if you were hoping for more sunshine. I dont think i can promise that right now unfortunately this weekend. I have to say quite the forecast, we had the hallahan girls in the fountain, we had somebody setting up for a wedding i. I love it. Something happening all over the place. So today were meeting nine year old hero. Meisha joins us with todays love it. Good morning, good afternoon. We never know when tragedy will strike and when well need the helping hand after hero. In todays love it were meeting courageous view, at the right place at exactly the right time. Coincidence . You decide. The warm weather opens up schools, causes for the lakes, makes you dream about the ocean but for one young toddler in North Carolina that calling was a close call to say the least. His nine year old cousin was walking up to the pool when noahs body began to float. Believing he was already dead, but without hesitation, she braved the unknown, got in the pool, and pulled his body out as karen ran outside. I got him in my hands, and he was purple. Then, a man at the pool, complete stranger, carlos rodriguez, offered to help. He pulled him on the floor. He just said im sorry, im so sorry. Hes gone. But right then, rodriguezs wife melissa also stepped in immediately giving noah cpr, which to everyones relief, finally released water out of his mouth. After a long night in the hospital, doctors discharged noah with the good bill of health. Oh, and his mother says never one, never take your eyes off your kids, two, the next trip to the pool will shall for swim lessons, a former lifeguard myself, thats a good idea. Local Police Department gave the nine year old noah chief coins for their living selves. Do you believe more in fate or coincidence . I draw the line. Yes. Okay, so maybe a little bit of all right.
