A second night of protests has begun in new york after a grand jury cleared a white Police Officer in the chokehold death of an unarmed black man. This is downtown manhattan. Demonstrators are calling for reforms in the n. Y. P. D. , and today the mayor and Police Commissioner announced 22,000 officers will be retrained in light of the death of eric garner. Jim axelrod has what we learned today about the grand jury proceedings and officer daniel pantaleo. I cant breathe i cant breathe reporter the demonstrations following the grand jurys decision have been largely peaceful so far. The message Crystal Clear its not about black or white. Its about life or death. Reporter today, a judge granted the district attorneys request to make limited portions of the grand jury proceedings public. We learned that 23member grand jury sat for nine weeks, heard from 50 witnesses 22 civilians and 28 Police Officers, emergency workers and doctors. 60 exhibits were admitted into evidence. No testimony was released. That was not part of the prosecutors request. Cbs news has learned pantaleo was the last witness testifying for two hours. Dont touch me. Reporter in a phone interview, his lawyer says pantaleo told the grand jury he subdued garner with a technique taught at the Police Academy. He indicated that he never used a chokehold, it was never his intent to utilize a chokehold. He never intended to apply and force to the individuals neck, and any contact with the neck was incidental. Reporter today, the head of the police union, pat lynch, supported pantaleo and blamed garner. We feel badly that there was a loss of life, but, unfortunately, mr. Garner made a choice that day to resist arrest. Reporter pantaleo has been sued twice for alleged raciallybased misconduct, including illegal searches and arrests. One case was settled for 30,000. In a statement, pantaleo says he feels very bad about garners death and offered his condolences, which eric garners widow did not accept. Hell, no. The time for remorse would have been when my husband was yelling to breathe. Reporter this morning, a group of prominent civil rights leaders called for a national day of protest and set it for nine days from now, saturday, december 13, in washington, d. C. Scott. Pelley thanks, jim. Joining us now is bill bratton on his second tour as new york Police Commissioner and the former headline of the Los Angeles Police department and the boston police. Commissioner, thank you for your time. Do you see anything in that videotape that you can justify . Well, the way its going to now work, i will be doing an administrative investigation of the now that the criminal case is over. Well make a determination if anything that occurred is in violation of our policies and procedures. Pelley mayor deblazeio said the we we go about policing has to change. We are doing a lot of changing in the n. Y. P. D. We put in place new training for recruit officers, postrecruit training. We are going to retrain 20,000 officers with inservice training on policies, procedures, protocols to try and reduce some of the tension, to try and reduce some of the use of force we have to engage in from time to time. Pelley what does a black man in new york city have to fear from the n. Y. P. D. . Actually he doesnt have anything to fear from us. Pelley the people out there on the streets dont think so. Thats correct. Thats what im saying, they dont, but they do feel that, and its the result of, unfortunately, the stop, question, and frisk controversy that overshadows so much of the success in reducing crime in the city for so many years. Weve reduced that impact significantly down from 700,000 stops to less than 50,000 this year. Through the training were trying to improve the way our officers interact and approach people. And if they have to engage in force, making sure that they have better skills in using that force. Pelley the officer involved in this incident says that he was taught that maneuver that he used at the Police Academy. Is that taught at the Police Academy . Is that sanctioned by the n. Y. P. D. . Part of the investigation will be to determine what everybody has seen on that video is that, in fact, within the framework of what we teach our officers in terms of how do you take down a person youre attempting to arrest . Pelley well, let me put it this way is a chokehold one of the things officers are allowed to use in new york city . Chokeholdholds are prohibitey Department Policy going back to 1993. However, as in all cases with rules, regulations, there are exceptions. If an officer feels that he is in imminent danger, that some of the prohibitions that if he feels hes in a lifethreatening situation, what needs to be understood, chokehold is not illegal. Pelley commissioner bratton told us officers will be retrained on safer takedown holds. Concerns about violence by Cleveland Police led to a federal investigation that began two years ago. Today, the department of justice concluded that cleveland officers systematically engage in Excessive Force. Dean reynolds shows us what that means. Reporter november 29, 2012, a highspeed police chase in cleveland turned into this. gunfire . Malissa williams and Timothy Russell were killed in a literal hail of bullets, 137 rounds fired by police into their car. Police said they felt the couple shot at them, but no gun was ever recovered. Walter jackson was williams uncle. Really cant pinpoint what was in their minds, but all i know it was like a modern day lynching. Oh, no. Reporter on new years day, 2011, an unarmed mentally ill man named Edward Henderson was pursued for a traffic violation, and after srngd, helicopter video captured him being savagely beaten by officers. None was prosecuted. And 12 days another 12yearold tami12yearoldtamir rice, brany gun was shot to death by a cop whose Previous Department sought to fire him for incompetence. It looks like they got him in custody. Reporter the Justice Department is now basically confirming what many in cleveland already knew, including examples of rogue officers inflaming routine situations, slanting their afteraction reports, or not writing reports at all. Justice looked into over 600 cases of Excessive Force here from 2010 to 2013. Cleveland mayor Frank Jackson the review. There are problems in the division of the Cleveland Police. And this review has demonstrated some of those problems. Well, good afternoon. Reporter attorney general eric holder said cleveland is one of 20 Police Forces undergoing a Justice Department investigation. Has any pattern or pathology emerged from these that you think leads cops to cross the line . I think we certainly see patterns where you see inadequate training, where you see resource deficiencies. We see cultural problems that exist within Police Departments. Reporter cleveland and the Justice Department will now try to work out an agreement, scott, that will include the naming of an independent monitor who will oversee and ensure muchneeded reforms. The recent deaths at the hands of police have been investigated by grand juries, which typically sit for months in private to hear a variety of cases, deciding whether theres enough evidence to put a suspect on trial. Well, now, some people are questioning this process, so we asked chief Legal Correspondent jan crawford to tell us more. Reporter the grand juries that decide not to indict officers wilson and pantaleo are part of a system enshrined in the constitution considered by the framers to be an important check on government power. But now, there is growing criticism government prosecutors can hijack the system to get results they want. The cato institutes Timothy Lynch coauthored a scathing analysis 11 years ago, a grand facade, how the grand jury was captureed by government. If they want an indictment, theyre going to get an indictment. If they dont want an indictment, it wont happen. Reporter a grand jury is significantly different from a regular jury in a trial. It meets in secret to protect those who may not be charged. Prosecutors dictate what evidence and witnesses the jury sees. Theres generally no judge or defense attorney. Last week, st. Louis prosecuting attorney Robert Mccullough defended the grand jury that declined to indict officer wilson. They were extremely engaged in the process, asking questions of every witness, requesting specific witnesses, requesting specific information, and asking for a certain physical evidence. Reporter but critics say grand juries rarely indict Police Officers for fatal incidents. Prosecutors are often unwilling to take on members of the Police Department because they work with the police week in and week out. Reporter and theres another reason we rarely see grand juries indicting Police Officers. The law tend to give police a lot of discretion. If an officer reasonably believes a suspect is putting someones life in serious danger, scott, he generally can use deadly force. Pelley jan crawford in washington for us tonight. Jan, thanks. Tonight, there are grave concerns for an american held by al qaeda in yemen after a u. S. Rescue mission failed. Al qaeda put out a video, and heres david martin. Reporter as he pleaded for help, luke somers gave no indication he was aware american commandos had tried to rescue him. Im looking for any help that can get me out of this situation. Im certain that my life is in danger. Reporter the attempt began fridays morning, november 21, when the joint special Operations Command notified the pentagon it had found the cave where somers was being held, along with other hostages, and permission to conduct a rescue mission. Defense secretary hagel signed off on the mission fridays afternoon and sent it to the white house for the president s approval. After a series of meetings on saturday, the president S National Security advisers approved the mission on sunday morning. Even though surveillance of the cave had detected two hostages being taken away. The president , who had spent much of the weekend in nevada, gave the final goahead on sunday afternoon, ordering the raid to be conducted during the next period of darkness, which in yemen was monday night, november 24. American commandos flew into yemen by helicopter and hiked to the cave. They killed six al qaeda guards and rescued eight hostages, most of them yemeni, but somers was not there. He evidently had been one of the two hostages taken away from the cave. A local al qaeda leader warned the u. S. Not to try again and today, somers brother and mother posted a video on youtube trying to convince his captors they had nothing to do with the raid. He recently ruled that women should be allowed to vote in local elections and decided that 20 of the Shura Council, the body that advises him, should be female. One of those women, dr dr. Thora ahmed obaid is quietly working on a proposal that would revolutionize saudi life by effectively ending male guardianship. Men and women over 18 will be independent citizens of the kingdom of saudi arabia. They will make decisions about their lives. Thats according to this proposal for a family law. Reporter her colleague, dr. Thuraya al arrayed, told us some male guardians have exploited their power over women. The purpose is to help, to help the woman, but abusing it turned it into catastrophe. Reporter despite the male guardianship system, saudi arabia is already transforming. More saudi women are graduatingg from university than men, and their government is encouraging them to join the workforce. Theyre even playing sports with the permission of the authorities, even though some islamic hardliners say its sinful. But islamic conservatives are resistant to change opinion this High School Teacher told us she likes having a male guardian. Foreign women have more freedom than we do, but i dont want to be like them, she told us. These are our customs, and we follow them. The women on the Shura Council told us any change has to be gradual to avoid a backlash from the religious establishment. Nothing is cut in stone except the word of god. The rest can be improved on, can be fine tuned, can be made to fit with the needs of today. Reporter this proposal that would end male guardianship is still a long way from becoming law.
