Shell be campaigning in pueblo. A colorado case involving ethnic slurs and their effect on one mans trial is heading to the Supreme Court. Tarhonda thomas breaks down what jurors had to say and why some think a defendant did not get a fair trial. Gary, this original case unfolded in 2007. The defendant was accused of sexually harassing two teenage girls in aoo racing track. But, now, his lawyer says he was convicted. Because of his race. Today, the Supreme Court will hear an appeal from attorneys for miguel angel penarodriguez. He was found guilty of two misdemeanor charges. And senteenced to two years on probabtion. He was also required to register as a sex offender. But the Surpeme Court could overturn that ruling due to juror bias. Lawyers say after penarodriguez was convicted, his lawyers interviewed jurors. Two of those jurors talked about another likely committed the crime because hes mexican and quote mexican men take whatever they want, endquote. In the past the Supreme Court has been reluctant to overturn rulings based on private juror conversations. Colorado courts ruled that private deliberations were not grounds of reviewing the conviction. Thats why pena ropdgiguezs lawyers took the case to the Supreme Court. Supreme Court Justices will hear arguments in the ongoing patent dispute between the worlds top two smartphone manufacturers samsung and apple.
