You know honestly I'm a bit skeptical about the process I mean I have a couple of issues one I don't think an impeachment should be run through the intelligence community that means all of that other work that really needs to be done behind closed doors in close proximity with the intelligence agents probably isn't getting done number one but number 2 I mean these are political events remember there are as is not a court of law there are no rules of evidence this is about one team trying to convince the American people that the other party's president needs to be out of office and the other team is trying to defend that purpose for keeping their president in office and really that's what you saw the start of yesterday and that's what this impeachment hearing I think is all about well I want to ask you I mean I have a lot of other questions but you brought up something very serious suggesting this committee is not actually fulfilling its mandate which is to provide oversight of the nation's intelligence agencies do you really feel that that these lawmakers are distracted right now. How could you not be distracted this thing is sucking all the oxygen out of Congress let alone the committee and so I don't believe that the regular and important oversight work is happening and have been pretty good authority that it's just not happening and so even the disconnect you saw with the raid when we went and got Baghdad the United States went in and took care of Baghdadi in Syria raided the terrorist leader of ISIS that wasn't briefed back to the committee and that tells me that those really important functions of oversight aren't happening number one and they're not happening on even the most serious of matters and so that that does concern me again it's just not the purpose of that committee I would've preferred that they had moved that out of that committee to a more appropriate place maybe the judiciary maybe government oversight but the Intelligence Committee is designed to meet behind closed doors and not be out in the public as much as it has been. And it's clearly not designed to try to set aside a legal framework and create the articles of impeachment which is as you can imagine an intense process all of that's happening I'm just not sure the other is not a fact I'm fairly confident it's not and that worries me a little bit but I suppose that the argument from from some who are leading this impeachment inquiry which would be that while obviously that oversight is important so is exploring these accusations which suggests that the president United States might have dangled something as important as military aid to a u.s. Ally for the benefit of trying to get a you know investigation done that could politically benefit him they are going to be those things are as important or more important than some of the normal oversight. I mean I think you can do both honestly as I said I'm not a big fan of doing it on the Intel Committee and what was interesting yesterday to me David is both an f.b.i. Former f.b.i. Agent chairman of that committee I don't know if any new facts were out other than I think what the clip that you played when we started which was that phone call. And in somebody getting their feelings hurt and I worry a lot about that I just look at this process in the way it's happened and I think boy is this the right thing to do for the country at the right time I mean no other business is getting done is that the right decision do I think that I mean obviously I think it was highly inappropriate for the president to have a conversation. Senate staffer who doggedly investigated the CIA's torture program after the September 11th terror attacks this is a look back at a controversial part of our country's past but the CIA's use of torture continues to have huge implications at the u.s. Military court and prison in Guantanamo Bay Cuba where 40 accused terrorists are still being held such a fifer of N.P.R.'s investigations team reports and just a warning here the story may be disturbing to some listeners because it does include descriptions of torture techniques when the United States captured the people it believed were responsible for 911 it put them in an overseas network of secret CIA prisons called black sites and for years subjected them to what it called enhanced interrogation techniques that was a euphemism for torture beatings waterboarding mock burials a decade later a Senate report concluded that torturing those prisoners was not only immoral and illegal but also ineffective but the fact that they were tortured is a major reason there has still been no trial and may never be a trial for alleged 911 mastermind Khalid Shaikh Mohammed and other Guantanamo prisoners that's partly because evidence obtained through torture can rarely be used at trial and it's because information that is still secret like the identities of the torturers could come out at trial as CIA absolutely does not want that to happen Kammen is the former lead defense attorney for the man charged with orchestrating the u.s.s. Cole naval warship bombing. It's over what evidence is admissible over what details about prisoner treatment should be classified over whether prisoners are getting proper medical care over whether they're entitled to more lenient sentences because they were tortured if there is one feature of Guantanamo that probably can't be repeated enough because I think it is the original sin that creates all these problems is the use of torture and Michelle parody is a defense attorney for all machinery the u.s.s. Cole bombing suspect all this dysfunction why this 911 case for example was taken all this time the vast majority of issues that come up are in one way or another tied to the fact that they were tortured in secret for 4 years it just contaminates everything the legacy of torture from slamming prisoners into walls to locking them in coffin like boxes has also added to the massive cost of Guantanamo's court and prison $6000000000.00 since 2002 despite only one finalized convictions so far that amount includes tens of billions of dollars in annual legal expenses including defense experts who specialize in torture we have experts on the impact of torture for example the way it changes your brain neurologically how it influences false confessions how it affects memory out of production is a Guantanamo defense attorney for m r Alba Luci who's accused of funding the $911.00 hijackers we have experts on sleep deprivation because Mr Obuchi was the deprived continuously for 2 and a half years the CIA claims that by torturing prisoners it extracted information from them that helped capture other terrorists stop future attacks and ultimately save lives the Senate torture report concluded that was not true and that torturing prisoners yielded no helpful new information we're tired Air Force Colonel Gary Brown is a former top attorney for going Tom was military court who filed a federal whistleblower complaint alleging quote gross financial waste and gross mismanagement there brown doubts military court trials could ever happen since so much evidence is tainted by torture. And he says Guantanamo has been a failure at all but one thing they've been successful at doing something that I would have thought never could have been done and that is generating more sympathy for the detainees are than they really turned the detainees into martyrs and victims earlier this year a military court judge set a trial date of January 2021 for the 911 case he says he's determined to finally resolve it but defense attorneys for the prisoners say that date is wishful at best since nearly 20 years after the attacks the aftermath of the torture program and its impact on Guantanamo as legal process continues to play out. Good morning several congressional Democrats are demanding that Steven Miller resign Miller of course is one of the president's top advisers on immigration here's what's going on the Southern Poverty Law Center says it got ahold of hundreds of Miller's leaked emails Millard sent them to a former journalist at Breitbart and in them he talks about white nationalist ideas the White House is calling this a smear campaign and Miller for the moment isn't saying anything Jeanne Guerrero is a reporter at k p b s she's been writing a book about Steven Miller and she has seen the e-mails Good morning good morning so what are the specifics or what's in these e-mails. Yes So these are emails that were sent by part editors in 201520162 me the most revealing part is that Miller recommended a book called Camp of the saints it's a racist book that depicts the quote end of the white world after being overrun by refugees it's filled with descriptions that are perfectly degrading just as an example it describes migrants as quote kinky haired swarthy skinned long despised phantasms and as teeming ants toiling for the white man's comfort. Yet in a similar basically told by part to do a story showing parallels between the book and real life Julia Hahn who later became a special assistant to President Trump did a story saying that immigration could do much society just like in the book Steve ban in who is Breitbart News executive at the time also started talking about the book after that he later service trumps chief strategist but left in 2017 it's also important to note that the e-mails show a miller encouraging Breitbart to pull news from a white supremacist website that promotes a great replacement theory that's a conspiracy theory that says people of color are systematically wiping out the white race a Fosse had that's motivated white terrorists shootings are just even Miller is giving Breitbart advice on what to print and it appears they are printing it how did these e-mails end up coming out in the 1st place so a journalist named Katie McHugh worked at Breitbart at the time Breitbart editors had introduced her to Miller as someone who would influence the direction of her reporting Mickey was fired in 2017 for anti muslim tweets and she's since renounced the far right movement she shared her Breitbart e-mails with the s.p.l. See I spoke with McCue and she says Miller expressed a real familiarity with white supremacist literature there's more than 900 e-mails and the Southern Poverty Law Center plans to roll them out slowly including some new ones that should be coming out today. So Steven Miller. Did this a couple years ago right where was he working he was he was working with the Alabama Senator Jeff Sessions and then he joined the Trump campaign in January 26th seen Ok I get it and so the reason that some Democrats are calling for him to resign after after seeing these e-mails and hearing hearing news of them is because at the moment Steven Miller is a key policy adviser in the Trump White House exactly so he's the big guy on immigration and we can see some of what was captured in the e-mails in terms of immigration policy to trump often says he's focused on stopping people coming into the u.s. Illegally criminals drug traffickers but they've also put sharp limits on legal immigration for example the number of refugee admissions has been slashed there are restricting access to u.s. Asylum for Central Americans there is starting access to green cards for lower income immigrants together these actions have dramatically limited legal flows of people to the u.s. Something shocking that. Anything. To still play.
