It all started with missing funds from the Pride Alliance, a San Francisco Police Organization that represents gay lesbian bisexual and transgender officers. Reporter julie and frank, this is the claim filed today against the city of San Francisco and the police chief by attorneys representing officer pat burly. She stepped forward and broke the code of silence to report the embezzlement, first to the Department Internal investigation is ktvu. The days as she became the focus of a Department Investigation and was given an ultimatum, retire, or risk losing everything. Just background here. A crime committed by a Police Officer. Reporter when pat burly broke ranks and sat down with ktvu in 2015, she knew it was a risk. I didnt understand why the the department itself would want to know about it. Reporter she asked us to hide her identity afraid of what might happen for speaking out against fellow officers. Act like its fine. Protect the treasurer that did this. Outrageous. Reporter but she never imagined the backlash for blowing the whistle would be so severe. A big sense of betrayal. Reporter no longer in hiding, shes speaking freely about the retaliation she faced for exposing a closely held secret that some in the department didnt want her to tell. We did every other avenue to make sure justice was done. It wasnt done. Reporter burly was a board member of the Pride Alliance for lgbt officers and suspected the organizations treasurer, mike evans, had embezzled thousands of dollars. Burly and others brought the issue to the attention of the groups president but says she then raised concerns to the departments internal affairs division. Evans paid back the money and resigned from the police force. But burly thought he should face charges and thats where the case stalled. You take an oath as Police Officers to uphold justice and that wasnt being done. It was it wasnt right. Reporter frustrated with the way the investigation was being handled, burly decided to detail the allegations with ktvu. Turned out to be a costly decision. I spoke to you and then all of a sudden im in for misconduct. Reporter instead of being rewarded for turning in a dirty cop, burly became the target of an internal affairs investigation. And questioned about talking to the press. They showed me the video, wanted to inquire if i knew who it was. What did you say . I said it was not me because i feared i would lose my job and my pension, my benefits. Reporter but you knew that liann could impose discipline . Liann could impose discipline . In february a year after our story aired, and four months after mike evans was eventually booked on felony embezzlement and felony grand theft, burly was informed the department was pursuing the misconduct case against her. She was told the matter would be referred to the Police Commission for different disciplinary action including possible termination. Greg suhr would agree to close the case with the allegations not sustained, if she agreed to retire early. Im being forced to retire because i went to the press about a personal matter in an officer committing a crime and the chief did not like that. Reporter chief suhr said he could not comment on burlys case citing pending litigation but he insists there is no tolerance for retaliation against officers who try to report problems within the department saying in a statement quote, we encourage our officers to report any alleged misconduct by department members. Officers who become aware of alleged criminal conduct have a duty to report such behavior without cause. Theres no question shes a whistleblower. Reporter jamie walker is representing burly. She was retaliated against for coming forward with information so that another officer this is information that another Police Officer wanted to cover up, didnt want reported. And pat burly said not on my watch. Reporter officers have First Amendment protection against retaliation when speaking out about alleged Department Misconduct or corruption and that this case is evidence the antisnitching culture in the Department Remains destructive. The fact that an officer was forced to retire, that they could have lost their benefits, that they were investigation was initiated because they reported another officer to the press, that chills a whistleblower from coming forward. Thats a lot of blood sweat and tears. Reporter instead of taking taking her chances, burly took the chief up on his upper and retired on march 22. Amazing that the badge, what it represents and how much you feel like you are somebody with it and then you take it off and im still somebody but im not the same somebody. Reporter the veteran officer grew emotional as she talked about life after the police department. And about her decision to move forward with the whistleblower retaliation complaint. Burly says she spoke out because she felt she had to, it came at a great personal cost. One she believes was worth it. If you had it to do over again, would you do it the same way . Would you have spoken out . I would have spoken out, yes. Reporter burly retired eight years before she would have reached our maximum benefit. She was suing for those lost benefits, back pay and attorneys fees. She claims the retaliation continues. Just last month she received this letter from the department saying she might be added to the brady list, thats a list of current or former officers whose testimony may be suspect but because of their troubles. Sfpd sites dishonesty as the reason. Whatever happened to mike evans . The man accused in the first place . Reporter he resigned from sfpd, charged with those two felonies, yet to go to trial, but i did check and he has another hearing set for next week. And he also paid back the money.
