The 49ers number 49, bruce miller is facing legal trouble after Santa Clara Police arrested the 27yearold fullback thursday night, just before midnight at an undisclosed location on suspicion of battery. Miller lives in santa clara, and got engaged last fall. Even though this is a misdemeanor case. The police, because theres a 49er involved are going to take this very seriously. Reporter steven clark is a former prosecutor with the Santa Clara County District Attorney office. And notes felony charges come when there are physical injuries. This probably did not involve significant injuries, but it did involve a physical altercation between the couple. Reporter millers arrest comes less than two weeks after this photo of a profanity laden text exchange, apparently with a significant other was posted on his instagram account. Clark says if miller was behind the text, they could hurt his case both criminal and within the league. Thats why the cell phone information could be vital to the nfls review of the matter. Reporter a traffic stop of mason and her boyfriend. A search of the car turned up a backpack full of explosives. By that time, mason was already under suspicion because of explosions neighbors had heard. It really shouldnt have been an issue in the first place. I dont know what kind of person has explosive devices in their house. This is a really nice neighborhood, and it shouldnt be an issue here. Reporter neighbors say the house is owned by the suspects mother, who moved out of state. Given what a any search might reveal, neighbors arent sure how alarmed to be. I dont know if these are devices that could just take off a couple of fingers or could actually be fatal. I dont know. The devices that were found last time during the course of the search were equivalent to half sticks, quarter sticks of dynamite. Are they a threat . Absolutely. If those were left out in the street, anywhere in a residential area, anyone of the neighborhood children were to pick it up, weve got a problem. Reporter were learning mason made bail the very same day she was arrested last month, and was free to come home. Investigators want to know if new explosives were obtained since then, and if so, why. Police say a woman in her 20s was pronounced dead at the scene, while a man and a boy were hospitalized. Neighbors told us, they heard as many as 20 gunshots. They also say the woman was killed while trying to shield a child from the bullets. A sheriff spokesman tells us that a shootout across the street from Highland Hospital at about 8 00 tonight was connected to this afternoons shooting in west oakland. Nobody was hit. The Sheriffs Office says a car connected to both shootings sped away from the scene, but deputies caught up to it, and detained several people inside. And across the bay, San Francisco police are looking for two suspects, following a double killing that happened at a parking lot next to playground this morning in the excelsior district. The two men were shot to death about 9 30 this morning, as they were sitting in a parked car, at Crocker Amazon park. Police responded to calls from park workers and found one man dead in a car. The other was profoundationed dead at the hospital. Both were in their 20s. Distraught relatives and friends rushed to the scene and spoke with officers. Police are trying to determine the motive, and into the shootings were gang related. Our Gang Task Force will always take a look at it to see if it is gang related or not, or if it is gang motivated. Accused of destroying the records of some of the victims. Reporter frank, it is a mystery as to why missing persons records would be erased from a national database. As accused, and in a federal motion filed today, the Sheriffs Department of san joaquin is also accused of stonewalling outside investigators searching for victims of the speed freak killers. It was 2012, a well excavated turns up a thousand bone fragments and the remains of three victims. Theyre believed to be the remains from the speed freak killers. At the time, the san juan Sheriffs Department was accused of botching the investigation. Today, a federal motion accusing the Sheriffs Department of mishandling the case long before the dig. Its about getting to the bottom of why missing persons that are associated with the case, why they were deleted from the attorney general website. Reporter shermantine, from death row, wrote a letter to his sister, detailing the location of the well where body fragments would be found. It was three days later, that the deletions occurred. Reporter those occurred on the attorney general state missing persons database, typically only done when missing persons, or their remains are found. Today, the san joaquin sheriff said the records were removed, not erased. Its my understanding that the cases were not deleted. That they were transferred to the department of justice, as we stated for management, and oversight for a period of time. Reporter the federal motion also contains swan statements from two outside investigators who say the sheriff was uncooperative regarding their missing persons cases. The names of the victims have not been released. Authorities say the driver of the pickup was a 58yearold man who lived in windsor. A marin county man suspected of killing 84year old olga dinelli of penngrove pleaded not guilty. Hill was his alleged accomplice. Authorities believe silva, and hill ransacked the home on february 26, and left her bound to a chair and shot her to death.
