5:00 this evening. the fire is burning near robert louis stevenson state park. the fire consumed about a dozen acres by night fall. the highway patrol reopened highway 29 between napa and lake counties. firefighters say they claimed to remain on the front lines overnight to keep the flames from spreading. right now, that fire is about 40% contained. so far, there is no indication of just weather is everything. here we are in august. you would think a fire like this would be a huge, huge deal but look at the current conditions at the fire right now. we rarely see something like this. the winds are just 10 miles per hour. look at the temperatures, 53 degrees, the humidity at 83% may be double or triple what it could be. so firefighters are getting a huge break with the high humidity. that's just moisture in the air and a very cool temperature. on top of, that you have light wind. real good news for firefighters. more later. residents of a large apartment complex near walnut creek can breathe a little easier tonight. contra costa sheriff investigators say they have arrested a man responsible for three assaults on women in the apartments. amber lee has the story. >> reporter: residents say that the attacks have been a wake-up call. though there has been an arrest, they plan on being vigilant. contra costa detectives announced the arrest of andrew mouton. >> i'm very thrilled to hear that, because it's been very stressful. we have added locks to our door and everything. knowing that there has been an arrest made puts me at ease. >> she struggled free and then she pepper sprayed him. >> we received a break in this case when a citizen provide add tip to one of our patrol deputies. investigators say they arrested mouton as he was sitting outside of a pittsburg station this evening. it was not until today that they were able to link him to three attacks, which included the rape of one woman. >> we are confident that the dna we recovered came from mr. mouton. >> we are breathing a sigh of relief. >> reporter: authorities say that mouton does not work in this complex, nor did he ever work here. authorities are trying to determine why he was in the complex and why women here were targeted. this couple has been living here for 18 years and the attacks reminded them to turn on the alarm. >> reporter: would you turn on the alarm still today? >> oh, yeah, i do that. >> bail is set at $12 million. he is scheduled to make his first court appearance monday afternoon to face rape, attempted rape and burglary charges. reporting live near walnut creek, amber lee, ktvu channel 2 news. the investigation into the fatal shooting of a german tourist in san francisco last weekend has led authorities across the bay. san francisco police, fremont police and the fbi swarmed an apartment building. they carried away bags that they say may be evidence of the shooting. >> i department know if there was going to be any gunfire or not. they have body arm more, weapons drawn. >> a group of teenagers who attend add party at a building on mason street restarted the shootout that killed the german tourist and wounded two other people. meantime, san francisco city attorney has sent a letter to the owner and tenant that have building where the party was held saying they may face a lawsuit as well as fines for fire code vials. there was no permit to hold the party and application would have been denied because the space is designed to hold just 40 people. 200 people crammed into the building and another 200 were waiting outside. owners of a cafi say they are being singled out unfairly. the dance club located at pierre 50 is said to go quiet next week. as the port of san francisco told us today, enough is enough. it is time for jellies to million-dollar deficit. patient are s are losing their jobs and medical insurance and so are delaying their medical care. >> people are putting things off trying to get health insurance if you don't have it. if you lose your job . >> reporter: what's happening is happening at hospitals nationwide. according to the american medical news, declining hospital revenues resulted in 5800 hospital workers losing their jobs during the fir six first six months of this year. despite the financial healths of hospitals, people worry about the physical health of patients. >> if people delay health in some areas of their care, then that can cause a more severe and more acute condition further down the road. >> reporter: over the next 602 day, al camino hospital will decide which workers will lose sierra. the f.a.a. says that the piper cherokee went down in a heavily wooded area. a hiker found the plane about 2 p.m. the f.a.a. says that the plane took off from watsonville, landd in auburn and then took off again and that's when it crashed. coroners are conducting an autopsy. the names of the two people on board have not been released. the f.a.a. and the national transportation safety board are investigating. antioch police shot and killed a suspect in a shootout that wounded a police dog. neighbors reported a burglary. officers arrived and found the suspect, 29-year-old johnson inside. they began shooting after johnson shot and wound add police dog named thor. >> there was an exchange of gunfire between the suspect and the officers. the suspect was hit. he was pronounced deceased at the scene. >> reporter: thor was released from a veterinary hospital this afternoon and is expected to fully recover. the home's residents were not there when the shooting occurred. officials are trying to identify a body found in santa clara county. it's not just who killed the man but what investigators found nearby that added up to a mystery. >> reporter: it it was on this remote ridge outside morgan hill where sheriff deputies say they found the body. man called in to alert deputies about 1:30 this morning. when authorities arrived, they met with a reporting party who then led the deputies to the site where the dead body was found. >> the body was several hundred yards from where a private road, tom drive, dead ends the body is of that an adult male who has at least one gunshot wound. the body was along an unpaid dirt trail. neighbors say they were surprised. >> never had any trouble except for some teenagers partying at night and leaving some beer bottles. that's about it. >> reporter: investigators say that they found quite a bit of evidence around the body but would not give specifics. we did see the binge suv being towed away -- the beige suv being towed away from the crime scene. we learned that investigators made another startling discovery. >> they located another marijuana garden away from the body. we do not know if there is any connection between the body he seemed to be in acceptance that this is what happened and it instilled a lot of faith in me that i could get through it seeing his courage. >> reporter: you are not bitter, you are not angry? >> no, that would be stupid. i'm alive, right? my mind is still sharp and i let my imagination running a million miles an hour. >> reporter: many of the people that derek hired for his nil many are old 90 degrees on sunday but it is not a big heat up. when i say 90 degrees, i'm not there in oakley or livermore. we have had lots of drizzle. but we have had quite a bit of drizzle. some areas reporting to a quarter inch of just drizzle. so, you know, that's significant. it's been cool. it's been wet. the forecast highs in the morning, the forecast morning lows, pardon me, 50s. you knew that lots . lots of fog at your house. temperatures come up but stop at 75, 80 degrees. you get over the hills and you find the low 80s but it's just a mild weather pattern. specifically, walnut creek, noon time, 70 degrees. 80 degrees walnut creek downtown. that's when you should see maximum heating at 3, 3:15. good news for the firefighters up in calistoga. humidity at 85%. that's really, really moist for this time of the year. antioch, forecast highs comes from an increase in temperatures on sunday. temperatures will come up 3 or 4 degrees but it's very similar to what we have now. the fog should burn off as quickly as it did today. of course, in the newsroom when the fire breaks out this afternoon, in calistoga, this time of the year, we are going high alert because this thing is in the summer. you look at the temperature, you look at the humidity and wind direction, we knew ant firefighters knew, we're going to knock that thing down. very unusual for this time of the year to get a fire in
