Ktvus gentlemen lean de la vega was at a News Conference at the Police Station and joins us with more. Reporter the police chief was emotional, choking up talking about sergeant smith. He wouldnt reveal much about the actual shooting. We did find out new details that smith was wearing plain clothes when he was shot. The mood was grim, as bart police chief kenton rainy and his staff entered the conference to talk about tom smith. He was one of seven bart Police Officers and there was also an Alameda County sheriffs deputy on hand to do a probation search yesterday at a dublin apartment complex when something went horribly wrong. The team was doing a probation search and at least four were in plain clothes. Two were in uniform. Rainy says the officers were looking for stolen property at an apartment and knew the suspect was already in custody. Its unclear what caused one of them to fire at smith. The chief says probation searches are are common for the department and the officers receive 24 hours of training every two years to handle situations like this. They are supposed to practice good officer safety and in accordance with their training, and im very confident in the training that our personnel have received to make sure that they are prepared to deal with these type of encounters and situations, because you never know whats on the other side of the door. Reporter bart Police Officers in uniform are required to wear bodymounted video cameras on their uniforms. But the bart chief would not reveal whether the shooting was captured. The Alameda CountySheriffs Department is handling the investigation and are trying to piece together what happened in the apartment. Bart says the officer who fired the deadly shot is on paid administrative leave. The chief says he is not ready to release his name. We want to give him a chance to grieve, because of everything thats happened. Ive visited with him last night. Hes extremely upset, obviously, and we want to give him a chance and his family to come to grips with whats going on and whats happening. Reporter all the bart Police Officers have been interviewed and so has the Alameda County sheriffs deputy who was there at the time of the shooting. We know thomas was wearing a bulletproof vest, but the number of shots fired and where he was shot is being kept under wraps. An autopsy on smiths body will be performed today. Well, more details now about 42yearold Sergeant Tom Smith. He was a 20year veteran of the bart police force. He is the first bart officer to be killed on duty. He is survived by his wife, who is also a bart police officer, and a young daughter. Sergeant smith also has two brothers in law enforcement, one with the Alameda CountySheriffs Office and another with the Newark Police department. As the Investigation Continues into what went wrong in the moments before sergeant smiths death, a recent audit applauded the Bart Police Department for significant training improvements. An independent auditor found the department had improved its accountability and comprehensive training for its officers. The changes were based on 127 policy changes recommended by the auditor, following the 2009 deadly shooting of oscar grant. Stay with ktvu for continuing coverage about the bart officer shooting. Oakland police just released a photo of the car involved in a deadly shooting last night, involving california highway patrol. This is a picture of the gray or silver newer model toyota suv. The chp says during a traffic stop around 9 00 on wentworth avenue, near international, a passenger in the vehicle got out and ran. A chp dog caught him. When the officers saw he had a gun, they shot and killed him. Then the driver sped away. We spoke to a man who says the chp has increased patrols in the neighborhood since Oakland Police brought them in to help. They are just looking for drugs, weapons, probation, no license, whatever they can write up, and, you know, this is oakland. Youre bound to run into someone. They did. This is the second deadly shooting involving a chp officer within a 24hour period. Early yesterday morning, highway officers shot and killed a 19yearold driver in east oakland after a chase. Officers say they opened fire after the suspect pointed a gun at them. Oakland police are struggling to make needed reforms, according to a federal monitor. The monitor found that the department has regressed in reviewing use of force by officers and is not making satisfactory progress on other reforms, raising questions about whether Oakland Police will be able to emerge from federal oversight. A federal monitor has been overseeing reforms mandated more than a decade ago in response to a scandal about police brutality. A s. W. A. T. Team swarmed a Mobile Home Park in vallejo after reports a naked woman shot and killed a man. Ktvu is live in vallejo with more on the victim and the woman in custody. Reporter mike, good afternoon. Behind me is the mobile home where the shooting took place roughly before 6 00 this morning. According to our police sources, the body remains in the home. The coroner has yet to be called, as Vallejo Police continue to investigate and piece together a motive. What prompted a woman in her thirties to open fire and kill a man at a vallejo Mobile Home Park . Well, police are still trying to figure that one out, but residents that live here are stunned. Its wild. We ive never seen anything like this here ever. Weve had a couple of incidents around here, but maybe three or four cop cars at the most. This is by far the most weve ever seen here. Reporter when Police Arrived around 5 45 this morning at the vallejo Mobile Estates at the 100 block of san miguel road, they found a man who had been shot several times. He died a short time later at the home. According to witnesses who called 911, they had seen a woman apparently naked, leaving the home on foot shortly after the shooting. Officers went inside and did discover a male shooting victim, possibly in his forties. Reporter the search for her was on. Several Police Officers from vallejo, including s. W. A. T. , along with Solano County sheriffs were on the lookout for a short woman, about 5 4, about 135 pounds. They didnt believe she went far, so they shut down the only entrance for most of the morning, only allowing residents to leave if they opened the trunk of their cars. She was apprehended as she was trying to leave the Mobile Home Park on foot. Reporter police finally caught the woman, trying to climb a barbed wire fence that surrounds the complex shortly before 9 00 this morning. A resident who lives next door tells ktvu he really didnt know the people next door, but believes the female suspect and the victim may have been an unmarried couple. We heard a little arguing once in a while, but we kind of we keep to ourselves. Reporter now, neighbors also say even though they feel safe, they say this is a tough neighborhood. They say they have had their share of robberies and shootings just in recent weeks. One neighbor who did not want to be on camera says hes even considering moving out. One of the San Jose State University students accused in a hate crime against an African American roommate was officially charged in court today. The Santa Clara CountyDistrict Attorneys Office tells ktvu 18 yearold Collin Warren of wood acre faces misdemeanor, battery and hate crime charges for the alleged harassment in a campus dorm last fall. Warren did not attend the hearing, but entered a not guilty plea, the same as the other students charged in the case. The next Court Hearing is scheduled for march 4th. New at noon, governor jerry brown says a california resurgence is well under way, but that it could disappear as drought grips the golden state. Ktvus Ken Pritchett is live in sacramento this afternoon, where ken, the governor delivered his state of the state a few hours ago. Reporter Governor Brown started his speech with a swipe at what he calls nay sayers who say it couldnt happen, what the governor calls californias comeback. What a comeback it is a million new jobs since 2010. [ applause ] a budgetary surplus in the billions in the billions. [ applause ] but dont spend it. Thats the point. [ applause ] reporter Governor Brown spent much of his state of the state speech on that very theme, not spending money, but saving billions of dollars for a Rainy Day Fund and to pay for longterm liabilities. Those are things such as the 100 billion in pensions owed to state workers and teachers. In keeping with the theme of saving money, no Major Projects were floated by the governor this year, with only a scant mention of high speed rail. But the governor did focus on the drought, made official with his declaration earlier this month. Right now, its imperative that we do Everything Possible to mitigate the effects of the drought. Ive convened an inneragency Drought Task Force to declare a state of emergency. We need everyone in every part of the state to conserve water. They say years have been wasted, as lawmakers here at the capitol have been trying to do something about water and essentially getting nothing done. Just today, the council released a report showing that one in five women have been sexual assaulted at college, and just 12 reported the assaults. Former secretary of state Hillary Clinton is scheduled to visit the bay area in april. Oaklands top Business Leaders are moving ahead with plans to build a new ball park for the oakland as. Ktvu has obtained a letter recently sent to the port of oakland, signed by five prominent local leaders, including clorox ceo, don noss and douglas boxer, son of senator barbara boxer. The letter lays out the groundwork for the plan to build a 38,000seat stadium along oaklands waterfront. But this land was actually originally zoned to be the second alternative for the Oakland Convention center, so the zoning is pretty far along. This letter is the first step in a long and difficult process to try to stop the as from moving out of oakland. The as owner, lou wolf, has said publicly he is not a fan of this waterfront site. This comes as Major League Baseball announces tighter ball park security. Mlb ordered all teams to increase screening measures by the 2015 season. That means fans will be entered with metal detectors as they enter the ball parks. The giants and as were two of the teams that experimented with tighter screening last year. The former santa clara supervisor accused of misusing Campaign Funds is scheduled to face a judge in just a few hours. George shirakawa is called for a pretrial hearing, after he was accused of printing flyers with a communist flag that appeared to be from a candidate for the Santa Rosa City council. Shirakawa is serving a year in jail in dublin after pleading guilty to misusing public funds. We are still awaiting a decision on whether the mavericks surf contest will be held friday on the san mateo coast. There are concerns that wind and wave conditions are just too similar to those of 2010. This video is from 2010, when spectators on the beach were knocked over by a rogue wave. Viewing was banned after that, but there are still fears the conditions will be unsafe for the surfers. Organizers were expected to make the formal announcement today for 24 of the best surfers in the world to gather for the surf contest off of pillar point.
