Riders want to go through is another interruption on the system. As we look at the tracks behind me, its been quiet for the past five, six minutes. A b. A. R. T. Train moved through about five, six months ago. But this reenactment is scheduled to take place from noon to 350678930 today. Its important for from noon to 3 30 today. Its important for investigators to go through exactly how the workers were killed. Lawrence daniels and Chris Shepherd were killed by an oncoming train as they were inspecting a dip on the train tracks last saturday. What federal investigators hope to do is gather more information and better understand the situation that led to the fatal accident. Federal investigators tell b. A. R. T. Officials that they need to need the tracks again from noon to 3 30. So to accommodate. The la fayette station is halted. So to accommodate riders, buses will be running for those riders. It will only be three for the three and a half hour period. Its essential for the ntsb to shut down the tracks to do what they need to do to complete their investigation. Reporter this reenactment is scheduled to take place from now until 3 30. I just got off the phone from the ntsb who says this will entail a b. A. R. T. Train going back and forth so that investigators can measure and remeasure and analyze speed so they get a better chance to understand the situation from last saturday. But since the accident, the ntsb has concluded quite a few things. For one, there were no mechanical malfunctions from the accident. Only to say theres evidence of hard braking. We know the train operator was training at the time. As we take it back out here live, pretty silent. Were north of the b. A. R. T. Station. The b. A. R. T. Two Sonoma CountySheriff Deputies are on leave today after shooting and killing a young teen they say was carrying a very realistic looking toy gun. Christien kafton tells us friends are identifying the teen and then say he was no threat. Reporter he friends say 13 yearold andy lopez is dead after Sonoma CountySheriff Deputies mistook a toy gun for a real Assault Rifle and shot the teen. At about 3 00 yesterday afternoon, two deputies on routine patrol near the intersection of moreland and west robles avenue saw someone with what appeared to be an Assault Rifle. The deputies say they repeated told him to drop the gun and when he didnt opened fire. Investigators say he died on the scene. It wasnt until later, deputies discovered that the rifle was a toy, as was the plastic pistol they found tucked into his waistband. He was sweet. He loved everyone. He would never hurt nobody. Reporter this girl says several boys in the neighborhood share the toy gun he had yad and she doesnt understand how deputies could have mistaken it for a real weapon. It had an orange thing on it, the orange tip and its obvious that it is fake when you know, if it has an orange tip, its fake. You could notice it by looking at it. Reporter this individual is a friend of the family. He says they are struggling with their loss. Really tough time. He didnt they didnt know until like late last night. In about an hour, thomas bernowski is scheduled to be in court in connection with the death of a woman run over and killed at a park last month. Prosecutors say the woman was sunbathing on the grass with her dog and 11monthold daughter. Police say he did not stop or seek help but his Attorney Says his actions were not criminal. He felt a bump. He looked back and he saw a bag scam perking away scampering away and thought he did not get hit. This driver was very reckless and were gonna charge him accordingly. Hes behind bars on 350,000 bail since turning himself in yesterday. He faces felony vehicular manslaughter and hitandrun charges. The womans husband told ktvu i thinks the charges he thinks the charges are just but adds at this time, hes focusing on mourning the loss of his wife and raising their baby girl. The Alameda County coroner says sandra coke was strangled to death. The bod did of the 50yearold body of the 50yearold oakland woman was found in a creek bed in vacaville back in august. Her former boyfriend pleaded not guilty today to her murder. He claims the two had rekindled the relationship after he got out of prison last year. In developing news out of massachusetts, authorities in essex county north of boston are investigating the murder of 24yearold High School Math teacher Colleen Ritzer and 14 yearold student fill imchism is being Phillip Chism is being charged with her murder. Her body was found behind the high school after she was reported missing about 1 20 last night 11 20 last night. The teacher was reported missing. The police instituted a search and found what i described earlier as blood and secured the school at that time. Police found chism after midnight walking along a highway in a nearby town. Hes being held without bail and will be given a mental evaluation. Classes were canceled today because of the investigation at the school. A plan to put more Police Officers on the streets of san jose has ignited a controversy. San jose is dealing with a dwindling number of Police Officers. See the city started reaching out to retired Police Officers. It wants to hire those retirees to conduct background checks on police applicants. A job usually done by active officers. The purpose was to allow the city to keep more active officers on the streets. But the union sent letters to retired officers asking them not to take those jobs from active officers. And san joses mayor is outraged. That will make it more difficult for us to do backgrounds on the new recruits and may slow down the recruiting. That will undermine the department. An amtrak train hit and killed a pedestrian in san leandro. It happened in the area of washington avenue and florist boulevard around 15 this morning around 9 15 this morning. No one was injured. Amtrak set up a bus to take passengers around the scene. It looks like the male, adult male was pushing a shopping cart full of recycling and was struck by the train. Reporter inspectors with cal osha have decided to take a closer look at the june death of 63yearold elevator mechanic, donald white. State officials originally notified whites employer a week ago that it was cleared of any safety violations but that was rescinded. Cal osha wouldnt specify as to what prompted the change of heart. An experienced cal osha staff questions had some staff person had some questions and for that reason, the notice of no violation was rescinded yesterday and that investigation that was begun on june 11th is ongoing. Reporter in its initial investigation, cal osha determined white was killed while standing in an elevator shaft while the counter weight came down and hit him on the head. Thes jency said white was the agency said white was in communication with the other worker and knew the elevator was coming. I think a longer investigation is needed because it came in so quick and said what they thought happened and a lot of people want to know if it was fsh it was himself if it was himself that did it or someone else that hurt him, someone elses equipment that hurt him.
