officer who refused to be a victim, opening fire on the suspect. this was not an oakland police officer. they will not say who he works for. investigators say it turns out, the robber, he was holding a fake gun. the suspect was taken to the hospital in stable condition. he got more when he bargained for when he tried to rob a man and a woman on this street. investigators say one of the victims turned out to be an off off-duty police officer. he pulled a gun and fired on the suspected robber. >> i heard a number of shots. i'm not exactly sure how many. three, four, all in rapid suction and then i heard some -- successtion and then i heard somebody yelling down! down! >> reporter: the officer and his wife were by the trunk. >> he withdrew his service revolver and fired a tu times. >> reporter: the suspected robber shot was involved in at least two other holdups earlier in the night in this same area of oakland. neighbors are sternly thankful the way things -- certainly thankful the way things ended. >> i think it's better the way it happened than the other way around. >> oakland police tell me the man who was shot will be facing armed robbery charges once released from the question the acting police sergeant about the 7th homicide the year. 20-year-old mario romero was shot to death last week. police say he got out of the car holding what appeared -- holding what appeared to be a gun. some people say vallejo needs a citizens' review. tonight's meeting is the at -- at 6:0 as the city hall chambers. opening statements are about to get underway for the murder trial for william payne. he was arrested after investigators say dna evidence linked him to a 1983 homicide. he was -- he was 17 at the time. payne is charged with first- degree murder or the strangling death of nicholas crumbley. he was visiting from texas. milpitas police are searching for the gunman who killed a 7/11 clerk. here's more. >> reporter: we just learned from 7/11 that the victim was a 61-year-old man. he releaves behind a wife and two children. people are leaving behind, flowers, a candle. they are expressing sadness over this news. they are also expressing concern that this is just a quarter mile from the police station. police were called here just after:00 saturday morning and they found the store clerk suffering from a gunshot wound. investigators say it appears the shooter was trying to rob the store. they will not say whether the surveillance robberies were caught on the video or not. >> because it's so fresh, the detectives will are -- are gonna -- we don't want to make any mistakes in the investigation. >> i'm scared. i feel bad. i feel bad. they -- the people working there, they are very nice people. >> a makeshift memorial has been growing in tonight -- in front of the store and in the parking lot. the 7/11 says the family is in mourning and they are trying to respect their privacy. police tell us that this case is their top priority and they pulled this case to work another investigation. they've not said whether they've identified suspects in the case and they've not wess -- released the name of the clerk killed. this is the city's
