Yearold woman was taken to stanford hospital where she later died. Her name has not been released. She was apparently caught in a traffic backup and ended up on the tracks with nowhere to go. If she had backed up, she would have been in an intersection and going forward, she may have had other cars in front of her preventing her from moving forward. People who work near the train crossing say the intersection is often crowded and confusing. Many times, its like can i go . No, it doesnt look safe. Can i go . Ive been sitting here for, you know, five minutes almost. And just today, there was a minor accident a block from last nights collision. And the woman who heard last nights deadly crash says she was once struck by a car here while she was walking by last year. The train comes, already nervous trying to stay off the tracks or on to the other side. A pedestrian will run in the way. Theres too much going on. But changes are likely coming to this crosswalk. The menlo park public works director tells us the city received funding to design a different crossing. One that will have the street run underneath the track. But until that time, everyone should know that you never stop on the train tracks. If youre not clear to proceed all the way through the tracks, dont enter the rail crossing. And were back live. Now the crossing reopened an hour ago. Now the new crossing is most likely still more than two years away, but it should prevent the kind of accident that happened here yesterday. Gasia. Rob, thank you. There have been three accidents involving cal train in the last 24 hours. The first one as rob just told us was on the tracks in menlo park. The second was last night in San Francisco. A man was hit and killed inside a tunnel near 18th street and interstate 280. Later this morning, there was a third accident. Someone was hit, were told that person is still in the hospital. Not enough women in powerful roles. Women not making as much as men, and a possible run for the white house. Those were just some of the things that Hillary Clinton spoke about today here in the bay area. The former secretary of state spent the afternoon in santa clara talking to thousands of women and ali rasmus was at the conference and has more on Hillary Clintons message. Ali. Reporter that conference wrapped up a little while ago. You can see from the people leaving the Convention Center who the conference was geared towards. 5,000 women attended and its fair to say most of them were eager to hear what their keynote speaker, Hillary Clinton, had to say. The numbers are sobering. On the forbes list of the top 100 Venture Investors in tech, only four are women. Hillary clinton certainly knew her audience, speaking to a room full of 5,000 women in silicon valley. A woman with a bachelors degree here tends to make 60 less than a man with the same degree. The issues of equal pay for women in the workplace and paid sick and family leave for parents won Standing Ovations from members of the audience. Clinton then shifted to a broader economic message. The kind you expect a potential candidate to say. We no longer rise with productivity while ceo pay keeps going up. We have to figure out how to make this new economy work for everyone. Clinton made strong hints toward a possible run for president in 2016, but when put on the spot, she was coy. All in good time is my response, because you know, theres a lot to think about. After a lengthy investigation, the Justice Department decided not to pursue federal civil rights charges against George Zimmerman for the shooting death of Trayvon Martin. Zimmerman was acquitted in july 2013 for killing the African American teenager. The Justice Department said there was insufficient evidence that would have required the killing was racially motivated. Eric holder said this should not end the conversation about race and racial inequality in this country. The parents of Trayvon Martin said they were disappointed. They will honor his memory to work tirelessly to make the world a better place. In Southern California, a commuter train had collided with a truck. 28 people were injured, four are in critical condition. Phil hsu shuman in los angeles reports that safety changes in the trains made a significant difference. This was a dramatic view from the ground at sunrise as First Responders continue their work. Five cars in route from oxnard to los angeles derailed. Three of the passenger cars tipped over, lying on their sides. Rescue workers there in three minutes after the first 911 call had to deal with a burning truck on the tracks and also a 50 injured passengers. The evacuation was orderly and went well. Again, as i indicated before, we recently done training with amtrak and metrolink on these types of incidents. So things went very well and coordinated very well between the agencies. Reporter and the fact there were no fatalities on board was no accident. Since 2010, they have been upgrading, adding crumbled resistant passenger cars at 15 million a piece. Crash energy management, the technology is called. This has a particular section in the front and back of each of those cars, in essence, a protection area. Designedded to absorb the force, directed away from the passengers and did perform the way it was supposed to. Investigators believe all this happened because of a mistake. Oakland Unified School District has come to an agreement with two labor unions. The unions represent 1700 district employees, including School Security officers, food service assistance, and special education aids. Give some of the Union Members a 3 wage increase. Other members will receive additional pay increases to ensure that their wages meet or comped 12. 25 an hour. You may remember oakland teachers have been in a labor battle with the district. That expired in 2013. Cargo operations at the port of oakland ramped up seriously as thousands of desperate shippers and receivers are waiting for their goods. I looked out the side window and it was complete orange out there. So i yelled to my family to get out and by then, the firefighters were knocking on our door and we just ran out. It took an hour to put the fire out. Firefighters found the victim toward the back of the home. He hasnt been identified, but neighbors say it was an elderly man who lived there. Students also raised money to buy goats for families in nicaragua. And for the family that gets one, its like winning the lottery. The goat makes 16 cups of milk a day and you can have it mate with another goat and sell the babies. Students raised more than 1,000 for 22 goats. Other ways they can earn their wristbands include watching educational videos on civil rights leaders, participating in no name calling week, or a canned food drive. It makes me feel like i changed someones life and it makes me feel really good on the inside. As much as these students do at school, their learning doesnt stop when the bell rings. Fremont police say an associate of ortiz may be linked to one of their cases where a man was drugged, beaten, and robbed. As for this murder case, police are being extremely tight lipped about the homicide of this wellliked family man. As soon as Gabriel Ortiz walked into the courtroom, you couldnt help but notice how young she looked, the 19year old from san jose wearing a red jail suit, signaling the severity of her crime, ortiz rarely looked up. If we couldnt prove it beyond a reasonable doubt, we wouldnt have filed the case. Prosecutors say ortiz murdered 56yearold, robert. He was found dead at his home on bay tree drive on february 16. According to the criminal complaint, ortiz took her personal property, electronics, wallet, and keys. Ortiz may have had help with at least three other people. Police are not saying how he died, but hours after his death, a store surveillance camera captured ortiz seen here on the right and another woman using his credit cards. In an interesting twist, Fremont Police tell ktvu ortizs associate seen on the left, could be a woman who goes by the name crissy. Authorities say back on february 7, crissy lured a man who solicited the services of a prostitute. The man was beaten and robbed. That woman has not been caught. His death doesnt make sense. This is a friendly neighborhood. Basically everybody around here knows everybodys business, so to speak. And everybody watches out for each other. According to his obituary. He comes from a large family. The Sales Executive who volunteered for the Second Harvest food bank leaves behind three daughters and six grandchildren. A celebration for life will be held this thursday at a gilroy funeral home. As for ortiz, she is scheduled to be in court next tuesday to enter a plea. She is being held without any bail. Gasia. Thank you. President obama today vetoed the controversial keystone xl pipeline. It would move crude oil from canada down to refineries on the gulf coast. Supporters say the project would create jobs, but critics say the environmental risks are too great. Congressional republicans plan to try to override that veto next week, but theyll need a 2 3 majority in both the house and senate and the sponsor of the bill says that right now, they dont have those votes. Veterans affairs vex Affairs Secretary issued an apology. He made a misstatement while speaking with a homeless veteran in los angeles last month. Mcdonald served five years in the armys 82nd airborne division. While he trained with special forces, he was never part of them. The oakland Police Department was ordered to undergo a major overhaul. Under the eye of a federal monitor. The department was in a real state of crisis facing lawsuits over corruption and brutality. Ktvus ken wayne has been following the changes at opd. You discovered 12 years later, some of the fiercest critics of the department are saying, you know, some things have changed. Some dramatic changes here. Oakland isnt the first to go through this radical change in policing. The opd found a stark example in another city facing the same problems. High crime, poverty, and a Police Department in turmoil. I went to detroit two years ago as that city was struggling to turn around its troubled Police Department. It is also where a prominent open civil rights attorney traveled to see what was happening in detroit and how the positive changes there could help reform the oakland Police Department. When i went to detroit and met the chief there, the first thing he said to me was constitutional policing is good policing. So here we have a city that, you know, has more problems than oakland. And has a very tough crime problem and the chief was saying that in detroit. I went to detroit twice, actually. And that is where Oakland Police chief, sean learned more about constitutional policing. Its a Simple Police practice that detroit was using and where the crime rate not only started to drop, but so did complaints of Police Misconduct. The philosophy of constitutional policing is simple. We, the police, are not above the law. If were going to enforce the law, then we have to respect it. So, we expect our officers to treat people appropriately. That means no more random stops of civilians being questioned and frisked if they havent broken the law. Whats happened . Well, oakland is also seeing a drop in crime. A drop in officer involved shootings and the number of complaints of Police Misconduct are also down. One of the big changes is the use of Police Body Cameras that record officer interactions. Tonight at 10 00, well talk about some of the other changes the department has made and how close it is to coming into full compliance with the changes that were mandated during this reform process. Just how close is opd to the full compliance mark . There were 51 items listed in the nsa, the negotiated settlement agreement. Oakland police has reformed 48 of those 51. One of the last big ones is how they handle minorities who are stopped, particularly blacks. A stanford professor hopes to have some conclusions that could be implemented by perhaps april. The wish heard around the world. It is about fiveyearold cancer survivor, miles scott, and his wish to become a super hero. Youll recall with the help of thousands and thousands of volunteers november of 2013, San Francisco was turned into gothem city where bat kid came out and saved the day and caught all the bad guys. The Film Festival runs through march 8. Helping officers see the people they serve differently. The one thing a city leader wants Baseball Players to stop doing on San Franciscos field. Plus, the problem that this pilot face right as his plane was landing in san jose. The pilot of a small plane with a landing gear problem managed to land safely today at the airport in san jose. The plane skidded on its belly and came to a stop with one wing touching the grass. Three people were on board, but no one was hurt. The mercury news reports the pilot was a Southern California attorney trying to make an appointment and he did manage to get to that meeting on time despite that crash landing. The richmond Police Department was among several Law Enforcement agencies that took part in a unique Training Exercise today. Upper command staff from the department listened to a nationally recognized expert on bias within Police Departments. Explain how impacts the communities they serve. A woman who works with people who have been in prison says she hopes that the training will help officers see the people they serve differently. To be able to realize their own implicit they may be carrying around. Some of the Police Tactics need to evolve to be better received by our community. Members of the oakland Police Department, the alameda county, and the Contra Costa County department will also part of todays training. The state board voted today to cut the tax on gasoline. Voted unanimously to reduce the states excise tax on gas by 6 cents. Its going to lower the tax from 36 cents a gallon to 30. The money is used for transportation projects and road repairs. The board chose a lower number because of a recent uptick in gas prices. The tax cut takes effect july 1. Security measures are under review at kansas state tonight after an unruly court storming by basketball fans. Kansas state fans flooded after the wildcats beat the jayhawks. Members of both teams had to fight their way through that enormous crowd. Jayhawks coach found themselves crushed against a press table and needed help. Kansas state officials apologized today saying guards just didnt have time to move into place. They plan to review video to identify any troublemakers. Cost nearly a quarter billion dollars to build and even longer for this new Police Headquarters building to open. How workers found an unexpected problem in an essential part of that building. Frank, theres already a ban on cigars, cigarettes, and e cigarettes and baseball diamonds. The hope now is to strike out chewing tobacco. Bay area little leaguers today made a pitch to ban chewing tobacco from San Francisco baseball and athletic fields. I know its really bad for you and you can get cancer and die from it. And it also looks really disgusting. Someone who played baseball in high school and in college and chewed tobacco for years, i personally know how difficult and addicting chewing tobacco is. Supervisor joined by Health Officials and antitobacco activists said hell introduce legislation to ban smokeless tobacco from the citys athletic fields, including at t park. Smokeless tobacco causes oral cancer and pancreatic cancer. One of the deadliest cancers that we know. The goal is to deter Young Athletes from picking up a deadly habit. The announcement came in conjunction with the statewide bill introduced today that would ban it from Major League Ball parks. A spokesman declined comment. I would be shocked if there was not opposition to this. But major league Baseball Players could fight it as well, even though the league has taken a stance against smokeless tobacco. Major League Baseball has long supported a ban of smokeless tobacco at the major league level. We sought a ban of its use on field and discussions with a major league Baseball Players association. We support the spirit of this initiative in california. Giants fan and chewing tobacco user was surprised by the proposed baseball park ban. I feel like it doesnt affect anyone but me. Supervisor says he hopes to have the ban approved by the full board and operational by january. But he didnt rule out making exception for at t park here at Major League Players fight it. These were the highs from today. Above average by a ton. 70 in santa rosa. Significantly warmer than you would expect for month of february. Not so on the east coast, so here it is right now. These are current temperatures. Not current temperatures, these are the highs from this afternoon from east to west and then well run through tomorrow and you see, stays pretty chilly on the east coast. Whats going on is this ridge of High Pressure goes up over us. Thats why its warm. The warm air resides under the ridge. So the ridge is upper atmosphere. Its like a river of air. And then down here when the ridge drops, we call this a trough and all this cool air settles to the north of the trough. So, the warm air, see its down here underneath the jet stream. Down around florida, down around texas, and all the cool air is to the north of it. The jet stream really, truthfully if you want to rough it out, its the separation of the warm and cool air. So, the polar air here, the warmer subtropical or lower latitude air here and where they meet and because of the earths spin, this jet stream spins in the upper atmosphere. When i show you the jet stream, theres the warmer air. Its all relative. Very cold air, relatively warm air. Its the difference between the two. Forecast tomorrow, a lot like today. Less wind, we had a little bit of wind today. It wasnt howling, but it was blowing strong north, northeast. Now its blowing northwest. 65 in walnut creek. Overnight lows will drop down. At issue, a black History Month presentation not sanctioned by school officials. Why some parents its not what the teacher did, but the way she did it that has them upset. These stories and more are coming up at 6 00. A man and woman got off the bus in south korea. Look at that. They fell through a sidewalk into a sink hole that opened up. Emergency crews were called in and ended up pulling them out and took them to a hospital. The two people only suffered minor injuries. The cause of the sink hole is still under investigation, but officials think that it may be linked to construction of a highrise Apartment Building going on next door. Its crazy. The new headquarters for the Police Department expected to open up next month following a delay. Its a 243 Million Building at 3rd and mission and it was supposed to be ready late last year, but right around that time, the citys public works Department Said it found cracks in the buildings foundation. Two young girls, both of whom were adopted by American Families in china were reunited this week here in oakland. Unfortunately, the circumstances would bring them together arent good. Ktvus amber lee explains they are battling the same health problem. Laughter and smiles and a long awaited reunion. Two girls from an orphanage in southern china. Separated 3 1 2 years ago when they were adopted by different u. S. Families. But memories have not faded with time. We sit by each other when we eat lunch. We spend together for as long as i can remember. And we seem to find each other in the orphanage. May franzen, 11, now lives in madera and tenyearold may who lives in north carolina. Her chinese name is mungmung. This reunion is a dream come true for the two girls. A piece of the past that was missing. She always asked about her. She came home asking to try help her find her friend from china. It was her missing piece. When our children are adopted from china, they come with nothing. They leave everything. They had already lost their parents. They lost their friends in the orphanage. This photo given to her parents by the orphanage was key in the two families finding each other. She suffers from a disorder in which the body fails to produce blood. And her parents were looking for a bone marrow donor using the internet and connected with may franzens mother who is part of a Facebook Support group because may and her little sister, melissa, also suffer from the same disorder. All three girls are patients at Childrens Hospital in oakland. Known nationwide for the program. The franzen sisters received blood transfusions here once every three weeks. She is now being evaluated for her condition. Their doctor says a bone Marrow Transplant is the cure. But a good match is rare when its not a relative. You are more likely to find the match on your own ethnic group. Because there are similarities. With one piece of the past found, a renewed optimism for the two families that their daughters will long and healthy lives. We did one huge accomplishment, right . Now we have one more to do. It was a piece of her that was missing. Its a lifelong friendship that will be for ever. The girls were reluctant to part ways as the franzens left to drive home. Controversy at a bay Area Middle School over a black History Lesson not sanctioned by school officials. Parents tell us its not about the lesson itself, but the way it was taught. The lesson was intendedded to teach students about the Civil Rights Movement and the history behind racial slurs. But only black students were invited to attend. Now some parents are speaking out. Noelle walker is live outside the middle school where the district is doing some damage control tonight. Noelle. Reporter frank, we heard about this from parents who posted to our ktvu facebook page, saying students would be segregated for anything. It turns out the school was, too. The superintendent told me this event was planned by a well liked, well intended teacher who didnt get the districts approval first. In a place that teaches lessons. The middle school is learning a tough lesson. It looks like seg regages. Segregation. The district is reviewing protocalls after the only African American teacher issued passes to African American students only to attend an Assembly Monday afternoon. It makes me uncomfortable that all the African American kids walked out
