Our cameras were rolling as 49ers player ray mcdonald walked out of the jail just after 11 00 today in a tshirt, shorts and flipflops trying to hail a cab. But the defensive mineman at first didnt say much about the arrest then he opened up. What do you want to say to your fans [ inaudible ] the truth will come out you know. Hey i i cant say too much on it right now. But you know the truth will come out. I mean, Everybody Knows what kind of person i am. And reporter what kind of person are you . You know im a good hearted person. Reporter just after 2 00 this morning, Police Arrested the 9yearold for fell m 29 yearold for felony domestic charges in san jose. The Sacramento Bee is reporting mcdonald was involved in an altercation with his fiancee. Who according to the paper is ten weeks pregnant and showed police her bruises. The article goes on to say other 49ers players were present at the home. Its not the old 49ers i can say that. This Younger Group is i dont know. Sometimes they seem like they dont have their head on their shoulders. Reporter last september, 49ers linebacker al don smith was arrested for dui in the same neighborhood as mcdonald. Smith is now facing a nine game suspension. We want them to be the best players that they can be. And not have any distractions off the field. And making unethical and idiotic decisions is really hurting this team. The fans. Referee this comes as nfl commissioner Roger Goodell on thursday changed the leagues personal conduct policy regarding Domestic Violence. Implementing a six game suspension for a first offense and a banishment from the league for a second offense. 49ers general manager trent baalke issued a statement saying taxi. Let the law run its course but theres an obvious issue anytime is a play serai caused o player is accused of breaking the law. Depending on the law the effect can be decidedly secondary. If the accusations are true, the 49ers and mcdonald can expect a severe penalty. The league was heavily criticized just this summer when Baltimore Ravens running back ray rice received just a two game suspension for an assault on his then girlfriend that was caught on videotape. Commissioner goodell candidly stated last week the league probably got that wrong. Fellow 49er smith will serve a nine game suspension for a series of transgressions that didnt involve any kind of physical assault. The league will most likely wait for the criminal Justice System to run its course before handing out a penalty. But if mcdonald is found guilty, the 49ers should expect a maximum sentence. What would that mean . On strictly a Team Performance basis . The 49ers are already without smith for nine games and fellow pro bowler bowman who will miss the first half of the season due to injury. Reporter in some neighborhoods crews are working through the holiday to restore water. Knocked out again by a 3. 2 aftershock this morning. Napas mayor says it didnt cause any physical damage. Just in peoples psyches. You know . Mainly arent we dont yet . Reporter although napa is hurting, she says having people shop local is the only way theyll recover. When things like this happen, it people just step up to the plate and they care. Reporter and the mayor tells me fema crews here inspecting the city to determine whether or not theyll receive any federal aid. But regardless, the city already is working on getting a one stop shop location set up for people to get some help and that is set to open in about one week. Live in napa, christina rendon, ktvu ktvu channel 2 news. A church damaged by the earthquake opened its doors for Sundays Services this morning. The First Baptist church welcomed people back today. This time, last week, the chunk was blocked off after crews deemed it too dangerous to enter. The bell towers separated from the building and it had to be repaired. During todays service, pastor al marks showed the congregation the damage and talked about what might have saved the church. This part had to come down. The fire marshal that came earlier in the day said that we had not retrofitted the bell tower it probably would have come down. It was felted in 1992 following the quake in 89 and Officials Say the damage would have been much worse without the retrofit. Set to open a new Emergency Assistance Center Tomorrow in napa. The center will be located at the napa valley marriott on the solano avenue in the meeting room. Quake victims will be able to meet with trained red cross caseworkers who can assess their needs. And provide information as well as assistance to help them move toward recovery. That new center will be opened from 10 00 in the morning until 7 00 in the evening and as we mentioned a week later, napa is still seeing some significant aftershocks including another one just this morning. Thats right meteorologist mark tamayo is here now with details of the series of aftershocks that continue to rock the area there. Yeah thankfully most of the aftershocks have been in the magnitude 2 range but today this morning we had a magnitude 3. 2 to report. In fact around the epicenter of last weeks main shock magnitude 6. 0. They correspond to the earthquakes aftershocks since the last week a week ago. Quake a week ago. In fact heres a tally report coming out to 36 reports of these are the quakes the red areas indicating the aftershocks. Greater than 2. 0. Now the developments for today, two to report. The one happened at 1 56 this morning. That was the magnitude 3. 2. That was the same spot as the accept earn of last week. And then another quake to report as you can see just outside of napa. In fact that was about seven miles east southeast of napa. Not as strong but a magnitude 2. 5. And theres the chance of some for weak aftershocks more weak aftershocks over the coming week or so. Thousands of people have been filling the streets throughout the day for some live music, food, and celebration. That pride festival there has been an annual tradition for five years but this year theres another event. A parade. And while it may be a bit smaller than San Franciscos pride event it didnt lack the heart or fun. Thousands of people lined the streets of downtown oakland this morning for the citys first ever gay pride parade. Somewhat small. Just seven blocks but people who came say they were excited to represent their city. Oh man its a beautiful thingment you know im happy to be out here with my family and friends enjoying myself. According to the advocate magazine, oakland is home to more lesbian couples per capita than any other major american city. And ranks third in gay and lesbian headed households just behind San Francisco and seattle. None of the people why dont we have a pride in oakland . A pride parade in oakland . And so here we are. And i think its going to be part of the tradition now. Organizers say they made an effort to include a diverse crowd. Making sure the event was familyfriendly. Were making great strides. One man was shot and killed tonight in oakland. It happened near 50th avenue near the coliseum Public Market where the west wind coliseum swap meet is held. Police say they are investigating the shooting as a homicide. Right now we do have a crew there on the scene. Gathering more details and well bring them to you as they come into our newsroom. Happening now, want to give you a live picture of interstate 280 in San Francisco. Which as weve been reporting is temporarily closed as crews continue to do some retrofit work there. Caltrans says that traffic has been flowing smoothly despite that closure. On thursday, crews closed the northbound lanes from the highway 101 interchange to king street on interstate 280. They are removing large sections of the roadway to replace aging hinges. They will allow the roadway to expand and contract during an earthquake. And we spoke to a caltrans see spokesman about 45 minutes ago and he says they are on track to reopen the freeway on schedule at 5 00 on tuesday morning. Continuing now on the crisis in iraq. And a second day of humanitarian aid drops on the town as the Iraqi Military says it has broken the long siege that has trapped thousands of people without food and water. The United States continues to carry out air strikes in support of the iraqi fighters on the ground there in the town. And as mary mali knee reports the joint effort is paying off. We have to protect americans, thats the number one issue. Reporter the u. S. Is continuing air strikes in iraq. Sunday officials announced the u. S. Hit isis targets near the town. The town of about 20,000 is home to in shiites an ethnic minority passing massacre from isis. We got into iraq because we had humanitarian issues that we had to deal with. It happened at about 12 30 on stone valley road near miranda avenue not far from a fire station. The chp says the driver of a jaguar traveling eastbound went off of the roadway. The car then hit a light pole and it caught fire with the driver trapped inside. Investigators are looking into alcohol or drugs playing a role in the crash. The california Highway Patrol is looking for the driver in a deadly hit and run near petaluma. The chp says it happened just after 4 00 p. M. Yesterday on bodega avenue near king road. The suspect was driving a 2007 chevy pickup truck when the driver drifted into the shoulder of the road. The truck then spun out and then reversed into a sedan trapping a driver inside. The chp says the other driver a 51yearold man from napa died there at the scene. Were told the suspect took off on foot. We have new developments now in a shooting in livermore. Police arrested three males after five people were shot at a house party earlier this morning. Officers made the arrest during a traffic stop just around 9 30 a. M. We are told Police Released two people but one suspect is still in custody. Police say 21yearold Anthony Jesus torres was booked and charged with five counts of attempted murder and shooting a firearm into a home. The shooting happened around 12 30 this morning at a house on south q. And third streets in livermore. Allie rasmus reports on what happened right before the party. Reporter its a picturesque neighborhood with fences and tree lined streets. Third and south q. Streets in livermore is not the place she ever thought shed see crime scene tape. For this neighborhood, nothing like this has ever what happened. Ever happened. Ever. Reporter Livermore Police patrolling the area heard those gunshots too this morning. They arrived at this home on south q. Street to find five people struck by the bullets. Three females, two males. And all adults. Reporter all in their late teens to early 20s. They were among the 20 people gathered at a house party that evening. According to witnesses, three people from out of town showed up to the party uninvited. Everyone is partying but during that theres a verbal confrontation between the three individuals and someone else at the party. They were asked to leave. Reporter about 30 minutes later police say a white sedan pulled up to the front of the home and someone inside the vehicle started shooting. Five really loud pops like backtoback. Just bang bang bang bang bang. Reporter police say the five victims suffered nonlife threatening gunshot injuries. They were my friends. To me, its unexpected because usually the only they only invite people they know. Reporter she was supposed to be at that house party last night. I went with my gut instinct and didnt go. Reporter she spent the morning trying to get in touch with her friends. She was glad to hear everyone who was injured is expected to survive. Livermore, allie rasmus, ktvu channel 2 news. The Sheriffs Office is investigating a double shooting at a house party overnight in contra costa county. It happened in oakley on Ridge Crest Court and Cinnamon Ridge drive. When deputies arrived they found two men suffering gunshot wounds. They were both taken to john muir hospital in walnut creek. No word though on the extent of their injuries. Another person at that home was hit with an object and treated there at the scene. So far no arrests have been made. A man injured by a car in oakland is still in Critical Condition condition. The man was hit yesterday Afternoon Police say at east 12th street and third avenue near lake meren. The investigation into finding out if he was in the crosswalk is still underway. In oakland a Police Lieutenant says the officer was making a turn at a slow rate of speed while responding to a call. Theres a warning out today about a Mountain Lion sighting in woodside. The sheriffs deputies received a report about one year the county park about 10 30 this morning. They were investigating the report and advising residents there to be cautious. Its especially important not to approach a Mountain Lion thats eating or with kittens. But that generally they will try to avoid confrontation. A traditional coin toss by lawmakers maybe to blame for breaking a statue in the State Capitol thats been around for more than 100 years. Police say the victim was walking from a train to the parking lot when man came up to him with a knife and demanded his backpack. Two wildfires are threatening as many as 250 homes near happy camp and theres also burned close to 100 scare miles in the National Square miles in the National Forest but cloudy skies and lower temperatures are slowing the spread of the fires.
