Thats why there are no charges that reflect any sexual assault. That investigation has not commenced. Its still under review. If convicted on the drug charges, prosecutors say he could face five years behind bars. Alameda county sheriff investigator says that a man came with them with bat so they were forced to open fire. Reporter theyve been to the house 19 times over the years for one emergency or the other including Domestic Violence and psychological issues. But goemz family says this never should have happened. The Coroners Office said it is still trying to provide positive identification through dental records. Her body was discovered at the entrance to Redwood Regional Park late saturday night. Police used evidence found near the remains to contact possible family members. New at 5 00, accusations that certain jail juveniles in Contra Costa County are being mistreated. A lawsuit has been filed on behalf of the juveniles. The u. S. Department of justice and education have joined in. Reporter smith is managing attorney at disability rights advocates which filed the lawsuit. This is very much like an adult penitentiary. Reporter smith offered up parents testimonials. He just sits there every day doing nothing. He did that for almost the last three years. No schooling, none whatsoever. The whole three weeks that hes in solitary confinement. California law specifically says that juvenile halls are intended to be a quote supportive home like environment. Reporter the lawsuit seeks to lessen if not eliminate solitary for the mentally disabled. It seems seem seeks to make sure inmates get education and rehabilitation. When the department of justice and the department of education become involved in a lawsuit, it is uncommon. And its because they see a real problem that has national implications. Reporter the feds want the county prohibition to stop pointing fingers at each other holding both parties responsible for the solitary confinement and lack of education for mentally disabled juveniles. It could be as high as 70 of populations in juvenile hall. Now the director here said that his countys lawyer instructed him not to comment. And the case goes back to work sometime next month. The victim lived alone and may have been sleeping in the back bedroom when the fire started in the living room. Does look like the fire resulted from a combustible material over the top of furnace in the living room. Unfortunately the home did not have any smoke alarms at all. The fire may have been smoldering for a while. And if that house would have had a smoke alarm the man who lived inside may have survived. A violent protest in ewe cane. The state Fire Fighting agency tweeted an update this morning on the impact of the unusually dry conditions. And Agency Spokesperson said that since january 1st, the agency has responded to 600 wildfires. Those fires have only burned 1,500 acres still. The number of fires is a 330 increase compared to last year and forecasters say when it comes to the drought there is little relief in sight. The city of berkeley is planning to exterminate hundreds of squirrels. Chavez park was converted from lorenzo. Now the area is covered with holes dug by squirrels and gophers. The city is now planning a Pilot Program to fence off a 1 acre area of the park and then trap the rodents.
