A Community Meeting right now for those those effected by the fire. More than 100 have been evacuated. The evacuation watch is in effect for more homes in the area. The fire is now at 550acrest. It is just 5 contained. At least 15 homes have been destroyed. No injuries have been reported. That fire and another one on the peninsula are causing concern about the air quality in the south bay. Youre looking life at the conditions in downtown san jose. It is much the same story farther south in gilroy. Thats where our robert honda is. How is it where you are . Reporter we can still smell smoke. Many people here didnt realize all the smoke coming from so far away and from Different Directions would hit them so hard. We gilroy is more than 60 miles from the fire. The smoke still made the owner smell sick, then combined with smoke from the fire and a spare the air day t it was a bad day for business. The chemical smell in the air just turned my 12078 accused. I just p did gist did not feel like having lunch. I knew it was not going to be a good day for us. 50 miles away, a school joined numerous other south bay schools and moved pe classes, recess and lunch indoors. The principal didnt wait to take action. The smell dominated by the recycling fire told her all she needed to know. It was a chemical smell, burning tires perhaps. And it just didnt smell good. Lots of icks from the kids. Later, the Public Health officer issued a letters to schools, hospitals and Skilled Nursing facilities as the smoke is spread south. I live in north county. The air up there smelled fine. Then i came down to san jose this morning and noticed a real difference. So i can feel it in my eyes and in my throat. And that meant a day of coping. I smell the smoke and its really bad. It bothers me. I have had a cold for the last two weeks so i want to make sure my lungs dont get irritated. Reporter the air has started to clear up. And then you have this fire burning. With the winds that have shifted south, what that means is those winds will starting to blow in this direction, of course from big sur north up into the san jose area. So it is at a Higher Elevation than the haze thats right down at the ground. But that smoke is infiltrating that area. As it settles in, it is making things worse. So a spare of the air day again tomorrow. Visibility up to about 4 miles now, but people are smelling smoke down there. It is definitely from san jose, gilroy, morgan hill is where you notice it the most. You have the redwood fire, the big sur fire and the spare the air day. It is a lot of haze. We 62 violations of federal environmental law at the chevron. A fire last year was caused by a corroded pipe that failed. The epa says chevron failed to maintain equipment and didnt respond adequately to air bourn chemical releases. The epa could pursue criminal charges or fines if the Company Fails to address the violations. Cheiron says it is working with the epa and other agencies to remedy the issues. New development in the case of a young girl on life support just days after a routine surgery at oakland churchs hospital. Tonight, her family says they have won a victory. The 13yearold girl at oakland Childrens Hospital has been declared brain dead. Her family says the hospital will not remove her from life support. Ktvus john fowler live at the hospital with medical and legal issues that are intertwined here. John. Reporter this is an unfolding tragedy tonight. Made worse in some ways by medical technology. Please, god. It is not her time to go. Her family refuses to give up. I just dont think i will be able to sit here and let them take her like that. Im her mother so i will fight for her until tend. But the end came five days ago. Doctors told the family declaring the 13yearold brain dead. No one is saying why, but she died after a routine tonsillectomy. The surgery was supposed to help her sleep apnea. The hospital has nowback backed off the efforts to remove life support. I want her on as long as she can because i really believe god will wake her up. Experts say brain death means dead, legally and actually. That no one is required to keep a dead body on a ventilator. Guidelines require only one bedside exam. Childrens hospital has apparently done several. Experts tell me the hospital is extending her life support only out of compassion for her surviving family who almost cruelly now see the appearance of life. If her heart is still beating, why are you trying to take her off life support. Obviously, there is still a chance that she can survive. Police announce the arrest of a suspected credit card chief. Shortly after releasing two surveillance today, they say the man tried to make a stolen purchase with a stolen card. The victim realized his wallet had been stolen and called police. Two people have now been charged with obstructing Santa Rosa Police officers. The deputy mistook the teenagers bee bee gun for a real ak 47. Police say last month, a 24 yearold David Douglas refused to get off the street during a protest march. He pleaded not guilty today. And, 30yearold ramon cairo was charged yesterday with assaulting a Police Officer during another protest december 10th. A third man will be in court lacer later this month to face possible charges stemming from that zymodemation. The crime rate in san jose is now higher than the average crime rate for the entire country according to a new report. The citys independent auditor said last year there were slightly more than 3,000 major crimes per 100,000 residentses. That is 3 above the state average and 1 above the countrys average. The auditor also says that arrests are down while response times are up. Just days away from christmas, one east bay charity is having trouble keeping up with demand. Because whatever is coming down or coming up from the big sur fire is going to get trapped back in that atmosphere. It doesnt really have any way to get out of there. The winds will shift tomorrow. It should clean the atmosphere out quite a bit as we go into the next 24 hours. Between now and then we will see a lot of smoke particular lat kind of lingering in the valleys. 37 in napa. 37 in antioch. Those are the forecast overnight lows. High clouds out there now. There should be patchy fog showing up as we get into late tonight early tomorrow morning. Here is the sunset. The winds in the bay area are northeast. So this is the haze and pollutants mainly from the morning commute and afternoon. The winds are lowing them out to sea out towards San Francisco. That layer makes for a pretty sunset. Just not good air quality right now. It will get better as we go through time. But right now the inversion is setting up. After that, winds kick up as we get into thursday and friday. The Group Accuses them of seeking to create a loophole in the citys living wage requirements. The city says the projects developers and potential retailers, including start bucks are concerned about having to pay a living wage. We know the city has always said it needs to be a shining example, to lift up the people that it has power to do so. So when we say the city has a living wage policy and they are trying to exempt it, they are going to wrong direction. The city council was set to discuss tissue today but has put it off until late next month. Right now, san joses living wage is 15. 78 an hour. Now investigators from the state and epa are looking into what sparked a fire today at a Metal Recycling plant on the peninsula. Tonight, we are getting our first look at the damage inside that plant. Ktvus alley rasmussen is now live at the plant at redwood city. Ally, that site has seen previous incidents such as this one. Reporter thats right. The recycling plant shut downed to because of the fire. No one was injured, but it is going to take investigators awhile to figure out how this fire started, and how to prevent it from happening again. News chopper 2 circled overhead this morning as flames and smoke poured from a fire. The fire started just before 1 1 00 this morning. Eight hours later the fire was still burning. Wind plow the smoke into the south bay triggering a shelter advisory. During a tour of the site this afternoon, Company Representatives apologized for the disturbance. We are very sorry about it. I take my position here very seriously. This is the fourth fire in the past six years at the facility. The most recent on november 10th. They say the company made changes after that fire putting auto scrap and light metals into smaller separate piles and using infra Red Technology to show heat. This was a big surprise. We really have ramped up our intake program. Investigators with the bay area air Quality Management district were on site today deploying extra monitoring commit to measure air quality. Equipment to measure air quality. Smoke violations that day and the impact on the community, that violation can be as much as 10,000 per day. But 10,000 is probably not what the company will end up paying. Companies typically negotiate a lower penalty. Well take it as it comes. The companys focus right now is solely on investigating this fire, understanding why it happened, look at the root causes, coming up with corrective actions so that we dont have a fire again. Reporter it will take the air Quality Management district at least a week to calculate just how bad the smoke was from the fire and figure out what types of compounds were in the air while this fire was burning. Ally rasmussen. One man is facing charges after prosecutors say he tried to throw his wife off the san mateo bridge. The 47yearold fell into the bay instead. It happened friday afternoon. The coast guard pulled him from the water. Prosecutors say he was arguing with his wife. Police say he pulled the wife out of the car and tried to throw her into the bay. Several witnesses were able to grab the woman by the legs and save her. Clinton is being held without bail and due in court friday. We got our first look today at the oakland Police Departments new patrol cars. The department showed off its new Ford Police Interceptor utility vehicles. They will be used to replace some of the older Crown Victoria police cars that are in service currently. Overall the department is getting 82 of these new suvs. They are designed to provide more space and better access for officers and their equipment. Interim police chief says they will help officers do their job, quote, well and safely. We ask a lot from our Police Officers. In order to provide them the necessary equipment, they can do the job we ask them to do. This is the departments largest fleet purchase in a dozen years. The interceptors will be deployed overthe next few months. Toy donations for charities are slow this Holiday Season. One east bay nonprofit says it is suffering because of that and from a major crime earlier this year. The Group Christmas for everyone lost 50,000 worth of gifts and supplies in a burglary almost a year ago. As ktvus john sasaki reports every since, the charity just cant seem to catch up. David, explain to us what this ritual may mean. Reporter we talked to an expert about what it may have meant. We learned about the frequency of such incidents the popping up all around San Francisco, also. Workmen this morning found the bodies in broad daylight and called the police. They were wrapped in black and red fabric. Unusual. It is the remains of an animal sacrifice. A bundle of plants, candles and fabric marked with symbol. Animal control officers say they find about 20 similar cases a year. We pick up discarded, headless corpses a lot. San franciscos health code allows the ritual slaughter of some types of animals that will then be eaten, but animal control officers they their time is being consume by illegal cases such as this one. In 2007, there was a ritual left. It must be investigated as animal cruelty. Recently, i tried to keep a log of the locations. It is literally no point in it at all. Penalties in which the animal is killed but not used for food include up to a 1,000 fine and a year in jail. But. We have almost no luck in figuring anything out with these cases. Tonight, an epa Emergency Response team is at the simms recycling plant. The fire began overnight and is now out. But it sent potentially toxic fumes into the air for hours. And in big sur, crews are making slow progress on the other fire. We just received new numbers. The size of the fire has now jumped to 769acres. 22 buildings have been destroyed, including at least 15 homes. The fire is only 20 contained at this hour.
