Saying about the death. Reporter we are in the North San Jose neighborhood, where police have been since this morning. You can see that investigators are still conducting their search for evidence, to try to solve what they call a violent death. The creek view inn in san jose is a subsidized housing complex filled mainly with people who have known each other for years. Neighbors were stunned when someone called the San Jose Fire Department to say one of the residents, a 62yearold woman who lived here alone, seemed to be in distress. She was laying on the floor and they were doing cpr. Her stomach was very extended. When they brought her out to the emergency vehicle, they were still doing cpr. I heard that some woman broke in and beat the [ bleep ] out of her. I dont know. Reporter San Jose Police homicide detectives were summoned and later confirmed she had been assaulted but not shot or stabbed. We do believe she had some type of physical attack or trauma. We dont have any kind of suspect information. Reporter several neighbors told us the victim had someone staying with her this past week who had left abruptly. This was a person who used to live in this building about three to two years ago, and she was sent for a Home Invasion in those apartments. Reporter while police investigate, neighbors mourn the loss of a friend. She is one of the elders that lived in our complex, and its sad that, you know, shes gone. Reporter neighbors told us the name of the victim, but it has not been officially released by police or the coroners office. At this hour, detectives are still talking with neighbors and other possible witnesses about this recent roommate and anything else that helps them figure out what happened in the last hours of the victims life. This was the scene the weekend before last, after the not guilty verdict came down in George Zimmermans murder trial. Many merchants had windows smashed and complained there werent enough police to stop the violence. The interim police chief says it was an intelligence failure. It was all pointing to a significant rally and march. So we staffed according to that. In hindsight, we obviously should have put more people out on saturday night. But weve learned from that. Were working on that to make sure that doesnt happen again. The department has cancelled regular days off for this weekend, and expects to have 150 extra officers patrolling friday and saturday nights. Trayvon martins father speaks out. Ahead in 35 minutes, the emotional speech he gave on capitol hill and the fight hes vowing to take on. San Carlos Police are stepping up patrols after reports of a peeping tom. In both cases, the women were showering in the bathroom. One incident happened on tuesday and the second this past monday. Police say at this point, they have limited suspect information. I believe one of the windows had kind of a texture to it, so it was difficult to see out, which is good, because hopefully it was difficult for the suspect to see in. In the other case, the woman only saw set of eyes. Police are asking people who live in the area to lock their doors, windows, pull down their blinds and always be mindful of their surroundings. A big section of downtown alamo was cordoned off after a gas line was ruptured. Our newschopper 2 was over that gas leak earlier today at 3195 danville boulevard. It was right near the alamo plaza and pleasant courtyard shopping centers. Ken . Reporter gasia, right now im standing on danville boulevard, which is closed, as it runs through alamo. That intersection you see right there is stone valley road and there is that construction work taking place. It was an east bay crew working on a water line. That crew ruptured a gas line. The gas has been shut off. The repairs are being made. But questions remain about how the evacuation alert unfolded. This is danville boulevard in alamo. Usually a busy road, but not today. Everybody has been evacuated. When i left my office, i figured id go shopping at ace for a while, but they were closing down two. Reporter lloyd was one of the few people left around town. As we were digging to do our work, the markers were off, so our crew hit a halfinch gas line. Reporter the crew called 911. A safe evacuation area was identified and we established the evacuation area around the scene, with the publics safety in mind. Reporter a 1,000foot evacuation area was declared. What followed was a county phone alert. But the Fire Department says it got calls from people far from alamo, asking if they too should evacuate. This alert, which went out over at least one cable system, read evacuation in contra costa county. But the county says it sent out automated landline calls to the reds areas on this map and that their phone and email alerts did specifically name alamo. Where the confusion came from is unclear. For what was a relatively small gas leak but a major headache for some. Everything will get back to normal pretty quick. Reporter well, the fire received calls as did ktvu from people in contra costa who live far from alamo, asking if they should evacuate. Now, we did see the alert, the text alert, that was sent out by contra costa county. It was specific to alamo. The county says it is looking to see how that message may have been watered down or that information omitted as it was passed from one medium to another. As for the gas line and evacuations, the evacuations have been lifted. Pg e says repairs here should be complete in six to eight hours. Gas was also a concern in oaklands chinatown district after a minivan accident. It crashed about 2 00 this afternoon and receiverred a gas line. That forced a quick evacuation of the people inside. I smelled the gas. Thats why i asked my wife, hurry up, get out of the house and we called 911. Then the Fire Department and the police, they come in. People in several nearby homes were also evacuated until the gas was turned off about 3 30 today. The man driving the van was described as police as disoriented and was taken to the hospital with injuries that are considered nonlife threatening. Bay area environmentalists filed suit today to protect children from pesticides. New at 5, ktvu health and science editor john is live with the story. Reporter angry parents here in sebastopol are trying to stop this vineyard development. They say it threatens children with pesticides that could drift into homes and these classrooms. Once a lowimpact apple orchard, workers preparing to plant grapes here. The problem . Orchard view school is just yards away, one of five nearby schools. When they come out and spray, the wind is going to push it over, and my kid is going to be basically breathing in pest seeds. Reporter her son, cyrus, is in the second grade at orchard view. Today we obtained this federal court petition. They are charging the epa with years of failure to act. We are asking the epa to do its job. It has a mandate under federal law to protect children from pesticide exposure. Reporter environmentalists say with this air monitor, they discovered pesticides near every field they checked. Environmentalists say readings significantly exceeded federal limits. Pesticides are linked to learning disabilities, to autism, falling iqs and the epa needs to take action today. Reporter environmentalists and parents want a big buffer zone. You cant smoke around kids, so why should you be able to spray pesticides . Reporter the Property Owner plans to comply with federal laws. But activists say its simply not enough. The epa told me it will decline comment until officials review this litigation. The clock is ticking as bart and Union Negotiators try to find Common Ground ahead of another looming strike. There are now 11 days left before the unions 30day contract extension is set to expire on august 4th. The alternatives being considered the strike does happen. They are continuing to negotiate. But all indications are that the negotiations are still far apart. The demand for that service far outstretched the supply that was available. Reporter and that was during a slow holiday week. A large number of people stayed home. Drove alone. Just sat in traffic or were on vacation. We dont see that there was a huge shift over to carpools. Traffic in august is traditionally higher than a Holiday Weekend in july. I do think for those people who got tied up in the bart strike in july, you can expect the worst experience in august. Reporter some commissioners openly wondered. We should be engaging with the private sector. We should be doing everything we can to provide an alternative. I dont think its stepping on anyones toes to say we should make every effort to replace that service. What it would take to have an entity in the region that was in effect a true backstop to replace bart, we would need somewhere in the neighborhood after 8,000 buses. Reporter an alternative . And the unions say that despite barts claims that their negotiators havent been available about 40 of the time, the unions say their negotiators have been available 100 of the time since negotiations began. Police say they stole firearms at reeds indoor range in santa clara at around 3 00 this morning. They shattered a lot of windows. Reporter the alarm system alerted police, who say they arrived within three minutes. They spotted a suspicious car leaving the store and followed it. The officers got behind them. Some items were thrown from the vehicle. Those items turned out to be two rifles and five handguns. Reporter officers caught up with the car a quarter mile away on lafayette. Police say the two men tried to run away, while the female passenger stayed. The men are brothers and are identified by police as 20year old jorel moreno and marcus moreno. The woman is Tina Marie Guzman of san jose. Im upset. Its like violating your own personal resident, as far as im concerned. Its a big mess to clean up. San franciscos mayor today signed a new budget, one he says will improve the citys neighborhood and balance its books. The budget will close multimillion budget gaps over the next few years, he says. The budget funds 300 new Police Officers and 120 firefighters. The mayor says the budget is both fiscally and socially responsible. Socially responsible budget also means that we engage our community leaders, we engage how we do services. The budget also adds funds for education, street improvement, parks and homeless services. But a federal Appeals Court has now frozen all litigation against the city for the duration of the bankruptcy proceedings. Reporter contra costa and marin counties banned cigarettes anywhere tobacco is outlawed, including restaurants and work places. They are proposing a similar statewide ban. The fda has yet to regulate e cigarettes at all. Whats ahead for this suddenly booming business . Estimated revenue, 1 billion this year, doubling each of the last four years. Most of the heat stays out in the great basin. Whats going to happen is it does this deal where it presses against the cooler air at the cost, so it stays cool at the coast. And oh, look, its hotter inland. Classic pattern. Mid to upper 90s as we head into tomorrow. Youll still find heat in the valley. Its not a big cooldown, not a heat wave, just what you would expect. You see that cool bite of air right around the sea breeze, the greens and the yellows, 60s and 70s, and thats what you expect for this time of year. 95 in vacaville, 95 in clear lake. Pretty toasty. East bay, 95 in livermore. Air quality, it gets a little not around the bay, because weve got a breeze, but in the inland valley, air quality will take a bit of a hit. Gilroy, 92. Air quality not as great in these areas, as the sea breeze doesnt get in there very easily. Along the coast, fog, as weve had. And youll see clearing too. You notice on saturday and sunday, the clouds kind of start to come in a little bit. Thats from a weak weather system thats going to introduce quite a few clouds and send temperatures downward. So those are your inland temperatures. These are your coast. Or these are your bay and these are your coast. And the bay, were talking like hayward, fremont. Ktvus patti lee has been talking with police. What are you learning . Reporter this victim was a 66yearold caucasian woman here there oakland, shot up the street on fern street. You can see the broken glass. Police just finished collecting evidence about 20 minutes ago. Now, here is what happened. At 1 24 this afternoon, this woman was driving on fern street when she was shot. Her car then slid backwards and crashed into a parked car. Neighbors called 911. But by the time help arrived, the victim was pronounced dead here at the scene. At this time, were not sure of how many suspects, if were looking at one or several suspects that are responsible for the shooting. Investigators are still on scene. They are talking with witnesses, reviewing Video Surveillance footage. Reporter just before this live shot, we had a chance to run up and talk to a couple of neighborhoods, including the gentleman whose car was hit in this incident.
