edition of ktvu's channel 2 news at 5 i'm heather holmes. ken wayne is off tonight. we begin with the pedestrian accident in foreman that left an elderly security guard dead. police say he was run over at a muni bus at 5th and mission tv his right leg ended up he pinned under a wheel. emergency crews freed the man and took him to the hospital. and we got word about 45 minutes ago that the man died from his injuries. the driver has been placed on leave pend an investigation. now to oakland, and a new order or occupy protesters there as time is running out for them to leave. the city this morning issued its third warning in as many days. now this latest cease and desist notice called on demonstrators there to vacate all city property and parks including frank ogawa plaza and lafayette square park and snow park. ktvu's patti lee is from oakland and the city is offering shelter to the protesters, but few if any are taking the city up on its offer. >> reporter: [ inaudible ] a city shuttle bus pulls away from the curb devoid of protesters, whom city offered beds at two homeless shelters. >> we cannot go anywhere exempt in a shelter. >> reporter: the city offered shuttle service to those yesterday, but according to staff members at the shelter on international and 75th, only two people from occupy oakland checked in yesterday. >> we're encouraging the encampment to break up and people to leave. >> reporter: despite the notice that prohibits protesters from camping on city patriot the at least 25 tents near lake merritt show there is a growing encampment there. >> i can't take this anymore. >> reporter: he says occupiers are worried that an increased police presence at frank ogawa plaza signals the possibility of impending enforcement. >> some people are packing up and getting ready. >> reporter: i asked city officials if there is a timeline to close the encampment? what part are going to enforce? >> that i do not have knowledge about. >> reporter: [ inaudible ] well today's notice comes three days after a deadly shooting near the occupy oakland encampment outside of city hall. police still haven't released the name of the victim who was an african-american man in his 20s. so far no arrests have been made. authorities are now offering a $10,000 reward for information leading to an arrest in this case. police describe the two suspects from that shooting as two black men in their 20s. the first suspect is 5'9" tall and weighing about 150 pounds with short hair. now the second suspect is only described as 5'10", 250 pounds with long dreadlocks with red tips. uc berkeley's police chief says is he looking into whether any officers should be disciplined their response to the occupy cal movement last week. the chief is reviewing footage of wednesday's violent clash between officers and students to see if excessive force was used. he is also using the incident to decide whether pepper-spray and tear-gas should be used in future demonstrations. occupy portland camps have been cleared out, but the situation remains very tense. police and protesters have been facing off with each other in the streets near the two public squares where protesters had been camped out for the last six weeks. most protesters peacefully moved out of those camps this morning after the mayor ordered them out at 12:01 a.m. >> and in denver, 17 protesters were arrested when police in riot gear forced occupy demonstrators out of civic center park last night. cities across the country ordered occupy protesters to tear down their illegal pitched tents, citing health and safety concerns. occupy organizers are rethinking the next step in their movement with some in favor of continuing the encampments and others supporting different forms of mass protest. for the latest on all the occupy protests, be sure to visit our website, ktvu.com and click on "the occupy protest" tab. traffic on the peninsula is moving smoothly again tonight after a major accident allegedly caused by a sleepily driver. the chp says just after 2:00 a.m., a big rig overturned on highway 101 between willow and marsh roads in menlo park. investigators say the driver likely fell asleep behind the wheel. he wasn't hurt, but the action slowed lanes of traffic for six hours. caltrans had all of the lanes re-opened around 9:30 this morning. and an apartment fire in san francisco this morning caused minor injuries. flames broke out about 8:00 a.m. at the apartment in clement and 3rd avenue. the two residents escaped, but you suffers from smoke inhalation. with help from neighbors, everyone else was able to fetout safely. >> we saw the flames shooting out of the building and the guy who pulled the fire alarm went and kicked the door open on the building and began to wake people up and getting them out. it was a pretty good-sized fire. >> crews aggressively controlled the fire by attacking from the ground and roof. they say the cause was accidental l. a santa cruz county man is behind bars in illinois after police say they found 72 pounds of pot in his truck. officers say 27-year-old thomas de bakker, jr. of aptos was pulled over on thursday for speeding along i-00 near highland. that is when a police dog alerted authorities to three duffel bags full of marijuana inside the truck. he faces drug trafficking charges. authorities in contra costa county are investigating an armed robbery that happened at the verizon wireless store in pleasant hill. they say two men walked into the store armed with semi- automatic handguns. one of the men held an employee at gunpoint and took money from the register and the other men hold go customers at gunpoint and stole their wallets. two serum robberies happened wednesday in concord and clayton and police have not said if those accidents are connected. santa clara city leaders are expected to take another big step to bring the 49ers to the south bay. ktvu's alli allie rasmus explains. >> reporter: tailgating in the shadov candlestick is what sundays are all about for diehard niners fans. >> win or lois we come to the game, but this is what we really like to do is tailgate. >> reporter: imagine all of this happening miles away from san francisco and this week santa clara officials could make the next step to take it to the south bay. it's not a done deal yet, but on tuesday santa clara council is expected to allocate $10 million to prepare for possible stadium construction. we contacted santa clara a mayor and vice-chair to ask about tuesday's meeting, but didn't hear back from them. the reaction ranged from disappointment. >> it's ann icon and that is what it's all about. the niners at the stick. >> we accept what comes. we're okay with change, even at our age. [ laughter ] >> reporter: and some fans said that they are excited about a possible change. >> the city of santa clara is warmer weather all the time and of course, you have several highways that feed into the area. >> reporter: while some fans may be attached to candlestick park. >> we're niner fans so we'll go wherever they go. >> reporter: they come to cheer on the team, not the stadium. in san francisco, allie rasmus, ktvu channel 2 news. pennsylvania may soon change its laws in the wake of the child sexual abuse scandal rocking penn state. governor tom corbett told "meet the press" that the state will pass legislation requiring employees to report abuse allegations directly to police rather than just to their superiors of an institution. penn state assistance football coach jerry san jerry sandusky's abuse went on for years because accounts of it were not passed onto police. an employee responsible for testing the eastern patch bay bridge has reportedly falsified tests on other projects. an investigation bit sacramento bee found that the technician has been disciplined for fabricating test results. the report says on the bay bridge work he failed to verify his gage was working properly. the technician is on administrative leave, but that doesn't happen until after the newspaper's investigation. caltrans says the construction is safe. the new eastern span of the bridge is scheduled to open in 2013. san francisco officials are confirming that turnout was low for last week's off-year election with one key exception. despite the intense race for mayor, only 40% of registered voters cast ballot. that is the lowest turnout since 1975. but 50% of chinese-americans, who were registered to vote, they actually did, breaking a record. the excitement is credited for helping elect ed lee, san francisco's first chinese- american mayor and four other candidates also have chinese heritage. a house is destroyed in chicago in an early morning explosion. what officials suspect caused the blast that critically injured two people. and questions of fairness. what one g.o.p. candidate says happened during last night's debated that swayed how the moderators asked questions. queer wrapping up a nice fall weekend across the bay area, but change is on the way. coming up the warmest day of the workweek and the timing of our next cooling trend and which rain showers will be added to the bay area forecast? there goes dwayne's car. oh, man. there goes dwayne's house. whoa! whoa! and there goes dwayne. man, that thing does not like dwayne. ' . in chicago had this morning a fire destroyed a home and critically injured two people. neighbors described the windows as being shattered and seeing the house collapse. the fire spread and heavily damaged several other homes. investigators blamed the explosion on a gas leak. neighbors say they could smell the leak last night. 37-year-old martinez police sergeant brian carter lost his battle with cancer last june, but as ktvu's claudia wong tells us tonight his widow continues to fight for a cue and get more people on the bone marrow registry. >> i miss his humor and his little one-liners, laughing and joking, brave, great father, great husband. >> okay, let's go handle and it we're like let's make it happen and nothing really shook him. >> reporter: back in 2009 just after his wife found out she was pregnant with preston, martinez police sergeant brian carter was diagnosed with non-hodgkin's lymphoma. >> it was very devastating, but you know, we kept busy with our two kids and the goal was -- there really wasn't any doubt in our mind that he was going to get better. >> reporter: despite a bone-marrow transplant brian lost his fight in june of this year and yet tiana says that anonymous donor gave them all a precious gift. >> for this man to provide so much hope to our family was so wonderful and whether he gave brian an extra day, an extra hour, an extra month, you know? it was that much longer that my kids and myself had with him. >> reporter: this morning tina ran in southern california to raise awareness about bone marrow donation. brian's friend rode 100 miles for the leukemia/lymphoma foundation. >> brian fought with everything that he had, so just continue to do that work. >> reporter: claudine wong, ktvu channel 2 news. the latest presidential debate focused on foreign policies, but issues of fairness were raised about the way the event was moderated. >> congresswoman michelle bachmann's campaign say she was not given given as much chance to respond when an e-mail revealed the moderators were focusing on those with higher poll numbers. rick perry rebound after his appearance on a former debate. >> then we'll have a conversation. >> congresswoman bachmann says she supports water boarding of supported terrorists while congressman ron paul spoke against us military involvement overseas. president obama meantime is in hawai'i for the asia-pacific economic cooperation summit. the president have trying to spur economic growth and free-trade among the 21 nations taking part in the apec summit, a plan supported by business and labor leaders in the u.s.ment summit leaders expressed concern about the european debt crisis and discussed ways to mitigate the damage if europe falls back into a recession. >> hey, hey, ho', ho', apec has got to go. >> occupy protesters were followedd by police on bicycles. a hawaiian singer farm performing for the president and other leaders revealed a t- shirt that said "occupy aloha," as i sang the dangers about corporate greed. a supercommittee is working on a reduction deal to cut $1.2 trillion from the federal budget over ten years. and with the november 23423rd deadline looming, lawmakers are stuck on the same issues that prevented a debt-reduction deal two months ago. republicans are opposed to tax increases and democrats are opposed to cuts in health and retirement programs. but they say they have not lost hope for a deal. italy is in the process now of forming a new document to deal with the nation's debt crisis. former european union commissioner mario monti has been appointed as the new prime minister, taking over from silvio beryl conei. berlusconi, who resigned last night. a series of sex scandals eroded berlusconi's public support. >> i think it became different when his wife left him saying i am leaving him because he hangs out with minors. prime minister mario monti is moving quickly to appoint a new cabinet before european stock markets open in the next few hours. a u.s. astronaut and two cosmonauts are scheduled to lift off bound for the international space station. it will be the first manned- mission since the crash of two russian rockets. in august a rocket carries supplies to the space station crashed in siberia. since the retirement of the program in the u.s., the russian program is providing all manned flights to the space station. well, it was a pretty nice day out there. checking in with our meteorologist mark tamayo. >> today we enjoyed mild temperatures, but a big dropoff in temperatures expected in our forecast. you may have notice hide clouds punishing into the region?
