The walt disney chief executive says the new block bust enter film has been hacked. They want money. Theyre going to release it if they dont get money in sections. Is this a big deal for hollywood . It is a 3 billion film. Theyre going to release it online. Do people look at pirated stuff online . Do you. No. But my internet habits are minimal to the average person. Youre still going to go to the theater and see it. If i wanted to, im not going to go online and go to some questionable site which might infect my computer to watch this movie. Hacking is not unusual for hollywood. There are those generations that like to watch movies at home, grab their computer and watch it and take advantage of it. I dont know. Saving ten bucks. Im cheap and thats not worth it. We have a busy newscast. Last week on the 9 we brought you the verdict in the murder trial of garciatorres. After ten years of deliberation over a couple of days, the jury found Garcia Torres guilty of kidnapping and first degree murder in the death of sierra lamar. Right now the same jury is hearing arguments in the first day of the penalty phase of the trial. They will decide whether to sentence him to death or life in prison without parole. Allie rasmus is live with more on what both sides will present. Reporter the testimony is expected to be emotional with the jurors hearing directly from some of sierra lamars friends and family members. Prosecutors have asked to show the jury a Video Montage of sierra lamar in her childhood, teenage years set to music. The same men and women on the jury that convicted Garcia Torres of kidnapping and murdering sierra lamar will now decide his fate in the penalty phase of the trial. One of sierra lamars friends will take the stand to make the case that garciatorres should be given death. I support the fact that if he gets pushed to that point, it will make him talk. Reporter sierra lamars body has never been found. According to court filings, they would like to conduct a psychological profile of Garcia Torres and use that in the penalty phase. It is expected to be an emotional week of testimony with as many as 12 people testifying on behalf of the prosecution. In his defense, garciatorres attorneys are expected to argue that he should receive life in prison. They would also like to show a Video Montage of garciatorres family life and submit their own psychological evaluation. He suffered a troubled childhood with abuse and incest in the home. Garciatorres suffered the negative psychological effects of pesticide exposure. The judge has not ruled which of these doctors or experts or psychologists will be allowed to testify in this case. But the whole process is supposed to last about two weeks in this penalty phase of the trial. In san jose, allie rasmus, ktvu fox 2 news. And allie right now is inside of the courtroom as the penalty phase of the trial begins. She will have a live report in the noon broadcast. If garciatorres is sentenced to death, he will join more than 700 prisoners on death pro. The first execution in california was in january of 2006. Just last year californians voted on proposition 62 which would have replaced the Death Penalty with a strict life sentence. It failed with only 46 of people supporting it. Our question of the day is, do you support the Death Penalty, yes or no . Lets take a look at the results. 59 say yes you do. 4 1 say no. The Death Penalty is an easy way out. They should spend the rest of their life thinking about what they did. Michael says it is a waste of time as with the multiple appeals. Most death row inmates die from other inmates or Natural Causes before they are executed. If he or she has viciously taken someones life, then of course i do. Why should they be allowed to live . It is call justice for the victim. We will continue watching your responses. Thanks for using ktvuthe9. We are joined by michael cardoza. Were going to see a lot of imagery and testimony in the days to come. Can the defense argue about the length of this, about how much imagery there can be or do they not have a say here. Because a life is at stake, the judge is liberal with letting the defense do what they want. I dont want to cut them back or curtail them from putting some evidence on. Then they will appeal and then it might get reversed and were coming back. So theyre going to err on the side of caution and pretty much let the defense have their day in court. Because california does not execute people for all intents and purposes, is that going to hurt the familys chance of finding out where sierra is . Because he might say, fine, give me the Death Penalty. Ill just diane old man. Well, youre probably right. Scott peterson is a classic example. Still on death row. Were looking at 20, 25 years out. But the state is looking to speed it up. So do you want to take that clans and be cavalier about it and say give me the Death Penalty and then we and and then you say, whoa, wait a minute a minute. Youre seriously. Im sure that garciatorres is taking it seriously. Here in oakland about ten years ago, he said he was not guilty killing his wife. When it came to the penalty phase, he offered to show where the body was buried in exchange for a lighter sentence. Do you expect trading to happen in this case like that. They may do that in this case. Wait to see if the jury brings back the Death Penalty. I have to tell you, number one, it will be up to the family. It will be up to sierra lamars family to decide. Thats what the d. A. Will say. What do you want . I have to tell you. I have thought about this. God forbid it happens to any of our children, but if you come to me after youre convicted and say to me as a father, all right, i admit i did it. Ill tell you where your son or daughter is. Im thinking, wait a minute, now youre going to admit it to me . I know you did it because the jury brought back that verdict. Do i really want to know where you buried my child and how you killed them . Im not sure i want that information. So i would probably err on the other side. If i were in favor of the Death Penalty. Dont need to know. Keep it to yourself. Let him be given death. This is not about guilty or not guilty. There is a ton of emotion from here on out. In the guilt phase, michael. Im asking. No. In the guilt phase, the judge instructs the jury, you cannot consider emotion. You cannot consider sympathy. You cannot consider passion. You have to look at the facts and decide guilty or not guilty in this case. In the penalty phase, its all about emotion. Do we hear from Garcia Torres himself . Thats going to be interesting. I doubt it. Because if they put him on and the District Attorney gets at him, it will be did you kill her . Where is the body . And how did you do it . So why would you put him up . There goes your Bargaining Power too if youre of that mind. I dont think we will hear from him. I could be wrong but i dont think you will hear from him. Thank you, michael. Youre welcome. Coming up on mornings on 2 the 9, reaction from President Trump about a report that he shared classified security information with russia. Why he says he is not in the wrong. Wheres the rest of it . President trump declared that he has the absolute right to share information with anyone that he wants, including the russians. In a series of tweets he says that he wanted to share the information that isis may be plotting an attack on the use of laptops. President trump seemed more angry that Washington Post had an article that was reportedly said during his meeting last week with the Russian Foreign minister. Quote, i have been asking direct comey and others doctor the beginning of my administration to find the leakers in the intelligence community. The information came from another country that did not want the details to get out. According to the Washington Post, moscow could connect the dots and put the source in jeopardy. Mcmaster addressed the issue at a White House Briefing that wrapped up minutes ago. The premise of that article is false. In any way the president had a conversation that was inappropriate or resulted in any kind of lapse in National Security. And so i think the real issue and i think what i would like to see debated more is our National Security has been put at risk for those violating confidentiality. Mcmaster says the discussion between President Trump and the Russian Foreign minister was wholly appropriate and it was based on open source reporting. However a senior european official tells the press that his con free may stop sharing information with the United States if they learn that classified information was shared with moscow. Brian sobel joins us right now. Right off of the bat, your reaction to the president tweeting this morning and mcmaster responding. Well, i think the information that was disseminated is of interest. But i think theres there is a bigger story here. And the story is why and how this information is getting out of out of meetings like this. Because at the end of the day, the president , whoever the president is, can share data that he thinks is important for in this case world security. So theres Something Else afoot here that is troubling. Do you think that someone inside of his administration is trying to, i guess sabotage what is going on here . It has to be somebody inside. Only a certain number of people in the meeting. Who could know what was said in there unless its an insider. Thats right. The only other people in the room were russians. So you just dont know who said what to whom. But its this is troubling. Because if information of whatever strike is working its way out into the media and and into where our enemies can pick up on it, that is really, really troubling, sal. Is there it is not illegal. But there are concerns this may be a breach espionage etiquette and jeopardize the information that the United States gets or doesnt get. Well, thats an open question, gasia. And that is whether a source provided by a third party, another country, was somehow not revealed directly but by they say connecting the dots could be gleaned or discerned, that would be troubling. But mcmaster said that wasnt the case. Now to question who do you believe. And it further erodes trust in the government and you kind of wonder who keeps doing this. What do you think, brian, that the Senate Majority leader, paul ryan, are in this . Are they talking with the president . Are they concerned about, you know, what has taken place here over the last 24 hours or is he not listening to them. No. No. Im sure there are conversations between the speaker and leading members of congress, the senate in particular. I saw mccains statement as well. He was concerned about it. But there is also concern that just generally were not being tough enough on the russians right now. That is an undercurrent here. In past years, whether we talked to the russians or not may not have been such a big concern. Now we know the russians are actively involved in many, many campaigns, literally and figuratively. So mccains point is we should have been in the room hitting them hard on what theyre not doing correctly on the world stage. Okay. Brian sobel, thank you for joining us this morning. Absolutely. My pleasure. Cyber Security Experts say there could be a connection between the attacks and north korea. How tragedy for one Bay Area Police department turned into an inspiring story for a young Police Explorer. Quin was crazy about curls. But it took a twist of fate to find a highend curler at such a head turning price. And thats the beauty of a store full of surprises. You never know what youre gonna find, but you know youre gonna love it. East Palo Alto Police officer richard may was killed in the line of duty more than 11 years ago. One of the first people on the scene was a 14yearold Police Explorer, jose. I sat down with him to hear him tell the story of that tragic story and heard how it inspired him to follow in his footsteps. There is a fight in the business. Saturday, january 7th, 2006, east palo alto. How many people are fighting. The call, a fight at a taco dria. How many people are fight. Just two. Albert alvarez is one of them. A nearby surveillance cam are catches him walking away. Turned left out of the restaurant. East Palo Alto Police officer richard may responds and in the patrol vehicle with may, Police ExplorerMarco Marques. He running from me down weeks. Are you in pursuit. Im following in the car. K9 officer dave carson heard the chatter on the radio and also responded. In the patrol vehicle with carson, another Police Explorer, jose larasco. I remember were driving down do not going towards university. I remember looking at jose. He was quiet. And i looked at him and i said, man, something is not right. Something wasnt right. Radio silence. 12 seconds of radio silence. And then are you there . When did you know something was wrong . When marco got on the radio. Jose was 14 years old. Now he is 26. And telling his story for the first time. When he got on the radio and said man down. Man down. Man down. Man down on weeks. Whats the cross . We arrived. And then we saw officer mays car in the middle of the street. Did you see officer may. Yeah. I i ran up to him. Officer has been shot. Officer has been shot. Hot. 104. Officer has been shot. I saw the head the bullet wound to the head. Yeah. What were you feeling at that at that moment . I was scared. Sad. I had to get marco out of there. And i had to get jose out of there. I didnt want them to see what we were looking at. Dave carson is now a sergeant with the police department. Department. I had to lean on them to help that day. In what way . I was tasking them with things that we would normally do. Drop some tape for me. You know, look for some selfed and make sure that the scene is secure. Carson was telling me to do this and that. So i was just, okay. I did what he asked. Jose was eventually led away from the scene. The gunman tried to escape but was captured nearby. Four years convicted of the killing. Officer may was shot multiple times that day. He was 38 years old. Prior to his watch in east walnut creek, may served the country. He was a ma rehabilitate. I followed his footsteps. I joined the marine corps. Because he was a marine. Then jose became a Police Officer just like richard may in east palo alto. What is the hardest part of the job . What is the hardest . I would say, you know, trying to convince the people that dont want us around, you know, trying to convince them that were not bad people. During one stop, we found ourselves at the corner of university and weeks. Just yards away from where officer may was killed in 2006. There are times that i come through here and just drive by the house. Its a job that i have to do. So i just have to keep moving forward. [bagpipes] two weeks ago on this warm spring day in redwood city, a service to honor officers killed in the line of duty in san mateo county. Richard a may. East Palo Alto Police department. It was jose who placed a flower and saluted a man in blue. A man who inspired him to reach high, to live the dream that he is living today. I just think he would be really proud of how far he has come. Officer mays widow diana may and her daughters drove hours to be here. He is missing. He has missed so much. But even so, she knows he has inspired. And that his hard work and dedication to others lives on in another. It gives me chills hearing that rich inspired him and was that much of an experience on him that he wanted to follow in his footsteps like that. And i didnt realize the impact that he had on jose until just the last few years, i think. He was always kind to people. You know, always talked to them with respect. So thats something that that i do. The moment that you walk over to officer may when he is there on the ground, you know, they talk about moments in lives where you can go this direction or that direction. Was there any second there where you thought, you know, this isnt for me . No. After that, i thats when im like im really going to be a cop now. And now he is. On his wrist as he patrols richard mays memorial bracelet. And these days his sergeant is dave carson, the officer that he rode with that day 11 years ago. To know richard was to love him. He had this funny sense of humor. And jose has got the same the same same thing about him. You know, its almost its uncanny almost. His biggest thing that he tells you is that family is always first. Family first. And for this young officer, while he may patrol at times with a heavy heart, he is being guided by the light of a man who will always be his partner, by his side in spirit. The east Palo Alto Police chief says the second Police Explorer on scene that day, Marco Marques is currently a Police Dispatcher in the bay area doing well. One item that i didnt report in the story but i found out while talking to jose is he would do a number of thinks ridealongs with richard may. On that particular saturday, marco wanted to do a ridealong with richard so they had switched. Just because he wasnt with him, they had a strong relationship prior to that day because he rhoda long with officer may quite off rode along with officer may quite frequently. As part of my job, i listen into a lot of Police Radios where i sit. Yeah. And every once in a while ill hear something that i wish i hadnt heard. I cant imagine being on the scene and seeing that. Even just hearing stuff that i hear sometimes, it stays with me. So i cant imagine what he went through. Right. And now he is serving the same community. And he wants to be the chief some day. Good for him. People unable to pay for their coffee drinks. The widespread outage reported at Starbucks Stores this morning. All right. Anybody else looking forward to game two warriors and spurs . They will be playing here tonight at oracle arena. Were getting ready for the game. The intensity of game two will always be ratcheted up a bit after a very controversial play in game one. And the results right there for you on the screen. 60 say yes. 40 say no. A lot of chatter online, social media. Francisco chimed in and said for me it depends on the crime itself. Right. Right. Some Starbucks Stores are reporting a power outage that are affecting the payment system. Reporter were good right now in danville. This danville store did have to lock its doors for about an hour ago this morning right during the Morning Coffee rush leaving customers confused and turned away. If you check out some of your twitter feed, you may find other customers at definite locations not getting their morning pickmeup. A few locations like this store in orinda offered free coffee outside of the store. The official word from starbucks is a regularly scheduled Technology Update that they had to do last night, it didnt go through. It ended up shutting down their cash registers. So that is why some of these stores have gone off line. It is across the board, across the u. S. , even in canada. Not hitting every store but select stores. This particular store here in danville what they ended up doing whats doing a systems update with an Older Technology version. And thats how they were able to get their cash registers back up and running. So far everything is good here in danville. Everybody is getting their coffee again. Thank you, leigh. Here are some of the top stories were following from the news room. The case has been rested in the trial of the killing of kayleigh. Kayleighs mother kruger and her boyfriend Ryan Scott Warner killed kayleigh in 2014 and then hid her bod knee a suitcase and put it in a refrigerator. Yesterday in court there was a video played showing her on christmas in 2013. Prosecutors say it showed that she had good Language Skills and would have been able to communicate to her mother to tell her if she didnt feel well. Last week an expert testified that kayleigh suffered from extremely painful injuries in the leads days leading to her death but her mother never took her to a doctor to be examined. In other news, families of the people who died in the ghost ship warehouse fire in oakland are filing a lawsuit against the buildings owner and manager. 36 people died in the fire during an unlicensed concert in the warehouse. The building manager, Derrick Alameda organized the event and charged an entry fee. He also lived in the warehouse and rented out liveworkplaces to artists. Were learning more about a surveillance camera system that will be installed along two east bay freeways after a series of shootings. There are already cameras in san pablo and pittsburgh. The state of california is providing the funding for 15 more cameras along 880 and highway 4. The officials are not revealing the exact locations. It also includes shot spotter detectors and license plate readers. Gunfire not on a freeway. The microphones will actually move the cameras in the direction of the gunfire. And the cameras will be recording and the license plate readers will be taking photographs of actual license plates either on the front of a car or on the back of a car. Since 2015, there have been more 80 car to car shootings on bay area freeways. Eight people have been killed in Contra Costa County on freeways. The discounted price would be a sliding scale based on income according to a bill proposal judges would have the discretion to reduce the fine for a traffic ticket up to 80 if drivers can prove they are unable to pay the original amount. Income must be two and a half times more than the poverty line. It would not apply to fines of driving under the influence or reckless driving. Today is game two between the warriors and the spurs. The spurs are angry about what happened in game one to leonard. He has been ruled out of tonights game after landing on the foot of zsa zsa zaza pachulia. The warriors are the super villains after that play that some say was a dirty play by zaza pachulia. Things will be interesting when the two teams take the floor at oracle arena tonight. While the focus was on the injury, we should not lose sight that they came back from a 23point deficit in game one to get the win. Leonard this to leave game one after going up for a jump shot. He landed on the foot of zaza. The head coach suggested that pachulia was trying to hurt leonard or said the play was representingless reckless. And that is something that the interim coach of the warriors disputes. It is unsportsmanlike. This particular individual has a history of that kind of action. He shot the ball and went under steph. And steph avoided landing on his ankle by falling to the ground. And i even asked two of the three officials, i said, hey, thats the same call that you just called on zaza. And both of them told me that the difference was kawhi landed on zazas foot. Thats why they didnt call the foul. It is the same play. You know, zaza is not a dirty player. Demarcus is not a dirty player. And obviously getting back into game one for the warriors was a lot easier with kawhi out of the game. He will be side lined for game two with the ankle injury. Kawhi was already playing on an ankle that was hurt and he injured it before that play involving zaza pachulia. Important to keep that in mind. We will bring you out to a live picture of oracle arena. As we talk about the play with zaza pachulia, interesting that the coachs comments come. He used to coach chris bowen, a spurs player well known for sliding under jump shooters in sort of a similar fashion here. So it is interesting that now the shoe is on the other foot and you have him criticizing this play by zaza pachulia. Thank you, alex. He may be trying to fire up his team too. I would expect a coach to always take his teams side. Yeah. Thats what is going on. Defend your guy. Lets talk about the celtics quickly. They are moving on to the Eastern Conference Finals after beating the wizards 115105. Game 7 between boston and washington did not dispoint. The two teams went back and forth. But the second half surge from the celtics was enough to earn a trip back to the Eastern Conference Finals. They will play the cavaliers tomorrow night in boston. The San Francisco giants continue their winning ways with another victory over the los angeles dodgers. The dodgers take a 10 lead in the 3rd. It will feature a cast of well known stars in the figure skating world and will benefit the always dream foundation that works to benefit childhood literature. Kristi yamaguchi is joining us in the studio this morning. Back in 1992 i was a teenager hanging out, not winning gold medals. Does it still seem like yesterday. It doesnt feel like yesterday but it is hard to believe its been 25 years for sure. A lot has happened. But yeah it did fly by. People in the Grocery Store still connect with you to the gold medal moment. I think so. Yes. Its amazing how many people watch the olympics and are just supporting the athletes while competing. So its heart warming. I cant complain. Do your girls think it is a big deal . Theyre like whatever, mom. Im just mom to them. Im hungry, mom. What can i eat. Make me lunch. After you won and you were basically on the national stage, you immediately started doing things to help others. Can you tell us about what youre doing now . Absolutely. Shortly after the olympics in 1996, i established always dream foundation. We wanted to help the underserved kids out there. The last seven years we focused on child literacy. Currently serving about 22 schools. And throughout the bay area, arizona and hawaii. So its all about getting books into the hands of the kids, getting them to establish reading routines at home with their families and just giving them access. Because we are in underserved areas and we know about 50 of low income kids do not have age appropriate books at home. Were trying to fill that gap. I was going to ask you, is there one particular reason that you have focused in on this topic and you wanted to help child literacy. Looking at education, if a child cant read, that is the foundation of their academic success, their life success. If we can give them the tools to create that foundation and develop that love of reading, develop that love of books, its just going to be is starts in kindergarten. Before kindergarten. We try to start as early as possible with our youngest students. There is time to have a positive everything on them. My boys are old enough to read on their own. But we do a family bed time story time. I use it as an excuse to cuddle because the closeness that you feel, the one on one, that cant be replaced with a tablet and some audio voice reading to the kids in their headphones. No. It is a special time. It is encouraging parents to set aside the time whether theyre on a device or book, setting aside the sometime, 20 minutes a day. For my husband and i, the easiest time was bed time because theyre kind of winding down. And a lot of times they wouldnt go to bed before they heard a book. Or two or three. So we would have to cut them off. But that is really important to establish that. Yeah. At least two. If i try to go with one, not happening. Or if you try to skip pages. Right. If it is late. You missed the part where exactly. Lets go back to figure skating. The bay area stamp in the world about what we produced here. Theres a strong legacy of skating here in the bay area. Starting with charlie tickner, bronze medal at the olympics. Brian, rudy, debbie thomas, peggy fleming. And its its continuing on. I mean, we have two incredible olympic hopefuls from the bay area. You have been working with karen or have in the past. She is a fremont girl. We have that connection. And, you know, ive known her since she was about 11. And she has been a recipient of a grant from the from our always dream foundation. So its been fun to watch her develop and grow into the skater she is now.
