President trump maybe celebrating his first big legislative victory but there are is a lot of work ahead for the repeal and replacement of the Affordable Care act the bill passed by the house yesterday still has to pass the senate. There may be some longer term political consequences. Doug luzader joining us live from washington. You have much more on this story. Good morning. Reporter good morning. By longterm consequences we are talking about the midterm election. There is some concern amongst republicans that they may face a backlash. On the other hand, many of these House Republicans feel like they delivered on Campaign Promises and got through this repeal yesterday. Congratulations on your boat today. Thank you very much. It was great. A big day. Reporter it was a big day for the president as he was congratulated by the australian Prime Minister in new york last night. The republicans came together. Two days ago it was like magic. Reporter the vote was close but the gop prevailed. Passing the plan that would allow states more flexibility to alter obamacare insurance requirements to help bring premiums down. And it would offer tax credits to help purchase plans critics say many would pay more in coverage would be worse. House democrats saying goodbye after the bill passed suggesting republicans will suffer in next years midterm elections. You have every provision of this bill tattooed on your foreheads. You will glow in the dark on this one. You will glow in the dark. Reporter whats next . The senate which could spend several weeks preparing for a vote. Expect changes and skepticism from both democrats and republicans. I want to be supportive. I want to repeal obama care but i dont want to have to vote for a federal program, a new one that will be hundreds of billions of dollars paid to insurance companies. I am all for capitalism but im not a big fan of crony capitalism. Reporter that gives you an idea of the challenges that lie ahead for republicans in getting this thing through the senate. There are a number of reports that the senate may more or less start from scratch and come up with their own plant rather than try to fix what they see as the shortcomings in this house plan. That could make it even more difficult to reconcile the house and Senate Version and get something to the president s desk. Doug luzader live in washington extract joining us now live in the studio talking about the potential impact of this bill is doctor ison of, the ceo of the Community Health care provider, health right 360. Thank you for joining us. You are really concerned about this. Your focus is on low income people and Substance Abuse victims. What are your concerns . You have to realize that in california almost 4 Million People got healthcare through the medical expansion. And another million and a half got insurance through the exchange and through the subsidies from the exchange. They all stand to lose those benefits with the new Health Care Bill that the house of representatives just passed. In the bay area, thats about 700,000 people affected. In particular, one of the things that the new bill does is it eliminates the mandate for covering certain kinds of Health Benefits which includes Mental Health treatment and Substance Abuse disorder treatment. That could have a serious impact on the people. So many people get their care through our clinics because of medical. Prior to the medical expansion, about 80 of our patients had no Health Insurance. Which means even if they could be seen at a free clinic, its hard to get followup care its hard to get medicine and its hard to get those medications you need to help treat depression, other types of Mental Illness and treat Substance Abuse disorder and to prevent opioid overdoses. Thats really what we are concerned about, the loss of care for those people. The bill now heads to the senate. What changes would you like to see . We hope the senate takes a more humane approach and thinks about we cannot in this country afford to kick 24 Million People off of their Health Insurance. That has a profound effect in a developed country like ours. Its hard to imagine that we could do that. Will we hope to see is that they cover previously previous conditions. The guarantee that the essential Health Benefits that people need like Maternity Care and pharmacy benefits, that those things are covered. We help the people of all income levels get the support. It potentially puts at risk older adults who can be charged five times more for their healthcare. We think that the senate, we hope, its a more deliberative process. It went through so quickly, if you recall, it was not even scored. We do not know what it will cost. We will not no its impact. We hope the senate takes a more deliberative process. Do you agree with those who say, even supporters who say, the Affordable Care act needs to be changed in some way. Absolutely. I dont think theres anybody on both sides of the spectrum, democrats and republicans, who disagree on that matter. There were elements of the Affordable Care act in which Health Insurance was still not affordable enough. I think we definitely can look at what the congress can do to find some way to make sure that all americans are covered in a way thats affordable and covers all their healthcare needs but if we dont treat them now, people get sick. We will treat them one way or another. Thank you for joining us today. Heres the question of the day about this topic. Do you support the new American Healthcare act that was just passed by the house and is now heading to the senate . Let us know what you think i voting on the twitter page or on ktvu. Com. We love redding your comments. Leave those for us on our Facebook Page. 7 08 am. Right now, registration just beginning for a very popular Afterschool Program in south San Francisco. Joining us about the potential impact of the bill is doctor eisen of Health Threat 360, thank you for coming back. The biggest impact in california if he goes through, will he be a cut of federal funding and medical . Thats the biggest impact. 3. 7 Million People got medicaid , medical through Medicaid Expansion but theres only 30 Million People in california who are on medical. One in three californians get their healthcare through medi cal. So the cuts planned are larger than covering the Affordable Care act its a redesign of medical program with serious impacts on the health of people in california. People responding to the poll say they are against the plan. Not many details are coming out yet. Its important to note its not the final product. Well, people are concerned. It was rushed through. People who voted for it were not the details or the details but it will result in loss of care for 24 Million People in the country and 700,000 people in the bay area. You can see why viewers reacted that way. Whose getting charged more the people who are sick or the people who are healthy . People who are sick will get charged more people who have had gaps in coverage. If you are insured by your employer youre not guaranteed Health Insurance through the new law. If you have a gap of employment and you had a gap in Insurance Coverage when you resigned, theres a 30 premium surcharge so i just go up. Older people will pay more five times more for older people that people who are younger. That is a serious impact on older americans. Younger adults may payless , could be news for some because insurance premiums undercover california jumped 13 last year. Younger californians could pay mess but they tend to be lower participated in Health Insurance. They are healthy. Again, listening to the news before i came on talking about car accidents, these things happen unexpectedly. The fact they may not have Health Insurance, it can bankrupt any family or individual if coverage isnt there for them. In general, do you think patience is getting lost in the mixed. Seven years later another fight for healthcare and it goes back and forth and maybe continues for another decade. Seems to me it was a drive for congress to say we live thats delivered something we promised as opposed to lawfully designing the system for americans the guarantees what the president promised which would be access and insurance for everyone, everyone would be covered. This new law does not deliver on the promise. I think it was not done in a way that was transparent. It was rusted through. Was not scored by the congressional budget office. There will be tremendous impact. It will be a fight in the senate. We expect that. Dr. Eisen thank you. Thank you very much. Five years sierra lamarr case is finally in the hands of the jury. Benicia police are asking people to evacuate the area near the valero refinery in Benicia Police this is the result of a power outage causing flaring and smoke which are seeing this video people are being asked to avoid the area. On the phone one of the producers on ktvu. Set the scene. Where are you and what can you see or smell . Good morning mike and gasia im on panorama drive ive seen significant process theres at least two stacks burning flames shooting black smoke billowing out, shooting along the lines of the water. One of the stacks looks like water is shot onto the shorter stack and flames are out. I see less smoke. White smoke from that stack. A better situation compared to 10 minutes ago. Maybe 7 45, 7 50, there was a siren that went off and it stopped after a few minutes. I talked to a resident here who got a text message about a school closure. I took a screen grab of the information he got regarding the school that says theres been an incident on valero authority suggests Matthew Turner students to shelter in place and all of the students can attend school at this time. If they are already there, if you choose to keep your students home, they will not be marked absent. What that said is things are looking better and the evacuation orders are for the people who are down wind from the plant. If you are not familiar with benicia downtown if you look at pictures and video i posted, downtown areas to the right. Thats where a lot of people live. The wind is blowing in the other direction. Yes, things are looking better in the past couple minutes. I know people who live in the area for a long time know what to expect when they live close to a refinery. Your family that you are new to the area. Is is concerning is that something you were aware of before landing in this part of the bay area . I was talking to a gentleman who has been here 12 years. He says he has not seen anything like this. Naturally, california has a lot of safeguards in place. These things are not being ignored right now. Anything can happen. At any time. I was not too concerned. I love my community here. With that said, its a rare incident. Right now we saw Benicia Police send out a tweet 40 minutes ago when they tweeted businesses and homes down wind from valero should evacuate and now they say all other areas to shelter in place and keep doors and windows closed and bring pets inside it. You mentioned seeing some sort of water on the stacks. Where is the water coming from . Can you tell where you are . Is it a Fire Department or a Sprinkler System in place . Well, its difficult from my Vantage Point to see. It looked like water maybe shot from the crown to the stack although that would be a tough angle to shoot from. Looks difficult from where im standing to see if there is water. It looked like perhaps it may have gotten control of the flames. The black smoke was so thick earlier you could not see across the water and now its light smoke and the toddler stack on the right side the toddler stack is burning but not quite like what we were seeing earlier. Reporting from benicia pd resulting from a power outage. You think it is combined to the refinery . It might be confined my power is on. I did not spell anything. I hear a siren in the distance and i got a text message and looked out the window i could see something in the distance. We will put you on hold briefly. Minutes ago a spokesperson for valero released a statement saying quote valeros venetian refinery is flaring also asked pma oh to assist us and conducting Community Air monitoring. He said the situation has improved over the past several minutes. I doubt its over for those handling it but theres less black smoke in the air less to be stressed about and people are getting on with the day and people are trying to take their kids to school and a lot have a questions about whats going on. Senior producer, youve done a great job reporting thank you. Steve, westsouthwest reporting 10 minutes ago it was the wind toward suisun bay. Is orion on the phone . Yes. We know benicia well this is going toward suisun bay. Correct. Not toward cordelia but toward 680 between benicia side and open area and toward suisun bay. Is that generally the right direction . If you cross the bridge you will see the smoke blowing away its not crossing the bridge. There you go. Heading toward open area in suisun bay. Okay are good. Thats what we thought. We see a westsouthwest wind only concord buchanan has south only. From crockett and benicia , thats us westsouthwest unveil into vallejo. That takes it may be toward suisun bay. When you gust its traveling faster cooler forecast. We will get breaks probably some sun this afternoon theres already sun breaks. Set for a cooler day compared to a couple days ago when we were in the 80s, 90s record highs. Sfo west of 20 hayward west of six oakland was the 14 15, low 60s. Brownwood at 63. That is down 17 from two days ago. Vacaville is cooler. If it makes it to vacaville theres a low point dropping and bringing cooler, breezy powder into saturday. 50s and 60s with a few low 70s. And you want to add , sal . I want to add pg e is investigating the cause of the power outage which we hear may have caused flaring and thats what Benicia Police that. Pg e is investigating the power outage source. Flowing a 680, Traffic Volume all of the bay area is lighter. Traffic pictures. You can see how light it is at the bay bridge. We have cleared out on this friday and that is going to help us a lot when it comes to driving anywhere. Traffic looks okay at the bay bridge toll plaza. Looks better than normal. Northbound 80 is slow and improving as you drive to downtown oakland. San mateo bridge has improved. You have good news if you have to get somewhere. Things seem to improve the east bay, commute not a lot going on. Highway 4 is slow through pittsburgh of a point. A 37, back to the desk. Garcia toward his, we wait and pray and hope for justice for sierra. The jury will decide if 25 yearold Garcia Torres kidnapped and killed sierra lemar in march 2012. Hes accused of trying to kidnap three women outside a grocery store. This morning as legal analyst Stephen Clark good morning. Good morning mike and gasia. Al lopez said in closing arguments do not be lured by gimmicks and half truth look at the totality of the evidence do think he put enough doubt in their minds . What the defense tried to do is establish the prosecution did not prove sierra lemar is dead and if they did that, this could be a jury verdict because that is the first thing you need to establish in a homicide for the prosecution, they kept focusing on the forensic evidence. Dna, dna, dna. That was the forefront of the case. Both sides had significant challenges for the defense. It was the mountain of forensic evidence the prosecution put forward and mr. Garcia torres is on statements putting himself at the scene of the crime. For the prosecution we have no body or crime scene or no murder weapon and they hit that hard and in fact they suggested someone else could have kidnapped and killed sierra lemar. The jury has a lot to think about over the next several days before they reached a verdict. What if anything did you read into the fact that the jury chose to get deliberations today when given the option of taking friday off as they have throughout the trial. This case has gone on for months. This jury is ready to get to work and what you will see is the jury choosing a fourperson and getting organized in a fashion they can move forward on not just sierra lemar but three other counts. Theres a lot to do and we may start to see how the jury is thinking if they start asking the Court Questions or asking for read back, we may get a window into how the deliberations are going. This jury has been through a long, arduous trial and its time for them to get to work. No body, no crime scene, no murder weapon. How long have you seen the defendant go to prison and get a guilty verdict in a case like this . The da tried to point out to the jury that we do not have to show you a body, crime scene or murder weapon. We just have to show that this man killed sierra lemar and they had to build their case with the forensic evidence circumstantial evidence case and the defense is saying sealer sierra lemar could be alive. The prosecution is thing 15 yearold girls do not disappear off the face of the earth. Thats not who sierra lemar was. This jury is going to have to get through some challenging issues before they reach a verdict and if they reach a verdict for the prosecution they need 12 jurors to agree not just on the sierra lamar count but the safeway attacks. Both sides that a great job presenting the case and accepting the challenge they had and this is what the system is about when mr. Garcia torres got a fair trial because both sides were ready to go it was well presented. You agree with the decision not to put him on the witness and stand . Is a difficult decision but we dont believe the prosecution proved the case and therefore we do not need to put the client on the stand. The hardest decision a different attorney makes and you never make it until the end of the case. In this case they relied on the state of the edits of the evidence. Jury will be instructed they cannot consider Garcia Torres did not testify and it will boot remain to be seen how the jury views that he doesnt have to take the stand. It would be unusual for him to take the stand. We will get advanced notice if the jury comes back with a verdict today. Stephen clark, appreciate your time. You can talk about the wind where the smoke may be pushed i thought it would be better to be pushed over sparsely related area. This is almost the best case scenario. Its going toward marshland along 680. When you come over the benicia bridge go left it will take you to benicia and vallejo or 688 will take you toward cordelia. To the right theres marshland and based on what i hear thats the direction most of the smoke is going more toward suisun bay oakland has west. Port chicago crockett and fairfield and even benicia west southwest is the direction the wind is coming from. Its pushing the smoke more toward the east or the northeast or suisun bay which is good 31 mile an hour i would think it would help to disperse it.
