Violating a mandatory Evacuation Order is a misdemeanor and it is punishable by up to a year in jail and a fine of up to 1000. The reasoning here, is it somebody stays behind and needs to be rescued that jeopardizes the rescue workers. The law hasnt been enforced because of the emotional nature being evacuated. We mentioned that the east bay is busy and i have been looking here southbound 880 is going to be slow as you drive down to highway 92. There was an earlier accident in this area but it is actually not a major one but is slowing traffic 680 traffic is slow out of the dublin interchange. The relative humidity is 35 a dry fog like smoke layer with 100 yard visibility at 2000 foot elevation. And, that is my observation, its pretty close to what he had. Humidity is up, are seeing a little westerly component on that breeze. And i think by tonight and tomorrow the base of that and depth of that fog layer will start to help. Right now, it is just held below that. But there is plenty of low clouds making a push. Not up the mountain. If it does, its not going up high enough to help those firefighters but cooler temperatures and we will take that westerly breeze any day. Low clouds and fog just getting ramped up. There is a crash and traffic is slow. Thats heading over towards the peninsula and on the expressway, at homestead, it is a motorcycle accident and a lot of people use this expressway to avoid the freeway. But the freeway traffic is moving, it is slow, i dont know, is a halfdozen of the other. Youll see a lot of slow traffic. And, 7 33 am. Back to the desk. Fire crews will be investigating a fire that destroyed for homes. And it badly burned eight others. Leigh martinez is in the neighborhood now. In the flames move fast. Thats reporter and the flames move fast. Reporter thats right, two were injured, and one pet cat did die. And, now that it is daylight were going to show you some of the damage that has been done. This house has been a red flag. It is uninhabitable right now. A lot of the stuff that they have out here was once inside of the home. And, about 10 other homes received damaged damage. And, a lot of people are saying that these eucalyptus trees are partly to blame because it went up very quickly and because neighbors and fire crews really helped intensify. They are forced to flee their homes with no time to grab their belongings. Man suffered smoke in relation but refused to grab belongings. And, she has blisters on her feet after she awoke from a nap and ran barefoot across the grass to save her elderly neighbor. I ran out and they were ambers everywhere. They got her out of the house but my feet were burning. And im trying to make sure that im pacing. I got her in a neighbors car. The fire appears to have started on highway 1016 shoulder and spread to a row of eucalyptus trees that create a buffer between the highway in the homes. By the time the fire trucks arrived houses were all ready burning. They said that the trees were torching off and ambers were being blown through the wind and fire is under investigation. It is presumed to be human caused since it started near the highway. The back out here live, a fire truck has just arrived we are told that they are going to be continuing their investigation today are calls have not been returned. We are told that cal fire is no longer handling the investigation it is now the Petaluma Fire Department and homeowners said they have complained to put these trees up in the past before about how flammable they are. So, we will be making calls to see if there will be any changes. Back to peer all right. Thanks fire crews say that a 14 yearold boy started a grass fire yesterday that spread really quick. The flames damaged one home and burned right into acres. Several homes were also in danger. Police say police cited that teenager for playing with matches. Now he is being sent to the youth Fire Center Intervention program. In the north bay we just received an update regarding a wildfire the sole male fire the sawmill fire is burning, containment went from 75 to 85 . And, while there were two minor injuries, there were no minor evacuations. A wildfire has burned more than 1000 acres. It is 25 contained, and they believe it was caused by people because, there is no other reasonable explanation they say for how it started. They say they dont know if the fire was deliberately set or an accident. Right now they are focused on keeping the flames on the west side. If it were to go on the east side, it has an uphill run for miles and miles. And with a lot of homes in there. The fires burn more quickly upheld then on flat land, no one has been evacuated but that could happen if the fire starts burning more quickly. No homes are threatened but power lines in the power plant are in the line of fire. Lets go ahead and take a look at a fire map you can see, 10 active fires are burning in california. They are looking for two men who being and robbed a couple as they were unloading groceries outside of their home. The 63yearold and his wife 70 yearold carol brown outside of the home when they were attacked. He says that his wife picked them up and then went to safeway before coming home. Moments later the gunman approached them. He said that his wife thought that it was a joke. She fought to keep her purse. The gunman shot her two times. Once for the pelvis and the upper arm. I was unloading my stuff in the back of the car and she was standing in front waiting for me to come in and this guy comes up to me and meanwhile, the other guy sort of jumped around on the stairs and went after carol. I bolted for the door and somewhere in there she was getting shot. I dont remember the exact sequence. They say it will take 3 to 6 months for his wife to recover. She may lose mobility in her arm. Welcome back. A Major Development in the famous gone girl kidnapping case. Matthew muller, the man who is accused of the bizarre kidnapping now wants to plead guilty to the crime. We discovered in Court Records filed late last night that the disbarred attorney Matthew Muller plans to ask a judge to change his plea tomorrow. It is not clear why he would like to change his plea. However federal prosecutors say that he has suffered from Mental Illness. They want a judge to make sure that he his change of plea is not influenced by medications that he is taking. If a judge moves ahead with that plea hearing there will be no trial. Who could face up to life in prison but the details of a possible plea agreement have not yet and released. Before he was arrested for the crime, police accused him gusts accused her boyfriend of faking the kidnapping. They are now suing police for destroying the reputation. One of three directors accused of killing a woman and the death of a hiker has admitted to the killings. Sean described how he and the two other defendants went on a drug fueled field crime scene. He exchanged testimony. He said they met the 23yearold tourist and lowered her to the Golden Gate Park to rob her. They said that he was the one who pulled the trigger. Dry is drive. Its late in the season. Its reached its lowest moisture point. The battle is on for crews trying to contain the wildfire. A live report on those challenges that they face today. Good morning. Welcome back. It is wednesday, september 28. And, lets begin with more on the wildfire that is still raging out of control. Janine dela vega is live. They are trying to get a handle on that fire. Reporter yes, a big help is going to be the weather. We just came out of a briefing with fire chiefs and, one of the things mentioned is its going to be 10 degrees cooler today compared to what it was yesterday. So that should help quite a bit. Right now, fire crews are getting ready to leave to go up to the mountains. And, the latest information that we have is that the fire has burned 2250 acres and is five 10 contained. And, this is moving down towards the canyon area which is on the east side of the fire. And, one home and six outbuildings have been destroyed. But 300 houses are still threatened. Today, a Damage Assessment team is coming to take a close look to see if anything has been missed. One of the challenges that they are facing is all the dry vegetation affected by the drought. We have resources on the line that are doing an excellent job keeping this where it is. And as you have been told, youre pretty much heard what kind of terrain we are dealing with. As far as getting resources in there. A lot of aircraft is available. Resources coming in, they are available to us so we should be doing really well. Firefighters are concerned about the houses. And, all of those homes are staying there and protecting them. They are mandatory Evacuation Orders and, most people have left but some have chosen to stay in thats making it difficult. Because they need those dirt roads cleared. It also takes away from fire personnel because they have to be taken away from the front lines to stay with the person and thats one of the things that they warn them about during the briefing. They said that the Sheriffs Office said to be aware if you run into missing persons, to make sure you may contact and, urge them that they need to leave. Thank you. Despite mandatory Evacuation Orders, some people in the Santa Cruz Mountains are choosing to stay and protect the property. The decision is actually against the law. And, it is a misdemeanor to violate that punishable by up to a year in jail. And, the reasoning here, facility stays behind in needs to be rescued, that unnecessarily jeopardizes the lives of the rescuers. Its not always enforced because of the emotional nature of being evacuated. But, should people who violate mandatory Evacuation Orders face criminal punishment . But by tonight, they will lift and some of that fog is back with a vengeance. And, we had same reports here as well, very thick fog. But here thats the good news. Its just a matter of time before that lets. Plenty of low clouds in place. This is a start of a much cooler pattern. Its not that strong, but temperatures are 60s 70s and 80s. Well, we have a stalled vehicle, the bay bridge is getting into San Francisco and, thats going to make things very slow not only on the span but getting onto that span we have a lot of picture thats a live picture from that. And, they have may move the car, but it is still obviously very slow on that deck. And what happens at the toll plaza is that the metering lights go on extra slow and there is more waiting to do. Instead of waiting 10 or 15 minutes you might wait a half hour. And, obviously that is not optimal. Weve also looked a very heavy traffic, and we had a dead animal on their we had a couple of stalled vehicles and this whole commute has been slow. But look at all of these actions here, we had an accident at 680 heading down towards the venetian bridge down to walnut creek. So this whole stretch 680 southbound as you drive from the venetian bridge all the way down to hear has just been a huge mess. Highway 4 is traditionally slow. This whole commute has been super slow. Lets go back to the desk. A new complication linked to the Millennium Tower. City leaders have now blocked funding for the Transit Center project. Alex savage is live to explain. Some city supervisors are so concerned about the sinking millennial power that they decided not to continue funding the nearby trans bay terminal project at least the time being. The Millennium Tower right behind us at the corner of mission and fremont street. In this building was supposed to settle anywhere its been four and 6 inches. But as we have been reporting the upscale condo tower has sunk seen inches in just the past eight years and experts believe that it could potentially sink another 30 inches. Officials with the Millennium Tower project have suggested that the nearby trans bay transit the new project may have been to blame for that thinking. And thats why yesterday San Francisco city leaders voted to withhold almost 7 million in funding for the second phase of the transit project which would create a caltrans extension into the downtown area. But not everyone supports the move that was made yesterday. Scott was one of those who voted to continue funding the project. That is completely separate from the design work to extend caltrans and highspeed rail to downtown San Francisco. One has nothing to do with the other. And, according to the San Francisco examiner, the trans bay joint Powers Authority says that the entire project could potentially be in jeopardy if that money is not released or, at the very least the project could be delayed significantly. We should point out, that yesterday both are not a final decision, supervisors will meet next month. And, continue funding phase 2 of the trans bay terminal project. Again, this is not the end, its one boat taken by the supervisors yesterday they will be meeting to discuss this issue and this could potentially be a big bump in the road. Is affecting a lot of people. New this morning, the Alameda County Sheriffs Office made a big bust. And, take a look at what investigators say they found when they searched the home in oakland. They confiscated for firearms including a fully automatic Assault Rifle with no serial numbers. And, the Sheriffs Office also says it has seized ammunition and a bulletproof vest. We will get higher humidity more of a westerly breeze as a pattern breaks down. And, much cooler pattern. And sunday into monday for the north bay. And not as hot as yesterday by this time yesterday it was about 80. And, the westerly breeze by tonight or tomorrow, i would think that that fog bank would be lifting up. Its below that right now. Temperatures are either very cool yet, there are others it just depends on the elevation. A lot of 50s around ocala, and upper 50s at cupertino. But above los gatos 61. And, its getting there. Not only that, but a much cooler pattern. And, a comfortable 58 and foster city even if you dont have the fog. That makes your pets happy. Theres more of a westerly breeze, and that will continue. It hasnt ramped up yet. And, when you get that little push, it will make a dramatic impact. And, they are dropping about 5 degrees. And, its all about the fog. Then, swinging in from the north, a Second System will come in behind that. I think thats the best opportunity. And, this is transitioning. And, for the overall pattern, today starts a much cooler pattern to take us into friday. Axes in 70s we will hold onto a few 90s. Then maybe a week before we pencil in anymore 90s. Thats for sure. Temperatures today will be a little bit of below average for some. And by tomorrow everyone goes below. And a big drop in the temperatures and i still think late sunday and monday. An investigation under way into it sparked a fire. The damaged several homes. Leigh martinez reports from the neighborhood where we can see those homes that did not survive. What started out as a vegetation fire, it quickly spread to the backyards of these homes and forced many people to run out and flee the flames. One of these houses has been red flags. This is one of four houses that has been completely destroyed by the fire. 10 other homes have been damaged mostly to their exteriors. And, neighbors and fire crews blame these eucalyptus trees for causing the fire to intensify. Homeowners were forced to flee their homes with no time to grab belongings. There were two people injured a man suffered smoke inhalation but refused to go to the hospital. And, the 22yearold rachel has blisters on her feet after she woke from a nap and ran barefoot across the grass to save her neighbor. I ran out and they were everywhere. I finally got her out of the house but my feet were burning. It is trying to make sure that i got her into her neighbors car. And, it appears to have started on the shoulder and spread to a row of eucalyptus trees that create a buffer. By the time the fire trucks arrived houses were all ready burning. They said that the trees were torching off and embers were being thrown i the wind. The fire is under investigation but is presumed to be caused by humans since it started near the highway. And you can see, a fire truck has arrived fire crews have a few steaming spots that they need to keep an eye on. And theyre going to be in control of the investigation but as you have heard, they believe that it is caused by humans because it was so close to the highway. They are saying it could be anything from a lit cigarette to a car kicking up a spark. Firefighters reacted quickly, and it burned more than 2 acres and several homes were also threatened. Investigators say that this fire was started by a 14year old boy who is playing with matches. Firefighters say that he has been referred to an intervention program. We just received an update regarding the wildfire in sonoma county. The sawmill fire is burning 10 miles. Containment jumped from 75 to 85 . The fire has burned 1500 acres. While there were two minor injuries, there are no more evacuations, the cause about fire is under investigation. And, another wildfire has burned 1000 acres. It is 25 contained no homes are threatened the power lines at the hedge are in the line about fire and for now, crews are trying to keep the flames on the west side of highway 49. If it were to go into the east side it has got an uphill run for miles and miles. And with a lot of homes there. Fire Officials Say they burned more quickly uphill. No one has been evacuated but that could happen. A Major Development in the famous and many consider bizarre kidnapping case. Matthew muller the man accused of the kidnapping of Denise Huskins wants to plead guilty to the crime. We discovered in Court Records filed late last night that they disbarred attorney Matthew Muller lands to ask a judge to change his plea. It is not clear as to why he wants to change but federal prosecutors say that he has suffered from Mental Illness and they want a judge to make sure that his change of plea is not being influenced by medication.
