In berkeley and emeryville not too bad as you get to the bay bridge toll plaza. We can see the toll plaza better after the sun went up. Its backed up for a 20 to 205 minute delay. This is the peak time for the morning commute at the bay bridge toll plaza, and you will see traffic that is going to be slow. We can also look at 880 southbound driving from hayward to freemont. Its beginning to fill in. 580 is not an issue in livermore. When we go to san jose we can push in 101, 280 and 58 are beginning to get a little bit more slow traffic as you get through. 280 in san jose, ill show it to you now here. Northbound 280 getting up to highway 17 is very slow right through downtown. You see how that is . So its already beginning to fill in here on the way of the west valley. 7 02. Back to the desk. That was relatively calm compared to what happened overnight. At one point it looked like some on the house floor might come to blows. Democrats staged a sitin trying to block the work in the house to force votes on new gun control laws. We are calling on the leadership of the house to bring common sense gun control legislation to the house floor. Give us a vote let us vote we came here to do our job. We came here to work. This time democrats relied on mobile phones and social media stream to go keep going. Republicans would not budge, arguing that democratic proposal to deny gun sales to those on the federal nofly list would violate the constitution. We are not taking away citizens due process rights, their Constitutional Rights. That was defeated in the senate. This is not a way to try to bridge up legislation. So there is not much hope the democrats will get any legislation moving in the days ahead. We have seen these issues come up in the house. They were dismissed. The remaining campaign is led by Prime Minister david cameron. That side argues that britain is safer and richer inside the e. U. Its back in the news because a ned judge will hear arguments about whether evidence should be thrown out. The lawyer for the suspect, matthew muller, says muller was arrested just because he left his cell phone behind after breaking into a home last year in dublin. The lawyer says police illegally searched that phone to find out who owned it. Prosecutors object. They say a burglar cant expect privacy for an item left behind. Investigators say after unlocking that phone they were able to connect muller with the kidnapping of Denise Huskins a few months earlier. Vallejo police mistakenly labeled that case a hoax. Investigators later admitted the kidnapping occurred. We are following developing news from San Francisco where two bicycleises were killed in separate hitandrun crashes. The first happened 6 00 last night in Golden Gate Park. The second incident occurred about 8 30 in the south of market area. In the first crash, witnesses told police the driver in a white honda fit was speeding and driving erratically. Now, they say he slammed into a woman on a bike coming from the opposite direction and then the car took off and the driver abandoned the carlos than a mile a carlos than a car less than a mile away. Bikers are on high alert. I live in the area. Yesterday they had blocked off the area. It was yellow taped because i think it was a homicide. A hitandrun. Reporter when you hear about that as a cyclist, you hear that this person hit this woman and took off, its got to be scary. Whats it like sharing the roads here in San Francisco . Its pretty scary. It makes me sad to hear that, that she potentially died. And it is scary. Now, while investigators were at the Golden Gate Park hitandrun scene, the call went out about another car hitting a cyclist. It happened near 7th street and howard. In that incident, witnesses told police the driver ran a red light and hit a man on his bike. That cyclist was also killed. The driver took off, but was later arrested. Also happening today a meeting is set in las vegas to finetune a publicprivate financing plan for a new stadium where the raiders could potentially play. Raiders owner mark davis met with the Southern NevadaTourism Committee a couple of months ago and pledged 500 million towards the construction of a new stadium. Its estimated to cost 1. 4 billion. Under the plan to be considered by the Smith Committee today, the financing would come from hotel taxes and redirecting sales and payroll tax revenue. Moving the raiders from oakland would require support from the other nfl team owners. Yesterday the National Hockey league announced its putting an Expansion Team in las vegas. Time is 7 09. A short time ago one of her cousins stopped by and talked about the pain the family is still going through as they prepare to bury this young woman who had such a promising future. Its really sad. I just cant believe it. She will be missed a lot. She will. Reporter regginae was hit by gunfire while attending a vigil for two of her friends who drowned last month. No arrests have been made in connection with this shooting. To make sure her killing doesnt go unsolved, her great aunt wrote a moving letter to governor jerry brown. She asked the governor to push current mayor libby schaaf to address ongoing gun violence here in the city of oakland. Regginae had a bright future. She is cheerleading coach of the crusaders in san leandro. She is associated with girls, inc. Bright girl on her way to college gunned down in the street. Reporter regginaes great aunt also suggested in that letter that cases like this one may fall by the wayside as the Oakland Police department is dealing with an ongoing sex scandal involving officers. Now, the Department Denies that would be the case. They say their attention remains public safety. Their focus remains public safety. The Mayors Office said the city and the department are focused on identifying and arresting whoever killed regginae. By the way, regginaes great aunt says she did get a response after emailing that letter to the governor. She says, however, it was a form letter that referred her to the police department. She was quite upset with that response. The funeral for regginae jefferies gets underway at 11 00 this morning, dave, at ax Gospel Church in oakland. 7 15. Meantime, east bay congressman barbara lee taking part in the sitin at the u. S. Capitol, says, as you see here, she has a photo of regginae jefferies with her. The congresswoman tweeted out, she is staying on the house of representatives floor on behalf of that 16yearold shooting victim this morning bart directors will hear how their bike program is doing. Bart says more people are using bikes to get to Transit Service and it says bike rider use is growing much faster than the goals it set just four years ago. The manager of the program is expected to discuss details at this mornings bart Board Meeting. He is likely to suggest new goals for the Program Based on the current success. Also at the Board Meeting talks are scheduled today on how to keep passengers from hogging seats on the train. The new policy applies during busy commute hours from 6 to 10 00 a. M. And then 3 to 7 30 p. M. On weekdays. People who take up more than one seat during those hours will first get a warning. After that its a 100 ticket. Then it goes up to 200 for a second offense. How does it look out there . We mentioned bart. So i should throw in that there are no significant delays, pam and dave, on bart. If you want to take bart instead of driving the car, a nice pleasant trip into the city with no major problems. This is a look at highway 24. Speaking of bart, i was stalling for time here to wait for that train to get into the shot there, steve. Westbound 24 looks pretty good. We do have an interesting phenomenon, the directors, we noticed that traffic slows to the lafayette bart station. That is because, especially in the summer months, there are people to look at on the platform. People like to look at other people. After that it clears up a little bit until the next bart station in lorinda. Correlation . Maybe not causation, but there is a strong correlation there. Lets take a look at the bay bridge toll plaza now. You can see traffic is backed up all the way out to about the 20minute delay at the macarthur maze. No problems on the upper deck of the bay bridge. San jose commute is filling in, although it looks a little better than it normally does. 85, 101, and 280 all getting a little bit slower getting into the west valley. 7 18. Lets go to steve. The prosecutor is now making a proposal he says could prevent another controversial sentence in the future. Santa clara County District attorney jeff rosen is pushing for tougher mandatory sentences in Sexual Assault cases. He says one of the things the judge had to consider in the turner case was whether the victim was conscious or not. Rosen wants to change state law to make the penalty for sexually assaulting a woman the same no matter what the victims condition is. Convicted rapists, whether they committed their crimes on campus or off campus, whatever racial or ethnic background, rich or poor must be sentenced to prison. Rape is rape. If lawmakers approve his plan, it would require the attacker to spend time in prison, not just probation. Now, turner was sentenced to six months in jail and is likely to be released after just three months. Rosen supports a minimum sentence of three years in prison. Time now 7 24. San mateo bridge most of the slowing is in hayward before you make it onto the span here, but the dumbarton bridge slows from newark to what we call the facebook side. Why do we call it that . San Francisco Police officers are one step closer to having a revised use of force policy. Last night the San FranciscoPolice Commission approved a compromised agreement on a new policy. Ktvus brian flores is covering this about what it means and what details need to be ironed out. Its interesting. Weeks before the vote there were two different versions. One that was backed by the Police Officers union. The other was backed by civil Rights Groups and community advocates. But reportedly all sides came to a third version that was approved last night. Now, basically, the use of force policy puts a higher standard for officers to deescalate situations by using crisis intervention training rather than reaching for a gun. The disagreement between the two policy versions came from policy language. For example, there were differences for the words shall, which would indicate something is mandatory, versus should. This revived version had the word shall. It comes after the december shooting of mario woods in the Bayview District last december. The Hunger Strike by the group known as the frisco five who called for police use of force reforms and the shooting death of stolen car suspect jessica williams, which ultimately led to the resignation of then police chief greg suhr. We should mention the policy still has to be approved by the police union and the city. They need to resolve officers use of caro tid holds. Thank you, brian. Time is now 7 34. Democrats say they will continue to fight even while republican lawmakers take their fourth of july recess. The Oakland City Council is agreeing with mayor libby schaaf to postpone the start of another Police Academy class. That academy was deaded scheduled to start next february. Now it will begin in may. City leaders say the time will be used to look over hiring practices by the department. Two other Police Academies scheduled to start this year will move forward as planned. The city of oakland has hired a private detective to investigate one aspect of the Ongoing Police misconduct investigation. City administrator sebrina la time drad said someone has been giving confidential details about Police Personnel to the media. Time now 7 38. Happening today a judge in baltimore is expected to hand down the verdict for another Police Officer in the freddie gray case. Caesar goodson waived his right to a jury trial. He is facing the most serious charges, including Second Degree depravedheart murder. Now, he is the third of six Police Officers being tried for the death of freddie gray. Freddie gray died from spinal injuries that were sustained while he was in a police van that goodson was driving back in april of 2015. Neither of the two Police Officers who were tried were found guilty. President obama is heading back to the bay area later today. It will be a familiar scene. The president s plane will land at moffat field. The president is coming in tonight to prepare for a speech that he is giving at stanford tomorrow morning to the Global Entrepreneurship summit. The fbi now confirming the gunman who killed 49 people at that nightclub in orlando, florida bought plane tickets here to the bay area just days before the shooting. Investigators say omar mateen bought three tickets for himself, his wife, and his child for a flight to sfo in july. The fog bank is now trying to the fbi is trying to make sense of the timing of that. Mateens motherinlaw lives in contra costa county. There is new information about major wildfires in southern california. The border fire near san diego, it has burned 6800 acres. Its 20 contained this morning. We have been looking at the brings keeping an eye on the dumbarton bridge, which is slow all the way across to menlo park. New this morning a tie vote by the u. S. Supreme court effectively kills president obamas immigration plan. The one that was aimed at protecting millions of People Living illegally in the u. S. From being deport the. Texas led 26 republican dominated states in challenging the Obama Administration program that was announced in november of 2014. Congressional republicans also supported the states lawsuit. Now, a tie vote sets no national precedent, but it leaves in place a ruling by the lower court. In this case, the federal Appeals Court in new orleans said the Obama Administration did not have the authority to shield up to 4 Million Immigrants from being deported and make them eligible for work permits without getting the approval of congress. In a grassroots effort, its underway in a San Francisco neighborhood to raise money for people affected by that massive fire on saturday. It destroyed several buildings that housed apartments and businesses. Almost 60 people lost their homes. Seven businesses were either destroyed or so badly damaged that they were forced to shut down. Our impact, first of all, isnt as bad as people who lost their houses and stuff like. This that is devastating. Our bartenders have no jobs now. The loss of income. I cant even imagine losing a business. You put your heart and soul into building it. On saturday, they watched it burn down. Well, the Mission Association is encouraging the community to spend their money and shops and restaurants left in that area, many of which are holding fundraisers for the victims. Good news. If you live in san jose, and you have been watching your lawn and garden turn brown because of the drought, city leaders just approved a new rule letting you start watering around your home three days a week starting july 1st. The Bay Area News Group reports san jose residents have been doing a great job saving water under that 25 state conservation mandate. Now homeowners will be under a lower water savings goal of 20 . The heat caused major issues for electric and hybrid cars in palm springs. Several drivers said they were vehicles wouldnt start because of the high temperatures. A study by triplea found that temperatures at least 95 degrees in that range, the electric cars range could travel, dropped by 33 . One owner says her car wouldnt start because the battery was overheated and needed time to cool and she called the dealer for help. He was puzzled. He said he hadnt heard of that happening and that maybe i should bring it in and have it checked for like a Software Update or something. You can see what it likes in emeryville and oakland heading down to the maze. When you get to the bay bridge its a 20minute delay at the toll plaza getting onto the bridge. Southbound 101 at woodside road there is a crash. One vehicle is overturned and fire and medics had to get someone out of a car. Doesnt look like the injuries are lifethreatening. Still we have slow traffic on 101. 280, on the other hand, i would say it doesnt look bad. Its a decent alternate heading down the peninsula and into the valley. 8 04. Back to the desk. Thank you. We are following breaking news from overseas as well. There has been a shooting inside a Movie Theater in a town in southwestern germany. Police in the town of viernheim are releasing very few details. We have reports a gunman went into the Movie Theater, started shooting. Several people reportedly are wounded. Back here at home San Francisco police are looking into the circumstances of two separate crashes last night that killed bicyclists. In both cases the driver left the scene. Yeah. We want to show you a map of the crheas the first one happened in Golden Gate Park in San Francisco. The second one, pam, happened in the south of market area. Ktvus Christien Kafton has the latest. Reporter investigators are looking into the two deadly car versus bicycle accidents, one of which happened at 7th street and howard. This happened at around 8 30 last night. Witnesses telling police that the driver ran a red light and hit a man on his bike. That cyclist died from his injuries. The driver took off but was stopped shortly after and detained by police. That was not the case in the other deadly car versus bicycle incident. Here is what witnesses tell police. The driver was westbound on john f. Kennedy drive at around 6 00 and tried to get around some slower cars and hit a cyclist head on in the biking lane. Witnesses also tell police that the driver of the white honda fit was speeding and driving erratically. Now, the woman was thrown from her bicycle and died from her injuries. The driver took off, abanding the car less than a mile away. Police have a good idea who that driver is and are working on tracking him down. Cyclists this morning are telling us they are on high alert every time they ride on the streets of San Francisco. I wasnt there yesterday. They had blocked off the area. Reporter when you hear that this person hit this woman and just took off. Yeah. Reporter its got to be scare. Reporter whats it like sharing the roads here in San Francisco . Yeah, its pretty scary. It makes me really sad to hear that she potentially died. And it is scary. Reporter both those incidents witnesses tell investigators that it seems that the driver was the one at fault. Cyclists this morning are telling us that they still need to follow the rules of the road every time theyre out. In San Francisco, christian kafton. The story of a bizarre kidnapping case in vallejo is back in news because a federal judge will hear arguments about whether evidence should be thrown out. The lawyer for the suspect, matthew muller, says muller was arrested just because he left his cell phone behind after breaking into a house in dublin last year. The Attorney Says police illegally searched that phone to find out who owned it. Now, prosecutors object. They say a burglar cant expect privacy for an item that was left behind. Investigators say after unlocking the phone they were able to connect muller with the kidnapping of Denise Huskins a few months earlier. Vallejo police had mistakenly labeled that case a hoax, but later admitted the kidnapping did occur. Time is 8 07. Happening today a meeting in las vegas to finetune a Public Private financing plan to build a new stadium where the raiders may potentially play. Raiders owner mark davis met with the Southern NevadaTourism Committee a couple of months ago and he pledged 500 million towards building a new stadium estimated to cost 1. 4 billion. Now, under the plan to be considered today by the committee the Public Private financing would come from hotel room taxes and also redirecting sales and payroll tax revenue. Moving the raiders from oakland would need the support of other nfl team owners. Just yesterday the National Hockey league announced its expanding and putting an Expansion Team in las vegas. First of all, in just a few hours the 16yearold girl regginae jefferies, her body will be taken from this funeral home here in east oakland and will go down to the place where her funeral will happen in just a few hours. The church, i should say, where the funeral will happen in a few hours. This is a young woman who, according to her family, had a promising future ahead of her and her killing is really senseless for so many people. The family is asking for the governor to step in to make sure that regginaes killer does not go free. She was shot while attending a vigil for two of her friends who drowned last month. In an effort to make sure regginaes killing doesnt go unsolved, her great aunt wrote a moving letter to governor jerry brown. She asked the governor to urge oaklands mayor to address gun violence in the city and make sure this case gets the attention it deserves. Her great aunt also suggested that cases like this could fall by the wayside as the department is happening to focus now on the sex scandal involving Police Officers, but the Department Denies that that would be the case. Now, this crime struck a nerve with many in this community. I talked with a father a short time ago who told me that he is planning to attend this funeral even though he didnt know regginae personally. He was really moved by what took place. Her great aunt tells me she did get a response after emailing the governor and sending that letter to the governor. She tells ktvu it was simply a form letter that referred her to the Oakland Police department and she was upset by that. She wanted more in response from the governors office. Again, this funeral for regginae jefferies will get underway at 11 00 this morning and again thats procession to the church will begin here at about 10 30 this morning. All right. New home sales could be picking up because there are fewer previously owned houses on the market. The National Association of realtors says the bay area has seen the number of home sales drop, though, because there are so few homes, new or old homes, listed for sale at this point. The western part of the country has seen the tightest inventories, and that is certainly pushing prices higher. A new report from realty track says that the most unaffordable place to live in the u. S. Is on the other coast. It says brooklyn tops that list. Realty track reports the average home price there is 121 of the average salary. Marin county and Santa Cruz County ranked second and third. Analysts say many people are being priced right out of manhattan, San Francisco, and san jose. Thats also pushing up prices in neighboring areas as people move a little further out. There was a shooting by a masked gunman inside a Movie Theater in viernheim in southwestern germany. We are hearing that gunman has been killed. 25 people were hurt. We dont know yet if they were shot or if they were hurt by tear gas from police. Still a fluid situation. The motive of the gunman, thats not clear yet as well. But again that area is still sealed off by police. Again a gunman who went and started shooting inside a Movie Theater in southwestern germany, that gunman has been killed. We will have more information as the morning goes on. Also this morning protests in baltimore are already underway after a judge just found another Police Officer in the freddie gray case not guilty. Take a look. Can you see the crowds demonstrating outside that courthouse right now. Caesar goodson is the third of six officers to stand trial so far. None of the officers have been found guilty. Now, goodson waived his right to a jury trial and was facing the most serious charges, including Second Degree depraved heart murders. Gray died back in april of 2015. From being deported. Texas led 26 republican dominated states in challenging the Obama Administrations Program Announced back in november of 2014. A tie vote set it in place. The ruling by a lower court that found the Obama Administration lacked the authority to shield up to 4 Million Immigrants from deportation without approval from congress. And the Supreme Court upheld an Admissions Program at the university of texas that takes account of race as part of how it decides which students to admit. I think its a reactionary approach and i think they need to sit down and strategize better and not wait for a tragedy to happen before they react. Last night the San FranciscoPolice Commission vote the unanimously yes for a refused use of force policy. And while most of the policy is agreed upon amongst the parties involved, there are still some major disagreements on some of those revisions. Thats why while the Commission Approved it, there is still a lot of review and possible changes ahead. Now, there were two versions up for consideration for the commission. One that was backed by civil Rights Groups and community advocates. The other backed by the Police Officers union. Now, there were negotiations amongst the groups up until last nights vote. It came to this latest version that again was mostly backed by all involved. However, the Police Officers union and the city have to approved the revised policy. According to some reports, the Union Disagrees on some language that talks about when officers can shoot at moving vehicles. This revised policy comes after the december shooting of mario woods in the bayview, the Hunger Strike by the group known as the frisco five, and the shooting death of jessica williams, which led to the resignation of then police chief greg suhr. The san gabriel complex fire in Los Angeles County has grown to 5200 acres. Its at 15 contained. We understand president obama is lets listen to the president speak now live from the white house. Important value in our society and that this country should provide a high quality education to all of our young people, regardless of their background. We are not a country that guarantees equal outcomes, but we do strive to provide an equal shot to everybody. Thats what was upheld today. Second, one of the reasons why america is such a diverse and inclusive nation is because we are a nation of immigrants. Our founders conceived this country as a refuge for the world. For more than two centuries, welcoming wave after wave of immigrants has kept us youthful and dynamic and entrepreneurial. It has shaped our character and it has made us stronger. But for more than two decades now our immigration system, everybody acknowledges, has been broken. And the fact that the Supreme Court wasnt able to issue a decision today doesnt just set the system back even further. It takes us further from the country that we aspire to be. Just to lay out some basic facts that sometimes get lost in what can be an emotional debate. Since i took office, with we deployed more Border Agents and technology to our southern border than ever before that has helped cut illegal border crossings to the lowest levels signs the 1970s. It should have paved the way for comprehensive immigration reform. And in fact, as many of you know, it almost did. 70 democrats and republicans in the senate came together to a pass a smart con sense bill that would have doubled the border papa troll and offered undocumented immigrants a pathway a way to citizenship if they played by the rules. Unfortunately, republicans in the house of representatives refused to allow a simple yes or no vote on that bill. So i was left with little choice but to take steps within my existing authority to make our immigration system smarter, fairer, and more just. Four years ago we announced that those who are our lowest priorities for enforcement, diligent patriotic young dreamers who grew up pledging allegiance to our flag should be able to apply to work here and study here and pay their taxes here. More than 730,000 lives have been changed as a result. These are students. They are teachers. They are doctors. They are lawyers. They are americans in every way but on paper. And fortunately todays decision does not affect this policy. It does not affect the existing dreamers. Two years ago we announced a similar expanded approach for others who are also low priorities for enforcement. We said that if you have been in america for more than five years with children who are american citizens or legal residents, then you, too, can come forward, get right with the law and work in this country temporarily without fear of deportation. Both were the kinds of actions taken by republican and democratic president s over the past half century. Neither granted anybody a free pass. All they did was focus our enforcement resources, which are necessarily limited, on the highest priorities. Convicted criminals. Recent border crossers, and threats to our national security. Now, as disappointing as it was to be challenged for taking the kind of actions that other administrations have taken, the country was looking to the Supreme Court to resolve the important legal questions raised in this case. Today the Supreme Court was unable to reach a decision. This is part of the consequence of the republican failure so far to give a fair hearing to mr. Merit garland. My nominee to the Supreme Court. That means that the expanded set of common sense deferred action policies, the ones i announced two years ago, cant go forward at this stage until there is a ninth justice on the court to break the tie. I know a lot of people are going to be disappointed today, but it is important to understand what today means. The deferred action policy that has been in place for the last four years is not affected by this rule. Enforcement priorities developed by my administration are not affected by this ruling. This means that the people who might have benefited from the expanded deferred action policies, longterm residents raising children who are americans or legal residents, they will remain low priorities for enforcement as long as you have not committed a crime or are limited Immigration Enforcement resources are not focused on you. But todays decision is frustrating to those who seek to grow our economy and bring a rationality to our immigration system and to allow people to come out of the shadows and left this perpetual cloud on them. I think it is hard breaking for the millions of immigrants who made their lives here, who have raised families here, who hope for the opportunity to work, pay taxes, serve in our military, and more fully contribute to to country we all love in an open way. So where do we go from here . Most americans, including business leaders, faith leaders and law enforcement, democrats and republicans and independents, still agree that the single best way to solve this problem is by working together to pass common sense bipartisan immigration reform. That is obviously not going to happen during the remainder of this congress. We dont have a congress that agrees with us on this nor do we have a congress thats willing to do even its most basic of jobs under the constitution, which is to consider nominations. Republicans and congress currently are willfully presenting the Supreme Court from being fully staffed and functioning as our founders intended and todays situation underscores the degree to which the court is not able to function the way its supposed to. The courts inability to reach a decision in this case is very clear reminder of why its so important for the Supreme Court to have a full bench. For more than 40 years there has been an average of just over two months between a nomination and a hearing. I nominated judge merritt garland to the Supreme Court more than three months ago, but most republicans so far good morning. We are listening in on president obama speaking about the Supreme Court ruling that effectively blocks his immigration legislation. He is talking more about that right now. Lets listen in. And america should not let it stand. This is an election year, and during election years politicians tend to use the immigration issue to scare people with words lick amnesty like amnesty in the hopes that it whips up votes. Keep in mind that millions of us, myself included, go back generations in this country with ancestors put in the painstaking effort to become citizens. We dont like the notion that nanci millions of people who have come forward and worked to get right with the law under this policy, they have been living here for years, too. In some
