No problems with the fog in the valley. Quiet up in the sierra. Windy as heck down in Southern California hence the red flag warnings and wind advisory for the high desert. So a lot of people take the m to get to San Francisco state or just you know, the m line, its blocked now. Muni is running shuttles. Thats from a tweet that muni sent out. I want to show you the bay bridge toll plaza, its backed up for 25, 30 minutes. It looks likes a normal tuesday. I think by tomorrow well start to see people who are living the bay area for the thanksgiving or perhaps not even going to work. Lets take a look now at the 880 freeway, interstate 880 in both directions near the coliseum is moving along well. As we take a look at marin county and the north bay, southbound 101 from 37 to about marinwood is slow but after that it looks good to the golden gate bring. One last thing i want to mention is if you are driving on 680 out of the pleasanton area down the sunol grade, its slow because of earlier issues. Back to the desk. Thank you, sal. Well, dozens of buildings damaged or destroyed in overnight violence in ferguson, missouri after it was announced that the grand jury decided not to indict the Police Officer who shot and killed 18yearold Michael Brown. You see et pictures. There was gunfire, rocks were thrown, looting and fires throughout the night. A lot of the protesters broke storefront window, and emptied shelves. One store hit was a store that police say Michael Brown stole cigars shortly before his encounter with Darren Wilson. Several businesses were set on fire including this Oreilly Auto Parts store. Windows were smashed and looters grabbed items from inside before setting it on fire. Explosions could be heard for miles. The building is completely destroyed. What ive seen tonight is probably much worse than the worst night we had in august. Im not saying there werent folks out there that werent out there for the right reason. Im saying this spun out of control. Even before the announcement, some districts there anticipated violence and they decided to close schools today. And rallies are not over. This is video from just a short time ago showing more protesters beginning to gather in ferguson. People, as you can see, are blocking an intersection walking barn in a circle around all four parts of it. Close to 30 people were arrested last night. Interesting developments, tori. Here in oakland, more than 1,000 people marched through the downtown area. It was a protest. It was marked by acts of violence and vandalism. Business windows were smashed, walks were spray painted. Trash cans lit on fire. Tara moriarty is outside a Smart Final Store with a look amount the damage. Tara . Reporter were here on 10th and broadway. The protesters definitely got to this place. All. Windows are boarded up after all of the windows are boarded up after being smashed that. Businesses around here are faced with the task of boarding up tonight in case more riots happen. Protesters broke nearly all. Windows at the starbucks down the street near Oakland Police headquarters and stole baked goods and merchandise. That kochfy shop is closed today. As we mentioned, a smart final targeted, looters making off with bottles of liquor. Demonstrators spray painted we stand with mike brown on the side of the marriott hotel. Heres video from that location. You can see looters had just broken into the smart final and set fires in the street. Right after the announcement from ferguson was made about 2,000 demonstrators marchedded from 14th and broadway blocking traffic twice. We wanted to be here that whatever we heard about indictment or no indictment, we wanted to be here in a capacity of people who are concerned about faith and love and hope but who are also concerned about justice. Reporter a Police Cruiser was vandalized. Officers arrested 40 people. A few people were injured but no one seriously hurt. Witnesses say officers were here last night but they did not stop the vandals from reek wreerking wreaking havoc. Well talk to Business Owners about how they plan to cope. Also a lot of questions are being raised about how police hand. Ed this situation and the fact that mutual aid was not called for and the protests went on well into the night until at least 1 00 in the morning. Tara moriarty, ktvu channel 2 news. Thank you. Another thing that happened last night, a large group marched right onto the freeway. This was westbound 580. It was at macarthur boulevard. As you can see, they caused traffic to come to a stop. There were 500 people on the freeway. A lot of people there. You can see the Police Moving through the crowd trying to get this under control. About 8 36 last night, the chp actually issued a sigalert, shut down traffic in both directions. This was 59580 and at one point 580. At one point, the crowd began to form a human ladder to climb on the Center Divide of the eastbound side. Thats how they were able to block both directions of traffic. They were climbing on top of each other, using each other as a ladder. You can see the camera panning around. Around 9 30, the chp started to divert eastbound traffic to highway 24 which is always busy, while people on the westbound side, they were just stuck. No place to go. I guess this lasted until about 11 00 last night. A lot of police presence. You can see there. Whats interesting, i heard a couple of people who said they didnt mind. A couple of drivers didnt mind the protests because the protests were mosley peaceful and voicing their opinion. One person felt it was almost this is the start of a revolution. Were hearing more protests planned for tonight. People should be aware of that for the evening commute. Stay with us for full coverage. Another part of the story, family members of oscar grant were out there joining in the demonstrations on the streets of oakland. This is oscar grants uncle. He told ktvu his thoughts were with Michael Browns family and that the demonstrations he says are necessary to start a National Dialogue on race. Im glad the community is out here standing with Michael Browns family, standing together with Police Terrorism in the country. This is what we need. We need this all around the country. Oscar grant was shot and killed in 2009 by b. A. R. T. Police officer, johannes mehserle, who was later convicted of involuntary manslaughter. Now, oscar grants urge. We are looking at a commute where traffic is moving along pretty well in some areas. Slowing in others. Well sort it all out for you coming up. Very quiet here. A chilly, cold morning for some. About a halfmile of cars stopped on the freeway. We need to figure out how to get everybody off the freeway at some point. Boy, just look at the pictures. Interstate 580 shut down for a few hours in both directions after about 500 protesters blocked the highway. Several arrests were made. By 11 00, the chp was finally able to clear the freeway and start the process of reopening it. Ktvus Tara Moriarty will join us in about 20 minutes from now to tell you more on how oakland was affected by the ferguson grand jury decision. Now that the decision has been announced, no indictment for officer wilson after he shot and killed Michael Brown comes the questions, mainly how did the grand jury reach this decision . Last night, Robert Mccullough tried to justify the grand jurys decision and it boiled down to this they are the openly people only people who have heard and examined every witness and every piece of evidence. Joining me now is former District Attorney, jim hammer. Its often said you can indict a ham sandwich and grand juries always decide to indict. Why do you think they decided against it . It was no secret the District Attorney was watching public reaction. Grand juries can be used to indict a ham sandwich as you said. You use it as a true investigative tool. You dont just put on a couple of witnesses. Sometimes you have a real question about what the facts are. We heard so many different cold fronts from the public, people saying what they saw. Turns out they didnt see it. That is sounds like this prosecutor used it to put all of the evidence on, to shake out the evidence, to compare it to the physical evidence and find out what happened. The most rearc man thing the most remarkable thing for the public so they can say i agree or dont agree with the evidence. Is there usually a higher standard or a higher bar to indict Police Officers mainly because of the violence of their jobs . It is and listen, most people when they are looking at the conduct of the Police Officer are thinking that Police Officer is there to protect me. They are gonna sympathize more with the officer than someone who shoplifted and then they have to prove it wasnt in self defense. So with the Police Officer giving his account of being charged and Michael Brown grabbing his gun and Michael Brown not there to go give testimony its tough for prosecutors. Can you explain the difference between a grand jury and a trial jury . Grand juries are in secret, you dont even know the identity of the grand jurors. You dont know how they voted because they deliberate in secret. While they are working, theres no judge in the courtroom, no defense attorney. Just a prosecutor. I would stand in there with 15 members of the public. When they went to deliberate, nobody would be there to help them out. Its truly a civilianrun grand jury. The downside, if its abused, theres no defense attorney and no judge. All of the burden is on the prosecutor to make sure that fairness happens in that case. It can be abused but used directly, its a very powerful investigative tool. What is next in this case . Could the officer face any federal charges . So in terms of criminal cases, the District Attorney has all the discretion in the world. If the d. A. Decide not to prosecute, its over. From the tea leaves, it doesnt look like a federal prosecution will happen but thats a possibility. The real avenue left for the family now is the civil case. They can file suit either in federal court or state court against this officer. They can say that it was a violation of civil rights. He was killed wrongly and then everything would be public. That burden of proof is very confident to get a recovery against the officer. Still some potential developments down the road. Thank you. Absolutely. Thats after a grand jurys decision not to indict the white Police Officer who shot and killed Michael Brown. At least a dozen businesses in ferguson were looted and set on fire. Protesters smashed windows out of police cars and buildings. Officers used tear gas to break up the gas. Justice for Michael Brown this was in oakland. Similar scenes, angry protesters blocking a freeway and vandalizes businesses and there were several arrests reportedly so many people were taken into custody that Police Called in a bus to transport them. Thats not the end of it. There are more protests planned for tonight around the bay area. We have Live Team Coverage this morning. Let me show you the scene in missouri as people are beginning to gather this morning. You can see several dozen protesters marching through the streets right now. Police are, of course, hoping todays demonstrations remain calm after widespread damage and more than 80 arrests overnight. This was the violent scene overnight in the ferguson area as protesters clashed with police in riot gear. Officers were pelted with everything from bottles to batteries. Demonstrators set at least a dozen large fires. In one case, huge flames shot from an auto parts store. There were a number of cars set on fire, that included several Police Cruisers torched. There was quite a bit of looting as well as demonstrators smashing out store windows. Some say police were slow to act. Law enforcement officials are promising to step in even sooner if future protests turn vine violent. We do not tolerate criminal activity, window smashing, looting, Crime Associated with these. While we support everybodys right to have their voices heard, you will see a large police presence. Protesters say the decision not to indict officer Darren Wilson is an injustice. Last night one of the stores ransacked during the rioting was the same store that police say Michael Brown stole cigars from before being shot and killed by Darren Wilson. And there is a letter written by Darren Wilson. He thanks those standing by him. It was just publicly released. And it was read aloud by hunch his supporters. I would like to thank you all for standing up for me. Your support and dedication is amazes. Its still hard to believe that all of these people that i have never met are doing so much for me. Law enforcement officials in the ferguson area reported hearing as many as 150 gunshots through just the night. Although in the end, there was no one seriously hurt or killed during the demonstrations. The st. Louis county police chief defending the actions of officers he says there was no way to prevent people who were intent on causing this kind of destruction. There are many businesses and schools closed in the st. Louis area as police and the National Guard prepare for more protests. A up in of them expected throughout the day. She ended her post by saying, im fine but ferguson is not. She used to report in israel and india. Shes been all over the world reporting from cnn. We were more on the protests online. Hes facing charges of possessing child pornography. 49yearold Sergeant Eric lund has been with the chp for 26 years. He worked out of the fairfield office. Investigators say they found evidence that he downloaded and shared videos of child pornography sometimes while on duty. He was arrested back in october. But he has since been released on bond. Hes on administrative leave while the investigation goes on. President obama flies to chicago today. Hes trying to rally support for his executive actions on immigration reform. The president will peek to Community Leaders in chicago. Its part of an ongoing effort by the president to defend a decision to bypass congress. His orders could protect almost 5 Million Immigrants currently in the use illegally from being deported. Happening right now, shoppers are camped outside a store in the south bay even though black friday is still several days away. One man has been there for more than a week. Miguel angiano is first in line outside of the best buy in san jose. He hopes to get a 50inch tv for just 200. He said it typically cost 4600. But he says hes not sitting in line all day long. He and a few others are trading off shifts in line so they can go to their fulltime jobs. We alternate with people. Everybody has a life and they have to go do things. A bad near to start counting the calories. Right. Two new rules will require calorie information on the meant measure. It applies to chain restaurants, Grocery Store takeout counters and movie theaters with 20 or more locations. The information has to be in place by november next year. The fda says americans eat and drink about onethird of their calories away from home and that people need to have the nutritional information to make informed choices. Weve learned hes dealing with a medical problem during his retirement. That hey, look at you. At 71, Dennis Richmond is as imposing as ever even in his running suit but last month, dennis was in excruciating pain after doctors inserted two metal rods among his spine attached with titanium screws. He was put under heavy medication after the surgery. Doctors considered him a fall risk and set up an alarm on his hospital bed. But one night dennis was able to disarm it. When i saw where they pushed the button to turn it off. Smart. Got wobbly toward the end. I got real wobbly. I went head first into the wall and woke up everybody. She came running. It was like an explosion. The entire hospital woke up. Dennis still uses a cane and has a back brace to wear when he needs it. His doctors say it will be a while before he can get back to his beloved golf game. Great story. 7 48. Today, two state lawmakers from the bay area, are gonna announce legislation about a plan to charge pedestrians and bicyclists a toll to go across the Golden Gate Bridge. Democratic Assembly Members phil ting and mark levine, they will unavailable a bill that they say will protect Public Access to the worldfamous bridge. Last month, bridge directors agreed to consider this controversial toll because of growing budget problems. Southbound 85 at winchester, there was a report of a crash there. Also northbound near union, there was a report of a crash. They are still trying to sort it out. 85 is slow in the area. 101, i havent said this for a long time. But actually 101 may be your alternate. Looks not that bad as you drive through. Lets go to the bay bridge toll plaza. Thats backed up for a 20 minute delay. But approaching from 880 is not all that bad. Back to the desk. Thank you, sal. Dozens of buildings damaged or destroyed in ferguson, missouri after it was announced that the grand jury decided not to indict the Police Officer who shot and killed 18yearold Michael Brown. And it is feared there will be more violence in the days ahead. Reporter adam housely has more on what it looks like in ferguson, missouri now that the sun has come up. Reporter as the sun comes up in ferguson, missouri, destruction up an down one of the rain roads called florissant. This was an areas where the riots were last summer. People didnt board up their windows. They thought they were safe. They are left in destruction. This burned out building is a Beauty Supply store. Fs had to let it burn because there were shots fired nearby. They came back. At that point, it was too late. As you move down the sidewalk here, every business, whether it be the laundromat, the nail salon, the Chinese Restaurant or another hair salon at the end. Everyone was looted. The windows busted out u rioters came through here and really took out their aggression on these businesses and frustrated a lot of people here locally who no longer have a place to work, who no longer have a business to call home. As of this hour, more than 80 people have been arrested. There were more than 25 fires last night. Some of those were car fires. But many of them were businesses that burned to the ground. In ferguson, missouri, adam housely, fox news. All right. Thank you. 8 04. Meantime, here in oakland, more than a thousand people protested in the downtown area after that decision was announced. Ktvus Tara Moriarty is outside some of the boarded up businesses, showing us some of the damage left behind from last night. Tara . Reporter yeah, we also just got word there were some injuries to oakland Police Officers last night. A lot of them took rocks, bottles even skateboards. They were being hit by skateboards by some of the protesters. At least one officer we know was hit in the head and what his helmet. The skateboard hit his hefl met and it shattered. He helmet and it shattered. He received injuries to his face. This is the starbucks. This has been boarded up. It is closed to open up at 9 00. Most windows were smashed in. Many downtown businesses will keep up the plywood in case another wave of violence hits tonight. Witness say looters stole baked goods and other merchandise from the starbucks. Rioters stole liquor from the smart final. Chase bank had the windows smashed. Demonstrators spray painted we stand with mike brown on the side of the marriott hotel. We have video of those breaking into the smart final. After the ferguson announcement. 2,000 demonstrators marched down to 580 blocking traffic on the freeway twice. This morning people we talked to said they werent surprised by the violence. Just disappointed. I think its disappointing. These type of situations you want people to have the opportunity to voice their opinions and be heard. But its sad that violence has to be a result of that and broken windows and things line that. That they are destroying property. Thats not really making anything better. Reporter groups were busy until well past midnight. A Police Cruiser was vandalized. Officers arrested 40 people. A few people were hurt but no one seriously. Officers were here last night but did not stop the vandals from wreerking havoc. Thats because of the handsoff policy the department adopted in the wake of the protest years ago. Some officers said they felt that oakland was underprepared. Mutual aid was not called in until later in the evening. Some businesses plan to board up later this afternoon in preparation for another round of protests tonight. One officer as we mentioned was injured. Actually, i said it was a skateboard t was a bottle. He supposedly does not have serious injuries but was indeed hurt. Tara moriarty, ktvu channel 2 news. Now, police are out there. They are on standby just to keep things under control and keep them from getting out of control. 8 07. Two children are recovering after getting injured by a falling cabinet at their preschool in fremont. The accident hatched last week while the children were napping. Police have not released the name of the preschool but its located near warm springs boulevard and warren avenue. Investigators say the cabinet was not mounted properly. One child suffered minor injuries. But a 3yearold suffered critical injuries and is still in the hospital. Were gonna change gears. Millions of people getting ready to travel, hit the road for the thanksgiving holiday. The chp has a very Important Message as the Holiday Season begins. Cara lui is joining us live from martinez. You talked to a Highway Patrol officer involved in this safety campaign. Reporter well, thats right. You can certainly expect to see a lot more officers on our roadways here in the bay area starting tomorrow, the day before thanksgiving. Now, the chp has a maximum enforcement period. It starts tomorrow and goes until november 30th. Its not just speeding they are focused on, they are targeting seat belts, especially after four fatal crashes here in Contra Costa County. In the last few months, involving people not wearing them. There were two deadly collisions just last week including one on wednesday on 680 and Pleasant Hill where a white sedan veered off the roadway, hitting a pole and killing one person. Officers will focus on distracted driving as well. And all unsafe driving behavior this Holiday Weekend. There is a chance for people to celebrate a little bit too hard. We want to make sure were out there enforcing dui laws. We also want to keep speeds down to within the legal limit. Traffic collisions that have higher speeds have a higher ability to cause fatalities. And soap those are the main focuses. Thats quite a statement, its a common sentiment among some of the protesters over the grand jury decision in ferguson, missouri. No criminal charges against a white Police Officer who shot and killed an unarmed African American teenager. While many are expressing their frustration through violence and looting whik you are seeing on while you are seeing it on, tv, joining me live, we have bishop bob jackson. So glad to see you, Bishop Jackson. Flies to see you. And im glad to see you, jim hammer. You were on earlier. A former prosecutor, somebody who is well versed in the law. We were talking briefly early. Bishop, your first reaction to hearing the announcement from the grand jury was what . It was one of sadness. Just i was really sorry to hear that decision. I was hoping they would have said something wiser to Say Something like were gonna indict him and were gonna have a trial with him, et cetera. Sort of like we did with johannes mehserle. I thought maybe they would do sort of the same think. To me in the interest of safety and quelling the violence, that would have been a good, wise move. But it seems as though they werent concerned about the outcome or all of this that you see, they just wanted to say that they didnt see any problem. Jim, let me ask you, as a prosecutor, is it a nowin situation for a prosecutor for a grand jury in a very flammable situation like this one . Listen, i think this prosecutor knew there was gonna be outrage in the public. Yeah. This outcome came, the one credit i will give that prosecutor for, theyve made the entire record public. Usually grand juries are in secret. The grand juries i put on in San Francisco, if the person is not indicted, it remains secret forever. People will have the chance to look at every bit of evidence. Who will be able to see it . Everybody, the media, the public can read witness by witness what people actually said. My hope it will take away some of the some of the idea this is a conspiracy. But having said all of this, most of the murder cases ive prosecutorred, the victims were young africanamerican men. There is a sense in the African American community that their lives are not valued as much, that they dont get a fair shot. So people are not crazy. Regardless, there is a systemic problem. When you have a community which is overwhelming African American and a police force which is almost all white. It will breed distrust. People are not crazy when they are angry about the whole system when that goes on. Thats what we need to focus on changing that. Any time you look at a police force and 53 Police Officers, 50 are white and three are black and you look at a neighborhood thats predominantly black, you know something is wrong with that picture. One of the things you are involved here in oakland with healing centers. Right. That have been set up. At least three or four that have been set up. Tell me about those and the reason for that. Well, because the young people and others that are really upset about the decision, the outcome, it needed a place to come and talk and talk about it and previousably begin the 0 process of healing. I think its an opportune time to share. We had 30, 35 youth uprising who did a wonderful job facilitating that there and we had the Youth Employment place on 23rd and international. And then a couple of places in west oakland. People could come and vent and talk because hurting people hurts people. Thats a yoen adage ive heard known adage ive heard all of my life. The unjustice that goes on, Everybody Knows it is, i dont care how you shape it. How can a man with a gun lose with a man who just has hands . And then shoot him that many times . Its kind of like its ludicrous to me. Were concerned own lip only because were out of time. There may be more protests tonight in the bay area and around the country. We dont know what may happen. The idea of healing, finding a right direction, getting facts out are important and jim, theres also maybe other legal revenue remedies in this case beyond and those are the federal authorities could bring charges from what i started to read in the tea leaves, it wont come. This family has redress. They can go into court and file a lawsuit. If the family believes their son was wrongfully taken them from, they have the right in america to file a lawsuit. Im not sure what the outcome is but its not over for them. I think we all agree, we hope that the spirit of peace somehow will work its way through this even as people vent their feelings one way or the other. In the news, violence erupted in ferguson, missouri and around the country yesterday. Thats after a grand jury decision not to indict the white Police Officer who shot and killed Michael Brown. Look at the pictures. The at least a dozen businesses in ferguson were looted and set on fire. Protesters also smashed windows out of police cars, out of buildings, out of stores, Police Brought in tear gas to break up the crowds. Justice for Michael Brown back here in the bay area, in oakland, similar scenes angry protesters blocked a freeway, some vand amazed businesses and there were vand amallized business vandalized businesses. Thats not the end of it. There are already more protests planned around the bay area for tonight. Alex savidge is live in the newsroom now with the unrest that is still going on in ferguson, missouri, alex. Good morning. Those overnight protests certainly were districtive and this morning destructive and this morning a lot of cleanup. Now that the sun is up, you can get a better accepts of the damage in and around ferguson. Buildings that were burned are still smoldering, that includes a Beauty Supply store, auto parts business, a meat market as well. Also new this morning, were getting a look at protesters beginning to gather. This is in crit clayton. A few members of the clergy have begun to march there. Police are hoping the demonstrations stay peaceful after a long night. Protesters clashed with police in riot gear. At least 80 people were arrested. Demonstrators set at least a dozen large fires in the area. A number of cars including some Police Cruisers were torched. There was also looting a demonstrators smashed out store windows and cleared off shelves. It was a frustrating night for police who opened for civil protests. Were gonna come together and make changes. But we have to understand the community has to be whole. Right now the community is fractured. Law enforcement officials reported hearing as many as 150 gunshots throughout the night. Although in the end, there was no one serious hurt or killed. One of the stores ransacked last night during the rioting was the market that police say Michael Brown stole cigars from shortly before being shot to death by officer Darren Wilson back in august. Protesters say that decision not to indict the officer is an injustice. What are you saying . Our lives are not equal . Our lives are not worthy . This morning some city leaders in the st. Louis area are questioning the Police Response to last nights protests, although the county police chief said this morning there was no way to prevent people who were intent on causing this kind of destruction. Missouris governor has ordered even more National Guard trooch troops into the ferguson area expecting another day of demonstrations. It said, we are profoundly disappointed that the killer of our child will not face the consequence of his actions. We respectfully ask that you keep your protests peaceful. A measure was introduced yesterday that would ban the use of bull hooks by elephant trainers. He says the sharp point on the device cause the elephants pain. This is video showing trainers using bull hooks. The only way that the circus can be in oakland is by causing, you know, abe mal pain and animal pain and suffering. We shouldnt have circus in oakland. An executive said bull hooks are in inhumane and are the only approved tools for working with elephants. Happening today, the government announced new rules for calorie counting. Pam cook is in the studio now with the businesses that will be fearkted and the affect and the reason behind the change. Good morning. The food and Drug Administration just finalized new rules that will require calorie information. This applies to chain restaurants, Grocery Store takeout counters and movie theaters with 20 or more locations. The fda says americans eat and drink about onethird of their calories away from home and that people need to have that nutritional information in order to make informed choices. The menu labeling rule also requires the restaurants to provide information about calories from fat, saturated fat, sodium sug sugar and protein. They are protesting the planned tuition hikes. [chanting] thousands of students at uc berkeley and other campuses walked out of class yesterday angry at the uc board of regents who vote the last week to raise tuition by as much as 5 every year for the next five years. In the state of california, the state actually funds 7,463 dollars per student. However, per inmate, they fund 48,000. Boo now, if those tuition hikes take effect instate students will be paying more than democrat 15,000 in tuition by the year 20 2019. That doesnt include books, room, board and other fees. Students say if the regents dont stop the tuition hikes, they will declare a school wide strike during the spring semester. Two state lawmakers will introduce legislation. Its about the plan to charge pedestrians and bicyclists a told to go across the Golden Gate Bridge.
