This is pretty slow at the bay bridge toll plaza, where if you are counting from the end of the line for how long it takes to you drive into San Francisco, were looking at at least a halfhour for the entire drive. There are no no major problems or crashes. Looking at the san mateo bridge, its busier from hayward to foster city. It looks like a normal commute, about a 20minute drive across the span. Westbound highway 4 is slow and slow is 680 but lack of major problems. 580 is slower than usual on a monday. 580 from tracy all the way to livermore. Most of it is slow. The woman from the bay area who sparked a National Discussion about death with dignity ended her life over the weekend. 29yearold Brittany Maynard was diagnosed with a stage 4 brain tumor early this year. Alex savidge has more on her controversial decision. Good morning. Maynard was surrounded by family and friends at her home in portland, oregon when she took a lethal dose of medication this weekend that was prescribed by a doctor. She had moved to oregon from california because that state is one of a handful with the so called death with dignity law in place. I cant even tell you the amount of relief that it provides me to know that i dont have to die the way that its been described to me that my brain tumor would take me. Maynard was diagnosed with an inoperable brain tumor and made the public decision to end her life on november 1st. She said her pain and seizures were getting worse. She became an advocate for the right to die movement and in this age of social media, maynard brought many young people into the conversation. The organization compassion and choices says she died peacefully on saturday after taking medication given to her by a doctor months ago. Maynard spent the final months of her life traveling to alaska and the grand canyon. Her family describes her as as independent and determined which is why she wanted to control how it ended. I will die upstairs in my bedroom that i share with my husband, with my mother and my husband by my side and pass peacefully to music i like in the background. She grew up in california. She attendedcal and uc irvine but moved to oregon after the diagnosis. Oregon law allows someone to end their life with prescribed drugs, while california does not. There is a push to pass that law here in california. Despite there have been similar efforts that have failed over the past 24 years. The public decision has sparked a National Debate. A burning garage in concord forced a family out of their home. It happened around 3 30 on san carlos avenue near clayton road. This photo of the garage engulfed in flames was tweeted out by the Contra Costa County fire department. Firefighters say three people lived in the home but no one was hurt. Investigators are searching for the cause of the fire. The chp officer accused of sharing nude photos taken off the cell phones of women he arrested is expected to turn himself in this morning in martinez. Shawn harrington has been accused by two women of removing nude photos and texting those photos to other officers. There are reports of a possible third victim. Prosecutors are investigating all. Harringtons traffic stops for other possible incidents. He resigned on wednesday and is scheduled to be arraign this afternoon. The new span of the bay bridge may end up with a deficit of 35 million or even higher. The project manager says theres plenty of unbudgeted work that still has to be done on the new span. And tearing down the old bridge, well, that may cost much more than originally estimated. Caltrans is now shifting money from other bridge projects to make up the difference. Now, earlier, caltrans repeatedly predicted the huge eastern span project would actually cost less than the budgeted 6. 4 billion. The election day is officially tomorrow. But some bay area voters, they are getting an early jump on making their voices heard. Brian flores is live in oakland now. Actually, starting yesterday, voters could cast their ballots at the court hours, the Registrars Office inside the building. The Registrars Office is expected to open within the next halfhour. So voters can cast their ballots then. We havent heard how many have turned out since then. But overall, voter turnout is expected to be low. If you want ta cast your ballot, early voting location, this one here at the courthouse is expected to be open later on this morning. It will be open from 7 30 and 5 00 today. It will be open from 7 00 a. M. To 8 00 p. M. Tomorrow, on election day. Voting analysts say turnout is expected to be low for the state for this midterm general election. Some are saying this could be the lowest turnout ever but they do say if there is a hotly contested race, voter turnout could be okay. That that could be case in oakland. Some decided to vote during the weekend because it was convenient. I have to work on tuesday. This is the first time that im voting in california as an adult. So i am excited to have the option to do early voting. Reporter one of the races that could generate a good sized turnout is here in oakland because of the mayors race. Jean quan, rebecca kaplan, libby schaaf, brian parker and joe tuman will meet. The forum will be held at the royce school at 11 00 this morning. Some election analysts are expecting a 43 turnout. New details this morning on what may have caused Virgin Galactics space ship to break up and crash in the mojave desert. Investigators say the tail booms known as feathers deployed early. They are supposed to help the ship reenter the atmosphere. The system requires a twostep process to deploy. The investigation has revealed that the copilot unlocked the system but the second step occurred on its own. The ntsb says its too early to say whether this was the cause of the crash and the investigation could take up to a year. Well be looking at safety culture, well be looking at the design, the procedure. Weve got many, many issues to look into much more extensively before we can determine the cause. The cause happened during a test run on friday. The copilot was killed. The pilot was able to parachute to the ground and is in the hospital. Hes suspected of killing perla avina while she was driving home from a Grocery Store last sunday afternoon. Police are calling the deadly shooting a road rage incident but are not providing any other details about what happened. A uc Berkeley Fraternity is planning a memorial for one of their members who died while attending a concert at the oracle arena. 20yearold Zachary Bradley was at a rave on halloween night when he fell about 20 feet from a restricted area behind the stage. The Alameda CountyCoroners Office is investigating the circumstances around bradleys death. Another student at the same event said she was surprised to hear what happened. Personally, what i saw was that the security was really, really tight that night. Its really shocking for all of us. A spokesperson for oracle is not commenting, saying the investigation is being left to police. Bradleys mother is making arrangements to take his body back to his home state of arizona. Passengers on a halloween cruise in the bahamas say things got too scary. The boat hit something and started taking on water. All right. Thank you, sal. A concord teacher accused of child molestation is due back in court today for his retrial. For the first time, Joseph Martin is talking to the media about his case. Tara moriarty joins us live from the courthouse with his exclusive jailhouse interview including who he says is partly to blame for his predicament. Good morning, tara. Reporter well, good morning. Yeah, martin partially blames a Police Investigator who he says was improperly trained an inexperienced. He says that his case then evolved into a group hysteria nightmare. Amber lee sat down with martin in jail a few days ago. Where he appeared confident. Reporter did you ever molest any of these students. Absolutely not whatsoever. Reporter he spent two decades teaching in concord until his arrest last year. Thats when a former 5th Grade Student accused him and others came forward. He taught at woodside elementary. He said he only patted or hugged students as a teaching technique. Its a misconstrued i do it fromment it in front of my class. Pats and hugs are only given to students if they give permission. Reporter his attorney said prosecutors said 73 of the 93 counts are expected to be dismissed today. 22 counts remain. His first trial ended in august. The jury acquitted him of charges involving three students. Jurors were split on the other counts. Four crab fisher manwere killed over the fishermen were killed off the coast. They all drowned after their boat capsized. A fifth man survived and is recovering. The coast guard said they were not wearing life jackets but professional firermen say thats common since life jackets can get in the way of fishing. Family members of the fishermen killed say they are beginning the process of planning memorial services. Oakland police are investigating latest homicide near a Catholic Middle School on 10th street in west oakland, not far from 880. Police say a 54yearold man was shot to death. At this point, theres no information on suspects or a possible motive. Another person was killed. Three others wounded in separate shootings during one five hour period. Late saturday night to early sunday morning. Theres no word of arrests in any of these shootings. 7 35. B. A. R. T. May be forced to eliminate two of four proposed stations through downtown san jose because they need federal funding. The Contra Costa Times reports the b. A. R. T. Stops that may be eliminated are at 28th street, the other near the Santa Clara Caltrain station and santa clara university. Planners say a fourstation, sixmile route would cost 6. 7 billion, by eliminating two of the stations that reduces the price to 3. 4 billion. Planners say there are a lot of requests for federal funding for transit stations. They say cutting back on the stations could help their chances of getting more money. Gas prices are way down over the past month. Ride sharing company lyft is reporting the death of a passenger. It happened on saturday when a lyft driver slammed into a car stalled on westbound 80 in roseville. One of the two passengers was killed. The victim was 24 years old from west sacramento. The mans father said he was returning from a halloween party. A 32yearold san jose woman is behind bars after leading officers on a chase and crashing head on into a San Ramon Police car. Officers say they spotted Stephanie Almada next to a stolen honda at a gas station on crow canyon road early yesterday morning. When they ordered her to surrender, officers say she drove off and finally surrendered in South Danville after smashing head in into a patrol car. Officers found, meth, syringes and stolen items. One officer was treated for minor injuries. A whistleblower contacted 2 investigates with Major Concerns about safety inside a busy San Francisco tunnel. An employee of the San Francisco publy Utilities Commission said there are Serious Problems at the broadway tunnel. He says a retrofit project meant to save moifn and make lighting more energy efficient, well, he says instead it wasted thousands and also made the tunnel too bright. It was clear that something had gone wrong in the deep sign process design process. Something is gonna get hurt or killed. It happened friday night in santa ana. Police say 13yearold twin sisters and their friend were in a crosswalk when they were hit. The driver took off. Yesterday, police made several arrests. The victims families are pleased about the arrests but say it wont bring back the girls. It wont bring my sister back. I think the whole community is proud, they are happy that the people who did this that just left them there, they are finally in custody and they have to answer to justice. A memorial at the spot where the girls were killed keeps growing. An online fundraiser has been set up to help with funeral costs. The new World Trade Center tower is opening for business. More than 13 years after the september 11th attacks. The first group of Office Workers from conde neste is moving into the building. This replaces the original towers destroyed in the 9 11 attacks. Construction took about eight years at a cost of nearly 4 billion. So far, the building is only 60 leased. Official opening ceremonies are set for later this year. Media Rights Groups are raising concerns about nofly zones over furgeson, missouri. Traffic is solid out of san bruno and south city all the way down to the burlingame area. Please give yourself extra time. 101 is just as slow. I cant recommend one other the other. The ridge of High Pressure is nosing. Lifting way up. Some of these clouds are toppling over and coming over us. Thats where were getting the source of these higher clouds. Any precip will be well to the north. It wont amount to much. I think its mainly clouds. Thats about it. Napa airport was 39 and i know clearlake, 38. Kelseyville, lake county, 38. We talked about 35, 38 ben lomond, Boulder Creek and scotts valley. A lot of 40s or some 50s. But again, the cloud cover no doubt about it keeping some mid 40s. Had a report in windsor, 42, 43. She said she took off her ring and placed it in a jar while carving pumpkins earlier in the day. You can understand pumpkins are kind of messy. Sometime during the day, she filled the jar with candy to hand out to kids. Im jut really hoping that somebody has it and just doesnt know what to do with it. They dont know whose it is or how to find out, you know, through the hundreds of houses they went to, they dont know which house it came from. She put up posters in the neighborhood asking for help. She said the ring is probably only worth 50 at a pawnshop but it means the world to her. The ring was given to her by her husband of ten years. Do you think they will find it . I hope so. I worked with bruno heller who created gotham on a pilot last year that didnt go to series but he wrote this character with me in mind and sent the script to me earlier this year. He said, take a look and, you know, we just started talking about it. He had already written the script and we just started from there. It was incredibly flattering that he thought i could pull it off. I think he was more sure that i could pull it off more than i was. But, you know, its been a great collaborative process ever since. And i think, you know, you see the cast of actors around me and its just, you know its fantastic. Jada pinkettsmith. Robin tailor playing the penguin. Really good cast. Its a fun show to be part of. It makes sense, though. I think you are fabulous as james gordon. I talked to a lot of true batman fans and they sank you are think you are it. You mentioned jada pinkett smith. Whats it like working with her . Because she play as really intense bad guy. Yeah. She couldnt be further from the persona shes playing on screen. I dont know how often shes had a chance to play the bad guy. I think shes relish, the opportunity. It looks like shes having fun. Shes having fun. Shes a pro. She has so much experience. Shes such a calm, collected presence on the set. Its been a real joy to work with her. Take us back to the o. C. A lot of people have been following you since then. I have heard you say you guys were babies and didnt earn it and it was like overnight success. Compare that to what you are involved in right now. Well, i think for me i cant speak for anybody else but for me, ive had the opportunity to work on three shows. I did a show called southland which was a john wells produced cop show. And that was a real education for me. It really helped me understand a lot of things. But to be part of this show now and to really be a leader on the show, you know, the central character of the show, i feel ready for it for sort of the first time. I think when i was doing the o. C. , kind of plucked out of nowhere and kind of dropped in the middle of hollywood tv show land. Very strange experience for anybody. And now i feel kind of ready to take on the challenge and i think weve created a really warm, welcoming set for actors to come in and do their work. I think you see it on screen. I think the performances are really terrific as well as the production design, the look of the show, the writing, the director. Im really proud of it. Its great to be a leader. So a big Chain Reaction from oakland into San Francisco if you have the option of using b. A. R. T. , i think b. A. R. T. Would be a much better option for you at this point. Lets talk about the east bay. We have had a lot of slow traffic all the san leandro all way to the lakeshore curve. As we go back to the peninsula, southbound 280 is throwing a curve because 280 is usually the alternate. Its very slow all the way to burlingame. And 101 is slow from the airport down to san mateo and the airport. The peninsula, not that great. 8 03. Back to the desk. The terminally ill woman from the bay area who touched off a National Debate about death with dignity ended her life over the weekend. 29yearold Brittany Maynard was diagnosed with stage 4 brain tumor earlier this year. Alex savidge is live in our newsroom with more on what led up to her decision. Good morning, alex. Good morning. Brittany maynard made the decision to die on her own terms. And this weekend, surrounded by family and friends at her home in portland, oregon, she took a lethal dose of medication prescribed by a doctor. All of my treatments came true if all of my dreams came true, i would somehow survive this. After being diagnosed with an inoperable brain tumor, she made the public decision to end her life on november 1st. She moved from california to oregon because that state is one of a handful with the so called death with dignity law in place that allows someone to end their life with help from a doctor. The organization compassion and choices says the 29yearold tied peacefully on died peacefully on saturday after taking medication given to her months ago. She spent her final months traveling to alaska, the grand canyon and her online videos were seen by millions of people worldwide. She became an advocate for the right to die movement and in age of social media, she brought many young people into this conversation. People here in the bay area, we talked to this morning, have varied views about her decision. You should be able to choose your own way of dying and, you know, people shouldnt have a right to tell you whats right or wrong. Taking your life from a religious perspective is taboo but who wants to die a horrible, painful death . Maynard grew up in california and attended cal and uc irvine but moved to oregon after being diagnosed with brain cancer. Oregon law allahs for doctors law allows doctors to end lives while california does not. Maynards family is planning to continue her fight by pushing for similar laws around the country. Alex savidge, ktvu channel 2 news. She would have turned 30 later this month. 8 06. New this morning, a burning garage in concord forced a family out of their home. Now, this happened about 3 30 this morning on san carlos avenue near clayton road and this photo, you can see the garage engulfed in flames. This was tweeted out by the fire department. Firefighters say three people lived in that home but no one was hurt. Investigators still looking for the cause of the fire. The chp officer, the one who is accused of sharing nude photos taken off the cell phones of women he arrested, hes expected to turn himself in this morning in martinez. Officer Shawn Harrington has been accused by at least two women of removing nude photos from their phones, then texting those photos to other officers. There are reports there is a third victim. Prosecutors are investigating all of his traffic stops. They want to see if theres other possible incidents. Harrington, who resigned on wednesday, is scheduled to be arraigned this afternoon. 8 07. Election day is officially tomorrow. But some bay area voters are getting an early jump on making their voices heard. Brian flores is live in oakland near the county Registrars Office to explain how its possible to vote early. Good morning, brian. Reporter hi, tori. Good morning to you. Were inside the county Registrars Office this morning, where polls will open at about 8 30 this morning. A point of clarification. We said 7 30 earlier. But again, 8 30 for some early voters. Overall, experts say turnout is expected to be low. Hopefully that changes, but if you want to get an early start to voting here, you can vote today, as we go to video. The courthouse will offer early voting from 8 30 to 5 00 and then on election day 7 30 to 8 00. Voting analysts say the turnout is expected to be low for this midterm election. That being said, we did speak with one person who came in to vote early. I was just in the area and had some extra time and decided to do it today instead of tomorrow. Reporter were back out here live at the Registrars Office this morning where we have tim, the registrar of voters here. Good morning. Reporter were talking about turnout. Were hearing different statistics on how many voters may turn out. Give us statistics on how many voters youve received so far and your projections. Weve received 116,000 votes so far. We had a couple hundred people vote over the weekend. We were open for early vote as well. As a statistic, we have about 440,000 permanent vote by mail voters. Weve seen about a 25 return on those voters. Based on the trending right now, im looking at possibly a 40 to 45 turnout of our 800,000 voters for Alameda County. Reporter what does that relate to in terms of the lowest or the highest . Is this is this around where you expect it . We would like to see it higher. In june, in the primary, we had a 27 turnout. Its nice to see that its trending up. In our last president ial election, we had seen a 73 turnout. We would like to see a higher turn out. Reporter obviously were talking about hot spots. You have the mayors race. Are you gonna find that places like oakland will have a higher voter turnout than other places . Certainly theres hot races in omof the cities. You would expect based on the attention they are getting there will be higher turnout. But we have countywide issues. So i hope all of our voters get out and let us know what they want. Reporter i want to talk about the nuance here. If you do mail in your ballot or if you turn in the mailing in of your ballot by mail, it has to be in by a certain time. Can you describe that. Its not based on the postmark on the envelope. We have to have the vote in our hands by 8 00 p. M. On election night. Thats the election code. Reporter and then you can turn in your mailin basketball on thes . Certainly. On election day you can yurn tur ballots in at the polls you can turn your ballots in at the polls and you can go to city hall and drop it off there or you can come down here today for early vote or even tomorrow. The new eastern span of the bay bridge may end up with a 35 million deficit or even bigger. Theres plenty of unbudgeted work that still needs to be done on the new span and then tearing downg the old bridge, that may cost a lot more than originally estimated. Caltrans is shifting money from other bridge projects to make up the difference. Earlier, caltrans repeatedly predicted the huge project would actually cost less than 6. 4 billion. Google is giving 3 million to a San Francisco clinic that focuseses on a connection between poor health and the traumatic lives of lowincome children. The center for youth Wellness Clinic in the Bayview District has received international praise for its work. Dr. Harris says 10 of the children she sees, specificker inianced four or more they have experienced four or more issues. She said toxic stress. It affects people of all ages, income levels and racial backgrounds. Despite so much focus on the deadly ebola, bill gates is still determined to wipe out malaria in his lifetime. The richest man in america is increasing by 30 the bill and Melinda Gates foundation to this cause are over 200. He says his plan includes developing a drug or vaccine to eliminate the malaria parasite from people who carry it but dont have symptoms. Gates says were likely to have an epidemic thats more transmissible than ebola in the near future. 8 12. The price is dropping right in front of our eyes. Officialles at duke say the unidentified patient recently came back from the u. S. From liberia and was admitted to the hospital after developing a fever on sunday. While the patient has no signs of symptoms for now, they are being kept in an isolation unite. A huge brawl involving one of nascars biggest stars broke out at a weekend race. It happened yesterday during the triplea texas 500 in fort worth. Take a look at the video. Car is right there. Jeff gordons car collided with a car driven by brad keselowski, causing gordons car to spin out. Tempers boiled over as the crash led to a melee between the two pit crews. No one was hurt but this fight got far more attention han the driving of than the driving of jimmy johnson, who actually won the race. A new study shows that dads, yes, you dad, need to talk too your baby more. The study published in pedate tricks reports that babies heard three times more words from their mothers compared to their fathers. Researchers used microphones to monitor this. The results showed dads rarely engaged in baby talk with their children. Thats interesting because i know that sometimes theres been studies that baby talk isnt the best way to communicate with your child. They told me i talk to much. We dont have we dont have a good commute right now on a certain part of the bray. Well start with San Francisco, where they cleared a crash and things are improving on southbound 101. But the damage is done. 101 is a mess. There was a crash near 280, traffic off the bay bridge was slower. They slowed the metering lights down. I will show you the bay bridge toll plaza, the traffic is backed up. So just when we were getting a break, we started to get slow traffic on the bay bridge and on the peninsula. 280 is trying to get in the act with an earlier crash. Southbound 280 at trucedale. 101 is backed up out of south city. It looks like 101 is backed out of the candlestick area all the way down. Thats not very good. Please give yourself extra time. Know that if you have an employee showing up today, that excuse my work. 8 18. People call me all of the time running a little late. Ill buy it. Sounds good. As long as you get your work done. The lava is 500 feet from the main road in and out of pahoa. Its not moved since thursday. Emergency workers have people who live close to the flow on standby for immediate evacuation if the lava starts to move closer to town. But so eerie, the pictures. I know. We had an issue in San Francisco san jose, everything back to normal. Well, we have a new crash. Just pointing our camera there. My friend, al, in the control room. We found this crash reported after Treasure Island but its not of the its a little bit farther along the bridge. You can see it there from our live picture. Its blocking the fast lane. And traffic is slow all the way across the bridge and out to almost San Francisco. Meanwhile, this crash is causing a big backup on the bridge. That means the metering lights are on extra slow and the traffic is crawling along get getting on the bridge. If you want to use the san mateo bridge as an alternate, its not too bad. You can see the san mateo bridge is okay. You will be driving over to a crowded peninsula. 101 and 280 are not having good days there. By the way, speaking of 880, lets go there. 880 southbound between hayward and fremont is a mess. This monday is terrible. Back to the desk. All right. Gasoline prices are way down. Over the past month. In fact, a gallon of gas in some places now a dollar cheaper than a gallon of milk. Janine de la vega joining us live from a san jose gas station where we were watching. You saw the price go down 12 cents just this morning, janine. Reporter yes, we did. There are a lot of happy customers here. Its 2. 85 a gallon for regular unleaded if you pay cash. This is at mckee and 33rd street. People cant remember when prices were that low. The manager told us the reason for the 12cent drop is because they are competing with the gas station next door, where it costs 2. 90 for a gallon. Customers are benefiting from this healthy competition. This is right around where the National Average is for a gallon. Its below 3 which is the first time thats happened in four years. Commits say the drop in gas prices will fuel other spending because people feel theyve gotten a raise. Some say they will pay bills with the extra money or buy groceries. Its nice to have to not spend so much on gas. I own my business. So i it is not good. You always i put 20 in, 40. I hate pumping gas. Reporter now you are smiling. Im smiling here because everybody else is. Reporter several reasons behind the drop, drillers are tapping new sources in the u. S. , americans are driving more efficient vehicles and thats created an increase in supply and weaker demand. Some people are so happy about it. The manager at this gas station here on mckee told us that he may lower prices even more just depending on what the gas station next door does. It just started a couple of minutes ago. Martin says that hes actually devastated for his students from this whole ordeal and everything that theyve had to go through over the past year and a half. Thats how long hes been in jail. He says that the investigation into his conduct was not done properly and that the whole case evolved into this sort of group hysteria nightmare. Did you ever molest any of these students. Absolutely never at all whatsoever. Reporter the 46yearold spent nearly twoe decades teaching in concord, mostly at woodside until his arrest. Thats when a former student accused him and others came forward. He side he only patted and hucked as a. Coming technique and says hes learned a lot from this experience. If you work with kids, dont touch them at all, period. Its a sad world that we live in to say that but thats the way you need to be to protect yourself is what i learned because even a handshake can be misconstrued. Reporter martin initially faced 150 counts involving 14 boys. His attorney said prosecutors told him that 73 of the 95 outstanding counts are expected to be dismissed today. That means 22 counts remain. Now, martins first trial ended in august. The jury acquitted him of charges involving three students and then the jurors were split on the other counts. San francisco, bottom out at they might have hit 52. I saw 53 here on one of the hourly. 53, 66. Average is time of year, 52, 66. Record high, 82, 1929. Some of those 30s in the santa cruz mountain, scotts valley, Boulder Creek, ben lomond all found 30s even with the higher clouds to the north. Santa cruz mountains didnt have as much to work with as far as the high cloud. There were a lot more 30s.
