A warm tuesday although some of the warmest temperatures will be close to the coast. 28, santa rosa, 29 napa. 55. They were up to 63 half moon bay. Upper 40s to even 50 at livermore. There are mild conditions. But again that red flag wearning takes us until thursday morning. A lot of sunshine. It will be here a while. No sign of cooldown until the weekend. So far, things are looking good there. Not the case here at the bay bridge toll plaza. You can see that the backup is quite extensive all the way to the maze. But bonedry across much of the bay area and the potential for strong winds. A huge concern for the oakland Fire Department. I want to bring in deputy chief mark hoffman. Thank you for joining us. How much concern do the conditions cause you . Well, traditionally, this is the time of year where people can go out skiing and walk around in the rain with umbrellas. This is a little bit scary to me as a career firefighter. Its extremely dry. You mentioned it. The relative humidity is low. The fuel moisture levels are low. The temperatures are climbing up to the 70s and today predicted into thursday, gusty winds. We have what we call a red flag warning going out. That gets issued by the National Weather service. Its a concern to me as a career firefighter. What do you do differently here, your department . Well, you get into microclimates. Right now were monitoring the weather stations. The wind is not doing unusual. A little bit of a breeze going. We dont get the gusty winds. We have to continue to monitor that. We know the relative humidity is low. We know the fuel moisture is low. If we start to pick up on the wind part, i will put out some patrols to make sure that people are operating safely, that theres no open flame, people are using a weed eater that could generate a spark are not doing that. Well go into the same protection mode that we would normally do in the middle of summer or late summer. This is whats unusual. Its january. Reporter and sending extra crews to some of these house fires if you get them in the Oakland Hills . We have a dispatch level thats elevated than it would normally be, so we could call for resources from mutual aid much more quickly than normal. Reporter and whats the warning to the public . Happening today Community Members get their chance to speak in front of the Santa Rosa City council about the shooting death of andy lopez by a sheriffs deputy. This will be the first time the city council has welcomed public statements about the shooting of the 13yearold back in october. A planned City Council Meeting after the shooting had to be canceled because of safety concerns. Investigators say the sheriffs deputy shot lopez because he was holding a bb gun that looked like an Assault Rifle and he ignored orders to put it down. Now, todays meeting comes after a Sonoma County task force created after the lopez shooting met last night for the first time. Task force members are hoping this will unite the community. My goal is that we have a completely open dialogue, that were willing to compromise and that we realize we have an opportunity to do something truly, truly beneficial for Sonoma County. The task force meets again on january 26th. They will make recommendations to the county board of supervisors about a civil yub review board for officer involved shootings. 7 06. Police in East Palo Alto are investigating the deadly shooting of a 19yearold. Officers found the young man on dunbarton avenue and bell street just after 7 15 last night. Hes been identified as jose zamora. No arrests have been made. Any one who witnessed the shooting is asked to call police. Angry parents plan to be at a meeting tonight in la fayette. They are upset about a plan to install a cell phone tower on the campus of a catholic grammar school. Brian flores is joining us live from la fayette with more on this cell phone tower controversy. Reporter this topic was brought up during a city planning meeting last night. Plans are to billion are to build the cell phone tower and make it look like a bell tower. This issue of cell phones and cell phone towers has been a controversial topic for many years now. But this particular one, at t is the carrier requesting it be built. The company says it needs to fill a coverage gap around the area and meets all federal rules and regulations. During a meeting review, many, some even including doctors oppose the cell tower saying theres not enough proof its safe. At t will reportedly pay the school a fee in order to keep the cell tower at their property. But at this point, we dont know how much that is. Now, last nights meeting, if you are take it back out here live, more meetings are planned to address these concerns including one hosted by at t tonight. That meeting is scheduled at 6 30 at the Veterans Memorial building on mt. Diablo boulevard and eventually the city council will make an ultimate decision on this. Thats planned for next month. Scott wieners proposal would allow developers to build more units in a new building if they increase the percentage of Affordable Housing in their budget. Meanwhile theres growing controversy with the thousands of People Living on the streets. The Mayors Office recently set into motion a new plan to clean up one of the citys biggest trouble spot, the midmarket corridor. Many are complaining the city is pushing the homeless out of that area and into other San Francisco neighborhoods. We spoke to one woman who lives near the civic center b. A. R. T. Station. City leaders admit theyve not reduced the number of People Living on the streets of San Francisco. The number of homeless, the mayor says, has remained static, around 6,000 a year. The fbi will investigate the evidence in a Southern California trial involving former Police Officers and their connection to the beating death of a schizophrenic homeless man. Yesterday, two former Police Officers were acquitted in the killing of kellly thomas. Those former officers along with four others encountered thomas in july of 2011 while investigating a vandalism complaint. This Surveillance Video shows the officers repeatedly hitting and tasing thomas. The defense claims the officers were trying to restrain a violent man during an arrest. However, thomass parents are stunned by the verdict. It just isnt fair at all. They murdered my son and they get away with it. Coroners report concluded thomas died because he couldnt breathe due to chest complex as well as injuries to his head and chest. Charges will be dropped against a third officer in the case. The three other officers were not charged. 7 11. Sometime this week, Governor Brown is expected to declare officially a drought emergency in california. City Council Members are considering reactivating old wells and using recycled waste water for irrigating parks and schools. The city Council May Ask homeowners and businesses to cut water usage by 15 this spring. The water agency says 20 sp was one of the 2013 was one of the driest years in history. Dairy farmers in marin county say grazing fields are brown and they had to import hay as far away as oregon. A vacaville Church Pastor accused of planning a firebombing attack at his ex girlfriends home, hes due to face a judge today. This will be the First Court Appearance of mark lewis since he was arrested on suspicion of arson. Now, according to the vacaville reporter, lewis is accused of asking three of his followers to throw a molotov cocktail through the window of his ex girlfriends home. Lewis has denied any involvement in that firebombing. They are just trying to point the finger at me. Thats normal. It will be clear and come out. Lewiss girlfriend filed a restraining order against him before the attack. Police say her car window was also smashed on christmas day. 7 17. A wyoming lawmaker wants to bring back any executions by firing squad. Republican state senator bruce burn says current state law calls for using a gas chamber for executions but the state doesnt have one. So burns has proposed carrying out executions with a firing squad because they would cost significantly less than building a gas chamber. Wyoming has one inmate on death row. Schools are closed in one south texas town after the city cut off the water because of a dispute over the water bill. Now, this started last month when the city increased the water surcharge and the School District refused to pay that higher rate. Students came back to class yesterday. They found a note saying schools were closed until further notice. Parents are frustrated. They say the adults involved will need to grow up and start thinking about the children. There are still concerns about west virginias drinking water. About 35 of the people there have been cleared now to use their tap water this morning. Most of them are saying, they are skeptical about drinking that water. Last week, there was a chemical spill, a toxic spill from a Storage Facility on a nearby river. Authorities say the site had not been inspected in more than a year and it could still be days before everyone is clear to use the cleeshed to use the water. The rattling from an apparent ice quake still has people talking in wisconsin. Dennis olson walked outside his home one night last week after hearing a very loud noise. He didnt see anything strange until the next morning. Thats when he noticed a huge crack running 100 feet along his rural driveway. A boom. Another one, a boom. What the heck . Police, firefighters and the people who live in a Downtown Neighborhood are on the lookout after 13 fires set over the past several days. Janine de la vega joining us live from that neighborhood that has been hit and everybody around there is on high alert. Good morning, janine. Reporter good morning, dave. Well, so far no suspicious fires reported in this area this morning. That comes somewhat as a relief to people who live here but i just spoke to a next door neighbor who says shes not gonna hes not gonna feel at ease until this person is behind barts. You can see im standing here in front of one of the homes hit by the arsonist in the past few days. This is a block away from a fire station which shows you how bold the suspect is. People who live in the downtown region are wondering if the arsonist has gotten the message that they are watching out for him. So far, there have been 13 arsons in the same area over a fiveday period. Many people there are keeping their porch lights on and numerous residents have volunteered to stay up to be lookout patrols. They are looking for a man who police and fire officials are calling a person of interest. A sketch of him has been circulated around. It resell bells a man caught on resembles a man caught on Surveillance Video either setting the fires or walking near where some have broken up. Residents are hopeful what they are doing is helping. Keeping lights on. Ive been waking up in the middle of the night, listening to taking quick circles around here trying to keep everything safe. I think were in a pretty good neighborhood. We watch out for each other. Reporter well, whats been particularly disturbing to firefighters and residents is how brazen and determined this arsonist is. This person has hit the same places numerous times, authorities say. St. Johns church was hit two different days so was a drywall business. And in these pictures taken from Surveillance Video, it shows an arsonist set setting a fire on the setting a fire on the poefer of porch of a home. Authorities are hoping to catch this individual. Residents are being told not to confront the man, to just call 911. Coming up in the next hour of mornings on 2, again, you will hear from the next door neighbor of this house and the message that he has for this arsonist. Health Department Officials in Santa Clara County confirm two additional deaths yesterday. The ages, 61 and 62 years old. One death was reported in san mateo county. That persons age has not been released. Sonoma county reports the death of a 54yearold. That brings the total of bay area people who died from the flu now to 15 so far this season. This map shows where theyve occurred. County by county. The number of fatal cases in Santa Clara County rose to 4. San mateo and Sonoma County are each reporting two deadly cases of the flu. A Senior Living complex in santa rosa taking extreme actions to keep its residents healthy. The lodge at paulin creek closed its dining room. Canceled Group Activities and told residents to please stay in your rooms. Visitors are discouraged from coming to the complex. The quarantine follows several cases of the stomach flu, the norovirus and the threat of a flu outbreak. My personal opinion, its overkill. Its for the safety of the residents. So you cant blame the administration for their going along with the health department. The facility hasnt yet said how many cases of illness theyve had but they expect to resume normal operation bis the end of the weekend operation by the end of the week. Prosecutors say 22yearold Darnell Williams knocked on the door of the home and opened fire as soon as that door opened killing alicia careadine. Police say the shooting was in retaliation for the killing of jer rain davis earlier Jermaine Davis earlier that day. The suspect of that killing lived in that house. Friends of lee whethers biiii held this car weathersby held car wash so they can bury home. I hope this is a wakeup for a lot of people that they embrace their kids. Now, lees mother still needs to raise more than 1,000. A viewing for him is scheduled for tomorrow. The funeral will be held thursday in hoekd in oakland. Were seeing Surveillance Video of a shooting from an off duty Police Officer in the bayview district. It happened sunday morning at a chevron on gerald and bayshore boulevard. Police say it started after a female sergeant got into a fenderbender with another vehicle. They both pulled into the gas station to Exchange Information but then got into a heated argument that ended with the officer drying her gun. Police say she opened fire in selfdefense. The suspect punched the female sergeant in the face. The sergeant has been placed on paid administrative leave. The man who was shot was booked on several charges including battery on a Police Officer. 7 38. Happening today, the u. S. Senate is due to vote this afternoon on stalled legislation to restore the benefits to 1. 3 million long term unemployed americans. A week ago, the Senate Passed the legislation on a test vote. But since then, the senators have been haggling over the terms. Republicans want the 6. 4 billion cost offset by cutting the budget elsewhere. Benefits for the longterm unemployed expired on december 28th because congress couldnt agree on the terms of an extension before the holiday break. And tomorrow, tomorrow is the deadline for congress to pass a spending bill in order to avoid another government shutdown. The 1. 1 trillion spending bill contains dozens of tradeoffs between the democrats and republicans. The republicanled house is expected to pass the legislation even though Many Tea Party conservatives dont like it. Democrats are expected to make up the difference. They like that the bill includes new money to education preschoolers, also build high priority highway projects. California is leading the country when it comes to the number of Health Insurance enrollments. According to numbers released by the federal government. Almost 500,000 californians are enrolled in covered california. Another 460,000 are signing up for medical. Of those enrolled, 61 signed up for a silver plan and that is the second least expensive of the four tier plans. However, there is concern about the type of people signing up nationwide. It appears many young adults are not enrolling for healthcare under the new law. 24 of americans who signed up for coverage from Affordable Care act are in the 18 to 34 yearold age group. Thats significant because young adults are needed to offset the higher medical costs for older enrollees. Experts say as many as 40 need to sign up to keep premiums from rising. Authoritiers of longtime east bay congressman George Miller are sad this morning because hes retiring. For the past 40 years, George Miller has represented Contra Costa County. The 11th Congressional District goes from richmond to concord and pittsburgh and south to danville. The 68yearold congressman announced his retirement yesterday. During his 40 years in congress, miller has sponsored legislation on education, environmental, and labor issues and is one of the most liberal members of congress. Hes wellknown as a champion of the working class. Wealthy and powerful, special interests have always had plenty of friends in washington. I went to the congress and i stayed in the congress to stand up for the rest of us. Miller says he still has a lot he wants to accomplish during his last 11 months in congress including pushing through legislation to boost the federal minimum wage. After he leaves office, he wants to keep working on the same core issues but in a venue outside of congress. Now, mark desanya says he plans to enter the race for congressman millers seat. The 61yearold has been in the state Senate State Senate since 2008. He served on the Contra Costa County board of supervisors. Governor brown has appointed a committee to review the weather conditions. His Administration Says it is considering a formal declaration. This morning a former Florida Police captain is facing a seconddegree murder charge accused of shooting and killing a man who was texting in a movie theater. Witnesses say it began last night when the victim 43year old chad was texting his daughter. They say the former Police Captain began arguing with the man, then pummed out a handgun and shot him pulled out a handgun and shot him. Olsons wife was shot in the hand when she tried to stop him from shooting her husband. Its absolutely crazy that it would rise to this level of altercation over somebody texting in a movie theater. Police say ole son was shot once in the chest and died at the scene. Witnesses say the movie had not started yet and the previews were showing when the argument began. The pilot and first officer of a southwest flight that landed at the wrong airport have been removed from flying duties during an investigation into what happened. Southwest flight 4013 was supposed to land at Branson Airport in missouri sunday night but landed at a smaller airport seven miles away. No one was hurt. But the pilot had to slam on the brakes as the plane came dangerously close to a steep embankment at the end of a short runway. Passengers were bussed to the correct airport and put on other flights. Community members get their chance to speak in front of the Santa Rosa City council about the shooting death of andy lopez by a sheriffs deputy. This will be the first time the city council has welcomed public statements about the shooting of the 13yearold back in october. A planned City Council Meeting after the shooting was canceled because of safety concerns. Investigators say the sheriffs deputy shot lopez because he was holding a bb gun that looked like an Assault Rifle and ignored orders to put it down. Todays meeting comes after a Sonoma County task force created after the lopez shooting midwest last night for the first time met last night for the first time. They hope this will unite the community. My goal, have a completely open dialogue, that were willing to compromise and that we realize we have an opportunity to do something truly, truly beneficial. The task force meets on january 26th and will make recommendations to the county board of supervisors about a civilian review board for officerinvolved shootings. A man charged with vehicular manslaughter for hitting and killing an 86year old man in San Francisco last month has a court pay peerns today. The Court Appearance today. He hit the 86yearold man in a crosswalk in the Crocker Amazon neighborhood on december 31st. Boschetti was arrested and booked into jail on charges of vehicular manslaughter with gross negligence and also failure to stop at a stop sign. Police in East Palo Alto are investigating the deadly shooting of a 19yearold. Police found the young man on dunbarton avenue and bell street after 7 15 last night. Hes been identified as jose barbosa zamora. No arrests have been made as of yet. Any information, call police. Some angry parents plan to attend a meeting in la fayette. They are upset over a plan to install a cell phone tower on the campus of a catholic grammer school. Reporter parents are upset about this. This very topic was brought up during a la Fayette Council meeting. There are plans to discuss this further. There are plans to build it on top of a building, make it look like a belltower. Parents are especially concerned not knowing the effects of how close it is getting to kids. At t is the carrier requesting that the carrier be built off the church in la fayette. The cell tower would be located on top of a building in the southeast parking lot. The company says its needed to fill a coverage gap around the area and meets all federal rules and regulations and the design would blend in with the community. However, during a meeting last night, many parents of kids who attend the school oppose the cell tower, saying theres not enough proof that its safe, especially around kids. We tried to talk to school officials. We have been repeatedly denied. The father of the church said the purpose of the church is to be of service for people. At t will also reportedly pay the school an undisclosed fee in order to keep the cell tower at the property. This is not the endall say all. More meets are planned more meetings are planned. On thursday also at 6 30, another meeting is planned. This is hosted by the campaign for radiation free schools. Eric marr wants to make it harder for individuals to join together and buy up apartment buildings so they can convert them to tenancies in common. There is a growing controversy over how to deal with the thousands of street people in San Francisco. The Mayors Office recently started a new plan to clean up one of the citys biggest trouble spots, the mid market corridor. Everybody is on high alert. Reporter this arsonist usually hits between 2 00 and 6 00 a. M. So far this morning as well as yesterday morning, no suspicious fires have occurred in the neighborhood. This house here behind me was hit over the weekend. But neighbors say they wouldnt put it past the arsonist to come back because hes known to do that. People are wondering if hes gotten the message people are watching out for them. Many people are keeping their porch lights on and numerous residents have volunteered to be lookout patrols. They are look fogger a man who police are calling a person of interest. A sketch has been circulating around which resembles a man caught on surveillance, setting the fires. The resident who lives next door to one of the homes hit says the arsonist better watch out. The only time i feel at ease, once they get him and once we know hes behind bars. Thats it. Better turn himself in. If i catch him back here, i mean, it will be selfdefense. You are trying to start a house on fire. Reporter whats been particularly disturbing to firefighters and residents is how brazen and determined this arsonist is. Authorities say this person has hit the same places numerous times. St. Johns church was hit two different days so was a drywall business in the area and in these still pictures taken from a Surveillance Video, it shows an arsonist starting a fire. The video shows he came back three times to make sure the fire ignited. Patrols have been stepped up in the area. With the publics help, authorities are hoping to catch the individual. Four more people have now died from the flu here in the bay area. Health officials in Santa Clara County confirm two additional deaths, yesterday. The ages 61 and 62 years old. One death was also reported in san mateo county. That persons age has not been released as yet. Sonoma county reports the death of a 54yearold. Now, there have been 15 deaths on the flu so far this season in the bay area. This map you are looking at, shows where they have occurred county by county. The number of fatal cases in Santa Clara County rose to four. San mateo and Sonoma County each reporting two deadly cases of the flu. 8 35. A Senior Living complex in santa rosa is taking extreme measures to keep its residents healthy. The lodge at pollen creek has closed its dining room, canceled Group Activities and asked residents to remain in their rooms. People are discouraged from visiting the complex. The voluntary quarantine follows several cases of the stomach bug, norovirus and the threat of a flu outbreak. My personal opinion, its overkill. You know, its for the safety of the residents. So you cant blame the administration for their going along with the health department. The facility declined to give account of how many cases of illness theyve had. Expect to resume normal operations by the end of the week. A judge has ruled that an oak man will go go on trial for the murder will go on trial for the murder of 8yearold alicia karadine. Prosecutors say 22yearold daschle williams Darnell Williams knocked on the door of the house and opened fire as soon as the door opened. Two other children and a 63 yearold woman were hurt. The charges against a second suspect have been trop dropped. Family and friends of a 13 yearold oakland boy killed in a shooting new years eve are trying to raise money to pay for his funeral. The friends of Lee Weathersby iii held this car wash after founding out his hour doesnt have the money to bury him. He was shot and killed as he walked home from the boys and girls club on new years eve. Lees mother still needs to raise 1,000. The funeral will be held thursday at axful Gospel Church in oakland. Were seeing Surveillance Video from a shooting involving an offduty Police Officer at a chesh ron station on gerald avenue and chevron station on gerald avenue and bayshore boulevard. It started after an offduty female sergeant got into a fenderbender on 22 on 280. They got into a heated argument that ended with the officer drawing her gun. Police say she opened fire in selfdefense. While they were in conversation, the suspect punched the female sergeant in the face. Sergeant has been placed on paid administrative leave. The man who has shot was booked on several charges including patry on a Police Officer. 8 37. Happening today, the u. S. Senate due to vote on stalled legislation to restore benefits to 1. 3 million longterm unemployed americans. A week ago, the Senate Passed the legislation on a test vote. But since then, the senators have been haggling over the terms. Republicans want the 6. 4 billion cost offset by cutting the budget elsewhere. Benefits for the longterm unemployed expired december 28th because congress couldnt agree on the terms before the holiday break. Tomorrow is the deadline for congress to pass a spending bill to prevent another government shutdown. The 1. 3 trillion spending bill has dozens of tradeoffs between republicans and democrats. The republicanled house is expected to pass the legislation even though Many Tea Party conservatives oppose. Democrats are expected to make up the difference. They like that the bill includes new money for educating preschoolers and also building high priority highway projects. 8 38. Supporters of longtime east bay congressman George Miller are sad this morning because hes retiring. For the past 40 years, miller has represented Contra Costa County. The 11th congress am district goes from richmond to concord and pittsburgh and south to danville. The 68yearold congressman announced his reear time. During his retirement hes sponsored education, virl and abe loor issues during his environmental and labor issues during his time in congress. Wealthy and powerful, special interests have always had plenty of friends in washington. I went to the congress and i stayed in the congress to stand up for the rest of us. Miller says he still has a lot he wants to accomplish during his last 11 months in congress, including pushing through legislation to boost the federal minimum wage. After he receives office, he says he will continue to work on the same core issues but in a venue outside of congress. Mark desanyae plans to enter the race for millers seat. The 61yearold has been in the state senate since 2008. Before that he served in the assembly and on the Contra Costa County board of supervisors. In a statement, he says he wants to help end the gridlock and brinksmanship in washington. Several bay area state lawmakers introduced legislation for protecting Senior Citizens in assisted living facilities. This is all a reaction to a Castro Valley care home where 19 of the residents were abandoned when a state agency closed it down last october. State senator mark leno is among those who drafted legislation. His proposal would ban you why admissions to ban new admissions. Medical marijuana supporters are collecting signatures on petitions to keep the dispensaries open in san jose. Now, the city has taken steps to limit the number of locations of marijuana dispensaries. But supporters want at least 50 stores in san jose. They also want the only limit to be no new dispensaries placed within a thousand feet of schools. The cost of importing feed could cause dairy prices to go up 20 cents for a halfgollen of milk. If the dry weather conditions, some small warms could go out farms could go out of business. Witnesses say it began last night when the victim, 43year old chad olson was texting his daughter. They say the former Police Captain began to argue with olson, then pulled out a handgun and shot him. Olson was shot in the chest and died at the scene. I cant believe people would bring arpistol, a gun to a movie bring a pistol, a gun to a movie and shoot one another over popcorn or even a cell phone. Witnesses say the movie had not started and the previews were rolling when the argument began. School sons wife olsons wife was shot in the hand while trying to prevent her husband from being shot. Everyone seems to be doing selfies. At a kentucky prison there is an investigation after several inmates smuggled in cell phones and posted selfportraits on facebook and instagram. Two inmates can be seen with a fistful of cash. I had to look up selfie. I didnt know what it referred to. Its strange for me to say selfie, let alone something a teen made up. Prison guards confiscated the cell phones. The inmates involved face several charges on top of the long drug sentences they were already serving.
