Police are at a Senior Citizens apartment complex where they say a Security Guard opened fire on a man who was trying to break into a car. Ktvus brian flores is at is live at the scene and who police are still looking for. Good morning, brian. Reporter good morning. The cruisers left just about 30 minutes ago. Still remnants from the shooting or burglary that happened roughly around 1 30. We understand the Security Guard that opened fire on the suspects is being held for questioning by San Jose Police and hes cooperating. Police say this happened just before 1 30 this morning off coleman road near the almaden expressway near a Senior Housing housing complex. Police say he was on his way home from work when he noticed people trying to break into the car. When the Security Guard confronted one of the suspects, that suspect ran into another waiting car. That car tried to run over the Security Guard. But for some reason it stopped a short distance away. It looked like the man was pulling something out of his waistband and thats when the Security Guard opened fire. Not unusual. There are companies that allow the Security Guards to carry guns. I dont know the particular company. But whatever their policies and procedures are, in certain cases they are allowed to carry. Reporter the suspect was found a block away lying on the ground from at least one gunshot wound away from the car. San jose police say they are questioning the Security Guard and figuring out if he will face charges. Its unclear if he its unclear if he works here at the senior apartment complex. It doesnt appear so. But police say the suspect once hes released will be booked into santa clara jail. Well also learning that the getaway vehicle was a stolen car reported out of san jose. There are no other injuries reported here from the apartment complex. Were live here in san jose, brian flores, ktvu channel 2 news. In vallejo, a suspected car thief is facing additional charges after he allegedly put his young daughter in danger while trying to avoid police. A woman called police to bay court, telling them a neighbor stole her truck during some sort of dispute. Officers went to the suspects home. They used grash grenades, searched the man but could to the find grash grenade flash grenades but could not find the mom. He was hiding with his young daughter. He was arrested. The young daughter is in the care of relatives. A sitin at city hall ended with 20 people being arrested. Most of the group were city college of San Francisco students. They were trying to get a meeting with mayor lee. They are hoping he would reverse a decision to withwithdraw the schools withdraw the schools accreditation. The mayor had them arrested. We didnt want to get arrested. It would have been much easier if the mayor had come with us. A huge sierra wildfire outside of yosemite. Its getting bigger by the hour. Its more than doubled in size. Its burning east of groveland and highway 120 has within has been shut down. Thats the main route connecting the bay area to yosemite. Look at this dramatic video. The Forest Service says the fire has burned more than 15 square miles. Its 0 contained. Its threatening 25 homes. There is still a big fire danger here at home. Firefighters across the bay area remain on high alert this morning. Weve been battling the wind here. Its whipping my hair around. Theres also high fire danger because of the dry hills behind me, they are just golden and hills are particularly dangerous as well because once they spark, fire traveled quickly up the hills. Combine that with the dry lightning. All of those factors are combining to make for high fire danger across the state and in the bay area. Some of those factors happened last night. Let me show you video of a grass fire that shut dune highway 4. It sparked around 9 30. By early this morning, calfire cleared the scene after 3 acres had charred. You can see a car engulfed in flames. The chp says its what sparks the grass on the hillside. There are no reports of injuries. They are still investigating what caused the initial fire. We were set up for a busy fire season because of the dry weather. The latest report says lightning has sparked 40 fires nation side. Now, in a 24hour period, there were 3400 strikes. The red flag warning for the bay area includes the north bay valleys and hills. As we mentioned, theres a risk of thunderstorms with dry lightning. That red flag warning going on throughout the day. Other parts of the bay area, just very dry and windy, which puts them at high fire danger. For now, live mere martinez, katie utehs, ktvu channel 2 news. 7 09. San Francisco Police are warning about a new tactic by thieves to scam cell phone owners. Police say the most recent scheme involves at least two people, one of the thieves they will steal a phone from the victim and then run off. The second person will act like a Good Samaritan and chase after the suspect. The police say onces phone is tracked down. The suspect will give it back. But they are gonna ask for a cash reward in return. San franciscos night court is expanding into the south of market district. The Night Court Program resolves low level cases like graffiti and petty theft. A set of a judge community leaders, pastors of churches, Business Leaders listen to the charges and decide on the punishment that can include cleaning up for community service. The city saved 330,000 by using night court instead of criminal court for those cases last year. The federal government is making progress on automatically identifying people by their faces. The system would pair computers with video cameras to scan crowds. Anyone on a Government Watch list would be flagged. The department of Homeland Security says this system would be especially useful with places where theres large crowds. Happening today in one hour, bicyclists will gather at a San Francisco intersection for a rally promoting safety. It will be held at folsom and 6th street. The scene of a deadly bike accident last week. A truck hit and killed a 24 yearold woman who just turned her bike into the busy intersection. The truck driver who hit her stayed on the scene and was not cited. This morning, the bicyclist will push for safer roads. And San Francisco and berkeley could soon be home to an electric bikesharing program, similar to programs to pedal power bikes. The bikes would have motors to get up steel hills or carry heavy loads. 90 bikes would be installed at 25 city car stations after the first of the year. They would be available to members of city car share. But would cost at least 40 less than borrowing a car. All right. Police on the peninsula made a horrifying discovery. He was convicted on espionage charges for leaking thousands of documents to wikileaks. Supporters of him are holding a vigil outside of fort meade. I contacted them. I think people are just avoiding 101 and now 85 is getting slow as well. When one freeway gets busy, people flock to the other one. Thats exactly what we see happening here in the south bay. We also see traffic that will be busy at the bay bridge toll plaza. As i told you, westbound 92, we also had an earlier accident in hayward, southbound 80 at 92. And investigation is underway into a deadly shooting in East Palo Alto, the victim was found slumped over the Steering Wheel of a car. Alex savidge is at the scene to tell us how police first learned about the shooting. Good morning, alex. Police say the 19yearold man shot to death late last night was from East Palo Alto but did live in this area. The teenager was sitting in the drivers seat of the car. [audio difficulties] were losing our signal there with alex savidge telling us more about a deadly shooting in East Palo Alto. Well try to get our connection back with alex in a moment and reconnect with him. Meanwhile, we have new information about a shooting in san jose where one man was killed and three others injured. It happened monday night at a restaurant in a strip mall on alum rock between capital avenue and white road. A man who lives across the street is now telling us that that area has a history of violence. He says 12 years ago, someone was shot and killed at a different restaurant white next door. Police have not released the name of the victim in mondays shooting. 7 34. Big earthquake hit mexico city this morning. But so far, theres no word of significant injuries or damage. It was a 6. 1 magnitude quake. It hit about 90 minutes ago. It was centered off the Southern Coast but it shook buildings in mexico city. Thats 250 miles away. It hit at the height of the morning rush hour. Several Office Buildings were evacuated. Emergency workers were out there checking for injuries and damage. Back here at home, the huge rim fire on the outskirts of yosemite, its more than doubled in size. This one is getting bigger every hour. Its burning east of groveland. It forced the closing of highway 20, the main route linking the bay area to yosemite. Tara moriarty is in our studio now with some new information about whats going on at those fire lines. Tara . Reporter well, this fire is out of control. Crews say the potential for it to spread farther is very likely. The rim fire has jumped roads and even a river. We have zero containment. The fire is in a very difficult spot for crews to reach. Thats really made it a huge challenge for firefighters. More than 10,000 acres have burned. So far, at least two homes have been destroy. 2500 homes are threatened. There is a high concern for firefighters safety, spoke exposure smoke expose sure has been an exposure has been an issue. The fire is not affecting Yosemite National park itself. But many tourists are now turning around and going back home. Under evacuation orders, 200 seniors left the camp there yesterday. Vacationers have left san jose family camp and the Berkeley Tuolumne camp. A childrens summer camp has closed as well. Investigators are trying to figure out what caused the fire. Park Officials Say take 140 to get out of yosemite and that will add about a halfhour to your commute. Tori, dave, back to you. [audio] are helping out in the fire lines near security. The guardsmen from the 29th rescue wing left Moffett Field to join the growing firefighting effort. Other members are helping battle the wildfires burning in other parts of california. Theyve done so by planning ahead, being resourceful resilient, using common sense and i expect that to be the case at this time as well. Another busy area will be the 880 92 interchange in hayward. The most congested dates and times will be the morning and the afternoon commutes august 29th and the 30th and the weekend from 11 00 in the morning to 6 00 at night and, of course, monday afternoon as people come back from their holiday travels. At a news briefing this afternoon, Law Enforcement and bridge administrators will be talking a lot more to give us information about Public Safety during the time that bridge is closed. And while b. Is planning around the Clock Service for labor day weekend, the San Francisco bay ferry will also be unking extra boats will be running extra boats, between San Francisco and oakland, alameda, and vallejo. The ferry managers will outline their plan this afternoon, on friday. There have been several missteps in connection to the bay bridge. The latest is the bridge opening ceremony. Plans for the multimillion dollar bash were canceled. Now the chronicle is reporting that Governor Brown will not take part in the scaleddown, chaincutting ceremony on labor day weekend. We want to go back to the investigation into a deadly overnight shooting in East Palo Alto. Alex savidge is at the scene, once again, to tell us more about the shooting. Alex . Reporter good morning, tori. Police say this 19yearold man who was shot to death late last night was from East Palo Alto but didnt live in this area. For whatever reason he was sitting in the drivers seat of the car parked right here last night when the shooter approached. You can see the shattered glass still on the ground. The victim was rushed to the hospital in Critical Condition but police say he died there. The shooting was just after 10 00 last night on the 2500 block of emmett way near cavanaugh drive. The shot spotter system detected gunfire and picked up a total of eight shots. Police responded right away and found the teenager slumped over in the car. It was clear he had been shot. Police are not sure if the shooter walked up to the victim and opened fire on the car or if this was a driveby. As of right now, detectives cant say why this young man was targeted. We have no motive, no suspect information and we just got the detectives out here right now. Well doing a neighborhood canvass. Hopefully some of those questions can be answered. Reporter police have not released the nail of the young man shot to name of the young man shot to death last night. Police have spent hours nouking on doors in the neighborhood looking for any witnesses who might help lead them to the killer. San jose Police Still Searching for suspects after this mornings attempted car breakin at a seepier citizens Senior Citizens apartment complex. Anoff duty Security Guard fired shots and hit one of the suspects. Brian flores is live. That Security Guard is being held for questioning. Reporter police sea thats procedure to a shooting whether the shooting was justified. Police say the Security Guard opened fire as he saw suspects trying to steal his dads car. Apparently his dad lives here. The Security Guard is being held at San Jose PoliceDepartment Headquarters and being questioned. We understand that hes cooperating with police this morning. What police are saying this happened just before 1 30 this morning off coleman road near the almaden expressway. Police say the Security Guard was on his way home from work early this morning when he noticed four suspects try to break into his dads car. He confronted one of the suspects but that suspect was able to get away in another waiting car. That car according to police, almost hit the Security Guard. Moments later the car stopped just a few feet away. And then one of the consider burglars got out and the Security Guard told police he was about to pull something from his waistband and thats when the Security Guard opened fire with his gun. Police are now talking about whether the Security Guards are allowed to carry. If he felt he was in danger of his life, he probably was within his rights. Reporter the suspect was actually found on the ground about a block away with a gunshot wound. Police do say the suspect, once hes released from the hospital will be booked into Santa Clara County jail. As for the Security Guard, there is a pending District Attorney review about chaurls. Police say he endangered his young daughter while trying to get away from the police. A woman called police to bay court yesterday, told them that a neighbor stole her truck. Police went to the suspects home, theyuressed flash grenades. They search grash anyone grades. They flash grenades. They searched the house but didnt find the man. They searched the crawlspace. They say he was hiding out with his 5yearold daughter. He was arrested on car burglary and child endangerment charges. The daughter is in the care of relatives. About two dozen proefers were protesters were arrested in a protest aiminged at ailed at saving city college of San Francisco. This is video of some people being cited by police. The protesters are mostly students from city college of San Francisco. Around 5 00 p. M. Yesterday, they started a sit in right outside of mayor ed lees office door. A grass fire spread quickly last night and shut down highway 4. It sparked around 9 30 last night. By early this morning, calfire cleared the scene near Franklin Canyon road after about 3 acres charred. You can see a car engulfed in flames. The chp says it sparked the dry hill on the grass side. They are still investigating the cause of the fire. A record dry winter et set us up for this. The agencys latest report says lightning has sparked 40 new fires statewide. In a recent 24hour period, there were 3400 strikes. The red flag warning for area is for the north bay valleys and hills. Thats where the risk of dry lightning is that could ignite a fire. A dog in San Francisco that fell 40 feet out of a window still recovering in a pet hospital and the dogs owner says someone shot the dog with a pellet gun. Now, john gunten is the owner. Thats his dog, freddy. While freddy is being treated for injuries for his helps and pelvis. The vet called to say a pellet was found in his leg. The owner thinks his dog was shot intentionally and wants the police to investigate. Somebody hurt my dog on purpose. Like what the hell is that . Who the hell does that . Well, the dogs recovery is expected to take at least ten weeks. Police are searching for witnesses. The owner says he thinks someone in the area might be using animals for target practice. Investigators say alleged kidnapper, james lee dimaggio, used a timer to burn down his house in rural San Diego County earlier this month. Reporter i should let you know that neighbors on this street heard this gunfire last night and a lot of them are telling me that they are disturbed by this killing that hammed very close to where they live. The teenager in this case shot was sitting in the drivers seat of a car parked right in right in this spot when someone came up and opened fire. You can see some shattered glass on the ground, all evidence of this deadly shooting. Police are trying to figure out who is responsible. The victim was rushed to the hospital in Critical Condition. A 19yearold young man. Police say he died at the hospital earlier this morning. The shooting was around 10 00 last night in the 2500 block of emmett way near cavanaugh drive. The departments shot spotter system detected gunfire in the area. It picked up a total of eight shots. Police responded and they found this teenager slumped over in the car and it was clear that he had been shot. Detectives cant say at this point, why this young man was targeted. But i talked to one woman who lives nearby. She says that kind of this kind of violence is rare. We were praying that the young man made it. It was crazy. It doesnt happen on the street. It doesnt happen in this neighborhood. Homicide detectives were out here until early in the neighborhood, knocking on doors trying to find witnesses who can be helpful in the investigation and hopefully lead them to the killer. Police have not released the nail of this 19yearold man shot name of this 19year old man shot last night. A sergeant said he was from East Palo Alto. He didnt live in this immediate area. The huge rim fire on the outskirts of yosemite is getting bigger every hour. Its burning east of groveland and its forced the closure of highway 120 which is the main route linking the bay area to yosemite. We just received word this fire has grown to 16,000 acres last night, it was at about 10,000 acres. This is exactly what fire officials had predicted. Crews are just being pushed to the brink. Later the fire is expected to swallow more trees and brush. Conditions are tough. High temperatures and low humidity. The fire is difficult to reach. The terrain is steep. Parts are extremely smoky. The u. S. Forest service says theres 0 containment. This video shows just how powerful the flames are. Flames have been skipping across rows and even a roads and even a river. Two homes have been destroyed. 2500 others are threatened. Turn it over to god. Theres nothing you can do. Totally helpless. My daughter has a home up there, and reportedly, her place burned up. But many touristsrying to tourists trying to get there are turning around and going home. Investigators are trying to figure out what caused the fire which broke out saturday. You may recall a fallen tree killed a young counselor from that same camp last month. The 21yearold was a student at uc santa cruz. A man from antioch badly injured in a hitandrun may never walk around. 47yearold Richard Fletcher suffered a broken back and a severely damaged final cord last friday. He was riding a bicycle when motorcycle when police say a car hit him from behind on highway 24 in oakland. Hes married e has three children. Hes the only bred winner of the family. Were a strong unit. Were gonna get through it. Were not defeated by it. Were struggling. We need a lot of help. The hitandrun driver has been identified as 35yearold david elkiro of concord. Investigators say he got into an altercation with a chp officer after the crash and was wounded by the police officer. Hes now facing possible charges including attempted murder. U. S. Marshals are working with Oakland Police trying to clean the streets of oakland of violent cles. The joint operation has captured 25 highrisk felons. Four were wanted for homicide. The arrests were announced by belinda hague, the u. S. Attorney. She says the level of violence in the streets should not be tolerated. Last weekend alone, 12 people were shot in oakland. Three were killed. One of the injured said he doesnt think the problem can be fixed. Maybe if they put more patrol on foot, my it might work out a lot better, keep us safer. This offduty Security Guard who does not work at the senior complex was on his way home when he noticed four suspects trying to break in his dads car. His dad does live here. The Security Guard confronted one of the suspects. He was able to get away into another waiting car. That car according to police, almost hit the Security Guard as it tried to speed away. Moments later, the car stopped an one of the alleged car burglars got out of the rear side of the door and then it looked like the suspect was trying to pull something from his waistband and thats when the Security Guard, fearing for his life, pulled out his gun. If he felt he was in safety or his life, he was probably well within his rights to fire. Reporter the car the suspects were in was found nearby. The suspect was found on the ground a block away with a gunshot wound taken to a nearby hospital with nonlife threatening injuries. Police say once hes released from the hospital. He will then be booked into Santa Clara County jail. The car the suspects were in was stolen from san jose. This Morning Police are looking for the other three suspects this morning.
