anywhere from 60s to 100s. let's go back to the desk. time 7:01. lots to tell you about this morning. this fourth of july holiday is day four of the bart strike. a marathon negotiation session ended last night, but still no deal. workers are back out there on the picket line, but negotiators will go back to the bargaining table this morning at 11:00 a.m. we continue our live team coverage for you have the strike. look at the traffic first. are we getting any breaks this morning? >> traffic is going to be moving along pretty well in most areas. we're looking at the freeway here. we don't see a lot going on at all. just the fact that most people have the day off really helping us out for the morning commute. we're also looking at some of the bridges getting across and into san francisco, southbound 101 the traffic is light. this is a look at san jose northbound 101 traffic. that's moving along nicely up to the santa clara valley. we continue our team coverage with sarah over the strike. >>reporter: they're just as frustrated about not going back to work as the public is. right now they're on a little break here. talks lasted for nearly 10 hours yesterday. the two sides broke for dinner, but otherwise they were trying to hammer out a deal and failed to reach an agreement. they began at 1:00 yesterday afternoon and ended things at 11:00 last night. the union negotiator sounded quite optimistic after tuesday's talks, but after last night, hopes faded. >> we really don't have any comment, you guys. we're working very hard with the mediator. we're going to be back here tomorrow morning very early. >> we'll pick up and get more details on the latest on all of that. time 7:04. if you happen to be commuting today, bart is cutting back on the number of charter buses they have out there. the buses started arriving just about an hour ago, and stations at walnut creek, dublin, pleasanttown and others, three buses are being sent to each location. they're going to leave for san francisco by 8:00 this morning. the return trips, they're scheduled between four and 6 p.m. unlike the first three days of the strike, san francisco bay ferry and the blue and gold fleet will not be providing extra service today. today's service is being scaled back because it is the fourth of july. tomorrow regular weekday ferry service will be available for all of those routes. ac transit is adding buses today. many people do have the day off, but there are a lot of independence day celebrations around the bay area, and coming up we're going to go live to oakland to here how transit will be helping out. extra trains and shuttles will be added for tonight's fireworks celebration along the waterfront. they'll operate on sunday schedules for this holiday, but there will be additional trains tonight for people heading to independence night events. the crews in san francisco busy setting up for the bay fourth of july fireworks show tonight. the fireworks will be launched from a barge. they're promising a spectacular display with new colors and combinations. the best place to see it all are on the city piers, and if you're going get there early. the fireworks show will begin at 9:30. here's other fireworks shows happening tonight. there will be one after tonight's san jose giants game. the county fair will set off fireworks at 9:30. more shows are listed on our channel 2 website, ktvu.com and look for the fourth of july tab on the home page. a new twist in the america's cup saga. this could possibly put the entire event on the san francisco bay in jeopardy. the director is threatening to cancel the race unless his safety recommendations are withheld. those recommendations stem from the death of a british sailor named andrew bart simpson, who died when his racing boat cap sized back in may while he was training for the america's cup. a bill holiday crowd is expected for the america's cup, festivities beginning at noon with a ribbon cutting. the opening ceremony begins at 3:00 at the pavilion. it is going to feature the crews of all four times, including depending champions. chp warning everybody, drive safe and sober as you celebrate the fourth of july. police will be out in force on bay area highways throughout the entire holiday weekend. there will be check points on several bay area highways and roads. time 7:07. let's go look at the roads for the fourth of july. >> right now things looking pretty good around the bay area. i want to mention that this day on the fourth of july usually we don't have any traffic at all. strike or not, we're looking good on interstate 880. there is a game at the coliseum, the a's versus the cubs, and traffic will be a little heavier for that event. moving along and taking a look at toll plaza, absolutely empty and no problems driving into san francisco right now. in pleasant hill, word of a new crash there. we'll find out more and have more details next time. a very good morning. a lot of tropical clouds makes for a beautiful sunrise and also adds a lot of humidity. if you're by the coast it doesn't matter because you probably have fog or cool temperatures, but inland a warm start for day game, but a lot of rain heading from the deep south into cincinnati. they'll say they'll play, i was reading on twitter, but we'll see. it looks like a lot of rain. a little shower activity here. lake county it's fallen apart. there's a lot of cloud cover over us, and some of it stretches from the bay area over sacramento. fog, sun, clouds, hot and muggy inland. a few isolated showers negotiators did not reach an agreement last night despite a 10 hour bargaining session. it all ended at 11:00 last night. the two sides are planning to meet again in a few hours at 11:00 this morning. union negotiators had expressed optimism after talks, but then when she left negotiations last night she had very little to say except that they're working hard with the mediator and are going to be back at it this morning. also last night management sent out a news release in which it blamed the union for not reaching a deal. meanwhile, directors are going to meet for a closed door session at 11:00 this morning, and that is the same time the talks are set to go back to the table a few blocks away also in oakland. time 7:11. hot, dry weather. steve's telling you about it. that's why a lot of bay areas have banned fireworks. safety issues and how the police are cracking down. also more on the bart strike. it has a silver lining for some people in the bay area. you kids should count yourselves lucky. we didn't have u-verse back in my day. you couldn't just... guys... there you are. you know you couldn't just pause a show in one room, then... where was i... you couldn't pause a there's one silver lining for those living near the traction. a rare and welcome break who describe the traction as very noisy. normally the traction that rumble across from 4 a.m. until around meatballs left on a san francisco sidewalk. we talked to the vet who's treating the dog called oscar. what did he say, katie? >>reporter: she said that oscar may pull through. it's heartbreaking to see the little guy. he's been in an oxygen tank and is being treated here in san francisco's inner sunset neighborhood. there may be multiple cases, and the dog is being treated. again, his name is oscar. he's a beloved pet. you can see oscar's in an oxygen cage and heavily sedated. the poisoning happened yesterday morning during a walk in the twin peaks neighborhood around 8:30 after he left a meatball left alongside the road. he started having seizures and his owners rushed him to the vet hospital. >> we're very suspicious that it was poison. >>reporter: oscar's been having seizures. the owner went back and picked up meatballs that had been scattered along the sidewalks there. she wanted to make sure it didn't happen to another dog. i spoke to another dog owner who lives in twin peaks. she tells me that while this is very upsetting, she's not surprised that it happened. 7:17. campus radio station may stage an on air tribute for a student killed in a bizarre accident near yosemite. this is a popular jewish summer camp. yesterday morning a tree fell down onto a camp fire circle right near the dining hall and killed her and injured several adult staffers. she was entering her senior year at uc santa cruz and studied environmental conservation and also also involved with the campus radio station. >> you don't always really know how much time somebody has left, and she's definitely one of the people i wish i could have gotten to know more. >> again, they're considering a tribute to her on the radio station. her parents both worked in the berkley area. the week long heat wave has claimed its first victim. a body of a 77-year-old was found in his home on the floor. an autopsy found that he died from heat and other medical conditions. a woman from toledo doe ohio had to be rescued from the huge sinkhole after it swallowed her vehicle. the woman's chevy malibu landed about 10 feet below ground. rescuers had to lower down a ladder, and she was actually able to climb out of the hole. she wasn't hurt, pretty amazing. they used a crane to get the car out. they're blaming a water main break beneath the road. more earthquake deaths being report in the indonesia. a 6.1 earthquake rocked the province. police and volunteers are searching through debris for a dozen people still believed missing. 275 people were hurt and more than 4,000 homes and four of the bart strike. we'll find out what's happening on the picket lines and bargaining table on this fourth of july holiday. >> still no bart service today. some transportation agencies are scaling back services, but one is beefing up services today, and the reasons why. we're live in the south bay where police are going to be patrolling and looking for people who are setting off illegal fireworks. you'll hear from one person who doesn't agree with all the enforcement when we continue. the two sides are planning to meet again at 11, but no agreement was reached after 10 hours last night. we'll have more on the strike at the top of the hour. the board of directors also having a special closed-door session at 11 this morning. that is the same time negotiations in the bart strike are set to resume just a few blocks away. time 7:30. with no bart service today, plus the fourth of july, some agencies are scaling back on transit services, but if you need to get around, there's one agency that's actually beefing up service. a c transit will be running more buses, right? >> that's right, dave. good morning. take a look around real quick. this pales this comparison to what it was early this week monday through wednesday packed with people. today there's barely anyone going on the buses. still, people need to go to work today. you mentioned the fact that there's a lot of events going on. there's fireworks and baseball games. you have america's cup as well. if you need public transportation, this is one of the few agencies beefing up service today. they'll be adding 11 extra buses to run on a sunday schedule today. the frequency of how often the buss run will depend. n and l line runs from mcarthur to the temporary terminal, then the f line runs along shadick avenue. there's also a safety measure. we spoke with riders who said they appreciate the extra buses, but hope that the bart strike comes to an end soon. >> we have to get back and forth to work. the bus and ferry, it's a little slow, but you've got to do it. >>reporter: the a line goes from market street in san francisco to berkley and richmond will add three buses. depending how the strike goes today and possibly the next day, ac says they may be adding services on saturday and sunday, but we'll see. we're live in oakland, ktvu channel 2 news. traffic lighter on this fourth of july holiday after what many called the worst evening commute since the strike began monday. this is what it looked like downtown. cars were bumper-to-bumper backed up as far as you could see. drivers say it took as long as an hour just to go maybe five blocks. many other commuters in san francisco had to wait an hour, maybe even longer, to get on a bus that was already jam- packed, trying to get across the bay bridge back to the east bay. if the bart strike goes on, changes are being considered to try to cut down on costs, and one option is already the norm at several u.s. cities, including new orleans and austin, texas. coming up at 7:45, what the option is and why it may not necessarily prevent another bart strike. in san jose a late night fire damaged at least two businesses. several people saw smoke coming from a commercial building on north king road. investigators had to cut a hole through a metal door to get to the flames. the cause is still under investigation. new this morning, the dangers of fireworks may have already started a fire in the bay area. ktvu viewer, paul anthony, took these pictures of a small grass fire along highway 15 this morning. a dispatcher told us that the cause may be fireworks. crews put out the flame quickly, and no one was hurt. that area is considered a high threat zone because it's dangerously dry out there. that fire appears to be an example of how fast flames can spread when it's this hot. fireworks are banned in most cities around the bay area. police in the south bay are really talking about this issue. >>reporter: they definitely are. this is the only city where fireworks are allowed in santa clara county. they're going to be very busy today. i want to show you this design where it says zero-tolerance policy against setting off illegal fireworks. you must be a resident and show proof of id to buy them. these type don't leave the ground or explode, and it's illegal to launch them in the air and against the law to buy them here and take them into another city where it's illegal. police and santa clara police will be out patrolling and so will various fire departments. one person we spoke to felt that all the enforcement is overkill. >> it's not fun any more because they don't go boom anymore because they regulate them so much. they shouldn't. >>reporter: fire officials say out of the majority of injuries on this holiday, most of the victims are children between the ages of 5-14. there are extra patrols to find out where fireworks are being set off illegally. if you get caught, you can get a misdemeanor and there is actually a fine up to $1,000. you could also be cited. it just depends on the circumstances of how expensive that fine is going to be. it could be as low as $250. again, $1,000 is pretty expensive. here are some of the events happening this morning for the fourth of july. there were almost 9,000 fireworks related injuries treated around the country last year. 40% of those hurt were under the age of 15, and one in four of those injuries were children who were just watching other people light the fireworks for the holidays. police hope new surveillance photos will lead to an arrest of an armed robber. he drove away, and if you have any information, call police. police chased a car thought to be involved in a shooting into oakland sunday. officers did call off the chase, but then the car rammed through a church minutes after a prayer meeting had let out. >> we're human, and when we hear squeaking and breaking it offends us and we're afraid. >> three other cars and a limousine have also crashed into the church, so pastors are asking for a traffic signal to protect the church. it's not clear when it's going to be able to reopen. time now 7:38. let's check in with is a city that have turned over the public transportation services to corporation in an effort to save money. however, transportation experts say a move like that would not prevent a future bart strike. they're still trying to come to an agreement on their contract, and we came across one man who said you'd be happy to take their jobs. one sign said, hire me instead. he said he would be more in just hours after the president was forced out of office by the egyptian military. >>reporter: the square was quite the place to be. the crowd erupt in the cheers and the sky lit with fireworks. on the streets people honking horns, waving flags celebrating, dancing. even the police force, which i've never seen dance before, were dancing with the people. today the new president of egypt, mansour, has become the new president. he has quite the task in front of him. he has two key things that he has to tackle right away. in the meantime he also has to deal with a new constitution. the old one has been suspended. he's got to get a new one in, as well as presidential elections and parliamentary elections. he's going to be quite the busy man. other people say that this is illegitimate, and they say they'll not go home until they see him reinstated, something unlikely. this is going to be a challenge for the new government to bring back the brotherhood and make and include the government. they cannot move forward unless they bring them in. we're learning about a program at the u.s. postal service to keep tabs on every piece of mail in the united states. they photograph the outside of every piece of mail, then send the images to government agencies that ask for the information. it's called the mail isolation controlled and tracking program. it was created after the anthrax attacks in 2001 that killed five people, including two postal workers. the program was revealed last month when the fbi cited it in its investigation. the president of bolivia is back home from russia after getting caught in the manhunt for edward snowedden. the plane carrying him was first diverted to austria. they searched his plane looking for snowedden, who was not onboard. he says the countries including france and italy refused to allow his plane to enter their aerospace. there was a protest outside the french embassy. snowedden right now is still at the airport in moscow. he has applied for asylum in several countries. a group of conservative bloggers is calling for a boycott of facebook. one conservative blogger who maintains a number of facebook pages says she's been kicked off the site several times because of what she's written. the freedom from facebook protests calls on conservatives not to use the website at all today. moviemaker george lucas will receive the national medal of arts at the white house next week. the creator of star wars, indiana jones is being honored for contributions to the movie industry. the white house says he combines the art of story telling with bound less imagination and cutting edge techniques. major league baseball has hired a legal heavy hitter against the city of san jose. an antitrust case is being pursued. he prosecuted oliver north and also defended lance armstrong. last month san jose sued major league baseball claiming it was blocking the oakland a's from relocating to the south bay. the city of berkley is defending its largest medical marijuana dispensary against a crack down by the federal government and has filed a claim to block them from seizing property used by berkley patients group. in the claim the city says it would suffer a huge economic loss if it closed. the mayor says the government is wasting resources and harassing law-abiding businesses. today marks the 40th anniversary of the first broadcast from san francisco's tower. it transmits signals for radio and television including ktvu. the fbi and homeland security use it as a communication tower, and the former mayor joined city leaders to mark the milestone. they began transmitting july 4th, 1973, and ken wayne is going to take us on a special tour of one of the city's most visible icons tonight on the 10:00 news. just in time for the fourth of july and independence day, the statue of liberty has reopened for advice terse. we're going to show you brand new video. visitors arriving this morning for the first time since it for free. shows will be lighting up bay area skies tonight. richmond celebrated early with that beautifulplay last night. organizers say the bay area based company produced the show to live music from the symphony. more than 5,000 people attended. here are some events happening this morning. a parade in downtown starts at 10:00 a.m. the red, white and blue parade in the rose garden will open on labor day as scheduled. on monday the toll bridge program oversight committee will meet behind closed doors in sacramento. the official word to the public is supposed to come wednesday, july 10. a lot of repair work remains to be done on some of those faulty bolts on the new bay bridge. authorities may decide to finish that work after it opens to traffic. let's head right out for a lot of people having the day off today. no major problems on the other side in san francisco. take a live look at northbound 101 approaching the 80 split. also in san jose 101 looks good. a lot of cloud cover over us. there are sun breaks and pretty good buildups of the clouds, especially along san jose along the peninsula. zoom in on that right there. there's still pretty good thunderstorm activity, some in the sacramento valley. we have enough cloud cover that i think things could pop up any time. so there is some fog. sun shallow. hot and muggy, isolated showers. doreen asked, did you look at the golden gate bridge. a little bit of thick fog. now we want to go to the bart station in oakland. you've been talking to some of the strikers. they just told you something. >>reporter: they're going to be coming out here around 11:00 this morning for a rally. that is the same time as a special meeting for the bart board of directors and bargaining talks. they say they want to boost morale among union members since this is a holiday. now, talks between bart management and striking union lasted for nearly 10 hours yesterday. the two sides broke for dinner, but otherwise were trying to hammer out a deal and failed to reach an agreement. they began at 1:00 yesterday afternoon and ended at 11 last night. the negotiator sounded pretty optimistic after tuesday's talks, but after last night that tone had definitely faded. >> we really don't have any comment. we're working very hard with the mediator. we're going to be back here tomorrow morning very early. >>reporter: again, negotiations are scheduled to begin at 11. we'll have the latest at noon. if you're commuting today, be aware bart is cutting back the number of charter buses today. they were sent to stations in walnut creek, west oakland, freemont and others. they're expected to leave from san francisco right about now. the ferry and blue and gold fleet will not be providing extra service today. it's actually being scaled back because it's a fourth of july holiday. tomorrow regular weekday ferry service will be available on all routes. some transit agencies scale back, and ac transit is actually adding buses today. we'll go live to oakland. brian is out there, and he'll tell you how ac transit will help people get to independence day celebrations. crews are settings up for the big fourth of july fireworks show tonight. the fireworks are going to be launched from the municipal pier. the national park service says the best place to see it all are city piers. those areas will become crowded fast, so you're advised to get there early. the show starts at 9:30. here are some other fireworks shows happening tonight. a new twist in the america's cup saga with opening ceremonies set for today. this could put the event in jeopardy. there are threats to cancel the race unless safety recommendations are upheld, stemming from the tragic death of a british sailor when his racing boat cap sized back in may while he was training for america's cup. in the meantime a big holiday crowd is expected for the opening ceremonies that start at noon. there will be a ribbon cutting ceremony. opening ceremonies begin at 3 p.m. at america's cup pavilion. it will feature the crews of all four teams, including the defending champ, oracle team usa. annual holiday warnings for everyone getting ready to celebrate the fourth of july. officers will be out in force on bay area highways during the weekend looking for holiday partiers who are hitting the road an having too much to drink. they'll have drunk driving check points on several bay area highways and roadways. we should mention that there's a reminder that carpool rules are still in effect. so don't hop in the lane thinking you have a heading towards hayward. there it is right there. look at all that rotating around the dominant high. a little bit of that clipped us. a possibility of showers. we've got the showers for sure. it's too seriously. >> the aclu say policies could lead to racial profiling and gives law enforcement too much discretion. however, organizers say they've just been doing what's been in practice for two decades. a bill that would require k- 12 public schools to let transgender students choose which bathrooms they want to use or which sports teams based on gender identity. now it goes to the governor. we'll learning more about one of the two restaurant workers shot to death this week inside a winning stop restaurant in oakland. he was known as omar and was the manager there. he also worked at home depot and took places at berkley city college and is described as a hardworking and sweet man who lost both of his parents at a young age. >> he just said he wanted to be the best he could be so his mom and dad would be proud of him. they would be proud. i know they welcome him with open arms in heaven. >> they were killed on monday. police say two customers hid in the store's freezer. they say when bradley and the other man went to see what was going on, one of them opened fire. one man has been arrested and another remains at large. police are working to increase safety in the wake of recent violence. >> it's the use of guns and weapons, people getting pistol whipped and shot on a regular basis. >> they plan to increase bicycle and foot patrols next week and are using more undercover officers and burglary enforcement units. time now 8:11. a shocking death at a summer camp near yosemite. >> it hasn't quite hit me yet. >> family members, friends, classmates remembering the students killed by a falling tree. a dog is being treated after eating poisonous meatballs in san francisco. i'll tell you what to look out for. a student was killed in a bizarre accident near yosemite. she taught art at a popular jewish camp that served bay area children. a tree fell on the camp fire circle killing her and injuring several adult staffers. she was entering her senior year and studied environmental conservation and was involved at the campus radio station. >> she's always really sweet and went in to meet new people. >> her parents both work in the berkley area. san francisco police are warning dog owners to be cautious after a dog ingested a meatball believed to be tainted with a poison. this is very concerning to me. i pick up dog poop. i pick up other people's pool because it's really annoying. i can see why somebody would get so annoyed. i don't know if that's the reason and i don't think it's justification at all. >> dog owners are to be on alert because there may be other cases after the next 48 hours are crucial, but he is likely to survive. they had to pump his stomach and his owner got him to the hospital quickly, which was key to his survival. keep an eye out the poison- laced meatballs. time is now 8:17. fire crews in arizona making progress on the wildfire, the one that killed 19 elite firefighters. evacuees hoped to be back home by july 12. back here at home a fire that damaged a former rehab center in oakland is called suspicious. firefighters were called to 29th and international about 8:00 last night. officials say the building sprinklers had been turned off. an annual pga tour event has been played south of san jose since 2010, and they moved it to the bay area from arizona, but the contract with the golf course runs out after this year's tournament this fall, and so it is going to move again in 2014 to the silverado's north course. almost a half million cars and suvs are being recalled. chrysler reporting a problem with the head restraints in the sebring 200 dodge avenger and jeep liberties. the 2011 and 2012 dodge nitro suvs are also being recalled. chrysler says they haven't had any reports of injuries, and they'll be notifying customers and are going to replace for free the problem in those vehicles. jet blue plans are changing their rewards problem after getting complaints from its best customers. starting now travelers points will not expire. previously fliers had to book another flight or use the jet blue branded american express to make a perfect at least every 12 months. now jet blue's travel rewards match delta's program. both airlines are big rivals at new york area airports. the cost of traveling this holiday is actually down. gasoline prices are about a nickel less than last week. the average price for a gallon of regular in san francisco, $4.6 a gallon. gas is $3.95 a gallon this oakland and san jose. today's prices are actually 20 cents more than they were for the the bart strike with more talks scheduled today. they failed to reach an agreement despite a 10-hour bargaining session ended at 11:00 last night. here they are. the two sides will meet again at 11:00 this morning. also last night bart management sent out a news release blaming the unions for failing to reach a deal. we'll have more on the bart strike negotiations coming up in just about 15 minutes from now. 200,000 people are expected to be at san francisco's fourth of july celebration tonight along the waterfront. crews were busy preparing for the fireworks show, which is set to start at 9:30. with no bart trains, transportation officials are bracing for a lot more cars. there will be shuttled bus service to the waterfront between 2 p.m. and 8:30. >> thousands of people are also expected to attend the opening ceremonies of the america's cup competition, adding to the waterfront congestion. traffic is lighter on this holiday after what many called the worst evening commute since the bart strike began. take a look at the scene yesterday afternoon. traffic control trying to speed people along in downtown san francisco where the cars were bumper-to-bumper as far as the eye could see, and then this was the line over at the buses. many commuters say they did have to wait about an hour to actually board one of those jam- packed bus for a trip across the bay bridge to the east bay. your time is 8:32. muni is on a sunday schedule, but they're going to add extra trains and shuttles starting this afternoon for tonight's fireworks celebrations along the waterfront. the santa clara valley transportation authority and others will be running on sunday schedules, but there will be extra trains this evening for people heading out to the independence day event. the dangers of holiday fireworks may have already started in the bay area. ktvu viewers paul anthony took these pictures you're looking at. this is about 12:45 this morning. the fire dispatcher told us it may have been started by fireworks. the crews put out the flames quickly. luckily no one was hurt. that area is considered a threat zone because of the dangerously dry conditions. and more fires are reported on the fourth of july than any other holiday of the year, but most have ban had the use. we're going to check in with that in a little bit. we may enjoy the fourth of july fireworks, but it's important to keep in mind most pets don't like it. to prevent pets from running off animal control officials recommend not leaving your pets unattended outside and do not take them to the fireworks show. here are some of the events happening this morning. the annual fourth of july parade begins at 9 a.m. in redwood city. chairs line the sidewalk for the independence day parade at 10:00 a.m. the celebration aboard the u.s. is hornet museum in alameda. we have more events. just look for the fourth of july tab on the home page. students at city college of san francisco, you may be forced to transfer to other schools. a commission this one credit dates community colleges says it plans to strip them of its accreditation because of lack of financial accountability, deficiencies in leadership and not complying with accreditation standards. >> i only come here because of the resources it has. transferring to another school is not something i'm looking forward to. >> students have already started protesting that decision. city college's chancellor vows to appeal. classes will continue and they can still graduate and credits will transfer. administrators still have time to make improvements, otherwise they'll have to shut down. san francisco mayor ed lee issued a response. here's a statement. these will be difficult times for the college, but this is a time to commit to true reforms so let's take a look at the bay bridge. we had a problem on the bridge a little while ago with police activity. they cleared that quickly, and traffic never really slowed for too long. once they opened up the lanes, it dissipated rather quickly because traffic is light. 880 here looks good in both directions, a reminder today at 1:05 the a's versus the cubs at the oakland coliseum. that means you're going to see more cars coming up for the game. bart is not running. you probably knew that. just in case you're just joining us, bart is not running. you're going to have to drive or take a bus. this is a look at the south bay. all showing clear on the major freeways. let's go to steve. i think the giants game will be delayed. it's raining. we have fog for some and rain for others. the fog is trying to work its way around. rain is popping up in clayton. a little bit of rain there. actually some of the atmosphere bubbling up. some of the rain is stretch from freemont to hayward. if you're wondering what the sam hill is going on, that's it right there. other areas are like, what are you talking about? not a cloud in the sky. i think this is mainly a morning event. there's some fog on the coast, but really warm and hot conditions already. some of these overcast conditions mid 70s for some. really warm and muggy. yet some of the fog looks to be increasing. i honestly believe this will be the last day for some of the intense heat. we've had a long stretch, about a week of it. i think over the weekend systems are going to move in and open the door for the fog. it's itching, raring to go. it's ready. one more day. until 7:00 we have the heat advisory. 60s to 100s. the cloud cover may stop some of these temperatures from reaching this high, but it wouldn't take much. we're already sitting about 80 degrees for some. it does look cooler friday. it looks cooler on the weekend. when in the course of human event it becomes necessary for one people to dissolve the political d.c. he's joined by thomas jefferson and ben franklin. this is the annual fourth of july tradition at the national archives where the original declaration of independence is on display. more fires reported on the fourth of july than any other holiday of the year. so we're talking about fireworks on this fourth of july. the sale and use of personal fireworks, very few cities where this is allowed. one of the few places where people can still buy them legally. >>reporter: this is the only city where you can buy these, safe and sane fireworks. you can see behind me the stand is about to open in the next 25 minutes or so, and there's some gentlemen inside unpacking boxes and getting their stand ready. now, these fireworks you can't buy in gilroy and then take to san jose or another city where it's illegal and then set them off. they do not leave the ground or explode. people caught with any other fireworks will be issued a disdemeanor with a $1,000 penalty or could pay $250 get a citation. it just depends on the circumstances. in all of santa clara county, law enforcement will be patrolling and responding to calls of illegal fireworks. the fire department will actually have additional crews out patrolling today starting at 10:00 a.m. fire officials say nationwide more fires are reported on the fourth of july than any other day of the year, and half of them are the result of fireworks. most injuries happen to children between the ages of 5- 14. here's one man's thoughts on illegal fireworks. >> as you get older you realize they're not necessary and safety of kids is imperative. >>reporter: over in the city of east palo alto, all fireworks are ill legal. police say they're increasing the number of patrol units and using a shot spotter that traction gunshots on a map to help them figure out the hotspots of where fireworks are being set off. now, i do sort of an unofficial poll on twitter asking people if they thought the enforcement was okay, most people seem to tell me that they thought it was a good thing because illegal fireworks can definitely be dangerous. again, you can see there's a ton of fireworks. this baby up here i'm told they sell about three of these a year. it takes about four hours to get through everything in the box. there's things here as cheap as $11 too. i'm sure this stand will be very busy today. . >> we get to talk about love, >>reporter: we're on south livermore avenue. approximately 35-foot eucalyptus tree fell on an apartment complex here. to talk about how this tree fell over, we have the gentleman that's going to be removing the tree this morning. good morning to you. >> good morning. >>reporter: what can you tell us about what happened here? >> we got a call about 4:30 this morning by the police department, fire department that a tree had fallen on a structure. we came out and they had to evacuate the tenants in four of the buildings until we could get in here and get it out. >>reporter: how does a tree like this fall? it's a rather large tree, but how does it fall-like that? >> well, these trees will draw the water weight to the top on a hot day, creating an excessive weight and uproot or break out. if it had any kind of rot or decay or anything like that, which we haven't been able to check it out just yet that would add to it. but we do respond to a lot of these in the real hot days. >>reporter: during the summer months. there's lots of eucalyptus trees here. are any of these in danger of possibly falling? >> we're going to be doing an evaluation on all of them once we get this done and see what needs to be either thinned out or even removed. >>reporter: there's damage here to the sidewalk as we're looking at the apartment complex. it looks like the tree kind of uprooted itself. what's the process going to be when you remove the tree?
