2. they've been at it all night long. it's been going on 15 hours since tom's kayak hit the wake of a barge and flipped over. the coast guard says even on the nicest afternoon with calm watt -- with calm waters, it can still be dangerous. >> you need to wear life jackets, have proper radios and just be vigilant. >> reporter: the coast guard expects help out here later this morning and they will reassess search efforts at daylight. right now, the temperature is in the low 60s in the water. there is always the fear of hypothermia, especially given how long he's been out there. back to you. 7:02. turkish officials say 272 people are dead after yesterday's earthquake. right now, rescue workers are continuing to search for people trapped under the rubble. the 7.2 magnitude earthquake has devastated cities in the eastern region of the country. this is video from early this morning of a man being pulled from a collapsed building. rescue workers say he was stuck in a fetal position and was only visible through a small hole in the debris. there you can see his back crouched down as the men rescuers pull him out from the rubble. again, he's expected to be okay. coming up at 7:15, we'll go live to turkey for an update on rescue efforts. an 18-year-old woman is expected to survive after being shot in east palo alto overnight. police say they received a report of a shooting victim in an at on newell court just before 10:00 last night. . family members and friends have launched a website in an effort to find this man, last seen in san francisco's fairmont hotel october 9th. hotel employees say he appeared incoherent. he was wearing two different shoes. his family says he's bipolar. he may not have taken his medication since the end of september. that, they say, makes him a threat to himself as well as others. time now, 7:04. well, this week the oakland school board is expected to vote an a controversial plan, one that may close dune five schools. school superintendent smith says this plan would save the school district an estimated $2 million. however, angry parents have staged rallies. they packed the school board meetings against the plan. the school board is expected to make a decision on those closures this wednesday. 7:04 this morning. we're getting a first look at the authorized biography of apple cofounder steve jobs. allie rasmus joins us live from palo alto with more on the book that hits store shelves today. >> reporter: good morning. the book is already available in electronic form. so undoudly -- undoubtedly people will be reading it on products that steve jobs manufactured. we downloaded a copy of the electronic form of steve jobs' biography. it started from the beginning of his life from his adoption and childhood. the book talks about how living here in the south bay influenced jobs and facilitated his interest in electronics. it talks about how he and steve wazniak started to work together, tinkering with electronic boxes in their garage. the book is 636 peaks lodge -- pages long and is written by walter isaac son who said he -- isaacson who said he recorded more than 40 interviews with jobs to formal sitdown interviews with jobs over the last two years, the last of which was done days before the apple founder passed away earlier this month. isaacson, the author, says it was his goal in the book to campaign-style tour. this time he's heading here to the west coast. he's launching some new initiatives to try to stimulate the economy, including helping homeowners with underwater mortgages. good morning, alison. >> reporter: let's get to a live look at -- at air force one. president obama is going to try to loosen rule for refinancing government-backed mortgages and streamline the process. this is the first in a series of executive action, the president is announcing this week as he tries to bypass congress with the "we can't wait" cam. he's also -- campaign. he's also going to try to make it easier for college students to refinance loans. i've interviewed a number of bay area lawmakers, bay area democrats who are really just furious with how president obama has managed the housing market so far. i'm going to ask how this proposal will help homeowners in the bay area and have that for you during my next update in about an hour. for now, we are live in washington, d.c., alison burns, ktvu channel 2 news. >> thank you, alison. 7:17. the biggest subsidiary of the financially troubled walnut creek group pmi has been seized by arizona regulators. starting today, those regulators are ordering pmi to begin to pay only half of all claims. the remaining 50% will be deferred as a policyholder claim. the company has suffered billions of dollars in losses after paying mortgage insurance claims on foreclosed homes. pmi's physical headquarters are in walnut creek but it's incorporated in arizona. a big debate is grewing -- brewing among president obama supporters over the role of a top fund-raiser who was linked to the failed solyndra deal. the "l.a. times" shows that the employee pushed for the loan. the obama administration says spinner was not involved and sees solyndra as a made-up controversy. 7:18. the u.s. credit rating may be downgraded again. a merrill lynch economist says there are warnings from moodies's and fitch rating. they will probably downgrade. the san mateo county sheriff's department is searching now for the two people blamed for an armed robbery and assault. it happened yesterday morning on ton avenue just off the -- eatton avenue. the attackers were wearing black ski masks and black sweatshirts. if you have any information, contact the san mateo sheriff's department. tonight, the cardinals face the rangers for game five hang on. it's a very disturbing crime. mentally disabled adults held captive in the basement. if you are driving from gilroy to morgan hill, there is a huge crash involving a truck that killed -- that spilled all of its load. if you drive in from, say, gilroy trying to get into the valley, you need to use ex-- plan extra time. the two man and one woman accused of holding two mentally disabled adults held captive in a baitment are expected in court today in philadelphia. as we told you last week, investigators say linda westin, eddie wright and gregory thomas held the adults captive to collect their social security checks. they are charged with kidnapping, assault and false imprisonment. the attorney for eddie wright says his client will plead not guilty at today's hearing. 7:23. well, today, arizona congresswoman gabriel giffords begins two weeks of very intensive therapy p -- therapy in north carolina. she'll be working with a therapist who helped her while she was in the hospital in arizona after that shooting rampage. she's still recovering after being shot in the head. the staff is not releasing any other details about her treatment. let's check in, once again, with sal who is covering a number of problems. we mentioned the situation in morgan hill and san francisco. that's right. northbound 101, we'll start in morgan hill. there is a crash that spilled all of its load on northbound 101 at morgan hill. it's a is sig-alert. the chp says it's gonna be there for a while. they are waiting to, basically, get get all of that debris on another truck. i want to move the maps now as we move up to the peninsula. highway 101 looks good. but if you're in san francisco, southbound 101 at cesar chavez there's an injury accident to the cesar chavez exit. 280 may be your best bet to get out of the city at some point. the westbound bay bridge is absolutely sold out. 25-minute delay before you make it onto span. this morning's commuter -- on highway 4 is slow. most of it is slow until you reach highway 242. 7:24. let's go to steve. a little cooldown today. a big cooldown by the coast. inland temperatures will come down to the higher clouds. higher clouds to the southed. also a front coming into the north. the combination of the two along with the fog means a big cooldown. santa rosa, 46. upper 50s or low 60s. temperatures on the lows are all over the place. west wind at sfo, fairfield, that's a sign the delta breeze is there not much but it's there. mostly sunny, some higher clouds inland but the fog will be on the coast. that means temperatures there come way down. 60s for some that were in the 80s yesterday. low to mid-80s. temperatures inland will come down as well. fog, sun, cooler on tuesday. but then it will be breezy to warm on wednesday into thursday. friday looks like where they start to go back to more of a westerly wind. it will be all right. it will be dry. it just won't be as warm. 7:26. it was an overnight traffic tragedy in san francisco. in this case, the of two of the victims have been changed forever in one horrible moment. accidental or intentional find out what police are now saying about a man who ran over a motorcyclist and then dragged his bike for one mile. and a disturbing new development tied to this year's tsunami disaster in japan that directly involves the united states. good morning. right now just a few miles away, headed directly there. we'll give you the first live pictures as soon as we can. let's go back to the desk. the san leandro police are trying to find drivers who witnessed the deadly motorcycle crash that forced the closure of 580 for several hours on saturday. tara moriarty joins us live. and you are learning more about the victim. good morning. >> reporter: yes, that's right. we haven't learned much about the victim but we know he could be a member of the hells angel and he was last seen riding in formation with at least half a dozen other -- half a dozen other motorists. we should learn his identity late own from the coroner's office. the man accused of killing him is being held here at the jail. the man on driving, dragging the motorcycle for one mile. it happened saturday near the grand avenue onramp around 4:00 this afternoon. alameda county sheriff's deputies say the man tried to run away but was caught and arrested. the freeway was shut down for nearly 11 hours as the investigators tried to gather evidence. as far as what led up to the crash, officials believe there was some sort of altercation between the two. whether or not it was road rage, perhaps we'll learn later. now, the paratransit company that hired eddie hall said their employee had a spotless driving record. police say the oakland man did have a previous arrest for assault but charges were never filed. hall just finished his route when the accident happened. no passengers were on board when this incident happened. now, hall is now here at santa rita jail facing felony hit and run and murder charges. he's skeled to be arraigned later on this afternoon at the hayward hall of justice and we'll, of course, be there. live from dublin, tara moriarty, ktvu channel 2 news. >> thank you. a man is dead after a crash in sonoma county. it happened around 10:00 yesterday morning at pepper and meekam roads near petaluma. investigators say an 83-year- old truck driver failed to yield to a van as he was turning. >> the man driving the van was killed. a highway patrol officer happened to be driving behind the truck. the officer tried to administer first aid but the victim was announced dead at the scene. san francisco police searching for the wrong-way truck driver who crashed right into a taxicab. it happened overnight on the 101 between cesar chavez and the 280 split. police say it all happened when they chased the truck after a reported road rage incident at 16th and mission. police say the truck drove the wrong way and crashed right into the taxi. the truck driver ran away from the scene. the taxi driver was not hurt. also overnight in san francisco, police say this white van ran a red light and crashed right into a dodge charger. it happen at 10th and howard, south of market. seven people in both of those vehicles were hurt and we're getting reports that two of the passengers are now paralyzed. police also tell us if both drivers face dui charges and the driver of the van is also facing drug charges. police say they found cocaine inside that van. 7:33. the woman accused of killing nursing student michelle le is lieu back in a hayward courtroom in about 90 minutes. 27-year-old gisele estebon is expected to enter a plea. she's pregnant with her second child. the judge granted her a four- week delay due to her problems with her pregnancy. prosecutors believe estebon killed le out of jealousy. president obama returns to the bay area tomorrow. air force one will touch down at 1:00 p.m. tomorrow and leave two hours later. he will attend that time attending a fund-raiser in at a hotel in downtown folks. he was here on september 25th and that's when he held a town meeting. san francisco mayor ed lee's campaign is being accused of voter fraud. seven mayoral candidates called for an investigation into possible ballot tampering. the letter says media reports claim a group of ed lee supporters prevented voters from marking their ballots for any other candidate but lee. mayor lee says the group in question has nothing to do with his campaign. well, san francisco is no longer number one as a tourist destination. for the first time in 18 years. san francisco lost its ranking as the favorite north american destination among the readers of conde nest travelers magazine. instead, number one is charleston, south carolina. the reason for that dropping in the rating appears to be, according to the magazine, friendliness. more than 90% of readers rated charleston as friendly compared to 66% for san francisco. now, the head of san francisco's travel association is blaming that problem on aggressive panhandlers. 7:35. well, for at least four hours now, a man has been on top of a structure at city hall in san jose and he is still there right now. ktvu's claudine wong is keeping an eye on this situation and jut got off the phone with police in san jose. so what -- so what are they saying. we want to show you the situation now in san jose because the man is still -- still handing on top of that building. we have our camera and sid, our photojournalist, to show you how high that man is up there on top of the cement structure. we know he's been there since at least about 3:20 this morning. when i talked to police, they said they got there at 3:20 to do their -- what's become routine clearing out. they've pulled the protesters out of san jose occupy. this morning they came out here and there were five people out there. they arrested five of them. four went to jail. one was cited and released. at the time this man was standing up there. he was holding a sign. there's -- there is a sign that talks about how many lives, four peaceful protesters, that was the mount of response they saw -- amount of response they saw at 3:20. so police believe someone was feeding him information. he's holding the sign himself that says stand up for what you believe in. and they said they asked him at the time, four hours ago, can you come counsel? he refused. so at this point, they've left the scene. the supervisors said they are gonna the wait him out. they didn't want to do anything that would force a confrontation or make it a dangerous situation. they said they are gonna wait. when he comes down, they will talk to him. he could face some charges like trespassing, failure to obey, lawful orders, interfering with officers' duties. they think somehow he just scaled up there and will stand up there for as long as he apparently wants to. but obviously, he doesn't have food or a different -- or different kinds of amenities. just give him some space and we'll hum down when he's ready. as far as protesters, no others on the scene. we'll continue to monitor the situation. if anything baked -- barked up on 101, even after the accident. the crash is northbound 101 at cochran road where a truck carrying scrap metal spined it all over the freeway as it flipped over. our newschopper2 is almost there. we'll give you just a little bit of a view of it arriving at the scene. as you look down, you can see that it's in southern san jose now. it should be moments away. let's move along and take a look at highway 4. you will see some slow traffic here coming from antioch and pittsburg. it stays -- it stays that way until you reach concord. also, this morning we're looking at traffic that will be busy from 680 from walnut creek down to alamo. 7:39. let's go to steve. a little change today. a big change by the coast and bay. temperatures rocketed up in the 80s even on the coast and inland to near 90 degrees for some. also some higher clouds visiting and so the combination here, it means a cooler pattern today. a lot of 70s and 60s instead of 80s. the forecast does keep some of that fog in place. it's working its way up the coast. it's heading toward the northern part of the marin khost -- marin coast. south of that it looks solid. a good 20-degree drop for some. you go from no fog and 80s to fog and upper 60s. there is a weak cold front coming in. you can see that between eureka and redding. the majority of those down in southern california but the combination of these two mean the westerly breeze will ginn us a cooldown. 46 in santa rosa. 61 downtown oakland. a lot of 50s, low to mid. the wind was easterly or northerly. >> from sfo all the way out to san pablo bay. our system will slide by, that will keep the fog going. high pressure will build in behind that, we'll get back to the northerly breeze. patchy fog but the fog is thick on parts of the coast. ship spotted debris north of the hawaiian islands. the debris was not expected to hit midway until next weekend. new projections say this will happen in less than two years. coming up, what walmart is european leaders say they are moving closer to finalizing a plan to solve europe's debt crisis. the 27 leaders of the european union met in belgium over the weekend. a final agreement is not expected until wednesday. originally they were supposed to have one yesterday. they were trying to calm come up with a plan to boost capitals for bank, reinforce a government fund. oracle wants to buy another big buy. they are offering $1.5 billion for a company called "right now." oracle expects the sale to be completed by early next year. 7:46. well, defense lawyers for dr. con -- conrad murray, michael jackson's doctor, they are expected to start calling witnesses today. but first they are gonna finish questioning a key prosecution expert. adam housley is live outside of the l.a. courthouse now with the details. good morning. >> good morning. we talked about the key witness last week. he's been really the guy that the -- i'm sorry the prosecution felt was gonna tie their case all together. and for a week -- and for a week he was on the stand. they had several days where court went dark for a number of reasons. so that week was only for about three days. but what he did for the -- so far, is they said that dr. murray a-- shaffer, the doctor, appearing crass, other times appearing frustrated. the defense at one time got him to admit about experiments on his own before the prosecution ever asked him to be part of the case. that will be today, and the interesting part will be when the defense starts to call their witnesses and they could be done with their case as the early -- as early as the middle of the week. one of the witnesses will be dr. paul white who has been a friend and colleague of dr. shaffer for more than 30 years. both are considered to be experts on anesthesiology and propofol. it's curious to see if the defense made enough inroads to allow a -- to allow dr. white to step in. it was -- they do expect to call witnesses today. but nothing has been normal or average in this case. if everything goes as planned, that's the big calf viet. this case could go to the jury at the beginning of the week. reporting live at the courthouse, we're about an hour or so fire. the three-alarm fire broke out at the apartment complex at south king road and bowling green drive. fire crews rescued a half-dozen people from the burning building. there were no serious injuries. however, more than a dozen families lost their homes including ten children. i think -- >> i think they are in shock. as you can imagine, roused out of bed. you leave with whatever you have, you grab. >> investigator sas i -- investigators say the fire started in a kitchen in one of the units. san jose police are investigating the department's 7th police shooting this year. officers shot vehicles are getting by on the extreme right-hand shoulder. but for this time of the morning, that's almost nothing. that would be trying to put salt on the ocean really. it's not doing much. it's a huge backup. and that's because of this truck crash that happened before 7:00 a.m. now, northbound 110 is very slow. southbound -- northbound 101 is slow -- is very slow. some people are using monterey road as an alternate. let's go up farther. 280 is slow and so is 101 even after the accident. a lot of slow traffic getting into the valley this morning the at the bay bridge toll plaza, we there's a huge traffic mess. if that is not bad enough as we show you the mess here, up the road in san jose, there is an injury accident northbound 101, right in front of the san jose airport. it's blocking three lanes there. so you get out of one backup and you will be right back in to another backup, trying to get into san jose. it seems like it is having a real bad monday. some people are bailing using 280, but those are all crowded as well. some people getting off the freeway using the highway here. that is also slow. so again, pretty much slow all around the south bay, a complete traffic update is just minutes away. >> all right, so now time is 8:00 and this morning, the coast guard, very busy? searching for a kayaker missing in the waters of the san francisco bay. the 55-year-old man was paddling yesterday afternoon. that's when his kayak flipped over. and she will tell us why the next couple of hours are very critical out there. good morning. >> yes, good morning. >> reporter: i just got off the phone with the coast guard and for now this is still a rescue effort off the san francisco bay out here. they hope to find the man alive. let's go ahead and take a look at these pictures this morning. a 12-man on crew on board this 80-foot cover vessel. they used to equip the search and rescue efforts. there are inflatable boats as well as first aid. the kayak overturned during the wake of the barge. the man on it, the 54-year-old did not resurface. >> as i looked back to watch him, the boat was upside down. and i didn't see it moving, like you know, she was not trying to get out of it. >> reporter: they recently came in to work after throat cancer. reporting live, ktvu channel 2 news. >> all right, thank you, lorraine. time is now 8:01. death toll in turkey now at least 270 after yesterday's 7.2 magnitude earthquake. rescue crews are still out there looking, sifting through all the rubble, trying to find people alive under it. this quake has devastated cities in the eastern region of turkey. now take a look at this video. we got this in a little whiling ago. you've got to look close. a man being pulled out of a collapsed building. he was stuck, believe it or not in a fetal position and visible only through a small hole in the debris, but as you can see here, they got him attending th and this is san jose's 7th officer-involved shooting this year. the board of soup visors for santa clara are facing voting. and that is not the interest of public safety. police are still looking for the man accused of killing the fellow hell's angel member at the funeral. and now, they fired tear gas. take a look at these pictures into stockton. they believe that the 38-year- old was hiding out there, but after the 12-hour lockdown, police say that he was not there. and he is suspected of shooting and killing the 52-year-old back on october 15. and san jose police, they are still searching for the person who fatality stabbed a 22-year- old man. and police, they rushed out there to union street at about 1:40 yesterday morning after getting reports of the fight there. they found the victim out there and unconscious, stabbed at least once. he later died at the hospital about an hour later and his death is now the 39th homicide of the year in san jose. 8:04, the much anticipated biography on steve jobs hit the store shelves today. and he joins us live. now, tell us what people are hoping to learn from and about the apple co-founder. we downloaded a copy of it this morning and the books start with the very beginning of job's life from his adopted and buy logical parents -- biological parents. it also talks about the jobs, growing up here in the silicone valley and how living here in the south bay, they influence and facilitated the interest. there's an entire chapter, dedicated to steve jobs met and started working with them. they began tankerring with the e -- tankerring with the area and they went on to find apple together. we talked to a few apple steve jobs fans, explaning what they were looking forward to reading on the book. >> the childhood is back with all the things that have happened before he put out the first computer. >> i heard he was not easy to work with. but i mean, i didn't realize how bad his personality could be. and so yeah, you know, i am interested. >> reporter: now, the book is written by the former times magazine editor who recorded 40 interviews with jobs over the last two years. in the introduction of the book, he explains that jobs asked him to tell his life story truthfully. and isaacson said it was his goal in the book to include all aspects of jobs' life, kind of along the lives of the last woman we talked to was talking about. but again, the book hits store be talking about road rules out there and with bicyclists, what they can and cannot do. and the classes are lasting about four hours long, being held at several places around san francisco. and one the onramps out there. but the backup is pretty severe. after the crash, there is another crash here, northbound 101 near the san jose airport. and it was blocking three lanes, cleaning it up now and housing secretary, talking about some major new initiatives the obama administration is announcing today that it says it will help millions of americans who owe more than their homes are worth, refinance at lower rates. we'll take a look here leaving the air force base about 45 minutes ago. nevada and california, they are the two states that have been hardest hit by falling home values and increasing foreclosures. now, the actions announced today by president obama will allow all homeowners with government backed loans who have been making their payments on time to refinance to lower rates, regardless of what they owe. and it eliminates the risk- based refinancing fees and many of the appraisal requirements that have kept many homeowners from refinancing. they will keep people in their homes, putting thousands of dollars back in borrowers pockets. reporting live from washington, d.c., allison burns, ktvu channel 2 news. new this morning, the website wikileaks will stop spilling secrets in order to try to make more money. a blockade by companies such as visa, mastercard and others lead to this decision. they will now aggressively fundraise in order to fight back against the blockade. the company pulled the plug on their financial contributions after wikileaks began publishing state department documents last year. today, u.s. and north korean diplomats are meeting in switzerland for a fresh round of nuclear talks. this is the second direct encounter between the two sides within three months. the u.s. wants north korea to stick to the term of a 2005 agreement that calls for north korea to freeze its nuclear program and allow u.n. inspections. north korea wants to resume the zibet nation talk in exchange -- sixth nation talk in exchange for news. on high alert, they are warning of an eminent terrorist attack. now, they sent hundreds of theirtroops to somalia there. they are warning the revenge. the possible targets include places out here, >> and new this morning, libya's transitional leader is not ordering the investigation into the death of moammar gadhafi and bound to the pressure, coming from the united states and others international powers. they said at a news conference today that the committee has been formed to investigate the killing of gadhafi, conflicting reports about how he died and take a look at the people lining up here, the country's new leaders put the bodies at one of his sons out for display. and people, they have been lining up to get a chance to look at them. and 8:18, there's more trouble for pg&e over the pipeline that caused last year's deadly explosion in san bruno. and the san francisco chronical, they report that the company, they were aware of more than two dozen leaks on that line when it declared it free of seeing that back in november of 2009. it's less than a year, killing eight people, destroying about 38 homes. the chronical said if he reported the leak, an inspection for similar problems that it would have been required. this morning, southern california police are admitting to shooting and killing the wrong man. at first, police said that he was an armed robber. and he was unarmed, innocent father of four. on saturday night, they were pumping gas while the detectives nearby were searching for the atm robbery suspect. and when he went to the tobacco shop, they tried to arrest him twice, but he ran away. on the third attempt, police used fatal force. >> the father of my grandkid, he was about to set that out on there. my baby. he was, you know, he was god's gift to me. and he was god's gift and taken away. >> police say that she was being aggressive and had not been padded down for weapons. his family says that they will be taking legal actions against the police force. and our time is 8:19. the new study out about the other possible health risk of bpa. a chemical used to make plastic. well, according to researchers, girls may develop a behavioral problem by the time they reach the age of three if their pregnant mothers ate foods stored in containers that had bpa. and the researchers found the girls who had mothers with higher levels of bpa were more likely to show signs of hyperactivity, anxiety, and depression, but boys, they were not affected according to the study. the experts not involved in the study say that there could be factors other than bpa that may explain the results. in san jose, a breast milk bank there says they are having very serious trouble meeting the rising demand for the milk. the executive director of the mothers milk back says that it has been an increase in demand for breast milk ever since they issued that in support of breast-feeding back in january. and the breast milk has been shown to protect the babies against infections and also promote growth and help with allergies. they have narrowed down their recipient list to nato intensative care units. it is 8:20, the desperate search continues man is accused of being a motorcyclist. and he is due in court this morning. ktvu has a live look on how the 31-year-old eddie hall is being held. good morning to you. >> reporter: yes, good morning. that's right. we just spoke to the alameda county sheriff's office. they tell us that eddie hill cannot be put into a holding cell because of the nature of the crime. and they are obviously concerned for his safety. and possibly retaliation. -- possible retaliation. they placed him in either a booking cell or an isolation cell. and now, the 31-year-old is, of course, accused of murder and felony hit and run. unlike anything, police officers have ever seen. according to court documents, the 31-year-old from oakland, again, facing felony hit and run and murder charges. indicating that investigators think he intentionally ran over and killed a member of hell's angel. he had some kind of altercation before the van struck and killed the biker. here's the crazy part, he kept on driving, dragging the motorcycle. now, it happened on saturday 580 eastbound near the grand avenue onramp. alameda county sheriff's department say that he tried to run away, but he was caught and arrested. investigators tried to gather evidence. now, the company that hired him said that their employee had a spotless driving record. police say that the oakland man did have a previous arrest for assault, but charges never filed. we're hearing reports that he is known as george of the california nomads. a group of riders are out there to get together in oakland for a chapter there when the incident happen. they say that he swerved into the lane, that he had cut them off. he clipped him, forcing the others to swerve out of the way. and so again, the victim, we have not learned the identity and as far as the suspect, he will be arraigned in court today at 2:00 this afternoon in a hayward courtroom. all right, thank you. time is now 8:32. an 18-year-old woman is expected to survive after being shot overnight. police were called about a shooting in an apartment just before 10:00 last night. and officers found the wounded teenager had been shot one time. she was taken to the hospital and is expected to survive. so far, police have not given us any other information about a suspect. time is coming up on 8:33, a san francisco family and friend of a missing man has launched a website in an effort to find him. the 29-year-old was last seen at the san francisco fairmont hotel on october 9. the hotel employees say he appeared incoherent and wearing two different shoes. his family says he is bipolar and may not have taken his medication since the end of september. they say that this will make him a threat to himself and others. our time is 8:33. we are still following the developing story out of san jose this morning. just hours ago, the occupy san jose protester climbed to the very top of the structure right in front of city hall in san jose and he is still up there. they have been talking to police, watching the situation, back now, and so it is happening. >> reporter: it appears that we're in a great situation right now. they told me that they will be waiting the protester out. we'll show you the live situation from san jose as you can see there, they are still standing at the top of the cement structure. it appears that we know who he is at this point and identified by another protester as this man and they climbed up on the wall sometime during the night. and now, we know that he was there at least by 3:20 this morning and because, you know, that's when police got there. and you could see his sign saying stand up for what you believe them. and now, they are also showing you another sign that lists the number of police officers. there you go. 10 vehicles, 14 police officers, four protesters. that's the number of people there at 3:00 this morning when police arrived. now, police say yes, they had 10 officers on the scene, three supervisors. they say they were there because they had been on the campaign to keep them from camping out there in front of city hall. telling me they arrested about five people this morning for the municipal code violation that does prohibit camping for those people. and four of them were booked into jail. one was cited and released as you can see that there are some people now back there. and they put up that max. this is an ongoing thing, put up the mattress, the tents, they come in, they take them out. when they get there this morning, the supervisor says they asked the man to come down, he refused so they decided to wait him out. they are not hurting anyone, damaging any property right now. what they don't want to happen is force the competition or do anything. so when he comes down, they are going to talk to him and you know, he could be facing charges. among them, possible charges, they are showing you the failure to obey the orders, interfering with the duties. and if it is this man that has been stood up there, they also say that they don't need to be there when he goes down. they can just file a report, send all this information to the d.a.'s office and they could actually later on release a warrant for his arrest that they choose to do so. so now at this point, everyone is just watching that man and waiting to see if and when he will be coming down. reporting response to the big spike in computer theft across the city. police in plain clothes are hanging out on bus stops, park benches, other public areas. prominently displaying their enticing laptops. the decoy officers hope to immediately arrest any robber who tries to grab their computers. and their laptops, they are also equipped with a hidden tracking device. all right, time now, 8:36. we've got to southbound 880 there. >> all right, big changes today, even though it will be mostly sunny, lots of fog over by the coast. that was not the case yesterday as you know. lots of 80s, no, today, a lot of 50s and 60s. fog is working its way into the bay. higher clouds above, but still mostly sunny and cooler with a lot of 60s and 70s. clouds to the south will start to thin out as the system to the north will be pushing closer. but still, you know, that's helping to pick up the fog bank. and santa rosa at 47. i mean, a little chill there in the morning air. but for others, mainly in the 50s. the front right there won't be doing much, not expecting it to rain or anything. but ushering in a westerly breeze. you're already seeing that out here, that will spell cooler temperatures. mostly sunny, high clouds, maybe some drizzle late tonight and tomorrow. but forecasted highs, which are all in the 80s yesterday. across the board in the 90s. maybe some morning fog on tuesday, then we'll clear it out on tuesday night. sunny and warmer, more of the northeasterly breeze, it does not look outrageous, but it will warm up again. mostly sunny, where it looks like they will start to work their way with cooler temperatures, still nice as we go into the weekend. the time now is 8:38. tropical storm rena off the coast of honduras could become a hurricane by the end of this week. rena is the 17th main storm. it is just north of honduras on the border. the national hurricane center says it will get stronger over the next two days. it is 8:38. the san francisco church is hoping whoever stole their historic bell will return it. the two-ton bell has a tourist attraction. it used to sit on the concrete pedestal in the church's yard, but some time between 2:00 to 11:00 yesterday morning, someone managed to steal it. people who live near the cathedral reported it missing. >> it looks different. >> they had to hoist it, whatever to lift there. >> reporter: the church leaders worry that someone may have taken it and planned to sell it for scrap metal. recyclers will be paying $1 a pound for breasts, meaning as much as $4,000 for the historic bell. time is 8:39 with an update on the story we first told you about yesterday. sacramento police are now saying that a man suspected of shooting and wounding a police officer died while in police custody. the 32-year-old, tyrone smith was found unresponsive in the back of a police car saturday night after a foot chase in a shooting. the cause of death still has not been determined officially. the police officer, he allegedly is expected to make a full recovery. the case of mistaken identity is being blamed for the shooting death of the 20- year-old u.s. marine. he was from french cap, just south of stockton. over the weekend, he was hiking to a state park near portland, oregon. walking through property owned by the local hunter when he was shot. police say that the man thought he was a bear. the shooting is being called an accident. and so far, no charges have been filed. all right, 20 minutes now. a baseball locker room, it may never be the same. the controversial plan that is now being considered. also, we are talking about gas prices. the changes in gas prices as we head into the holiday season. 17 hours and counting, the search goes on for missing kayaker right here in the san francisco bay. we'll tell you when the coast guard plans to reassess their efforts when mornings on 2 continues. take a live look at the big board on wall street. numbers are higher this morning thanks to good news on earnings, particularly from caterpillars and the dow is up, 98, creeping closer. and nasdaq is up about 2% of 55 points. and the s&p 500 is up 15. and the the online bargain site, groupon expected to have their ipo delayed. the expected price range is between $16 to $18 that will give groupon a value of just over $11 billion, but that's down almost 50% from a projected $20 million earlier this year. the number of ipo's has fallen sharply since last august as consumer spending and stock prices have fallen. crude oil prices, they top $88 a barrel this morning, up $0.65 from the opening price today. many analysts predict it could start to fall again in the coming weeks. and that's because, well, the death of moammar gadhafi could mean oil production in libya returns to previous levels. and changes in the price of crude generally translated quickly and prices at the gas pump. the national average for a gallon of regular is up almost $0.05 at $3.47 according to the survey. now, prices have been holding steady for the last week here in the bay area. the average is $3.84 a gallon and in san francisco, gas is about $0.08 more. time now, 8:45, we'll bring you up to date on some of the missing kayaker. this is yesterday afternoon when the kayak flipped over. and they have been out there all day telling you why the search right now is in a critical stable, already -- stage, lorraine? >> there are still no signs of him out here. we'll go ahead and take a look at the latest video we took of the search right here. the 55-year-old has been missing since 3:30 yesterday afternoon when his kayak capsized in the wake of the barge being directed in by a tug boat. they had the 12-man crew working to find him. this is still a rescue effort at this time and it has been just a bit more than 17 hours. right now there's no plan to include a helicopter search. and the coast guard does plan to reassess the situation right here at 9:00 a.m. we'll have updates as they become available calling in on witnesses today. but first, they will be finishing questioning the key prosecution ex-- expert. so now adam, is more drama expected today? >> reporter: yes, absolutely. you know, it began on friday when the first cross- examination began. he's really the star witness. now, momentarily, they should be going inside los angeles. you know what, what he did for the prosecution over the course of a week with a couple dark days in there. really it was on his hands for three full days. what he did do for the prosecution was help lay out their case, bringing it home if you will. tying up a lot of the loose ends. and these are 15 different educations, not cared for carefully by dr. murray. he also said that he abandoned jackson, and he is known to be one of the experts in the world on propofol, one of the best anesthesiologist. they found a few things out there. conducting some experiments before he was ever asked to be a part of this case. he went on and bought certain things on his own and he also, you know, admitted that the only time he has testified was against another doctor whom he didn't like. so there were a couple of things, people, who were watching this case, they were a bit surprised. but they do expect the re- direction from the prosecution today on him and they had start calling in on their witnesses, lasting through the end of the week. one of the witnesses, the other man considered to be an expert here on propofol and used to be the friend of dr. steven schaeffer had a falling out over this case. we'll keep you updated on everything on friday in san francisco's golden gate park. the hawk was taken to the wildlife center of silicone valley to get treatment. we can tell you that a $10,000 reward is being offered for information on whoever injured that hawk. on a lighter note, the comedian welfare is the newest recipient for the mark twain prize. this is the nation's top humor prize. there he is right there. and expected to are afraid of it. >> welfare, by the way, is -- will farrell by the way is now the 14th winner. 10 minutes before 9:00, new numbers are out on the amount of money that's being spent on overtime for san francisco's municipal transit employees. and according to the san francisco examiner, the sfmta has spent more than $12 million in overtime and in the current fiscal year that began in july. that puts immunity on pace to pay out more than $56 million in overtime this year, which would exceed by over 50%. the overtime budget by $25 million. there could soon be a big change in baseball locker rooms. major league baseball is now considering banning alcohol in the clubhouse. this comes as a response to recent reports that three boston red sox pitchers drank beer in the clubhouse on the days they were not starting. league executives plan to discuss the situation after the world series. it is still not clear how the ban would affect the traditional champagne showers that follow big baseball victories. texas rangers have now evened up the world series with a 4-0 victory over the st. louis cardinals last night. they got the big hit, smashing a three-run homer in the 6th inning. [ male announcer ] get to a better state. state farm. good morning to you, time now is 8:54. on wednesday, the oakland county school board is expected to vote on the restructuring plan, one that may close down about five schools. the school superintendent has recommended closing lake view, marshall, maxwell park, and santa fe elementary schools. now, the plan would save the district an estimated $2 million. however, angry parents have staged rallies, a packed school board meeting to reject and denounce that plan. a truck that operates in san francisco's park, they might be forced to move on out of there. and the examiner reports a proposal by the supervisor scottweiner. this comes after some of the residents complained about the presence of that truck making as they say the park feel too commercialized. and supervisor weiner calls the proposal a good compromise of a change that will also be affected. allowing the city to collect permit revenue from that taco truck. 8:55, a new york artist is using the my had cal of life as mote -- using the miracle of life as her motivation of life for the next performance. turning it into a home birth center, planning to deliver the baby there for a performance called the birth of baby x. she hopes that people will see that giving birth is what she calls the highest form of art. today, an engineer stuck in the south pole for two months with a serious medical problem will be passing through the bay area. she is on her way to john hopkins hospital in maryland for treatment. doctors say she suffered a stroke in august while working at the national science foundation's south pole research station. with the proper treatment, she will almost completely recover. time now is 8:56. well this week, the sonoma county board of supervisors will talk about a plan to improve the bumpy roads. one idea is to add about 63miles of county roads to a preservation priority list. but doing that would cost about $4.5 million a year. and to help pay for that, the county would have to cut costs elsewhere. and one idea to make the property owners responsible for brush clearing, well, the county residents may also be asked to improve the tax hikes. jay leno's annual love ride, the motorcycle ride, the charity, it's been marked by atragedy just before the start of yesterday's motorcycle ride. two people on the motorcycle, they collided with a big rig. and both of them were killed and you could see traffic there, it was backed up on interstate 5 for several hours while the police investigated. and the ride raises money every year for several childrens charities. all right, let's quickly go over to sal one more time for the update on the traffic area here. >> all right, northbound 101, cochran road, still clearing a truck that spilled all kinds of metal all over the place that will be going on for some new time. and southbound 880 at first. we'll go to steve. all right, thank you, cooler coast side today. not well for everybody. but the fog has come back, cooler over there. 60s and 50s. mostly higher. and about the same on tuesday and clearing out, sunny and warmer on wednesday and thursday and cooler as we head into the weekend. no rain, maybe around the 4th to 5th of november. somewhere around there. >> all right, that'll do it for us. thank
