Police in sunnyvale are looking for a car they say tried to hit an officer last night. It resulted in an officer involved shooting. Janine de la vega is joining us live from sunnyvale with the latest on the investigation. Reporter police have cleared the scene here at wolf road and elle camino but they are keeping their eyes open for a White Mercedes sedan. They made it stop at el camino at wolf when an officer exited his vehicle and approached the mercedes the suspect sped toward the officer and that is when the officer made the decision to fire his weapon. During the attempt to stop the vehicle, the vehicle drove toward the officer at a high rate of speed. Officer fearing for his life fired several shots at the vehicle. The vehicle was last seen northbound on wolf road. The officer was not injured. The other officer in a marked patrol vehicle chased the mercedes on wolf road in the northbound direction but lost the vehicle. Sunnyvale department of Public Safety is heading up this investigation. They are unsure how many were in the mercedes and working to see if they can provide us with a license plate number. Its unknown if anybody in that suspect vehicle was injured. The detectives are also looking to see if any Surveillance Video exists of this chase. I have put in a call to a spokesperson to see if we can get some sort of update. We are waiting to hear back. But again the suspect vehicle and the suspect is still at large. Back to you. Thank you for that update. A medical Marijuana Dispensary in berkeley can stay up and running while it defends itself in court. The Berkeley Patient Group is located on san pac row avenue. The federal judge has agreed to allow the dispensary to remain open. May 2013 as part of a crack down on cannabis. They moved to close the circuit. To have the federal government come in and shut down the citys dispensaries, any one of them, would be catastrophic for the community. Congress passed a spending bill that prohibited the department of justice from using funds to go after medical cannabis programs that are legal under state laws. It is normally open 24 how weres but a safeway is shut down because of a fire late last night. Ktvu fox 2 reporter Alexis Christoforous is joining us to explain how the fire could have been worse. Alex. Reporter firefighters were battling the flames near the storms loading dock. What was burning was a trailer. It caught fire in this area over night. And the big concern was the flames very nearly spread to the Safeway Store itself. But crews were able to come in here and contain this fire before it happened. Let me show you pictures. They were tweeted out by the San Rafael Fire Department after they were called out here to the super market. This fire started around 7 30 last night. The trailer was destroyed but thankfully the flames didnt spread to some of the flammable and Combustible Materials that were inside the loading dock. But the fire did however send quite a bit of smoke drift into the store. That means the safeway normally open 24 hours has been forced to close. However we do understand the store is planning to clean up inside. Trying to get rid of that smoke inside the store and reopen an hour from now. As far as the cause of the fire, that is still being investigated by the San Rafael Fire Department. This weekends storm brought a lot of water to the bay area, what does it mean in terms of our drought . Santa clara says their reservoirs went from 38 full to 36 capacity. They are not celebrating yet. Its just good to see the water in the reservoir. It was a good thing it was two storms. One after another. The second one produced more run off into the reservoirs. East bay mud and the San Francisco Public Utilities Commission Says the storms brought several inches of rain and boosted their reservoirs. Still biggest concern is warm temperatures and a snow pack that is at a third of what it should be. The north bay has so much water from the storm that Officials Say they have resorted to pumping some of it into the bay. The marin Water District says they are at 98. 4 of capacity. Many lakes and reservoirs are starting to spill over from the storm. So the Water District is sending thousands of gallons a minute out into the bay. Creeks and water falls are flowing which is attracting many people to popular hiking spots. Its wonder land. Beautiful. A San Francisco water manager is receiving a five day suspension for urinating into a reservoir. The reservoir normally holds water that is used in bay area cities as drinking water. The Transgender Community in San Francisco has declared today a day of action in honor of a transgender woman killed earlier this month. Some staple employees are upset over a threat that they will be fired if they work too many hours. Staples has a policy limiting part time workers to 25 hours a week. It was reportedly implemented to avoid paying benefits under the federal care act. Workers with more than 30 hours a week receive health care. Staples denies the policy in response to the law. The workers have gathered 200,000 signatures on a petition asking staples to change that policy. Harry reed is under going surgery to repair his injured eye. The surgery is a follow up procedure to help restore vision in his right eye. It will be done at George Washington University Hospital in washington. 75yearold reed damaged his eye and broke rib which is in that accident ribs in that accident. A lawmaker is allowing a bill to allow 18yearolds to drink in bars. Under the proposed law 18year olds would not be able to buy alcohol at stores. They would however only be able to drink in bars and restaurants and have to be accompanied by a parent or spouse that is of legal age. Businesses say they support the bill. They are able to have a beer. The bill passes, it would go into effect in august. However critics say it could put the state in violation of the National Minimum drinking age act that Congress Passed in 1984. That could reduce the highway funding that minnesota would receive. This follows violent protests last year over the killings of unarmed African American men by white police officers. Paul chambers is live in berkeley with what is expected to happen tonight . This is something the city council has tried to look at at times. Reporter some sort of gas. This was the scene back in december of last year when Berkeley Police deployed some sort of gas and smoke and rubber bullets into the crowd. Went from a peaceful to destruction. Some press tours threw rocks and items at police which led to confrontations between officers. Officers a few nights after the first patrol test another one broke out. That action angered some of the City Council Members who said back in december more needed to be done. Use of force against protestors. Reporter some of the recommendations before council is having the Berkeley Police officers wear body cameras and also putting cameras on their dash boards of their cars. Police in sunnyvale are investigating a shooting involving an officer from another south bay city and suspected car burglar. Ktvu fox 2 reporter janine de la vega is joining us from sunnyvale to tell us how this all unfolded. Reporter this intersection at wolf road was shut down for several hours last night. As you can see, it has reopened to traffic. Police are focusing their efforts on tracking down a White Mercedes sedan that put an officers life in danger. This started in the city of santa clara. They followed the suspects vehicle which was a White Mercedes sedan into the city of sunnyvale. When the sedan pulled over. Another that is when that officer sped toward them. I wish we had more details on the vehicle. Its just a white mer say tease sedan. We are canting to reporter the second officer in a patrol vehicle chased the mercedes on wolf road but lost it. Neither of the officers were injured. Its unknown if anyone in the mercedes was hit. They are unsure how many people were in the mer sigh tease and working on getting a surveillance camera. Pam. Weekend storms knocked out power to nearly 163,000 customers. We spoke with pg e this morning and they tell us all the storm related outages have been restored. A 17yearold boy is in custody for the robbery and rape of a pizza Delivery Driver in antioch. The 22yearold driver tells police she went to deliver pizza at a home on blue bell circle sunday morning. A car theft suspect led police on a wild chase. At one point during the chase yesterday the driver crashed a getaway car, got out, and tried to carjack the driver behind him. Take a look at this. He couldnt get the door open so he ran toward another car. He just came up to me and pointed the gun at me and told me to get out of my car. And he just took off on it. Do you know they got him . Yes. They let me know. He was pointing at gun at me so i just stopped the car and ran. Do you feel lucky you were not hurt . Tell us about that. Yes. I was just scared he was going to hurt me. Obviously very scared. He did take off with her car and sped away. The chase came to an end when the man got caught in traffic. He got out and tried to carjack another car. After that police opened fire. The man was wounded, arrested, and taken to the hospital. We now know man about the mark andrus died saturday of gastrointestinal bleeding and shock at a local hospital. He was arrested january 30th after the discovery of a suitcase containing body parts. The body has not been identified. Police source says investigators does not believe andrus acted alone. Tony riviera says with a key person of interest dead, investigators will have to rely on forensic work and interviews to close the case. Retracing activities. Talking to people. Trying to find a path that leads to the murder of the individual. Our Police Source also says andrus was a heroin addict and his body showed the effects of a hard life. We also spoke with his brother. He said he had not been in touch with him since his release from jail but says he was a good person.
