At oakland Childrens Hospital this morning. That is where the family of a 13yearold who has been declared brain dead is making another effort to try to keep her on life support. As a matter of fact, weve been looking at the commute at the toll plaza. There is not much of one. However, there is a little bit of slow traffic. Next week we might have we will look at this commute at this time and there wont be anyone on the road. Right now we have a little bit of a backup. Also the morning commute looks good on north and southbound interstate 880. And if you are driving this morning in the south bay, the traffic here looks pretty good. The family of jahi the 13 yearold girl on life support, they want a judge to block Childrens Hospital from taking the child off life support. Ktvu Paul Chambers is at oakland Childrens Hospital right now with all the latest developments in this case. Paul. Reporter good morning, dave. The attorneys family will ask the court today to file an injunction to not take the young girl off of life support. They will also ask for her full medical record. Last night the mother jahi asked the hospital at least to keep her around through next week. [ inaudible ] reporter now you may remember the 13yearold came to Childrens Hospital earlier this month to have her tonsils removed but complications from that procedure caused her to go into cardiac arrest. He was later declared brain dead. The family tells us they also asked hospital officials for a feeding tube and a Second Opinion about whether or not jahi has a chance for recovery. I dont know if i can do that because jahi is dead, dead, dead. He yelled it. He pretty much yelled it across the table four times. He said we cant do that. That is an unusual request. Jahi is dead, dead, dead. With no compassion at all. Reporter the hospital says they cannot comment about this case because they do not have permission from the family. Happening now in Solano County a power outage has left more than 4500 people without power this morning. Ktvu Tara Moriarty is live for us in benicia and says this is the second time the area has dealt with an outage in just a seven hour span. Tara. Reporter that is right. I dont know how these people are keeping warm. It is very, very cold out here. It is especially dark. Pitch black down the street. The only light we can see is right here off of turner. Turner drive. And you can see pg e crews are busy right here. Trying to fix the problem. Pg e says three outages were caused by an under ground transformer that failed. Pg e spokesperson says they werent sure if the explosion last night was related to this second outage. Definitely looking that way. We spoke to one man who said that his family has been trying to keep warm ever since they lost power last night. I would build a fire in a fireplace and stock more logs on there. Get it going. It was it helped. It helped a lot. You used a lot of blankets last night. Yes. It was chilly sliding in those cold sheets. Reporter last nights explosion happened at 7 30 and a neighbor shot this cell phone video showing flames shooting from the ground. About 3500 people lost power. All but 950 customers had power restored. Most of the outages have been concentrated in the areas of rose drive and columbus parkway. Again the power went out again three hours ago. They are expecting to have all power restored by 9 00 this morning. Time is 6 06. A huge fight outside of Oakland High School leads to three arrests. I want to show you cell phone video sent to us from a viewer. Police say two girls started fighting and one of the girls pulled out a stun gun when a Police Officer tried to stop the fight. When police tried to detain her they say she passed the stun gun to someone else who police say put up a fight when they tried to detain him. Police made three arrests. The investigation continues. Later today in santa rosa a rally is planned in memory of andy lopez. The 13yearold killed by a sheriffs deputy. Rally organizers who have been holding vigils and protests since that shooting in october they want rally participates to wear the color white and bring candles. Protest starts at 4 00 p. M. At Santa Rosa City hall. Deputy eric who went back to work this month after the shooting says lopez was holding what looked to him was an Assault Rifle and lopez ignored orders to put it down. The teenager accused of setting fire to the clothing of another teenager is due in court today. 16yearold Richard Thomas is charged with aggravated mayhem and felony assaults with a hate crime. Prosecutors have charge the thomas as an adult but his defense attorney will argue that the case should be sent to juvenile court. San Francisco Police are searching for a robbery suspect who critically injured a 71 yearold woman. The woman is walking to church near mcalter and mcarthur street wednesday morning when a man tried to steal her purse. There was a struggle and the thief punched the woman in the face. He was rushed to the hospital with critical injuries including bleed together brain. Your time is 6 07. Police in reno say a Northern California man accused of opening fire at a urology clinic in reno may have been angry about a botched vasectomy. He had adverse symptoms from that surgery in 2010. They say he walked into the waiting room on tuesday. He had a shotgun and two handguns and said he was looking for physicians. He is accused of shooting and killing a doctor and wounding two people before turning the gun on himself. We located a typed letter and it came to the suspects intent to commit this act. We also located other firearms in the restaurant. And the suspects actions during this incident were to be his final actions. Last night out in the cold dozens of people gathered outside the clinic for a candle light vigil for those shooting victims. Mourners say they may never be able to make sense of what happened in that attack. Many medical marijuana businesses in san jose may soon have to close. Ktvu has learned the city located pot clubs that they have to close by january 31st. The Code Enforcement department sent letters to pot clubs. New restrictions will take effect next march. There are 82 operations in san jose. Tesla is fighting back after claims of another fire. This time in a garage. There is report of a fire on the irvine campuses. The fire happened in a wall socket where a model s plugged in but the car did not burn. Tesla is already on the defense after two model s sedans caught fire after running into metal debris on the road. Holiday volunteers at Sacred Heart Community service in san jose are getting ready for this mornings annual toy giveaway. Look at all the toys. Senate passed a defense bill that includes changes on how the military deals with Sexual Assault in its ranks. The legislation would take away the power of military commanders to overturn jury convictions among other provisions. The bill also patrol sides more than 552 billion for the regular military budget and more than 80 billion for the war in afghanistan and other overseas operations. A report being released today analyzing the secret service concludes the agency does not have a wide spread misconduct problem. The report from the Homeland Security departments Inspector General was ordered after more than a dozen secret Service Agents were implicated in a prostitution scandal on president obamas trip to columbia. Its an attack on a bus in seat. Look at it a gunman walks up to the passenger and points the gun directly at him demanding his cell phone. Instead of giving the phone the passenger fought back. That gunman stole the phone of several passengers. They joined in and started to beat and kick that gunman. He came up to me and stuck the gun at me and took my phone. He jabbed me a little harder and said dont make this harder than it has to be. No one was hurt. The 19yearold suspect pleaded not guilty but he is facing up to 15 years in prison if he is convicted on charges of robbery and attempted robbery. Time is 6 17. We want to go back out to sal sal. Later on this morning, they will have the opportunity to shop for free for their kids. Many of them cant afford to buy presents. They are trying to scrape by and pay their rent and utilities. This year they registered 6,000 kids from needy families to be part of this holiday giveaway. That is the most ever they have registered at sacred heart. The charity didnt know if they could handle it. Yesterday they were 7,000 toys short. This morning they are still 3,000 short. They will have enough to give away to parents and kids today but they wont have enough for monday. If people make a financial donation, we can go out and buy in places where we are short. We have volunteers ready to go out to local stores to purchase that. Reporter parents will be able to pick out two toys and either a book or a puzzle today and on monday. One of the area where is the charity is hurting is gifts for teens. As you can see there is a lot of toys for younger kids but not a lot for the older children. Sacred heart is giving gifts to kids that are up 18 years old. They also need more books. Because its a priority for the charity to promote literacy. Happening today the family of 13yearold jahi continues their legal battles this morning. She was declared brain dead after what was supposed to be routine tonsil surgery. Childrens hospital and ask that they get a Second Opinion about her possible recovery. That meeting didnt go very well. They are the ones that put her in this position. We dont trust what they say. We dont trust their test. He looked across me and says i dont know if i can do that. Jahi is dead, dead, dead. Reporter now you may remember she was brought here to have her tonsils removed. The family tells us during last nights meeting they also asked hospital officials for the young girls medical records and a feeding tube. Jahis mother said she asked doctors if her daughter could remain on life support until after christmas. Doctors told her no because they want to remove her from the ventilator as soon as possible. I looked that man in his face and said you better not touch her. You better not take my child off that machine. You have no right. You do not have my permission whatsoever to take her off. Reporter oakland Childrens Hospital says they cannot comment on this case because the family has not given them permission to release thissen we continue to work closely with the family to support them during this painful time. New this morning Senate Majority leader harry reid has been admitted to the hospital after complaining that he didnt feel well. Multiple sources say tests have been conducted and everything is normal. But doctors have asked that he remain in the hospital for observation so he will not be returning to work today. Reids hospitalization comes as the final workday of the senate for 2013. Authorities in london are investigating what caused part of a ceiling to collapse inside of a packed theater. 80 people were hurt. Seven of them seriously when chunks of the ceiling started to fall on people. It happen the during a nearly sold out performance. More than 700 people were inside at the time. Some witnesses say they heard a strange noise before the plaster came crashing down. We thought it was part of the play. The ceiling came down. A lot of dust, chandelier, wood and all that stuff landed on about five or six rows. The theater is more than 100 years old. Authority says the building is now secure as they continue to investigate. Time is 6 46. One week after a shooting at a colorado high school, students are being allowed to go back to school to pick up their belongings. Yesterday juniors and seniors they were allowed back into arapaho high school. Today the freshmen and sophomores will go back. Last friday the students evacuated that School Leaving everything behind when an 18 yearold fellow student started shooting. Memorial in front of the school is paying tribute to claire davis. She was shot and remains in a coma. The shooter killed himself in the library of the school. Back here at home just 18 months after opening its doors an Oakland Charter school that was hoping to boost the Achievement Level of African American boys will close down next month. 100 black men in Community Schools will close january 24th. It suffered from financial problems, low enrollment, and high staff turnover. Members of the 100 black men Nonprofit Organization created the Charter School in the former Thurgood Marshall school. One of the schools Board Members says the Charter School may possibly reorganize and reopen in a couple of years. Billionaire bill gates gave a red member Rachel A Christmas surprise of her life. Federal officials have filed criminal and federal charges against a former may com soft worker. He fed inside information to a friend that was a day trader. They new this morning a Company Based in san jose recalling more than 700 pounds of sausage because it may be contaminated. Lee Brothers Food Services Incorporated is recalling 16 ounce packages of lee sandwiches brand pork sausage produced on february 11th. It has the id code 042p. And also 16ounce pork and chicken products with a code of 043pc. The sausages were sold here in california, in arizona, nevada, and also online. So far there is no word of any illnesses reported. If you have paid a parking ticket in oakland, you may get a refund. The city auditor says the city of oakland broke a state law. It didnt notify people after they overpaid their parking tickets dating back to 2008. Ruby says she first noticed this fiscal year with 316,000 in overpaid tickets. And we knew that was just the tip of the iceberg. Since the audit, the administration has gone back and scrubbed their books. And they have identified 2. 3 million.
