Reporter the family went to Juvenile Court and the suspect was convicted of having oral sex with a minor but the Palo Alto School officials have declined the on camera interview about the case but issued a statement saying that the district was aware of the issue, look into it and said administrators took appropriate discipline air action. Reporter the School Officials and county da said they cannot talk about it due to the rights of the federal Education Rights act that protects the records of minors, attendance, grades in criminal activity cannot be discussed or released. Reporter the legal expert disagree saying that Legal Protection should apply not only to the accused but to the hundreds of students that could be at risk. Failure to do so could leave vulnerable to a lawsuit. The schools have a duty to protect their students and they stand in the shoes of the parents that entrust their students to the school every day. The alleged victim did not want to talk on camera but her mother said the encounter started as consensual but at some point she said to stop and he did not. The mother filed a Police Report with the Palo Alto Police but no charges have been filed. No one at the school can share information about any allegations or convictions. Even if the School District thought the law was unappropriate or unfair they cannot turn over the information at risk of losing federal funding. The school has no discretion.
