A rally in San Francisco expressed support for a man shot to death by police, as a civil rights lawsuit gets under way. The parents of Alejandro Alex are suing four officers in federal court for wrongful death and excessive force. A jury will decide whether police acted reasonably when they shot and killed the 28 yearold in march of 2014. Officers were responding to a report of a man with a gun acting erratically. Police say they believe their lives were in danger, as alex nieto pointed a gun with a red laser light at them. It turned out to be a taser, one the man used for a job as a security guard. Alex nieto was struck at least 10 times. [ speaking spanish ] very emotional to see all of these people supporting us here and that they know that alex was such a good young man. A good young man, good student. He always liked to help others. Jury selection in the federal trial is now under way. The trial is expected to take about a week and a half. In the south bay, a preliminary hearing continues today for three Santa Clara CountySheriff Deputies accused of beating to death a mentally ill inmate last august. Another inmate, juan perez, testified this morning that he saw the three defendants go into the cell of 31yearold Michael Tyree the night he died. He said he heard tyree screaming, please stop. Perez says he heard sounds like someone being stomped with boots or feet. This hearing will determine whether there is enough evidence to take the case to trial. Today is super tuesday, the busiest voting day of the primary season. Donald trump and Hillary Clinton are up in the polls, but the other campaigns are fighting hard to catch them. Caroline shively has the latest from washington. Reporter the race has finally gone national. About a dozen states have the power to revive, kill or lock up the campaigns that remain in the race today. Donald trump has a massive lead in National Polls and in most states voting today, and he isnt trying to lower expectations. Were going to win, win, win, win reporter but trump is railing senator ted cruz in texas, which has more than three times the delegates of any other state voting today. And we are entering the phase of the primary where delegates begin to really matter. The first few states, the first few primaries serve a function of winnowing the field. The meeting in the oval office, the group discussed the Supreme Court vacancy left by the death of justice antonin scalia. President obama has said the senate has a constitutional responsibility to consider the nominee he selects, but following the meeting, reid said the gop leaders adamantly refuse to budge. The director of the fbi and apples top lawyer are in washington to testify on capitol hill in their dispute over access to an iphone used by one of the San Bernardino shooters. A Congressional Committee is holding a hearing on the issue at this hour. Apple has refused to create new software to unlock the iphone used by syed farook, saying that would set a dangerous precedent. But the u. S. Attorney general says Tech Companies have helped in other cases. In every single one of those cases, we have gone to court with a narrowly crafted request and said to the court, is this something that we can obtain under the law . And the courts have said yes. Weve then gone to apple and said we need your assistance here. Where they have chosen not to, we would go back to court and say could you please direct them, as you do companies every single day, to work with us. The hearing comes one day after a new york judge ruled the government cannot force apple to unlock an iphone in a brooklyn drug case. Families of the victims in the San Bernardino shooting have mixed opinions on whether apple should be forced to provide access to that iphone. The husband and survivor of the attack last november says he doubts theres any useful information on the phone, which was farooks work phone. But the father of another victim says the phone could contain what he calls critical information if others were involved. Now to new developments today. The u. S. Government has released a new batch of documents seized in the 2011 raid that killed alqaeda leader osama bin laden. Among the documents, his hand written will. Bin laden asks most of his fortune, which he estimates at 29 million, be used for jihad. According to the washington post, its not clear what happened to that money. The will is among some 100 documents released by the director of National Intelligence today. Richmond police are worried about possible retaliation after a 14yearold boy was shot and killed. Family of Xavier Mcclanahan say he was a freshman at kennedy high. He was shot several times yesterday morning while on a bike path near his school. Police say they believe he was targeted, but have not revealed the motive. Family members and friends say he was a funny and good person and that the shooting is a somber reminder of the dangers of living in the iron triangle. Hes not one of those hard heads, oh, i could do this, do that. He was actually a cool soul to be around. Nowadays, youre lucky to see the age of 16, let alone 18 or 21. A reward is being offered for information leading to the arrest of the gunman. In oakland, police are investigating a shooting that sent one woman to the hospital. It happened last night in east oakland. Sky fox was overhead, as emergency crews responded and one person was taken for treatment. At this point, police arent saying much. They tell us no arrests have been made. We do understand the victims injuries are not life threatening. Several state lawmakers introduced bills this morning, calling for tougher gun laws. Surrounded by guns themselves, lawmakers introduced assembly bills, four in all. Each bill is aimed at closing some sort of loophole when it comes to gun purchases or the use of a gun. One bill would change the definition of an assault weapon and the ability for a user to attach a magazine. When you look at the bullet buttons that in particular that just by magnet clip onto the bullet button so it essentially just works like its a part of the gun, you know that they are evading even the strongest laws in the nation. The bills are supported by democrats in sacramento. No republican lawmakers have come out in favor of them. There is no word yet on if governor jerry brown will sign the bill, if approved. Jaycee dugard has written a new memoir freedom, my book of firsts to be out in july. Dugard was kidnapped when just 11 years old and held prisoner near antioch. She bore children before she was rescued in 2009. In a press release, jaycee dugard said, quote, i still believe we each hold the key to our own happiness and you have to grab it where you can in whatever form it might take. Her kidnappers were sentenced to life in prison. The Golden State Warriors are back at home tonight, but could they be without two key players . We just learned the coast guard is not resuming its search for a man who went missing yesterday in the waters near half moon bay. The coast guard says the man was last seen struggling in the surf at dunes beach about 2 00 yesterday afternoon. Another man jumped in trying to help him, but was not able to. The coast guard sent out two boats and a helicopter to search for the man, but was forced to suspend the search at sunset. In san carlos, work crews are making repairs after a dump truck slammed into a home yesterday afternoon. It happened when the truck failed to stop at an intersection, lost control, then slammed into the home there on windsor drive. Fortunately, no one was inside the home during the accident. The home has now been red tagged. Neighbors say this is not the first time this has happened. They say two years ago, a barrier was built after an suv crashed into the same home. Its terrible. Its just not a safe place to live, you know. Weve always been worried coming down the drive, always joked, what an awful place to have a house. Its just on a really bad corner. The 29yearold truck driver told chp the brakes were not working properly. Officers did come back out this morning to take measurements for their investigation. An overheated shuttle bus, blamed for sparking a fire ball at a San Francisco gas station. That forced an employee to act quickly. Take a look at the intense scene all caught on cell phone video. The shuttle bus was empty except for the driver when it pulled into the chevron station at 9th and howard. As the driver calls the mechanic, the engine begins to smoke and then catches fire. Employees and customers were ordered to leave. They came runningback and said we need to evacuate. The gas station is on fire. So we left the building, heard an explosion and then ran down the street and got out of the way. Saw this big column of black smoke. Officials say the stations assistant manager prevented a major disaster by quickly turning off the gas to the pumps. In all, one firefighter suffered a minor injury. San francisco Officials Say the last of the homeless encampments on division street have been cleared out. This morning, about 50 department of public works crews and Police Officers arrived to move out the homeless there on division street from south venice to 11th. Just days ago, the area was deemed a Public Health nuisance because the amount of garbage, hypodermic needles and human feces. Crews began cleaning up the area just after 4 00 this morning and they say about 90 of the homeless have complied with the order to vacate. Its like my home, you know what i mean . Ive been here a few months. You dont want to think thats going to happen. I dont know where to go now. Down the street . But a group of about five Homeless People refused to leave the encampment on mission and division. They say they should not be punished for something the city forced on them. They say going to the citys homeless shelter there at pier 80 is an unsafe option. This is a situation for the mayor and the manager have brought out of control. This is not our responsibility. We shouldnt be it shouldnt be dumped upon us. We shouldnt be used as scapegoats. Crews set up Police Barricades and signs, warning of no soliciting and no camping along division. Police made no arrests. Some of the homeless say they dont know where they will go. In san jose, cleanup continues today at a homeless camp where more than a dozen people have been ordered to leave. Cal trans crews started dismantling the camp between 880 and highway 87 near rosemary gardens. The mercury news reports health and safety concerns are what sparked this move. More than 20 People Living in the space were given a 72hour notice to leave. The Berkeley HealthDepartment Today trying to track down the source of a flu like outbreak at uc berkeley. According to the Student Newspaper there, some 30 students have reported illnesses with similar symptoms compared to norovirus. Some say they started feeling sick while attending a dance competition at oaklands theater. Some of yosemites iconic landmarks have new names as of today. Park employees started covering up the old signs over the weekend at midnight. The hotel will be known as the majestic yosemite hotel. The lodge at the falls will become Yosemite Valley lodge. Curry village and the Badger Pass Ski Area will be half dome village and yosemite ski and snowboard area. The name changes are part of a legal battle over trademarks. Looks like the north bay will get the only chance at seeing a few scattered showers. Here we are at the noon hour. There is your line of rain. By 3 00, 4 00, 5 00, it begins to move through. But notice not a lot showing up in the bay area. Well turn mostly cloudy, especially over the north bay and we may see just a few light showers as we get into the second part of the afternoon, a little closer to sunset. I want to take you into the next possibility of some rain. We are all likely to get in on this one. It comes late tomorrow night over the north bay first while we sleep, shifting into the central and south bay. After a warm and mostly dry february, state surveyors returned to the sierra this morning to measure the snow pack at echo summit in the central sierra. It measured at 105 of normal. Our recent warm weather had officials concerned the heat could be melting the above average snow pack. The survey determines how much water the crucial snow pack will hold for use in the spring, summer and fall. That San Francisco das office Just Announced charges in connection with an alleged gladiatorstyle fights in the county jail. The District Attorney gascon says two sheriffs deputies are facing felony and misdemeanor charges and one former deputy is being charged with several felonies. Inmates say they were threatened or denied food if they did not fight each other. The allegations led to an investigation involving the fbi. To my knowledge, they have not yet surrendered themselves into custody. They will do so in the next 48 hours. A court date has not yet been set for the deputies. Today, mobile Payment Company square is rolling out another feature it says is better than good oldfashioned paper money. The San Franciscobased company says cash drawer will allow you to maintain a balance through the app. Instead of depositing money in your bank account, the cash drawer lets you carry that money on the app to use later on. The feature could make square cash more competitive with paypal. Changes are coming for people who have costco credit cards. Starting this june, costco will no longer accept the companys American Express cards, this after American Express struck a deal to sell its branded portfolio to citigroup. Last year, American Express was replaced by citigroup and visa to take over the cards. Customers with the old cards will be sent new ones without having to apply again.
