I want to tell you about highway 17. One southbound lane has reopened and northbound lanes closed. Ch p is expecting northbound lane to be closed all night and not getting through to santa cruz but one lane is open. Highway 37 is closed between aberton and highway 101 in both directions. A wrongway driver get on the freeways this afternoon on highway 4. This is a live picture of highway 4 and hit by a big rig and the driver realized he was going the wrong way and hit here and a major accident. Eastbound highway 4 is very slow and they made progress in the crash but this was a wrong way driver, highway 4 near bailey and realized that he was going the wrong way and tried to turn around and smacked by a big rig. Reporter residents in felton moved quick over the San Lorenzo River overflowed. You can see where i am standing it is kneedeep and one southbound lane of 17 has reopened but not after the mudslides caused afternoon headaches. The Santa Cruz Mountains pounded by heavy rain and major problem was this landslide in highway 17 outside of santa cruz. A headache for the c h p and they are used to it. It happened this morning about 10 00 a. M. You can see the dirts and rocks. As far as cleanup, the last estimation it will last through the night. In downtown santa cruz, river levels reached 23 feet and nothing compared to what the san lorenzo did with three inches of rain. As it overflowed, bernardo baltista was working from home. When you looked at your backyard and see the river, what goes through your mind. I went to work at six and my daughter called me at 8 and we get news alerts because we are on the river and got alerts and my wife and daughter called and i came back up at 8 30 and did what i needed and within an hour it was coming through. And they are saying three inches of rain. I know and ways funny the prior couple of weeks they say it was worse and this time they said it was not that bad but it was way bad. Getting into fell ton was a challenge. Trees down on summit and with chain saws it was neighbor helping neighbor after the mudslides brought down the trees and rocks. This slid last week and the city came and did small things but it was going to go obviously. We have been waiting for the tree service to come and they couldnt make it. Back here live. One southbound lane of highway 17 has reopened and hoping that the northbound lane will reopen but again they are saying that could take all night. It is called runoff been the ground is saturated and nowhere else to go and it seeks out a path like this one and this paths is bone dry during the year in san rafael. But when it cant find a friendly path it starts to cut in the ground and that is what caused todays slam slide. This is all that is left of 287 Mountain View avenue. A five bedroom split level home. It began as the future was taking one of his children to school. When he got home, firemen and public works crews were on the scene. One clearly worried about time asked him a pointed question. He asked us if anyone was in there and said to get them out and i said get out and there was a slide behind the kitchen and it came through the kitchen door and we ran out through the door and in the middle of the rain and watched it over the next 90 minutes slowly roll to what it was. It was a split level garage that you cant see anymore. The deck blew out and that came through and then you could see the main part of the house move and the chimney went and the living room windows popped out and it kept getting pushed forward with the power of the mud. And then there was another slide further up the hill and sheered the house. Im very lucky it was kind of in slow motion and all four of us are out and the dog came out and the fireman, god bless them got the cat. Nonetheless completely unexpected. There was a lot of vegetation on the hill. I was more worried about the fire danger in the spring and summer than the sliding. I would have thought it would have been held up. This may not have been over. This is yosemite and this is san rafael. And the ground is so saturated that the water has nowhere else to go but down this usually sparse or completely dry waterfall. This is powerful water and carves the land and great for creating dangerous mudslides. Regular Home Insurance or Flood Insurance does not cover this. Landslide insurance is virtually impossible to get and back breakingly expensive. Despite the disaster. John future says he will football coaches be defeated. That hillside that is behind that house and behind several other houses that is weak is now a work in progress meaning the water is squeezed out of it and that new face is susceptible to future rains coming in 24 hours. From a three judge panel from the 9th Circuit Court of appeals heard legal arguments about president trumps executive order banning 7 nations. Others argued that it broke up families and the Justice Department says it has broad powers to protect national security. I cant believe we have to fight to protect the security of our nation. I cant believe it. Homeland security secretary john kelley went before congress where he apologized for not looking at the leadership before it was rolled out and whether or not to deny or stay the order is expected later this week. David levine a professor at a law school listened to both sides and how do you think they did. Everybody did well. The two lawyers are extremely good professionals and well prepared and the judges were well prepared. Now remember they knew they were getting this case a few days ago and ordered briefings where one came in sunday fight and one came in monday afternoon and here we are tuesday and everybody was ready to go. So from the point of view how did they handle it . They did beautifully. Each side had 30 minutes to present their side. Can you summarize each argument because it gets complex. A complicated case. The core of the United States governments argument is that the president wrote an order that is facially valid and has tremendous power under the authorization from congress to make an order like this and nothing to do with the band on religion. But from washington even if the face of the order looks okay its intent was to ban moslems and prefer christians when they open it up and that can be reviewed. Does the president get to do this without any review in court or is there some review in court . There was a three judge panel. One appointed by a republican president. Could you tell from the questions which way the judges were leaning . Well, i think when you look at it especially i was looking over my notes and when you look at it when the judges were talking to the u. S. Attorneys position, they were talking to that person and really pushing him hard on the weak parts of his argument and the flip was that when the attorney for washington was pushing hard. The one attorney pushed the bush and the others pushed the attorney from washington. It looks like it was partisan but when you look at the whole thing it wasnt at all. The judges were doing their jobs. We are expecting to hear this week possibly a ruling. Walk us through what happens. A lot of people are saying whoever loses could appeal to the u. S. Supreme court. Tell us about that. Right. Well it certainly is true that they could try to go to the supreme court. And the core problem there is that whoever loses would need five votes to get relief. It is hard to imagine at this early stage that either side could go under five votes. If it is a split the law of the land would be whatever the 9th circuit ruled, correct . For the time being because we are in a very preliminary stage in the whole proceeding. The United States government pushed this appeal mush earlier than would normally be done so even if the 9th circuit says we will leave this day in place it goes back to seats for further proceedings and come back to the 9th circuit and go to the supreme court. Quickly because we are running out of time which way do you think the Circuit Court will rule . Basically they will uphold what the trial judge did. They may limit its scope in different ways. It has everything its need a low center and moisture plume and it is getting or giving us a bit of a break right now this is a nice. It will give us a chance to settle things down and flood watch is dropped and the wind advisory dropped and we are seeing showers down around hollister and pebble beach, the showers ending but they have had heavy rain all day. We have alianna down east polly anna. You were looking at the rain from the hills. There must have been a lot of water flowing. Neighbors say that rain that came down was a lot more than they have seen. Obviously a lot of rain here more than a lot of people have seen given the drought that they have been in for years. Cal trans crews trying to get rid of the debris that you see because they were excavating and you can see the debris next to me and i am told by East Palo Alto officials was a quarter of what we found. We found this volleyball and amongst the debris and all of that was pulled right here from this creek. Look at how fast it is going. Whoa. This creek was a spectacle. Palo alto neighbors stopped to take pictures. In the 34 years i have lived here. I have never seen it this high. Large trees rushed down the creek as it continued to rise closer to the top of this barrier. It piled up among the debris leaving the water with nowhere to go. Cal tran call in this excavator to prevent the water from spilling over the edge. It is a lot of water and concerned for our residents. I what about them to know we are doing everything we can. Out of precaution, a voluntary evacuation was issued in East Palo Alto. Cal tran had a place to drop the debris. Sand bags lined up and on the other side of the creek workers started to lay theirs down to stop the Rushing Water from filling the inside of this shop. High tide at 10 30 this morning. So thats when the big crest starts to hit. Scott walked us through the flooding and showed us the sump pump he purchased after that storm in 1997 that sent water flowing. The project is doing its job but they have a flap here that had an old valve that is closed up by the city. And thats blowing water up. We put bags in the wood all over it trying to stop it and we have a drain that backs up and we can drain out and we have all of this that they were trying to steal this. But they ran out of time. The city officials told me they were holding to lift that temporary or voluntary evacuation earlier. Im checking my twitter account and i saw on twitter that they have not lifted it yet. We spoke to neighbors at the Woodland Creek condos and werent concerned that the water had not come to the parking lot. This was obviously the main concern given the debris and East Palo Alto officials will be back out and officials will be back out here tomorrow removing the debris to remove the roadway and as i mentioned high tide expected tonight the creek will rise low to exceeding levels. We will keep an eye on that. We wap to talk to bill again. Watching this saying an hour more of rain could have sent things off of the chart. The creek got up to the edges and literally the rain stopped. Another hour of rain like that, same with san lorenzo and the same with Alameda Creek and coyote creek. Got to the edge and we were fortunate that rain stopped. Eventually what is going to happen is one of these. Hopefully not this thursday one, one will stop on top of us and we will see Russian River was at flood stage. How is the Russian River doing . It peaked. If we deposit have this break tomorrow, Russian River would be flooding. Back to the same point that we are talking about the same thing on thursday night. Yeah. We will. I think the Russian River and the napa river will get to the banks base on the forecast models and we get the break after that.
