New developments in the emissions scandal involving volkswagen. Today two volkswagen customers filed a Class Action Lawsuit saying it falsy used tests in the bay area that said the cars complied with laws. Ktvus tom vacar live in the news room with more on this. Reporter three companies with bay area connections could go a long way in proving how deep the scandal may go. Reporter lawyers for two bay area owners say the information is in the hands of volkswagen and two other companies. People who have data that will help point the finger as to who knew and when they knew may be in the possession of folks in the bay area. Reporter volkswagen has a laboratory. It had two firms test how well diesel fuels worked in the cars. They make alternative fuels from algae. They make alternative diesel out of sugar cane. They allege they had those results reviewed by experts. But last june when volkswagen used the results to brag about how clean and well performing they are, they made no mention of what the university of virginia found. When they are looking at the data from those tests, it concludes that the emissions, which are at the heart of the cover up, were found to exceed epa standards by factor of 15 35 times what was permitted under the epa for the jetta. Reporter if they were able to fool the Environmental Protection agency as it did, as well as the California AirResources Board then it is possible they fooled the two bay area firms as well. We are not saying they were complicit. Reporter they did not get back to us but they said all it did was pour its fuel into the vws provided to it, kept a log and never had access to the computer that they had attached to the car to gather data. New information about a hit and run that injured a man walking in San Francisco last week. Police say the driver was in a blue ford ranger pickup truck similar to this one. The 31yearold victim was walking on san jose avenue in the Mission Neighborhood when he was hit. Police found him on the sidewalk unconscious. Police say the truck should have damage to the right front corner at the passenger side head lamp and parking lamp area. The victim is still in the hospital. Traffic is moving on Mission Street through downtown San Francisco but it was a mess this morning after a semi knocked a tree over on a muni line. Authorities had to close Mission Street. Fraser smith has been locked up since 2006 when he pleaded no contest to assault with intent to commit rape. This summer there was a plan to move him into a home.
