As we come back out here live, you see there are cameras overlooking this back staff parking lot on campus. We dont know if surveillance cameras caught this crash. To recap, an instructional aide, a woman was seriously injured when she was hit by the gate and by that white suv behind me. This vogues is ongoing as to what led to this crash. Hen write, was this working henry, was this woman walking in front of that gate and how fast was that suv going . It literally ripped that fence off of its hinges. We do know that the instructional aide happened to be the sidewalk on the other side of the gate and on the opposite side was this white suv. We dont know if the driver mistook the brake for the gas but certainly traveled very fast to travel about 40 feet before coming to a rest. You see that gate is still implanted between the suv and the silver vehicle so what led up to it and how fast driver was going is part of the investigation. And the woman in surgery. Thank you. Now to new information on President Trumps executive order to cut funding from sanctuary cities like San Francisco. A federal judge today blocked that plan from moving forward. Tara is live with reaction from both the mayor and the City Attorney. Reporter you know theres been a lot of anger and frustration here at city hall since Donald Trump Took Office quite frankly. The mayor has been stressed about how hes going to balance a budget with nearly 2 billion missing so today, there was an enormous sense of relief. The City Attorney saying that he is extremely pleased with be judges ruling which will not allow the federal government to take that huge chunk of money away but rather a sliver of it. Herrera and other counties filed lawsuits challenging the executive order which directed his administration to withhold all federal funding from sanctuary jurisdictions. The judge ruled that trump exceeded his president ial authority when he signed that order. The court sided with us on every substantive issue. His first 100 days have been a disaster. The money that was at stake for San Francisco, anywhere from between 1. 2 to 2 billion paying for everything from medical care to Public Infrastructure and transportation. The mayor said he can now enter the budget season with clarity. This was not just a victory for the cities but its also in my opinion, it gives a little more calm to the residents of San Francisco, particularly immigrant populations. Theyre living in shadows. Some of them are not going to school or seeing their doctor or reporting to the police. The president does have some power to withhold funding, specifically three Justice Department grants tied directly to Immigration Enforcement but for the sanctuary cities nationwide, today was a win. Yeah, we know that this judge issued this ruling but did city officials talk about the chance that if President Trump goes back and makes some changes to maybe neat judges concern meet the judges concerns, are they concerned they might be back in this same situation with potential for losing funding . They seemed pretty confident. Dennis herrera says the arguments have been very strong. Obviously this is not completely over but they considered it a big win today and i think they are pretty confident that its going to stick. All right, thank you very much. Meantime, officials in santa clara are also celebrating that ruling. The county was at risk of losing 1. 7 billion due to its sanctuary status. Nctuary status. Todays ruling is a message that no one individual is above the law or the constitution of the united states, not even the president of the united states. Today, the judge sent one very simple and clear message that is that and that is that this executive order is dead. County Officials Say the ruling say clear sign that the u. S. Constitution prevails. President trump issued that executive order to force states and local governments into helping federal immigration officials with deportation efforts. The man who heads up a boys and girls club was arrested on suspicion of child endangerment. Authorities say the man was arrested at his home yesterday. They say the department of Homeland Security had alerted them about a picture of a 6 Year Old Girl that he posted in a chat room that hosts child pornography. They tracked him through his internet address. The picture was not pornographic but it was taken at the boys and girls club. Investigators say he put the girl and her personal information at risk with the picture. We arrested mr. Gorky for child engangerment because endangerment because he not only posted the photo of the victim but also was able to access the boys and girls club server, if you will, remotely and posted personal information regarding the victim. State auditor Elaine Howell released this report saying that uc administrators hid 175 million in a secret reserve fund and the report says this happened just as they raised tuition and asked for more funding. The report also found the office of uc president overcharged the systems ten campuses to fund its operations, paid its employees significantly more than state employees and interfered in the auditing progress. Interference, obstruction, tampering, cover ups, delay, delay access, all of those are damaging, even one or two of them are so were going to be holding a hearing next week looking into that. Theres also a strong reaction from another state leader. California Lieutenant Governor and uc region Gavin Newsome is calling for a reversal of tuition hikes in light of the report. Certainly is a new development in that story. Thank you so much. Police are searching for five robbers who stole 24,000 worth of laptops andiphones from an apple store. It happened just after 8 00 last night at the village mall. Police say there were still a few customers inside, fortunately no one was hurt. Authorities say the robbers are in their late teens or early 20s. This same store was robbed last november when 40,000 worth of merchandise was taken. A deadly rollover crash closed a portion of a north bay freeway. The driver of a red nissan died in the crash this morning. It happened on the eastbound lanes east of glencoe road. Theres no word on what caused the crash. This afternoon, a federal judge blocked President Trumps attempt to withhold funding from sanctuary cities that do not cooperate with immigration officials. The judge says the president has no authority to attach new conditions to federal funding. Todays ruling in federal court cements claims by cities and counties that theyre entitled to government funding even though their sanctuaries. Police in Southern California shot and killed the driver of a car after a high speed chase. It began about 6 00 this morning after officers spotted two people inside a car that was reportedly stolen. Investigators say the suspects drove through red lights, speeding around cars, and nearly overturning at one point. The chase came to an end after the suspects drove into a dead end and thats when they tried to maneuver around the Police Standing outside their cruisers with their weapons drawn. Thats when police opened fire on the car. The driver was wounded and later died. The passenger surrendered. In la one person died and ten others were injured in a huge crash. It happened on ifive. One of the two big rigs burst into flames after colliding with at least two other vehicles. One car was wedged under the big rig. One of the injured victims is in critical condition. The Highway Patrol says a dog also died in the crash. That portion of the freeway was closed for much of the day. No word on what caused the accident. Water managers said today they know time the short to repair the oroville spill way. That comes as state representatives demand answers about the chain overnets that led to a mass chain of events that led to a mass evacuation. Department of Water Resources laying out a fast approaching november 1st deadline to reconstruct major portionings of orovilles damaged primary spill way. The deadlines and getting this approved and done are on a very short time line. I mean, theres not a lot of time between now and november. Reporter the briefing taking place nearly three months since close to 200,000 residents were evacuated. Dwr explaining extreme conditions following five years of drought. In 50 days of january and february of this year, 4. 4 millionacre feet of water went through the spillway and the power house when it was operational. So this is equal to the average annual run off. We need to get to the bottom of why that crumbled so we can make sure this doesnt happen again . I think the situation could have been possibly been improved along the way rather than getting to this year in a high flood year with a big disaster. Warmer today by a good 5 degrees. Nice day. No fog at the coast. You do see some, this is moisture, low level moisture. I think you can see that. Yeah, thats what happens when you get a weather system to the west of you. It pushes all of the moist air out in front of it and when it hits the head land, it gets lifted up and condenses. Thats what we have going on there and this is the forecast for overnight lows. You ski a few sprinkles in the forecast. Again, tomorrow morning, San Francisco, its a non event. If it glazes the roadway that would be a big event. I suspect the whole day is marked by mostly to partly cloudy and a few sprinkles showing up here and there. This is silvas second request. Reporter former stockton mayor sat in court while his attorney asked for a judge to change bail requirements. Silva was arrested last month accused of embezzling money from the club while he was mayor. His attorneys maintain his absence from the club is hurting the non profit organization. What they told us is that they were on a trajectory. They were providing a lot of services to that community and now that is shuttered. They have struggling to provide services. An attorney for the club even wrote a letter to the judge asking for silva to be able to return and accusing the District Attorneys Office of obstructing their own investigation adding quote the District Attorney refuses to provide our computers and our calendar of Upcoming Events which has crippled our club. The District Attorney did question how silvas absence is impacting the club saying they have no idea what the former mayor did there has anybody from the kids club stood up and said Anthony Silva is employed in this capacity, these are the duties that hes required to do and we as a body ask that he return do work to be able to do the duties that weve just told you . At this point, School Police are investigating what led up to this tragic crash but again, it seems to be that a female student who was unlicensed mistook the gas and brake pedals while moving an illegally parked vehicle. According to my information, this student was not a licensed driver so, evidently was not one of my students, and they mistook the drive for the reverse and thats how the whole thing started.
