The dui trial of Oakland Raiders linebacker al don smith got underway today. He has a prior conviction for vandalism and hitandrun. The incident resulted in his suspension from the raiders. He was a member of the 49ers when he was arrested. His former teammate nick moody was reportedly with smith at the time and is being compelled to testify. There are new developments in a pair of murders that stunned the bay area. Three drifters charged with killing a young backpacker and a yoga teacher. Ktvus Cristina Rendon in our newsroom with a plea deal that could change the course of this case. Cristina. Reporter one of those three young transients agreed to testify against the other two in exchange for pleading guilty to a lesser charge in exchange for his testimony to two people who have pleaded not guilty to murder which happened two days earlier. Kerry was killed in Golden Gate Park after attending a bluegrass festival. Legal analyst Michael Cardoza says the deal could give the prosecution a boost. They feel that, well, you know, we may not be able to bring the case forward without somebody that was actually at the scene of the crime. Step forward. A fast moving fire damaged boats docked in the oakland estuary. Dark smoke and flames could be seen coming from a houseboat around noon. Fire crews and a small boat battled the flames. It took 30 minutes to get it under control. One boat was destroyed. The incident raised questions about the oakland Fire Departments main fire boat known as the sea wolf which is sitting idle off jack london square. Fire officials tell as you look of funding is preventing the department from maintaining and why ising that vessel during such incidents. Todays fire also comes after a pier caught fire in the estuary just over the weekend. Investigators are now looking into whether the two incidents are connected. In the south bay an elderly woman had to be rescued from a threealarm fire that destroyed two mobile homes and a barn. Investigators say it started in the barn just outside the property of the main of the mobilehome park. Flames then spread across grass and engulfed two near by mobile homes. Fire Officials Say crews managed to rescue an elderly woman from one of the homes that had caught fire. There is no word yet on the exact cause of that fire. Reporter the day of action has ended for today but four students have begun a Hunger Strike over what they say is a lack of funding for the ethnic studies program. About 200 students marked across San Francisco State University in what they call a day of action. Among the protesters were four students who announced they had gone on a Hunger Strike beginning last night. They say they wont eat until the university fully funds the Schools College of ethnic studies. What i fear more than me dying or me hurting myself is that theres a future where my kid is not going to be able to learn about where he came from. Reporter the students want the university to set aside 8 million for the cause of ethnic studies, 3 million more than what the university provides. The University Says the program is overbudget and will make up the shortfall for now. With 8 million what we hope to do is grow and not just survive, but to thrive and to flourish as a college where we can promote research. Reporter but some say the program is vastly underfunded. Spring semester we can expect 40 less lectures. Ill be out of a job. There are no plans, as there have never been to cut the budget of ethnic studies. Reporter students also marched to protest any future fee increases. Five classes on top of being a fulltime worker. Thats pretty hard for me. I dont have time to sit down and rest. Reporter concerns come from a proposal that talks about fee increases to the inflation rate but that has not been adopted. Despite student claims tuition is not rising and class sizes have not increased in the last two years. Reporter now, students say they are concerned about tuition hikes down the road. As for the ethnic studies program, the students want to meet with the University President , but its unclear whether that will actually happen. Julie. Rob what about the students who are on the Hunger Strike . Have they said how long they plan to carry on this Hunger Strike . Reporter well, theyre starting out by saying theyre going to stay on that Hunger Strike until the program is fully funded. She says starbucks advertises the size of its cold drink cups in fluid ounces but she says that number is only accurate when you include how much ice is added to those drinks. She says the drink is advertised as having 24 fluid ounces. It actually has 14 ounces of liquid and the rest is all ice. Starbucks says customers, quote, expect ice to be an essential component of an iced beverage. Coming up tonight on the 10 00 news the heroin epidemic in the United States and the battle to fight it. One city leading that fight, San Francisco. Ktvus mike mibach joins us now. 124 people die every day in this country from a drug everydose. More than half from heroin and painkillers. Health officials in San Francisco tell me heroin use is actually up a lot from five years ago, and its no longer contained to the downtown area. Were talking pacific hates, the sunset district, and the suburbs. Tonight addicts actually invite us into their world of black tar heroin as we tackle a number of angles in this story at 10 00. As one user told us, heroin, in his eyes, its like coffee for my soul. The worst thing about heroin is that its never enough. You know, its just this black, gluttonous hole of dissatisfaction. And in order to be in possession of that kind of dissatisfaction, you have to literally give up anything and everything you care about. Its a real ripoff. Many users we spoke to mention the availability of no lacks an to noloxan, or narcan. While other countries are seeing staggering numbers of deaths, we found out there were 62 reversals in 20 10. That number jumped to 599 last year, and those are just family, friends, and by standers who stepped in to save a life during an everydose. There are actually hundreds of more reversals reported by San Francisco fire. Just recently the Fire Department launched a new unit called ems6. We go out there on the streets with them. Their goal, searching for people who consistently cross the 911 system. This is handson outreach, working hard to get people into treatment. The San Francisco department of Public Health says that is key in its Harm Reduction approach to heroin and opioid use. People from all walks of life have run into issues with heroin use, absolutely. What we see on the street, were seeing more of the people that dont resources that are homeless, that dont have a place that they can use in private, but there are definitely people from all walks of life that are using heroin today. Frank and julie, one of the addict we spoke to says wants help but physically, he doesnt want to do it because it hurts so much. Physically in pain. Hes like, forget about it. Heroin is such a scary drug. Ive talked to heroin addicts. They say, i tried it once and it just grabbed ahold of me what. Did you get out of talking to these people . The same kind of thing . I did. I had a different look at the drug going into the story, and a completely different look now that i finished it and watched the complete version of the an hour ago. Very powerful. Its not just the individual down in the tender loin. Thats the misconception. Thats heroin. It is out there. One of the prime reasons is overprescription of opioids, according to the Health Department in San Francisco, because when that happens, and now the cdc is trying to clamp down on it, those folks who are addict, they go to the street looking for those same drugs. When they go to the street painkillers, thats where they can find themselves in trouble. In some cases they wind up doing heroin. It ruins life. These are individuals who were clean cut at some point, and the young man we highlight, 28, still on the city streets, hurts too much to get off of it. And he steals to pay for it. Thats his life, and thats where hes at. It you can see how it just rips apart families, destroys not only the addicts life but the familys life as well. Are there enough treatment programs in the city to help all the people . It takes a wave. It takes a mountain to really do. This thats one of the highlights or individuals we do high. She runs a nonprofit. Her goal is to really get as many people in these Treatment Centers and help. But the problem is julie, getting their hand and grabbing it, and bringing it in and saying, we can do this together. Thats the great part about San Franciscos new ems6, theyre doing just that. Its the facetoface encounter. Its not just seeing number on a page and going, hey, look how many people are on heroin this year. Youve got to go out there. Thats what theyre doing, boots on the ground, trying to pull these people in. Oftentimes you can offer the treatment but hat to be the addict who wants to get help. Thats the hard part sometimes. Like you said, that man feels like hes in too much pain, but its so hard once youre addicted. Ill be interested to see your reaction to the story. Im looking forward to seeing it tonight at 10 00. Look at oakland and hayward. Significant cooldown. You can feel it out there. Thats part of the fog and that onshore flow. Overnight lows will be in the upper 40s. Fog and low clouds will be back. The Bay Area Council study says one in three people here in the bay region are so fed up with unaffordable housing and gridlock transportation that theyre likely to leave the region in the next few years. About 80 or more think that we are not going to be able to solve our traffic problem. We learned last year that 60 of people think we should be building new housing outside the region. The Solar Impulse plane thats trying to fly around the world is right now more than 12 hours into its 16hour flight to phoenix. This is a live look at what is being called flight radar. We havent seen a whole lot of movement in the past 30 minutes. At the top of the hour Solar Impulse tweeted out that it is quote temporarily parked in the air because the plane is flying at the same speed at the front wind and is special beg pushed back. Flight radar says the plane is going about 11 knots, which is about 12 miles per hour. And that plane is completely powered by the sun. It took off this morning from moffit field before sunrise. Investigators say the fire started in a barn just before 2 00 this afternoon on north capital avenue and mckey road in east san jose. Then the flames spread to some mobile homes nearby.
