Reporter the north bay has been hammered by all this weather. Along with all that weather has come no shortage of problems. Around 11 00 a. M. A couple was driving in a toyota on Freestone Valley ford road. They came to a flood in the road and tried to drive through it which is never add visible. The car stalled, but they were able to get it to a dry stretch of roadway where they waited for rescue. The vehicle went into a foot to foot and a half deep of water and stalled out. Bodega bay fire arrived at scene and affected the water rescue which consisted of two of their members in swift water rescue gear walking out and assisting those folks to dryland. Reporter in santa rosa an awning collapsed from heavy rain. Officials said the awning came down partly because of dryrot. Be aware of power lines, be aware of trees. This is different. This isnt normal but it can happen. Its something we want to make people aware of. Theres a reason were telling people, hey, clear your gutters, get debris off your roofs. Even commercial businesses, this should be a wakeup call. Reporter on Petaluma Hill road, crews had to block one lane is of traffic so they could shore up at least one utility pole that had started to tilt. They told me all the water that was flowing by had eroded the soil. Still, rohnert park residents seemed pleased to see the rain. We need the rain with this drought. Even with all this rain i dont think were going to ever be able to totally wipe out the drought weve had for so many years. But i think its good. Reporter while people may be surviving the deluge okay, we saw some baby skirls who were knocked out of a tree by Stormy Weather, and we saw some baby 0 possums as well. Were recommending that people go out in their yard, keep your eyes on the ground, keep looking for baby animals just like these. Whats the biggest concern for that area now . Does it rising river . Reporter certainly the rising river. The Russian River. Napa river always a problem as well. But in recent years theres been a lot of mitigation of the problems that all these rivers have seen. So hopefully even with this big storm there wont be too many problems along those rivers. John sasaki, thank you. San francisco is teafght flood barrier system in the mission district. Watertight plastic barriers have been set up along folsom and 17th street. That area is known for its flooding. Most of the barriers are filled with water so they dont move but others are movable so the residents can get in and out. Thats why work crews are on site to move those barriers out of the way. But in the big scheme of things its relatively inexpensive compared to other solutions were looking at because were looking at doing projects in these complicated low lying areas that are prone to flooding that cost in the hundreds of millions of dollars. Some Business Owners say they arent too happy with the barriers. They figure the water will be pushed in their direction, and they arent convinced the barriers will even work. A verdict was handed down involving four San FranciscoPolice Officers after a seven daylong civil rights trial. A federal jury decided the officers who shot and killed alex nieto did not use Excessive Force. Tara moriarty was in the courthouse when the verdict came in. She joins us live with the emotional reaction. Tara. Reporter on both sides it was extremely emotional. You had alejandros parents who were so devastated. Then on the other hand you have these officers who are feeling overwhelmingly relieved. This decision came down about four hours ago. This is a jury comprised of mostly white women, and it came about after a day of deliberating. In the courtroom, alex nietos parents appeared to be in shock. All four officers were found not to have used Excessive Force when they shot and killed the 28yearold two years ago. The nietos must be very sad. Its a tragic event to lose a child in any way that that ever happens. But my officers didnt violate the constitution when they used force in this situation, and the jury obviously found that mr. Nieto had a what looked like a gun in his hand. This case signifies that we apparently, as a community, are ready and prepared to accept officers gunning down people in public parks under a hail of 59 bullets. Reporter the sfpd says that nieto pointed his taser at officers which they mistook for a real gun. Nieto carried that taser as part of his job in security. One of the key pieces of evidence presented in this trial, nieto suffered a bullet wound to his wrist and bone fragment was found in his jacket pocket which might suggest that he had his hands in his pockets when shot. In the end the evidence wasnt so strong to suggest this was Excessive Force. Was this a unanimous decision . Reporter yes, it was. In fact, during civil trials it has to be up a nan mouse decision. It we want to mention that the officer had been cleared of any criminal wrong doing, so that never went to a trial. But in any case, it is all over now, and in speaking with alex nietos family, they say this is not tend. They were just happy that everybody can now know his name and see testified and make up their own mind. Tara, thank you. The new San Jose Police chief says a Staffing Shortage has become critical and is prompting drastic changes. The Police Department blames the problem on measure b which voters approved a few years ago to reduce pension payouts. Ktvu spoke to the chief and other leaders. Jesse is live in san jose with the changes. Reporter frank, the chief says that starting this weekend mandatory overtime for all San Jose Police department officers. This could carry on for weeks, months, all depending on what happens inside superior court behind me. An ex city councilman and a Tax Reform Group filed suit to block a deal to repeal measure b, the stumbling block to reform. While that works its way through the system the department and the public struggle with a harsh reality. They should have more. That way they show up quicker. Reporter fred and his wife pick up dinner at this East San Jose strip mall. They worry a little over 800 cops patrolling a city of over a Million People is bad math that can lead to greater problems. I mean, for the whole city, that just does not work, period. Regardless of whether theyre slow or not. Weve got a crisis today in police staffing. Reporter earlier today the san jose mayor stood shoulder to shoulder with other politicians, police brass, and union leaders. Collectively they say measure b has caused a severe staffing shortfall. A stopgap measure to produce minimum Staffing Levels turns into mandatory o. T. In just days. If measure b is not invalidated and this pattern continues we will have no choice but to reduce our overtime units further to ensure that when someone calls 911, their call is answered. Police brass say Public Safety isnt at risk. But the strain of extra hours hurts morale and recruiting efforts. Leaders say the path forward is the repeal of measure berks restructuring of the Pension System which would save the city billions of dollars. I applaud our city leaders for recognizing the flaws in measure b. At any point weve got these storms and we could see some urban and small stream flooding. Up at gurnville weve got that Flood Warning for the Russian River which pretty much transpires when the river should go above or at flood stage. The forecast models have that on saturday morning, or saturday kind of midmorning. And then the flash Flood Warning down in pen grove, that goes away in the next couple of hours. Its raining hard now and hammering your afternoon commute. Just coming into work it was messy, and thats an off commute time. Theres red lines. You know thats bad. Red lines all over the bay area. Look at oakland, san ramon. Those yellow areas representing rainfall rates half inch an hour,. 7 of an inch an hour. Its really coming down hard. As we head into friday the system is a little bit cooler. Theres a little cool air in here. The next system, see how theyre coming from the north more . Theyre not going to be as productive for rain. More productive for snow, which i think this is the perfect setup. Rain coming saturday and sunday. Both storms are minor as compared to today and tomorrow, what were going to see. And then through lunchtime, and it looks like the afternoon commute might get a little bit of a break. But i think this will be widely scattered showers. Thats your friday. In my mind its the perfect scenario. When you look at it the Russian River flood gauges it goes a little bit flood stage saturday, but it isnt a major deal. You are not going to see houses floating down the requirement you will see some parking lots flooded, but then we get some breaks. We were talking yesterday, i never realized it can go up that fast. It was at 15 feet yesterday. It could be at 32 feet, 33 feet by saturday . Mark is going up there tomorrow morning, mark tamayo. Its probably going to be up around 30 feet tomorrow night at this. I when you get those breaks does it go down as fast as rises . The Russian River is so big, julie, all these creeks and streams, they just to have bleed off all that rain. So the Russian River aus point out julie is going to continue to stay high for many days after the rain stops. But on saturday we have more behind this storm coming up . . The centers for Disease Control is investigating a salmonella outbreak that has been traced to a california pistachio grower. Batches grown by the Wonderful Company in the town of lost hills have been recalled. According to the cdc they are linked to 11 people in nine states that are infected with salmonella. It was already passed by the assembly. If signed by the governor california would become the second state after hawaii to raise the age from 18 to 21 years old. The bill would also regulate Electronic Cigarettes the same as tobacco products. The bill would expand smoke free areas and allow counties to levee higher taxes on cigarettes. He would give her bear hugs where he would press up against her breasts and kiss her in unwelcome ways. Reporter in a statement, choudhry says while i disagree i am unable to comment on the substance of the lawsuit. However i cooperated fully and take seriously the confidential investigation into this matter. Sorelle says Claude Steele declined to fire choudhry. Instead, docking his pay and telling him to write her a letter of apology. The suit says steele had seriously considered terminating choudhry but didnt want to ruin the dannys career. Thats ludicrous. The idea that a womans safety is less important than a career of someone who is perpetrating Sexual Assault is just a completely ludicrous idea. Reporter choudhry is the second dean to resign as a result of Sexual Harassment allegations. In 2002 john dwyer stepped down after being accused of having sexually harassed a student. Last fall an astronomy professor stepped down. Uc berkeley has a problem with harassment. We had the problem with the astronomer accused of Sexual Harassment. Henry lee in our newsroom. Henry, thank you. San jose police say an armed man surrendered peacefully at 4 00 this afternoon after holding his threeyearold daughter hospital stack. An ambulance took the man away to be checked out. Then he was booked into jail. The incident apparently started in the willow glenn neighborhood about 10 00 this morning when the man went to his estranged wifes home. A witness said wept there to sign divorce papers but then he reportedly took the child inside the house and his wife ran across the street. Barricade he barricaded himself and the child inside the home. S. W. A. T. Teams surrounded that house on jonathan avenue and used flash bangs to try to get him out. He final released the girl after a couple of hours. We hear the neighbor yell, call 911. He moved his vehicle to block the estranged soon to be ex husbands car in the driveway, or his truck. And called 911. The next thing we know this is what happened. Police say the man did not appear to be injured. His name hasnt been released. Police say the mother and daughter are doing well. State lawmakers today paved the way for californias right to die law to take effect. The Legislature Passed the law last year following the case of brittani menard. She was forced to move to oregon so she could legally end her life. The new law allows terminally ill patients to end their lives with drugs prescribed by a doctor. State lawmakers adjourned a special session on healthcare meaning the law will take effect in 90 days, june 9th. Four other states have similar laws. The republican candidates for president are facing off in a debate in florida tonight. It is a key state with 99 gop delegates up for grabs. The National Guard has been called in to help people evacuate, and the red cross has now set up shelters. The National Weather service is calling it an historic flash flooding event. Were doing rescue missions for people that are flooded and stranded inside their homes as well as helping track people extract people from flooded out vehicles. And in texas homes and roads are flooding. Officials now confirm six tornadoes have touched down there during this latest storm. The wicked weather is also affecting other states from oklahoma to mississippi and tennessee. Coming up next, fines that can reach up to 500. Reporter bart Officials Say currently if police are asked to remove someone for taking up multiple seats the officer does not have any authority to do. So a rider reports the issue to bart personnel who then contacts police. We dont after police force large enough to patrol all our trains to enforce this ordinance. I agree this is a relatively minor matter that faces our riders. Reporter the issue may be minor but the proposed fines are not. The first offense comes with a warning. The second, 100 fine. The fourth time would cost you 500. Some riders we spoke with say seat hogging theyre something is happy being addressed. Especially coming back at night people sleep a lot, take up three seats. It started up north and its been coming down. I dont know about you guys but i woke up this morning and we knew it was going to thank north bay. It was like, gosh, when is the rain getting here . And then this afternoon did it finally show up. In the north bay it had been basically raining all morning where they got up to three inches of rain. If you look at san mateo theyre coming in about a half inch which isnt bad considering it hasnt rained that long. Most of the rain, now that weve got rape hitting the san jose area, julie told you about out there in arkansas, louisiana. Its crazy amounts of water theyve had. And thats a byproduct of the water theyre seeing is, from our last saturdays storm. Its moved up into the mississippi and ohio valley, and they are having bigtime flooding problems in parts of arkansas, louisiana, and texas. For us theres that atmospheric river. There is that Flash Flood Watch. Theyre going to keep that in effect until sunday. It has been upgraded to a flash flood advisory, urban and small stream flood advisory. Ive got a Flash Flood Watch here but this has just been upgraded to a flash flood advisory, which means its more imminent. Most likely pooling of water on the roadways, which is very typical. Its going to get to flood stage, then go a fat or two above, which will cause just, hopefully, minor issues. We did have a flash Flood Warning near pen grove. Thats for the small creek there near 121. Look at that moisture streaming on shore. Wow. Lets see that again. Look at that. Thats hundreds of miles of subtropical el nino driven moisture moving in. Thats why its in the 60s today, despite the cloud cover, despite the rain. The dynamics not that strong. The true dynamics get here tomorrow. When i say dynamics im talking about that low Pressure Center that triggers the heavy winds and heavy rain. This is ridiculous amounts of moisture coming in off the pacific.
