A judge delayed a Court Hearing with a suspect charged with killing a woman in charlottesville. He is accused of driving a car into a crowd of people. One of the organizers of the right wing rally surrendered to the police in virginia last night. Christopher cantwell is charged with bodily harm. Im not going to stop in my efforts to try to get it removed but im glad the city council recognized that it had to be addressed. The city is seeking state approval to remove the lee statue as well as one depicting stone wall jackson. A hearing is now set for september 1st. The wall street journal reports that the president s directive would give the military six months to prepare for the ban. The new rules would stop funding for procedural medical treatments and a lay out new guidelines that would allow the secretary of defense to remove any current Transgender Service member. The president sparked backlash back in july when he tweeted that transgender people could no longer serve in the military because of the, quote, tremendous medical cost and disruption it creates. President trumps Top Commander in afghanistan gave more details about the administrations strategy in the region. General John Nicholson said that the u. S. And nato will assist afghan forces. He said the push will be based on conditions on the ground, not a particular timetable. Nicholson would not say how many u. S. Troops would be involved. U. S. Two sisters out of South Lake Tahoe who were reported missing after attending a Solar Eclipse rally in oregon have been found. They were reported missing wednesday. The parents also got an alert from the bank card which was recently used in petaluma. One of eight people accused in the killing of an oakland mother was sentenced in an east bay courtroom today. A judge sentenced alex davis to 40 years to life in prison. He was convicted in the death of a 30yearold hospital worker. Police say she was shot and killed back in march 2015 while using her body to shield her children from gunfire during a gun battle right outside her home in oakland. Davis attorney spoke to reporters outside the courtroom shortly after the judge handed down his sentence. I asked for manslaughter. Yeah. I thought it was a shootout, essentially, and its tragic, as a matter of fact. Davis was one of three men convicted in this case earlier this year. A tense hostage situation came to an end this afternoon at a restaurant in charleston, south carolina. A new report is raising questions about Police Tasers and whether they should be looked at as non lethal weapons. That report found more than 1,000 incidents where people died after being tased by police here in the u. S. As Trace Gallagher reports, it also found more than 100 of the incidents began with 911 calls for help during medical emergencies. Get on the ground reporter a common tool for police nationwide, tasers are viewed by some as non lethal stun guns, but no reporting suggests tasers have been used in more policeinvolved deaths than thought. A report found more than 1,000 policeinvolved deaths that have involved officers using tasers across the u. S. At least 153 autopsy reports show a taser listed as a cause or contributing factor. For lots of reasons tasers should be an absolute last resort. Reporter reuters found in that nine of 10 incidents the person who died was unarmed, and a quarter of people were suffering from a Mental Health breakdown or neurological disorder. Meantime the company that makes the stun guns has for years said that tasers are rare toll blame. When tasers are used, yes, they have killed people. Around 20. Reporter the company insisting that most people who have died after a taser was deployed died because of Underlying Health issues, drug use, or other police force. Im not saying that tasers havent killed people but i think people tend to jump in cases where you can pretty strongly exclude it, and yet they still say, well, the taser was the only force used, therefore it was the thing that caused the death. Reporter the manufacturer says its up to police to decide how and when officers use tasers. Weatherwise a foggy start but a pretty good finish. So bill, are we going to warm up even further . We are. Ive seen reports of maybe two to three feet of rain in some places near houston. Houston is low lying. They have major issues with drainage because of all tur ban any sayings all the urbanization there. Heres the wind bands. Category 01, 85mileperhour winds, moving northnorthwest at 10 miles per hour. So basically in the direction its going. So by tomorrow its starting to move on shore, and its a big story if youre doing any traveling, and it will lead all the network newscasts most likely tomorrow and into the bay area weekend. Not just for rain but storm surge looks like its going to be a player as well. Galveston, corpus christi, and some low lying areas are going to take a positive. So we will watch that. Here are some of the temperatures that we have experienced today. About like it was yesterday, which we did expect. Beautiful outside right now in san jose. Good, clear skies, good air quality, and thats how it goes again tomorrow. But as we head toward the weekend and High Pressure builds in, by sunday, low 100s in those inland bay valleys. Less fog that would equate to some warming. There are the forecast highs. It looks a lot like today but a little warmer with some more low 90s showing up in those eastern valleys. Thats tomorrow. Again, this whole week, its a wash. Its all been the same. But things start to change around as we head into friday, saturday, and sunday. When i come back we will talk about it. Thanks so much, bill. Crews and city officials are now working to make sure the water in oaklands Mcclymonds High School is safe to drink, this after high levels of lead were found. Reporter the good news is the School District says they have addressed the most serious concerns, and a now they are working on a longterm solution. The School Districts environMental Health and safety manager was called after the coach noticed a brown tint coming from the tap. He was actually using water from across the street at his mothers house. Crews have now installed new spigots on the football field. They have replaced the shower heads in those locker rooms, and they are also telling students that all fountains are now offlimits, and they will now be drinking from 11 new dispensers installed in and around the campus and the cafeteria. The School District says the water is no longer a health threat. Parents we spoke with this morning were still concerned that they werent notified in a timely manner. When you enroll your kid you sign a paper that theres no lead. But i signed that paper but then i looked at the news. I was never notified. We have prevented anybody from having any contact with any leadbased water. So right now the only lead based water we have is in the showers. We are still in the process of replacing all the shower heads, which are the source of the lead in that water. And so once that is done, the showers will be turned back on. So nobody is accessing those showers. In the meantime what we have done with the other things is, what we found was that the sources of lead on the campus were a couple of fountain heads and a couple of faucets in the kitchen. Weve replaced all of those items with items that wont leech this lead. So weve taken all the lead out of the equation. Right now there is still the longterm fix of replacing all the piping. Californias state Supreme Court has upheld a voter approved initiative to speed up the process of carrying out the Death Penalty. In november california voters approved prop 66 which set a fiveyear limit for appeals of the Death Penalty. Opponents said that fiveyear limit was unrealistic. Prior to the ruling Death Penalty appeals could last 25 years or more. There have been 13 executions here since 1978. The last one, 13 years ago in 2006. All right, so maybe you can kind of wrap this up, but what actually happened today . Well something, very interesting. Now, your headline was the Supreme Court upheld prop 66, and in large measure thats true, but for most voters who voted for prop 66 in november, they will see this as a defeat. And the reason why is that at the heart of this, and certainly on the ballot proposition, the heart of it was that the initial stages of the appeals would be finished in five years. And what the california Supreme Court did is that all seven justices agreed that if you interpreted the proposition literally, that the word shall means that the word they used was directive. Its a suggestion that we move along with these. Two of the justices said, come on, the voters voted for this, but its unconstitutional, we should strike it down. So none of the justices wanted to do what i think most voters who voted for prop 66 wanted. And, david, we were talking offcamera, i forgot to introduce you, david, our legal expert here, does this have any teeth at all . Because the big worried was mandatory. They said, no, were not going to say its mandatory, but heres the guideline. For this piece it wont have any effect. On the margins it might speed things up but the reality is our system is very com play indicated, and there are two big choke points. One is not enough people taking on these cases, whether its in the Public Defenders Office or whether its attorneys who are willing to take them. To some degree prop 66 will require more attorneys who take criminal cases to take on these cases. But it really wont speed up the process. We need a lot more resources. And the other thing that would help if you wanted to speed it up, not everybody does, but if you wanted to speed it up, you would need a constitutional amendment to allow lower courts to hear some of these initial appeals. Right now the choke point is the california Supreme Court has to hear all of them, and it takes a very long time to go through that, let alone the rest of the process. So can we expect to see more executions . I guess not, right . Not for awhile. Any number of issues. Number one we have an issue as to the method of execution. Now, prop 66 makes a relatively minor change in terms of the approval process, but theres still federal constitutional issues around that. So we are not going to see any executions in california in quite some time, and while this what is going to happen is this wont speed things up. And for those, i think theres over 750 on death row right now correct. 400 plus still have their cases pending in appeal. At least that many. And that will take years, right . Decades. 20 years is nothing in this business. Now, you might remember there was a competing proposition in november which was to eliminate the Death Penalty. Of course that would have wiped all this off the process because this takes so long because it is death. Its something very special. It has to be done with great care. All right, david levine, thanks so much. U. S. Diplomats may be victims of sonic warfare. The symptoms they experienced that caused the u. S. To pull them out of cuba. And coming up next, the ousted google employee has now lawyered up. Were going to sit down with our legal analyst to talk about the options that he has against his former employer. Remember that Google Engineer who was fired by the company after he criticized google for its diversity policies for ignoring differences between the sexes . He has hired a prominent San Francisco civil rights attorney. He was let go after writing a memo suggesting that biological differences played a role in the shortage of women in tech and leadership positions. That memo was later posted on line and went viral. The woman that you just saw there, a San Francisco attorney, also a member of the Republican National committee, will now represent the employee in a case before the fascial Labor Relations board. So does he have a case . Lets bring in our legal analyst michael cardoza. On the surface what do you think . Well, number one, google invited comments from their employees. He writes a 3300word memo. People are picking that apart and saying, oh, look, this appears to be misogynistic, he hates women. It is going to be an interesting litigation because they are going to be parsing words. What did he mean by this, the or was this a political statement, which is allowed . If he got fired because he made a political statement, then google is going to lose this lawsuit. He says, listen, i was shamed because of the views that i expressed in that memo, and that this really goes against, and im quoting here, the left bias of google for creating a politically correct mono culture. It certainly teaches me if im working for a big company and they invite comment, im going to give them nothing but vanilla back. Im not really going to express my views, because this memo got out. A lot of groups start criticizing it. Google, being a large corporation, reacts to that. And im sure he is going to say, well, you fired me because it got out and people in certain groups didnt like it, they pressured you, you fired me. And now what his attorney is doing is trying to get other people that have been fired at google to start somewhat of a class actiontype lawsuit against them. The more they get, the more they can prove google is that way. He is asking for current or former employees who believe they might have been discriminated against to come forward. If they are successful, what does that mean for the case . Certainly it goes to proof. If you have more than one person saying the same thing, a jury sin kleined to believe it. I have talked to people in the industry in silicon valley, and they say there are not a lot of women that go into engineering, not like the number of men. You look at the engineers, and i hope this doesnt offend anyone, but its sort of a geeky maletype atmosphere. There are not a lot of women that go in. An example i think about, when i went to law school there were many more men in law school than women. But that changed. Women started to get into law school. Now more than 50 of graduating people from law school are women. And i think thats what might happen to engineering. Women will hear about this. They will say, gee, this looks like a good career, because im sure google is looking for qualified women to put into the Engineering Department at google. There just arent a lot of women in that industry. Lets go back to the fact, though, that he is taking on google. Right. I mean, that in itself is a david versus goliath action. No question. Look at google. They have massive amounts of money. They will have the biggest law firms. Theyre going to get papered to death with this. What they have to do is get in, do a lot of early discovery, then a lot of negotiations trying to get this settled. But he has said, look, i dont want hush money. I didnt do this. That memo is not saying what you say its saying. I didnt mean any of that. This was specifically my opinion. It was more of a political statement than anything. All right. So we are going to say. It is going to be interesting. Theres going to be a lot of money thrown at this. The u. S. Government is calling them incidents of great concern in referring to potential attacks on american diplomats in cuba. This comes as a u. S. Doctor diagnosed some diplomats with everything from nerve damage to brain injuries. And now the incidents are under investigation. This is unprecedented. We have not seen this type of activity take place before. Mystery in havana, cuba with u. S. Diplomats and their canadian counterparts reportedly suffering serious injuries while working and living in havana. Now some have reportedly been diagnosed with traumatic brain injury and even damage to the Central Nervous system, the injuries coming after the diplomats complained of balance issues and headaches, this after what the u. S. Is calling unprecedented incidents in havana that started in late 2016. These are u. S. Government employees. They were serving in an official capacity in cuba. Those incidents have caused a variety of physical symptoms. Reporter the u. S. Is now looking into whether the diplomats were victims of targeted sonic or acoustic attacks with some type of audio device directed at their homes. The investigation is still ongoing. It is an active investigation. Reporter a number of victims have been evacuated to the u. S. To be treated with some having to get hearing aids. Some we asked to leave because their condition necessitated that. There were others that have chosen to stay there, and some of them are still there. Reporter at this point the u. S. Has warned the cuban government of its responsibility to protect diplomats. Cuba has denied any involvement in the episodes. So far retaliation has involved ex spelling two officials from washington. The first major hurricane of the season now barreling towards texas. We will have an update for you on harvey. And harvey is going to be a big story especially going into the weekend. It is Hurricane Harvey and it is packing 85mileperhour winds. Right now it is moving towards the texas gulf coast. The storm is expected to reach major hurricane status by the time it makes landfall later this week. The National Weather service is predicting the storm will intensify and could be packing winds up to 125 miles per hour. Reporter along the texas gulf coast, multiple communities are now ordering evacuations preparing for what is now Hurricane Harvey approaching in the gulf. That could be packing up to 20 inches of rain for parts of texas. Weve got all of our drainage crews out. Were trying to get all the drain inlets cleared. Reporter with the surf starting to get rough, storm surge is now a concern in places like galveston. We are actually asking people to gather supplies, bread, water, eggs, some of the essentials. We want to make sure you have stuff in the fridge. Reporter nearly the entire texas coast is under a hurricane or Tropical Storm watch, and people are being urged to prepare for a storm that could stall for up to five days. The National Hurricane center is predicting the storm will be a major hurricane by the time it hits the texas coastline, packing winds greater than 110 miles per hour. Landfall is expected sometime between late friday and early saturday. The system was bumped up from a Tropical Storm to hurricane status thursday as during the day winds were clocked at 80 miles per hour. I think that the city will give us plenty of notice to get out of here if we have to get out of here. Reporter along the coast in some areas residents are now being warned that rescuers might not be able to reach them during the storm. While on twitter President Trump is warning now is the time for people to plan for the storm. In new york, fox news. Well, we are talking, what, two to three feet of rain in the houston area . Yeah. Thats a little scary. And they mentioned two, three, four, five days of rain. Theres a blocking. It is going to get stuck between two High Pressure systems. It will be a depression when it comes ashore but it is going to continue to rain and rain and rain. That will be the story in the weather world for the next five days. Heres the system now. You see the surface winds. Theres the spiral, the heavy winds in the center. Those heaviest winds are now gusting to 85 miles per hour. And as this thing tracks friday into the gulf, or into this area, right into here, you are going to see extreme storm surges around houston, up around corpus christi, maybe six, seven foot. Also in this area youve got thousands of oil derricks, and theyre movable oil derricks. Theres a lot going on economically, when you talk about moving that many derricks and that many adjustments. You are going to see some changes in gas prices, certainly down in that region. So here is what we are checking right now. The fog along the coast. Weve got a day tomorrow like today. This whole week, right . Ive been saying the same thing over and over. It seems like that. This week has just been consistently the same. Weve warmed a little bit, but weve had a little bit of fog at the coast. Weve had a good run of weather. We did have thunderstorms up in the mountains on monday and tuesday. Its just flat line. As we go into saturday afternoon, sunday, and monday, those days are going to have a pop of heat. Theres San Franciscos forecast in the morning.
