News out of the east bay. A fire broke out along highway 24. The Highway Patrol says it began as a car fire and flames spread to brush. That fire has burned about 25 acres. We are told the fire is out but two lanes westbound are still shut down as crews mop up the scene. No homes are threatened and no injuries have been reported. The situation has led to traffic backups in that area. You can see on the top of your screen that is the westbound direction of highway 24 headed towards the tunnel. Traffic is backing up all the way towards the lafayette area. Leaving oakland and heading toward walnut creek it looks like is wide open. You can see the village on the right side of your screen. Heres the latest on the Development Developing story. These charges come a little more than six months after this fire broke out. It was the deadliest fire and oaklands history in this case is going to criminal court. Reporter 36 felony counts of Involuntary Manslaughter is the charge filed against Derick Almena the socalled manager of the ghost ship warehouse with 36 people died in december. This is his mug shot where he was arrested monday morning. Also facing the same charges is max ohr, the secondincommand who acted as the doorman. Harris was arrested in los angeles. This equals 39 years. Nancy omalley said both men are criminally liable for creating unsafe conditions inside the warehouse that led to the deaths. They kept flammable material inside, allowed extension cords the snake through the building and lock an exit. It was an a possible lamb breath of the defendants making to get out of that building. Defendants Derick Almena and max harris created a fire trap. There were in adequate means of escape and they feel that area with human beings and are now facing the consequences of their actions. Prosecutors did not file charges against the property owner. They would not elaborate. We are discussing charges that we have b we have levity and were not taking speculative questions. Attorneys said we intend to vigorously defend them in a court of law. We believe that these charges represent no less than a miscarriage of justice and we are confident this attempt to make a scapegoat out of our client will fail. The oakland mayor released a statement calling these two mans actions deceptive and reckless. She said the charges send a message that quote you wont get away with making a profit by cramming people into dangerous bases are failing to maintain safe living conditions. Absence of the body in cases like that, jurors dont like to bring the Death Penalty. Do you think you will ever come forward and say where that body is . Can a judge overruled the jurys life sentence and impose the Death Penalty . No. The judge cannot do that. The jury has the last word and they have spoken. A judge has to abide by that. Will they try to go to the authorities and say, look, if you take life without possibility off of the table and give us a 25 to life we will tell you where the body yes. An interesting question for the family. I would think the answer would be no. We know you took her life. Maybe we dont want to know how you dispose of the body let alone give you a 25 to life where you make it out of jail. They may try it, it wont work. Its move over to the go ship fire that killed 36 people. We have 36 Involuntary Manslaughter counts against two people apparently running that building. Why did it take so long walk someone said the wheels of justice grind slowly. What the District Attorney wanted was the evidence in place. This is forensic evidence. How did the fire start . Was a because of the criminal negligence of the person that was running or the manager of the ghost ship . And then they return to the owner of the building. You can impose three years, 35 times and take three years as the base and then one year for every other count. That would be the most depending on if that is all they filed. 38 years. Simply, Forensic Experts will have a battle. The other codefendant, they better hire some of the best forensic people out there. Some judges will say, you know what . Maybe. Lets bring a panel in and talk with them to see if theyve all ready made up their mind. A juror could go up to him and say i heard about the case, but i havent made up my mind and im willing to wait to hear the evidence and then i will make up my mind. The fact that the jury hears it or has heard about it doesnt mean theyre disqualified. Of a juror says i know about it and i have made up my mind hes guilty or not guilty, if enough people say that, the judge has to consider moving it to a like county with the same population in such. We have cell phone towers across the country and those towers in many places are on public property and rented out. Is out one argument that would continue that the information is not private . I dont think the geographic location of towers is going to be much in contention here. Given the spread of where they are at, there on top of mountains and valleys and in for as. I dont think that that is going to be an argument. I do think that the volume of data that theyre talking about in the kind of information that they will be collecting in this tracking process is going to be up for some debate. There are cases where Law Enforcement will go to a court and asked for gps tracking devices to be placed on a suspects vehicle. I believe that happened in another case and then they can follow movements of somebody without their knowledge. You can go through cell phones all the way back is on a cell phone existed. Yes.
