What makes this a tough sell in some cases is the fact that this would be paid for through a fuel tax and higher registration fees. The fuel tax would cost drivers an extra 12 cents a gallon if passed. At a News Conference this morning Governor Brown says he knows that new taxes are not politically popular but he says there is really no other choice. You have to pay for it with new money. Our present gas tax, vehicle fees pay for the highway patrol, they pay for the road maintenance. This is where it is. I know a lot of people can say, oh my god, just get it out of somewhere else. Im telling you, and i have no reason to lie to you, im not like some of those other guys running for reelection, im here. Im going to be 69 next week. Im telling you, gods honest truth this is needed. If we dont do it the roads will crumble. Reporter most of the drivers we talked to today say as long as the money is in fact spent on road repairs and transportation improvement theyre okay paying a little more. We need the help, and these are the people who, if were using the roads, then we should pay for it. Apparently the general taxes arent working. Theres car after car having to pull over to the side just because they had a flat tire and a pothole. So 12 cents per gallon for better roads if it really does remedy the situation, then i would. Included in this proposal is a constitutional amendment that would guarantee the revenue raise goes to road improvement and not other projects. The sierra got clobbered with snow. Today surveyors measured the drifts and found the water content at 183 of normal. The snowpack survey is considered the most important for planning summer Water Supplies for the state of california. Now for most im joined on the phone by the man would performs those surveys, hydrologist frank. Frank, good to have you with us. We have got video of you doing your work. What a big year Mother Nature has had. Are we closing in on a snowpack record . No, we were flirting with that back on or about march 1st, and the storm track moved out of california somewhat during march. We have fallen off that record pace. But it is still a very significant snowpack up there, and we will have to wait to see exactly how it stacks up in terms of historic percentages, but its very encouraging for water supply as we move into the spring and summer. Frank, i wasnt there, but only fitting, it was snowing during the survey. And weve still got a little bit of snow to come in april. Theres certainly its certainly possible. The likelihood of big, major events declines quite dramatically past march. But weve had, for example, in 83, we had a big april. Not to say that were going to this year but the possibility is still there. In fact, looking at the 10day forecast theyve got some weather for us, i think in the next week sometime. So its very possible that we could add a little more to whats up there should. With all that snow comes the snow melt. Are there worries about flooding . We had a lot of issues with dams this year as well. The concern really is for what we call the san joaquin hydro logic area where the major Flood Control reservoirs down there are already full, and weve got a big snowpack up there. So the water managers are already in contact with each other to ensure that the releases from the reservoirs are coordinated so as to minimize potential downstream damage. East bay mud has been releasing water from our comanche reservoir, and we have been releasing for 70 days straight. Thats longer than we have ever done it since comanche was built in 1964. The sierra snow record by the way set in 1938. 819 inches of snow. That was at doarn summit. Not far away now at sugar bowl they have 714 inches of snow. Closing inon a record. Police now telling us that they have made an arrest in connection with the death of a woman who was gunned down on her way to a bus stop just yesterday. You may remember she was one of three people shot in the citys ocean view neighborhood. 65yearold sue wu was shot with two other innocent bystanders. Back here in the bay area were going to talk about the murder trial. It continues in the sierra lamar case th the accused killers best friend recently taking the stand. Time for theer of dict with michael cardoza. The issue came up about some items they say the accused killer, garciatorres, purchased shortly before sierra disappeared. That was a turkey baster and a jug of bleach. Bleach. What do you make of that . Certainly the prosecution is saying you get the turkey baste we are the bleach, it is to hide or mask dna evidence. So they are saying they used the bleach, they used the baste tore wipe out any dna evidence that possibly might be there. Mr. Fernandez, garciatorres best friend since kindergarten got on the stand and said, yeah, we made hash oil, and we could have used a turkey baster and bleach. On crossexamine he said we really wouldnt use a turkey baster and we didnt in this situation because it leaves a plastic taste in the concentrated marijuana. So believe what you want. Ive got a feeling that the jury is going to believe believe and the turkey baster used to hide some dna. Thats what it points to me. Yeah. Another interesting thing that came up is sort of the battle of the phones as well. In that case both sides, the prosecution and the defense have put on experts. And what happened for people that dont know, the phone went off 11, 12 hours after sierra lamar was kidnapped. The defense is saying, gee, shes alive, she was using her phone. One of the experts, in fact both, said that phone could go off by itself. If theres moisture in the air and moisture gets in the phone it could affect the phone so it intermittently goes on and off. So when do you believe in this case . The jury will to have make a choice. But there is a jury instruction that says if circumstantial evidence, that means evidence from which you infer facts, points to innocence and guilt, you must go with the one that points to inno 70s. But the big thing in this case im telling you are the three prior attempted kidnappings. I dont know how the jury is going to get around that. They are going to hear from these witnesses that he tried to kidnap me, and they cant identify him in particular situations, but they have his fingerprint on battery of a taser that was found at the scene. So how are they going to get around that . A lot of things. A lot of circumstantial evidence. Really quickly i want to talk to you about the trial tip south bay, three jail guards. Do you expect them to testify do you think . Its interesting. A lot of people say well, theyre policemen, theyre Law Enforcement. Jailers are not used to testifying. They dont testify as much as a street officer, a detective does. Would i put them on . The answer is yes because you have got them being accused of seconddegree murder. Thats a 15 to life sentence. Very high sentence. A lot at stake. So youve got jailhouse witnesses that are going to come in and say, we heard him screaming, we know they were beating him. I think theyve got to take the stand and say, no, we werent, here is what was going on. Mentally affected portion of the deceased in this case is a big deal, too, because he wasnt in jail for a whole lot. I think it was a misdemeanor. And the judge wanted to put him in a Mental Health facility but there just wasnt a bed for him. So he breaks loose, and it comes down to the training of those officers and how they handle mentally incompetent people. Were they trained properly . What happened . Only they can explain that. Thats why if they were my clients i would put them on the stand. To be able to explain it. The jury is going to want to hear from them. I think a lot swlus we watch sporting events and you see someone jump out of the stands on the field, running around towards the players or someone throwing something on the field it can seem entertaining from afar but for those players its a real safety risk. If you are a player and someone jumps on the field and starts running at you, you have no idea if that person is going to run around, if they are going try to hug you, or if the person is going to harm you, or maybe theyre drunk and theyre going to unintentionally harm you. It is a problem that Major League Sports have been facing for awhile. California is not in alignment with other statements other states frankly impose felonies for rung onto the field or throwing things on the field. Were not creating a felony here but in california its slap on the wrist. Its an infraction, just a ticket no more than 250 fine. Were trying to take the middle road go beyond or above a slap on the wrist but not all way to a felony. You go from a 250 fine. Would there be jail time, too . To would . By the way this is supported by all five Major League Baseball teams in california and other professional sports teams as well. Instead of an infraction with a 250 fine, the fine will be up to 1,000, and it can be charged as either an infraction or a misdemeanor. The amount of time that you could spend in jail for this would be much lower than other misdemeanors, no more than ten dance in jail. Again it could be still charged as an infraction butt gives an option of having more than just a slap on the wrist should. When you authored the bill did you get in touch with the 49ers, the raiders, just to get some input . Yes, this idea came from the Major League Baseball teams. This wasnt just something that i woke up with one day and decided to do. Major League Baseball has been concerned about this issue as there are a lot of threats in the world right now, and security at major league or professional sporting events has been increased significantly. This is a place where a lot of people are gathering, where you can do a lot of very visible harm. And so our Major League Baseball teams in particular have been concerned and so we work closely with them in putting together this legislation. On the other side of the border mexican authorities safilling their end is too expensive so they lead the tunnels open underground. Neighbors say it was really an open secret they were digging a tunnel. We got rare access to show you what was going on behind these doors. In the back of an empty tijuana warehouse we found a tunnel covered by a steel flap. Underneath its still hollow allowing the cartels to get back in and a reuse the drug portal. When the cartels get back in they can actually physically walk all the way up to the u. S. Border where its seecialtiond and thats when they can start tunneling around. Theres been at least seven document incidents where that has actually happened. Its a major frustration for american authorities who spend millions to discover and then shut tunnels down. We check it out. But in mexico it is a different story. We were able to walk up to one tunnel entrance after another finding that security is lacks or nonexistent. The director said richmond also took a different approach. Nothing stops a bullet like a career. So when students have a career, whether its in the trades or somewhere else, they have a Bright Future ahead of them. Richmond build has been teaching men and women what live in the city of richmond the trades. Preparing them for jobs inconstruction and renewable energy. About a third of all students are from lowincome households. A third have a history with Law Enforcement. Nearly all are my nor deals.
