Napa high school Johnny Torres has been suspended from school. There is an expulsion hearing and torres testified he did nothing wrong. The most that i did was horse blay and nothing serious. He is accused of taking part in what School Officials have called a football hazing ritual where some freshmen players are grabbed and touched inappropriately by older players. Torres is the jv quarterback accused of holding a student down while another one touched him inappropriately through clothing. He never saw any bad behavior. And the straight astudent torres has been suspended for the past nine weeks. These past couple of weeks i have been depressed i want to see my friends again and my teachers. I miss being at school and being in the classroom and getting good grades. A School District administrator testified that a student identified only by a number implicated torres. I believe that student 34 was dragged in by several students and he was dragged in by Johnny Torres. Now he is facing expulsion. One student had already been expelled. The District Attorney general is considering criminal charges and a coach for failing to report the incident. A similar incident took place the year before. The hearing was filled with family and friends of torres. Outside torres grandfather became emotional. The napa valley School District says it conducted its own investigation. It is sad for the penal that have been identified as victims. It is sad for the entire student body and it is sad for the people who are involved all around. The Administrative Panel is expected to make its decision whether or not to expel to the school board and the school board will make its decision. Ted. All right. Rob roth. Live in napa. Thank you. New information now on a deadly shooting on interstate 80 last week. The suspect that allegedly acted as getaway driver made his First Court Appearance today but did not enter a plea. Meanwhile learning more about what led to the shooting. Ktvu Crime Reporter henry lee has learned that this is a tragic case of the mistaken identity. Last thursday, 3 suspects were riding in a dodge when they spotsed a honda minivan and chased it on to interstate 80. Sources say that suspects were targeting a woman that often borrows that minivan. A 17yearold male suspect opened fire killing the driver. 24yearold demarcus doses and injuring his friend. The woman owns the car but seems to be a case of mistaken identity. The woman in the minivan was not target. The man driving the dodge, johnson, the 17yearold gunman and a second male have been charged with murder and attempted murder and shooting at an occupied vehicle. One of the teens is the estranged boyfriend of the woman they had hoped to shoot. Cameras were not allowed in court as johnson made his First Court Appearance. Doses family shielded the woman from gunfire absorbing most of the bullets. Hit three times including once in the back of the head. He died the next day at a local hospital. He wanted to be a probation officer. He wanted to go into law enforcement. He would be proud of what is going on right now, how they are caught and how justice is being served. Innocent kid. Innocent. He did nothing to nobody. It is the wrong place at the wrong time. And we just want to do something to turn this thing around. We are told the suspects were arrested with the help of several witnesses including an off duty Vallejo Police officer that provided a description of the dodge. Richmond Police OfficerOrlando Guzman spotsed the car and spotted johnson on a residential street. The teens name has not been released. But contra costa prosecutors are hoping to charge them as adults once they get approval by a judge. Henry lee, fox 2 news. There is a deadly shooting in napa involving two Police Officers. It happened at 6 20 outside a home depot near the napa river and highway 121. Officers received multiple calls about a man acting crazy when they arrived, they found him waving a long knife outside the home depot. A homeless man that stays in the area told ktvu he witnessed the deadly confrontation. He says the man first walked to a parking lot and accosted two of his friends. The man appeared angry and saying things that didnt make sense while holding a knife about a foot long. Police officers then arrived on the scene. He said to the police, said, hey, you fight me, you fight me with a knife like this . And when he put the handle like this, the officer in the center, three or four times did that. And the knife go to the floor. Authorities have not released the suspects name and our witness tells us he appeared to be white and in his early 20s. No other people were hurt in this incident. The two napa city Police Officers who opened fire have now been placed on administrative leave. Well, happening now in san jose. City leaders are taking steps to help out homeowners devastated by the citys worse flooding in 20 years. Plus a dispute between the mayor and the Water District over who is to blame for a delayed warning. Appears to be heating up. Ktvu Monte Francis is live outside san jose with more. Ronnie. Well, ted right now the city council is debating whether to declare a shelter crisis and that would mean Emergency Shelter for flood victims would remain open through april. Now before the meeting we spoke to the mayor and he had strong words for the Water District. There is no dispute that the 14,000 people who were forced to evacuate could have used nor time. Sam carter is not missing words about what is a lack of response from the Santa Clara River district to figure out why theres not more of a warning. If they are not showing up more forthrightly to the staff we are out of options and we need to take responsibility and hire highologists ourselves and we will do that. Mayor lacaro had a stern letter to the water board, john varillo criticizing him for failing to attend a march 10th meeting. La cardo has admitted that a breakdown of communication between the city and the Water District resulted in a failure to give adequate warnings during the worse flooding in 20 years. He criticized the Water District for providing what he calls inaccurate water data and repeatedly flood estimates and flooding risks. The Water District met behind closed doors and we were told that the chairman did not have time for an interview. In a letter to the mayor varillo responded saying we are interested in facts. Not blame. Which only serves to dishonor those that have been harmed and displaced by the floodwaters. But a 180 people displaced have been staying at the commune there. Many going to work and unable to return home. Everybody needs more time. Some are more devastated than others and sure. Any bit of help and a lot of help or a little help. And so right now the city council is debating whether to approve 250,000 in funding to keep that Emergency Shelter open through april 5th. Now in his letter to the mayor, the chairman of the Water District is committed to figuring out what went wrong and he also doesnt want to take part in what he called shortterm political theater. The santa clara board is considering aside two Million Dollars to pay for Legal Services currently in deportation proceedings. There are about 85 to 90,000 undocumented immigrants living in Santa Clara County. The funds would pay for education outreach so people know their legal rights. It is very important to sort of be able to look at the other areas that would impact. If that were the case. Especially with the economy and the impact on tourism and the many areas within the county. Many bay area cities have expressed the similar message reaching out to help undocumented residents as the Trump Administration takes steps to increase deportations and tighten the border with mexico. The state of california have joined five other states suing to stop President Trump revised travel bans. State attorney general Xavier Becerra will sign on in a case filed by washington state. The revised executive order bars new visas from people from six predominant moslem countries. It will take effect on tuesday. Democrats are signing the alarm for the Health Care Act saying it is a prescription for disaster and the republicans going to damage control after there is a glum forecast tore the new bill. Among the sobering numbers outlined by the government scorekeeper, 14 million americans are predicted to lose their insurance in the first year in nearly double that a decade later. But angry democrats argue it is a moot point because it rips Health Insurance away from those that need it the most. The poor. We think this bill is so bad, there is no way to make it better. And it is not just democrats who are upset. Some conservative members say the new bill resembles obama care too much. This bill does not unite republicans or bring down the costs of premiums. Republican leaders hope to push the bill through the house next week and the senate the week after that and the measure clearly still faces some major hurtles to passage. A lot of people gathered on an overpass nearby to get a look. Experts say sea lions are seen in the delta but unusual to spot one in this area of vacaville. However, boy, what a mess it has left in its tracks. The massive winterstorm blamed for thousands of Flight Cancellations and the kids stayed home. Thousands of schools were shut down and all as a result of this major winterstorm that has spanned nearly one thousand miles. Up and down the east coast. Crews are working hard to stay ahead of the snow. The late season storm now settled over the region with snowfall of two to four inches an hour in some areas. New york city was largely spared getting four to 8 inches. Far less than the foot that was expected. But the city remains in a state of emergency until midnight. The Sanitation Department is doing an outstanding job but i could say that conditions are very slippery still dangerous. New england upstate new york and pennsylvania remain unblizzard warnings with 30 inches expected along the new york, pennsylvania border. The white house says President Trump is monitoring the situation closely. The White House Office of Intergovernmental Affairs has been in state with local officials in the path of the storm to provide guidance. The storm also grounding almost 9 thousand flights causing big delays across the country. Some travelers say the airlines should be doing more and others are taking it in stride. They should help the passengers to find solutions. So the brunt of the storm in most areas should pretty much wind up and finish up by tomorrow morning, wednesday morning. However in new england and connecticut another round of storms could be headed into the weekend. Julie i heard that it takes one Million Dollars to clean up. This will be a multi Million Dollar effort. Are they preparing for that and how . Yes. New york city obviously has a lot of money on reserve to take care of security. Obviously with President Trump being elected in the trump tower and Trump International hotel being here and the city. We spent millions on security. As far as the storm believe it or not 1. 8 millions it takes just to clean up one inch alone. Here in new york city we are expected to get between four and eight inches. We were led to a solution but the problem is in california nobody wants to take people with obama care because they dont get paid as much as they would be regular insurance carrier so people are back in the Emergency Rooms anyway. Give us a sense of what it is like during this period with obama care in place. Yes. You know, i dont know how much of a difference it made. You know . We definitely with obama care saw more people in the er like you were saying. The people that will take the Medicaid Expansion of obama care, there is a limited amount of visits for that. When they cant get into that doctor where do they come . They come from me, the er doctor to get a refill on the medication. The whole system, part of that was not well thought out. The part that you and i talked about a little bit, at the end of the day, the number one question is how is this serving, all of this politics and talk in this stuff, how does this serve the people and the individual person and the person that i see in front of me, just not impressed that obama care did a lot. It did help some people. Im not that impressed that trump is going to make it that much better. There is still uninsured coming in and problems with referrals and still be crappy insurance. You know like great, i got obama care. I got insurance, guess what . Most doctors dont want it. About getting the same as reimbursements. Not getting paid. You got the four pillars. Government has an interest and politicians and you have big farma and hospitals and the big three. What are the big four pillars that are fighting basically . I want to contrast again like the person i see in front of me which im not sure it is made that much of a difference. You are talking about a patient. Yes, the average person. The big players, big farma. Hospitals is not big one. The government and politicians, the ama. You got all of these big insurance companies, all of the big interests and you got to get them to the table to change the system. The end question, number one in my opinion as a doctor needs to be not how does it affect the bottom line of pfizer but how does it affect the poorest people and the average person . Maybe obama care was good for some insurances for a while, they got you know a stipend from the government to help them and that is great but how does that translate to the average person getting the care they need . I think i have been disappointed. Bottom line and dont have a lot of time. As a physician, what would you like to see politicians do here . I would love to see him come to the er with me for a day and get on the front lines and you know come to me. Come with me to compton. Come with me to Santa Clara Valley and watch what happens to the average hardworking person who comes to the e r to get the care they need and grounded in that and ground whatever you will do not in stats and numbers and rhetoric but what it does to the average person. He somehow got stuck in a ventilation shaft outside a togo Sandwich Shop as alex savage tells us luckily for him a crew of construction workers heard his cries for help. Reporter this was the end of a very unusual rescue operation in napa today. The man being taken away on the stretcher was stuck for hours inside a narrow shaft at the togo Sandwich Shop. Firefighters had to cut open the wall to get him out. The man had taken off his clothes and was found sitting in the fetal position. And there is no telling how long he would have stayed there if not for this construction crew. They showed up this morning to do some paving work nearby and they heard the mans faint cries for help. At first they thought they were hearing things. We all go there and we can hear them yelling and sure enough they said he was looking for a wishing well and got drunk and fell down a shaft. Firefighters say the man had climbed up onto the roof of the Sandwich Shop last night and somehow fell down into the shaft. It is unclear why he was up there in the first place. His explanation to the construction workers that discovered him was a bit out of the ordinary near. He says im looking for a wishing well and i didnt find it. And i asked, how did you get in . He was reluctant and he says i was drunk and i fell in. Once they got here it took napa firefighters just under an hour to free the man from the wall. They used various power tools and they had to cut carefully. The small saw to cut the space open, some wire cutters for the chicken wire and very delicate operation because we dont want to hurt the person inside. Thats a tough one. He is like cramped in there. He was in the fetal position. Alex savage fox 2 news. A homicide in san leandro. Deputies called to the house around 1 45 yesterday afternoon. When they arrived, they found a trail of blood lead to go to house. They discovered the body of a 41 yearold man inside and say he was killed during a fight with someone he knew. Now investigators are still looking for the suspect and still trying to determine a motive. Our victim and a suspect in this case, a person that we are looking for now had an altercation and they knew each other and the case is a rule of some argument that occurred between the two of them. The victims name has not yet been released. Investigators have not released the identity of the suspect. Happening now. The uc regents are meeting in San Francisco. What an honor for you. I think the first question going through so many peoples minds is how did this point come about . How can a 17yearold be on the state board of education . Really how it came about was i serves a student member board of education and i was so passionate about education and i found that i liked it so much that i wanted to take it to the state level after Like Research on the internet. I saw the opportunity there, like a memo for applications. So i applied and lucky enough to be selected as semifinalists and we went to a coaches in sacramento where we have like a vote from our peers and we interviewed with state board of education members where they picked a final three and from there we interviewed with a governor appointment team and he made the final decision. Katie you are something special. What an honor. This is great news. So you are not old enough to vote quite yet. How is that going to work out while on the board . Well actually on the board of education the student member has full board privileges. We get to go into the closed sessions. Essentially we are a 10th member of the board of education. We have everything that an adult member has like we contain the Student Voice and able to advocate on students behalf with a student perspective. Im glad you mentioned that. I was curious to find out what you are going to accomplish and how will you represent the student body. Theres two main things, first when it comes to california education, we are really an important time in our accountability system. We are focusing on a lot of Different Things that evaluate schools and i find that is important. I really want to make sure that school board and the state really pays attention to how students feel about their schools. I want them to factor that in when they evaluate how schools are performing and being an advocate. Some people feel like they are not heard, the minority students from low statuses or students with disabilities. I want to make sure that i can represent everybody and make sure that everybody is able to have a voice so that is really thats the main thing. Aside from those trying to be a voice for your other students what ate one thing you bring to the table that separates you from everybody else on the board . I think it really is just a genuine passion and care for students and i think im very empathetic individual. I have met a lot of people in my life, a lot of people with different backgrounds and like my school is extremely diverse. I go to a unified School District and it is diverse and i have met so many amazing people and just people with different interests. People that have grown up differently and i think that really enables me to understand other people so when im up there advocating on peoples behalf, i will be able to approach problems from several different perspectives. What is it . It is just a series of websites that you cant get to using our normal way of getting there. If you go to google or bing or yahoo. Whatever your Search Engine is and type in the dark web you wont be able to get there and you use a series of ways to get to it and one is in the know if you are in chat rooms with other hackers or you are on in a chat with somebody or you down load a browser. You can go to a wicky and see the different websites and you can get in and there is just an amazing amount of information for sale. It is kind of ridiculous. When the c. I. A. Got ousted by wikileaks. You are thinking we are so vulnerable to the government hacking. But really, i could bet you my name and a bunch of other names are on list for sale on the dark web because they will sell credit card numbers and hacking exploits and hacking tools. All kinds of Different Things that heck, they can use to attack different people. Have you been on the dark web . I have. Doing research. I went on and looked around and it is dangerous because just like any other hacker form it is about bravado. One upping somebody else. You are almost instantly attacked because they want to see if your machine is vulnerable and the ports on your machine are constantly being bombarded with information to see if you are a newbie or someone of substance and when you are on there it is about trading and spending money to buy Different Things. Thousands of lists. For example, the other day for sale was a million user name passwords gmail and you can buy the list and thats the key to digital life if you want to reset the password it will go through email, if they got that, they can get into your bank account and so on and so forth. I would assume that authorities are also patrolling the dark web. That type people. There was a book in 2011 called king pin written by kevin paulton and he wrote this biography of one hacker and his name was max and he took down information about credit card information that spends money at nordstroms and turned into an in former. If you are a knacker or fed, you are called out instantly and mistrusted and this guy max took down most of the dark web when he was on it and kind of in a king pin type style and took down these tiny websites by hacking them so they could come to buy the credit card information and something similar happened four days ago on march 10th. An anonymous hacker took down the dark web hosting child pornography and took down 85 of the dark web itself.
