The city of San Francisco announced it is suing the Trump Administration for threatening to with hol federal funds because of its sanctuary city policy. Ktvu alley rasmus has more from republicans. San franciscos city Dennis Herrera says the city stands to lose 1. 2 billions in federal funding because of the president s executive order. Threatens to revoke the funding for cities that limit their cooperation. The mayor reaffirmed it. Sheriff deputies will not turn over undocumented residents unless ice has a federal warrant for their arrest. The suit names President Trump specifically as well as the head of the department of homeland security. Threatening to withhold the funding is a violation of the 10th amendment. The city of San Francisco is arguing thin suit that federal government cant force to it have local police do the jobs of federal immigration agents. The emperor that rules, we have to abide by the rule of law. And we are going to make that quite clear that San Francisco is in accordance with the law and we will live by the law and mr. President you need to do that as well. We spoke with the member of the Republican Party that described this as overreaction. The city has no standing for the executive branch. All of this climate of hysteria where were they during president obamas tenure. He never threatened funding to cities that have funding policies. Expected to nominate one of two judges to the Supreme Court. I want to show you the two gentlemen that we believe are top candidates. Neil gorsuch or tom is hardiman. As a republican do you have a preference . Neither one of these are actually two conservatives, they are just to the left of what a mike lee or a ted cruz. Either one of these should be acceptable. They both got approved 950 including the feinstein voting. I think hardiman is a safer choice and the other is about assisted suicides the others are conservative and should be approved. But democrats vowing for a fight. Do you remember when president bush came into office they filibustered 28 appellate offices and never gave them a hearing. I suspect this is the same. One side does it and the other doesnt. It will keep up this way. Lets talk about the executive orders. A lot has happened since you were on last time and it seems as though President Trump is getting opposition, does that concern you. There is two ways about taking away a troubled organization. There is a consensus issue and move it slowly and bring people together or you do what trump is doing which is go full force and keep your promises and there is a shocker, a politician doing what he said. And move so quickly that they cant catch up with you that they are fighting the last fight that they have gone by. Obviously doing that and now the real Prime Minister golda myar says to do it first and enjoy it later when you get hammered in the beginning. I think President Trumps policies are adversely affecting a small group of people but they will benefit a huge american populace. We are seeing travel protests and even republicans have come out and said it was not implemented correctly your thoughts. It could have been perhaps implemented better and keep in mind president obama banned refugees from cuba. It is overblown and in a couple of weeks this will be forgotten and the Supreme Court nominee will dominate the news as well has the tax proposal he comes up with and other things. Le move quickly on so many items that the democrats will be divided and not know where they should be shooting at but they will be shooting. You bring up a good point. For a while we were talking about the border wall and the keystone pipeline. Sanctuary cities. We havent had those discussions in the last few days because it has been dominated by the u. S. Supreme court and this is a part of the strategy. It is. There is a lot of things that can be fixed to improve america but theres only 192 people that were truly affected by that travel. There were 300,000 plus travelers last week and 192 was the number. The San Bernardino was a fake number. The system is not good. We should pause and not get hysterical about the travel band and care about the people here. Some argue that there is proper vetting and that what happened in San Bernardino and other places was from people here in america already. That is to be continued. That discussion is. This is my final question. Do you believe that President Trump will slow down . No. Do you think he will take a pause . No. He has big ticket items. He hasnt done big ticket item. The wall is not. No, 34 democrats approved of that in 2006. In fact his executive order on the wall is based on legislation that the democrats approved in 2006 along with republicans. Giving us a republican perspective ted. The defense presented to jurors in the south bay who will decide the fate of and to lin Garcia Torres who is on trial for the murder of sierra lamar. Defense attorneys says there is no evidence that sierra lamar is dead and they attacked the dna evidence against Garcia Torres that is at the heart of the prosecutions case. Sierra lamar was 15 when she disappeared on her way to school. Her body was never found with traces of her dna turned up in the truck of torres car and his dna was found on her clothes. Lawyers for Garcia Torres focused on errors in the evidence collection process. The evidence was contaminated from the outset and it cant be relied upon later and the defense did a good job in establishing that the protocols of the dna evidence collection were not followed. Garcia torres has maintained his innocence since he was arrested. If convicted he faces the possibility of the death penalty. His trial is expected to take several months. Ktvu will be in the courtroom and bring you live updates. Now to hayward where an inmate is at large after he jump from a car on a busy free way. It happened as deputies from the state of kentucky were driving him to the airport to be extradited. Crime reporter henry lee is following the story and joins us from the newsroom. Authorities are trying to figure out how the inmate while handcuffed escaped 880 and still on the loose. Sean new is wanted in kentucky for fraud and id theft and arrested for dui by the chp in hayward earlier. Sheriff deputies from boone county picked up new at rita jill in dublin. Headed to sf oand headed towards hayward and 880. At 9 30, the traffic was at a standstill and the suspect jumped out of the rental car that they had and escaped on the freeway. Last seen on the freeways, southbound. It is unclear if the back door of that rental car was properly locked or not. The defendant was in handcuffs. Hayward police and ch p officers converged and and could not find him. They havent interviewed the deputies fully and said they regret the inconvenience to hayward residents. Police and deputies will be increasing patrols. New is a white man, 61point with brown hair and 160 pounds and wearing a blue shirt and blue jeans and brown boots and those handcuffs. I think at the end of the day the numbers are such that the nominees of the president will be confirmed. But you know whoever it is, they will be asked a thousand questions and the democrats will assert their right to ask those questions. There is a lot of anger on capitol hill because of Donald Trumps first week in office that is obviously been crazy but because of Merrick Garland. The judge Antonin Scalia died a year ago almost and the republicans get to fill the vacancy. An interesting calculus. They said on the chance we win the presidency by blocking the nomination, we will have our own person and thats what happened. Had they lost of course, the same individual probably would have been brought forward by hillary clinton. Certainly. They thought they may lose because people would be so disgusted because of the inactivity. People were not upset about that and frankly what we are seeing in washington right now, ted is something that has been going on for a number of years and this is a whoever is in power seems to hold it over the other party and they are guilty. Neil gorsuch is considered by most people to be the front runner but both seem to be pro life and they do pass that litmus test and President Trump says the conservatives will be happy with his pick. Is that the case in your mind but keep in mind always with the justs. Look anything can happen. Look at david suter. We think they are the front runners and we believe that. Right. But i would not be surprised if somebody else emerged, it seems to be the way this president is starting his administration. And they are both young, 49 and 51 years old. Either one has the potential to be on the Supreme Court. How do you see it playing out in on capitol hill . I think first of all, we have her some of the democrats say we dont care who is nominated. We will fight this nominee and i think we are going to see their general proclivities and records fully exposed for debate amongst members of the senate and the american people. And then through the hearings, well hear a whole lot more about the cases, specifically that they written opinions on and how they have ruled on things for their entire general careers. And at the end of the day, theyll either solve the mystery in terms of bringing some democrats over or by blunt force the republicans will get their nominee. Brian sobel, thanks. The airlines hit with a major computer outage. We talked with the tech expert about whether that melt down reflects problems with aging technology. Delta airlines that had to ground planes because of tech failure in the recent months and years. Joining me is the chief cofounder of a software problem. It was delta yesterday and united a few weeks ago and southwest has had a couple of these where it is a complete shut down for hours. And the systems that the airlines are working with are simply old. That is true. By all reports. Admittedly i dont know if we know a ton about it. When you go to the terminal you ask for something and they go da da da and there is a thousand key stroke for one little thing. Thats right. And by all reports, a lot of the infrastructure that runs airlines, it happens a lot in industries from the 1990 and the logistics around bringing modernizing the systems. So why not upgrade . Why not. It seems simple. Those are the challenges. The logistics and the time and the cost and especially in the system or industry like air travel where timing is a real issue. Just getting things in place without existing service is no small feat. And a Large Company or Global Company that doesnt have the pressure of an airline, they have trouble when they convert over to a new system. Thats right. Thats a great point. We sort of joke that every major fortune five hundred is always within some refresh cycle of technology. They start it and it takes 18 months and within 12 they are starting the next refresh. Does the Airline Industry drop the ball on if. I wouldnt go that far. I would say they have a very difficult problem that a lot of people dont understand the full scope. I think the challenge like in most of the cases is just understanding and getting a sense of the complexity and what it takes to keep them alive and running and healthy especially in their case where they have lives on the lines. It is a big challenge. And proving forward, is it possible to make small changes or a complete overhaul in some cases do you think from the outside needed . I think every system is different. I think in this instance you have to take an in crammal approach to it. Which in some ways exacerbates the complexity because you are in this transition period of moving to technology. Meanwhile, we will see them creeping up from time to time and unfortunately getting passengers missing their flights. Thank you for coming in. Allison felt he needed to be a part of it. He ga i got this increase and was left hanging out there. Where does the team get that 650 milliondollars now. Is there talk of a new financial backer . Well, i would think that would be something that would have to be considered but the pool is small in terms of people not involved in the gaming industry that have that kind of money. We are looking at 1. 15 billion. And that is not something that the raiders could finance and they would need somebody to invest in it and make Goldman Sachs possible to invest. Any comments from the Las Vegas Stadium authority about the latest developments . They are letting it play itself out and they think theres possibilities that have not been talked about yet. They want to hear from the raiders in terms of the Goldman Sachs investment means. There are critics out there that are inpatient with the process. Interstate 980 is roughly two miles but the roadway has been ranked one of the worse in the country. We will talk to the group that wants the freeway torn down. Wet, windy weather on the way with several rounds expected over the course of the next handful of days. I will have whatis coming up next. An oakland freeways to be torn down. Congress for the new urbanism released the report and highlights interstate 980 on its top ten list of urban freeways across the country that it says are a flight to community. Libby shaft has been in favor of tearing down 980. We have done extensive studies to make sure that the volume of traffic on 980 does not require an actual freeways. 980 was built at an entry to a second bay bridge that never got built and it created a division between downtown oakland and west oakland. In case youre not familiar wit, the freeway runs from interstate 880 the square to the highway and interchange. Im joined by jonathan with the Group Connect oakland and i know it has been your goal to see 980 torn down. Tell me why. We just believe that at connect oakland what is now 560 foot wide basically garb through oakland that separates downtown from west oakland and had really kind of it getting built can be used much more efficiently. It is under utilized 173 cars a day and i want to be clear to the people listening that they dont get too upset not advocating we are advocating the freeway but not the roadway. We want to see a multiwave boulevard similar to octavia boulevard. That can reduce the width of the rightofway and having mass transit bart extend under it an. In a corridor that is about lets say a 5th of the width, you can get many more people through and it is kind of rethinking. It is an example of how you can rethink the urban freeway. How it got there and how it will be used in the future to serve many more people and restitch oakland back together. As you heard the mayor say it does divide west oakland and downtown. This is something that clearly the mayor supports and now it is on this list. Where are we in the process . At the beginning. Connect oakland, its mission has been to get the word out. We have a vision, not the vision but we think we have something that works and we have a website why we think it works and why it is a preferable alternative but there are many studies that need to be done. Traffic studies. Roadway realignment studies. What we part of the plan opens up 17, new acres for development because you are shrinking that right of way. What happens to that. It has been studied within the downtown pacific plan that oakland has developed. We have just started it and dont think it is starting soon. Are you facing opposition. We have not. People said it makes a lot of sense and we can understand it. We have done outreaches to west oakland and various agencies. Zea not seen a ton of opposition. Obviously once it moves forward, this is california, everything. What might the cost of Something Like this be . Well, thats a tricky question. Simply getting the roadway up to grade that we are saying is the current level of castro and brush street on both sides. Right. Within the city of oakland, that doesnt necessarily cost a lot when you are talking about big infrastructure but the one thing we are stating in addition to simply raising the roadway is making those mass transit connection points under the roadway. It goes to a more regional bay tunnel and maybe that uses that 90 corridor to come in from San Francisco so that obviously comes in to more of a discussion obviously but Something Like simply filling in what is that trench, you know, again, i would say one to two hundred Million Dollars but that is a guess. And we need to do studies. But at least there is this report saying what you and the mayor have been saying. Thank you so much. Youre welcome. Lets go to rosemary and talk about the rain. It will start tomorrow evening and not really going to let up until about friday. And then further out it looks like we may get more. Giving you a look here over the oakland estuary and San Francisco and the clouds are in place and streaming in. You can see them up above off of the pacific and picking up on moisture north of santa rosa although not hitting the ground yet. It will take another day. The rain is well back in here but plenty of moisture beginning to stream in and that is the case as we get to the first half of wednesday the rain arrives by wednesday night. Here we are on tuesday. Now into wednesday morning and wake up with mostly cloudy skies and dry tomorrow morning. Most of the afternoon is the dry one. We could squeeze out a few scattered showers but it looks like the onset of the more light rain will start by 6 or 7 00 and could take a little while and slow down a little bit and could speed up a little bit but this is the time frame at this point. Get to go to overnight hours. It continues to fall and thursday morning looks to be the real deal with the not only rain but wind in place for thursday and friday will be a wet day. The weekend looks unsettled. Friday morning. So expect your friday to be wet and if you go to the sierras there will be advisories in place. As far as rainfall amounts anywhere from an inch to two inches expected and three inches or so for the coastal hills and the Mountain Range through friday. Saturday and sunday looks unsettled and sunday night a storm and a good amount of rain. The wind advisory thursday morning and the overnight hours of wednesday and thursday will go the entire day on thursday for the hills and a breezy ones. Gusts reaching 50 Miles Per Hour and these are damaging winds that could take down trees and fire lines, if you are headed to the sierra the winter storm warning starts wednesday night and will go to the overnight hours on saturday morning. If you are driving up on friday be prepared and you are looking up to two feet of snow in the warning area and some of the Higher Elevations three to five feet. That is good news and getting up, it will be treacherous on friday. Here is a look at the numbers as we look outside towards the mostly cloudy skies. 57 in oakland and 67 in San Francisco and low 60s san jose and upper 50s for santa rosa. And tomorrow morning cloudy and cool and 49 in San Francisco and for the south bay starting out at 45 and low 40s in the north bay of santa rosa. A chilly start expected for us. Anything is sort of up in the air when it comes to President Trump. Yes. The democrats have said it doesnt matter who he puts out there, we are so angry that we will do everything we can to stone wallet and that means possibly a filibuster. How long do you think it will take . First of all the person is going through hearings and then to a vote. I think at the end of the day, the numbers, the republicans have the numbers to make it stick and they will do it and it will take time. You are seeing on your screen there a bit about these potential people and at the end of the day the democrats just feel like their person was not brought forward and we are going to stop the republican nominee. Who loses in all of this, if you will, and who wins . Applicantly, do you think . I think it is going to be drawn out and i think the republicans eventually win because they have the numbers. And you can filibuster and do whatever you want and at the end of the day there are mechanisms in congress to overcome the filibuster and eventually nominate this and confirm this nominee. And you can see that the reporters have gathered there at the white house awaiting this name that donald trump is going to be delivering live and this is the most important a president can do because it does shape the country long after president is gone because it is a lifetime appointment. And as we were saying 49 and 51 years old respectively. Thats a lot of years on the bench. Yes. Obviously really young in terms of the appointees. Both of them.
