Check into this hotel here, the marriott in fishermens wharf. He discovered there was no vacancy and thats when things went downhill. Just hours before the alleged assault, 49ers fullback bruce miller posted an Instagram Photo from the palm house bar in the marina district. Sundays are for boys, he wrote. A restaurant worker told ktvu the 29yearold came into the bar with his buddies three separate times that night and was, quote, hammered. He was like kind of wasted. Really intoxicated. Reporter fast forward to 3 00 this morning. This is Surveillance Video from the travel lodge on columbus where a clerk says miller sat on some steps and threw up. He had a little bit of blood on his face. Reporter police say he had tried to get a room at the marriott but it was full. When he tried to enter a room belonging to a sentyearold man, the mans 29yearold son in an adjoining room told miller he had the wrong room. Miller allegedly charged at the son. Officers say miller punched him out cold. Thats when miller ran to the travel lodge. The suspect on the run is bruce miller. He was bleeding so i thought it was better to call nine one one. Reporter police were able to track down miller. Reporter the clerk said he had no idea that miller was a famous football player. He had a chance and he blew it. What was he thinking before did he that . Its kind of it makes the Organization Look bad. They need to be setting an example. If you cant set a positive example it is time to go, find Something Else to do. Reporter now, the 49ers agreed miller was released from the team today. Surveillance video shows him in handcuffs being questioned by emergency crews. He did suffer minor injuries and was tweeted at the hospital but the damage to his reputation and to his career will obviously take much longer to heal. Live in San Francisco, im tara more i will arrest team. Back to you. Tear remarks given the fact that this victim is 70 years old, does than hans any charges that miller could face in this case . Reporter it definitely does heather. Thats considered elder abuse and it carries a much stiffer penalty. If this were to happen and somebody, say the victim was younger than 70, you are looking at a possible state prison sentence of three years. But now with 70 years or older, you are looking at five years. So it definitely makes a difference. Tear remarks thank you. This is not the first time hes been in trouble with the law. Miller has been charged now with assault with a deadly weapon, two counts of making criminal threats and battery. Remember last year miller was arrested on spousal battery charges in santa clara. He was accused of smashing his then fiances cell phone during a heated argument. He later pleaded no contest to a misdemeanor charge of disturbing the peace. Our sports anchor joe fonzi is here. You said that you know miller and these allegations do surprise you. Its one of those head scratching incidents that maybe you just say as much as you think you know somebody, maybe you never really know that person. I would characterize bruce miller as a guy who was always in the locker room willing to talk. Hes one of those guys that you would go to win, lose, or draw and know that he would always meet that media obligation and do so with a smile on his face. I think the way everything went down last year you kind of say, okay, theres one strike and now you are going to be on your best behavior. You didnt hurt anybody. You hurt an inanimate object. You served your penalty and went to the classes. So obviously he knew that he was on a no tolerance policy there this point moving forward. It really is surprising. He is one of the kind of guys that you kind of rooted for because of the chip kelly offense his position at fullback was not something that was used in this offense. So he had to change positions and be a tight end this year. Did he make the team. And as i said, he was probably in the locker room one of the considered one of the leaders. When the Colin Kaepernick thing went down he was one of the people who stood up and talked to the media. He was someone that i think despite the fact that he wasnt considered a star of the team was considered kind of one of the leaders in the locker room. So for me hes one of those guys you kind of rooted for. It is very shocking and very surprising but given the history and given the problems that the 49ers have faced on the Police Blotters in recent months it is no surprise that they had to let him go. Theres no other way to approach it. Was he kind of lucky to make the team out of the gate . Not so much lucky but they had eliminated his position in the chip kelly offense. He was listed as the number three tight end. So he switched, had to learn a new position. He learned a new position when he came to the pros in the first place to be a fullback. Sew was kind of one of those survivor kind of guys. Key play on special teams, do a lot of things. As i said he was seen as a locker room leader, so it is surprising to me that this went down. But as i said given the history of the things that had happened on the 49ers in recent years, two strikes, he had to go, no question. And the opener is coming up monday night. Were talking about something other than football when it comes to the 49ers. All right, joe. In Fremont Police there are looking for one of two thieves who broke into a dealership, stole a couple of cars, then crashed during their get away. Workers on this labor day. We crunch the numbers and look at whats on the horizon for the workforce. Next, we are going to speak with our tech expert on the release of the newest iphone plus a social media scam will you want to be aware of. In this Holiday Weekend it has been pretty cool so far but things are starting to heat up in time for your work week. I will have the specifics on a bay area warmup. Always on the sunny side keep on the sunny side of life i take pzero heartburn h morning for my frequent heartburn because you cant beat prilosec otc the 1 doctor recommended frequent heartburn medicine for ten straight years. One pill each morning. 24 hours. Zero heartburn. Keep on the sunny side always on the sunny side keep on the sunny side of life our desire for companionship is making people vulnerable to a new crime. Ryan this is really scary stuff. The Brookings Institute is reporting that nearly 70 of these cases involve children and minors. Let me give you an example. You are on social media, you get a friendq you look at their profile and go hey, they have a lot of friends, maybe they work at the same company or went to the same school and you think its okay. Maybe the person is slightly attractive. Sure enough they start chatting with you, then things start getting steamy. They want videos, pictures. Then all of a sudden you find yourself in compromising position and all of a sudden the video chat ends and they send you a notice saying, hey, you are going to need to send me some money or im going to send this to your friends and everyone you know. This has turned into a lucrative crime. What they do is they take young women in poor countries like the philippines is a hot bed for this. They recruit them to send these messages to men, get them to do . Kind of lure them in. But theres other ways, too. Stolen hardware or hacked accounts, hacked emails. They steal these pictures, then they go out and find the people, the victim, and then ultimately extort them for money or more pictures. In some cases, in fact, amanda todd, in british columbia, one of the most famous cases, flashed her breasts online, the person took the photo and said, now you need to send money. It is either going to be everywhere or you pay up. And daniel perry in ireland committed suicide after the scam hit him. And there was another young 17 yearold girl in new york who was sent a video of a man choking a kit ten and was told that if she didnt show her breasts, he would kill the cat. Of course, she did and he said he would send all the photos to her friends and family. What we need to know, when were online, weve all got cameras in front of our pcs that camera can get hacked. If you are in a compromising position someone can easily record that date that. Make sure you dont do anything in front of a camera that you dont want released to the world. Certainly make sure you keep your social media accounts private. We are going to switch gears and talk about apple and the latest iphone. Were all hearing that it is going to be thinner, faster, but no headphone jack. No headphone jack. Theyre saying theyre going to take away the headphone jack to make room some really great stuff. They are saying they are going to waterproof the home button. It is to longer going to be clickable. So they can finally compete with samsung that has had the waterproof phone for awhile now. Faster and thinner but always dual camera on the back so you can get some longer focusing so you dont need an adapter. But you are going to need some sort of connector, right . The headphones are going to be inside the box. They are going to give you a connector so you can use your legacy headphones, but i dont think thats going to be all that great. It is going to be nice not to have two jacks at the back of my phone, but its not so cool. One of the basic functions for me of my phone, i dont know, im going to have to get used to that. Its kind of a money grab for apple because now the only way is to buy an apple licensed headphone. I suspect a money grab here. Looking forward to it. Comes out wednesday . 10 00 a. M. Everybody get glued to your computers. Really important information, ryan. Thanks for joining us. Youre welcome. Thank you, gang. Storm hermine is putting a damper or labor Day Celebration back east. State unemployment is now at 5. 5 as compared to 6 last labor day, a far cry from the worst of the recession. On labor day 2010 that we were over 10 , and at one point earlier that year over 12 . Reporter he adds, employment has increased steadily since early 2010, the longest employment recovery in three to four decades. Nonetheless i dont know anyone who feels good about the economy here in california, even in the bay area, outside of the tech outside of the tech oligarchy. These official job numbers concerning payroll employment, concerning the Unemployment Rate dont pick up a lot of the structural shift. Part of it is the low wage, the expansion of low wage jobs. Part of is it the expansion of parttime jobs which are considered to be, if theyre just one hour, theyre considered to be a payroll job. Reporter many jobs are going unfilled because too many californians have retired or given up on finding work, a lingering recession hangover. The Labor Force Participation rate on which the Unemployment Rate is built is still under 63 . Or to put it in some perspective, is near the lowest its been since the late 1970s. Reporter yet the percentage of people willing to confidently quit one job and move on to another one subpoena. The brightest spot, we do not seem to be in a jobs bubble. A good day for a bike race and a barbecue. Its been pretty cool all weekend, and now it is going to start warming up. It did warm up today fur or five degrees, but as we head into tomorrow and the next day, you are going to get back into the low 90s. This shows a little fog at the coast but not a heck of a lot. Its kind of getting skimmed away. Fog should return the next couple of days. Just lightly, though. We are going to have more of a falllike weather pattern. 87 in fairfield, 80 in san jose. Thats right now. Look how much warmer it is. Seven degrees warmer in fairfield, seven degrees warmer in livermore. Its definitely a warmer day. Temperatures tomorrow are going to be another plus five. It is going to be warm. No fog at the coast. Well, there is a little bit but barrel any fog. So this is what is happening. All the last three weeks weve had this expanded marine layer. Now it is pinching down in association with the High Pressure. It is going to try to regain control. And when it does we heat up. Thats classic summer pattern. This time of year with the water temperatures and getting closer to fall it actually could heat us up more than we avenue. Look at the fog forecast for tomorrow morning. Not a lot. Very little if any. Then you see some clouds to the north, and then you see the temperature forecast for tomorrow. You have got reds. Those are your 90s. Even some 100s showing up towards sacramento. You see that strip of purple. Thats back into the heat. Thats back into the fire danger, too. As we look at san jose for tuesday tomorrow, you wake up partly cloudy, partly sunny. A few morning clouds. But then mostly sunny in the afternoon. Youre in the mid 70s. And then by the max heating of the day youre up to mid80s, upper 80s in some of those inland bay valleys around san jose. Downtown 84 degrees. So this low Pressure Center has brought us the cool weather. Hat gone away and now the warming trend builds in. The marine layer, inversion, all the same thing. This High Pressure makes that happen. When that happens this happens. The temperatures go back up throughout the area. So here we go. The downside to this is were talking about more you see what i just did there, frank . I just got a little off ba. They told me to come back this way, and i just had a little moment there where i couldnt remember if i was going to stay or go and here i am. Im over here now.
