On vacation and with relatives and at a wells fargo when he was stabbed by a complete stranger a woman. It started at the corner of east 14th street about 11 30. Thats when a 32yearold woman walked into the bank and immediately was agitated and very nervous and asked for money and at one point she then walks up to the boy sitting by himself in a lounge in the chair in the lounge and she took out either scissors or a knife and was stabbed pretty deep. He is at Childrens Hospital for surgery. We talked more about it with this man and here is what he had to say. He described to family and Law Enforcement that responded he thought he was punched in the back. And being punched in the back is what was the knife entering into his body and i understand it was fairly deep and thats why it will require surgery to repair it for him. So the woman, the suspect fled out of the bank with Security Officers following her to see what happened and as officers arrived, they did take the female into custody. We dont have her name. We spoke to a witness as it unfolded and here is what he had to say. The suspect walked in and the suspect kind of went like that to the back of somebodys, amalea back and everybody thought it was a punch. I dont know what people thought. Thought it was a punch. Why did you do that and then the suspect proceeded to the counter and asked for all of the money. At that point my girlfriend left. We understand that the suspect left with several hundred dollars and was caught outside the bank. We understand that the boy was visited at oakland where he is going to make a full recovery despite the full wound in his back. Henry lee, fox 2 news. Thank you very much. For that live report. And we have seen a lot of volunteers passing out shirts and signs and buttons and the supporters are optimistic about bernies chances in the california primary even though he leads Hillary Clinton by two points in the field and clinton has a 45 lead. If i win in california and if we do well and i dont know that we will, we may, if we do well in the other states, if there are super delegates out there that say you know what, looking at the objective evidence of polling, looking at the objective evidence of who has the strongest Grassroots Campaign and can bring out the larger voter turnout that i think is crucial, if some of those super delegates think it is Bernie Sanders, i think that is not insignificant. Because when he was talking today, he barely made mention of Hillary Clinton which is something before today in every statement he would say Hillary Clinton and here is why my positions are better than hers and didnt get that feel today. At the end of the campaign you can feel the primary season and feel a slight change in the air and it does feel that Bernie Sanders is softning on his position to perhaps unify the democratic party. They breached the site, poor security prior to 2013 and just before they switched over, hackers got in and breached all of the database. And they got user names and passwords and emails that doesnt seem that big of a deal, who uses my space anymore . But what we dont remember in 2008 it was the Largest Social Network and nearly 427 million passwords have been compromised and 360 million accounts. Thats a huge chunk and considered the largest data breach ever. You say that number and they have passwords. It is not like my space was taking credit card numbers. What is the big deal . Especially prior to 2013. They tighten ited up after that. They use a double assault where they do this cool algorithm to make sure you are safe. How many times do you go to a web site and set up an account and use your old use your name and password that you have used since the day you were born. It is easy. Hard to remember all of the passwords and in these days we got 7 or 8 different logins from g mail to whatever. You use the same combo all the time. Here is the cool part or not the cool part, the scary part. You use the same user name and passer combo on g mail that hackers get into fairly easy anomie space you can reset the pass everything goes through email, the blood hart of the internet identity. I was reading earlier for our viewers, rap artist drayp says he was hacked because of his old my space but that is apparently what happened. If you still have the same email address you would have gotten an email from my space a few days ago but if not you can go to a web site called link source. Com and you can type in your user name and password or your user name and email address and it will tell you whether it has been breached and you want to take the time and say whether or not you were involved in this at all is go ahead and change it. You use one user name and password and every time you log in, it will create a unique password for that web site. Thats cool. Or if you dont want to pay 4. 99 a year, create your own algorithm. Take the name of a Favorite Song like somewhere over the rainbow. I like that song. Take the first letter of the words and take a number, a random number, whether it is your birthday and take two numbers out of that and the first two consonants and it cant be predicted. You lost me on the last two. But i do like that technique. You essentially create your own puzzle so you dont remember the actual password but the code to get to it and no computer can breach it. Be aggressive about your password and you probably wont get hacked is the theme. Yeah, this is not going to go away. We will see the breaches constantly happen. Prosecutors decide not to charge the mother of that little boy who got inside the gorilla enclosure in ohio and killing the silver back gorilla. Firefighters in monterey are still trying to get a handle on the coleman fire that has burned through 3,000 acres since then began saturday and burning west of king city and the padres national forest. Residents are under a mandatory evacuation order. The cause of the fire is under investigation. In los angeles, people that live in the hills are back home after the evacuation orders let go. 5000 people have to leave their homes. The fire destroyed the Main Building of the restoration trust but no houses lost and it ultimately burned 500 acres. Cooler temperatures and calmer winds helped to gain control of the fire. Investigators say a truck that ran into a power pole may have started it. In ohio prosecutor has decided not to file charges against the parent of a boy that got into an exhibit resulting in the shooting death of that endangered gorilla. The prosecutor made that announcement saying the childs mother had three other children with her last saturday and attending to them when she says that the young son just ran off. The gorilla dragged the little boy and officials killed the silver back for the childs safety. The gorilla exhibit will open tomorrow with a taller barrier. Coming up. An eruption of outrage after a judge gives a 6 month sentence to a young swimmer convicted of Sexual Assault. And how a letter has caused changes to happen. The preparations put in place because of the heavy rain and powerful winds. We will tell you more about that when the four on 2 returns. Out range is growing regarding the Sexual Assault case. A former stanford swimmer, brock turner was sentenced to six months in county jail and three years probation and ordered to register as a sex offender for sexually assaulting an unconscious woman outside of a from a fraternity power and others are calling for a recall to the sentence. And adding more fuel is a letter that turners father issued a statement that he made at sentencing that was later posted on twitter. Dan turner says their family has been shattered. He went on to say his life meaning his life will never be the one he dreamed about and worked so hard to achieve. That is a steve price to pay for 20 minutes out of action out of his 20 plus years of life. Another letter that set this on fire across the internet. The Sexual Assault victim read a lengthy emotional statement published online and said the attack and trial have caused her emotional damage and pushed my family through a year of suffering and face the consequences of his crime of making us wait so long for justice. The four by 4. We are taking four minutes to take a deeper look at the case and joined now by our legal analysis, michael cardoza. Talking about why the six months . Positive character references. Lack of criminal record. Says that prison would have had a severe impact how can a judge say that . Is it for him to say whether or not a person will be affected by the prison sentence. The judge has to take everything into consideration in sentencing someone. Remember, this judge sat through this entire trial. He knew what went before the jury and he actually knew what the jury didnt see or hear. So he saw it all and came to a conclusion and thats what we pay our judges for. What im afraid of with this recall that they are doing. It will have a Chilling Effect on the judges. If you are a judge in another case, maybe a high profile case where people are paying attention and you think well i really shouldnt sentence him to the max but i dont want to be recalled so plain and simply, this shouldnt be done in this case. This recall is wrong. And michael, this is as old as time. Probably what people are not happy with what the judge decides to. This happens all the time when you go before a judge. How many times has a judge caved to Public Opinion. Not often and certainly didnt have the Public Opinion before he rendered his decision but both sides will be unhappy. I have never seen sides happy in a criminal situation. You sentence too much. You sentence too little. Im not happy, youre not happy. Can you imagine if it was 14 years. In the visceral reaction is too much. You know the thing that gets me, if you speak out against this and you and i talked about this, people think you speak out against this, you must be prorape. No, put the rape aside and look at the judges position and the positions we put them into make the decisions. Remember, this judge is an ex District Attorney so he sees it from a very conservative site and he decided six months was appropriate. We may not agree with it. Community may not agree but this is not the way to go about it. You can understand peoples reaction. Six months. To 14 years. I do want to get back though to this recall effort because i want to take a look now at what the District Attorney in that county had to say. He said that while i strongly disagree with the sentence that the judge issued in the brock turner case i dont believe he should be removed from his judgeship. I am so pleased that the victims powerful statements about the devastation of campus Sexual Assault are being heard across the nation and she has given voice to thousands of Sexual Assaults. I want to go back to you have been in the courtroom several times, many times. Countless times. But when you look at this though how surprised are you at the sentence . Without having watched the trial and knowing what i know im very surprised at this. Should it have been more . Maybe it should have been more. But as i say, the judge saw this entire trial. Hes the one that makes the decision. Hes the one that is on the hot seat. Dont do this to him because you will be affecting all sorts of other judges and the other thing, remember when a high profile case comes in, say we are the bench, do you want this case . No, i dont want to put my judge ship at risk and judges start to shy away from this. You got to let them do what they do. If you want to remove him at the next election do it, you cant knee jerk to anything. He is running unopposed. But thats why they are doing the recall. Maybe someone will run next time. Have you ever seen a judge recalled . I cant remember. Has it been done . Maybe somewhere. But i dont remember. It is telling, michael that the da and the judge doesnt want the judge recalled. We have sound from turners own attorney. Lets listen to that for a moment. Yes, i believe that her trauma and the emotional damage that has been done to her which is absolutely undisputable was taken to account by the judge. Absolutely. That may not be to everyones satisfaction but that is a relative observation. Of course that is what Michael Armstrong will say and speaking of his clients behalf and think about what he had to say. He is right to a certain extent. He was surprised that the judge gave six months but there was another actor here and that was the probation department, they recommended a year or less. You have the judge and probation officer saying a year or less. And the sex offender registry. Now he has that for life. So it is really not as lenient as just a few months and done, right . Let me read some of these comments. We have been getting comments. La kisha mcgray says this sentence is why a lot of us never come forward. It is bad enough to be raped but to report it, go through the Court Process and then have some judge give a sentence this small is just salt in the wound that will have trouble. Let me read another one. The jury could not convict on rape it convicted on Sexual Assault. There is a difference. If rape occurred it would have been far more lengthy talking about that. Are you defending the judge or the system . I am defending the system in this case. And im not prorape. Am i surprised . Yes. As i say but you dont attack the system this way. This is something that we live with, this is how our system is set up but you were talking about the 290 registration. When i defend people i have gone to District Attorneys and say take that 290 out and take my client in for five, just dont give him the registration. That is the life that ruins and maybe it should ruin his life for what he did. Im not saying anything about it. Rape is horrible. Should it be punished . Yes. We have all worked hard for our money and we want some control over what happens to our assets in the event of our death and we want to minimize potential hassles or headaches for loved ones and we know that not ever generation is adept at manage w ealth. Sometimes people think that the reason the money is gone because of the overspending or bad investments that blew up. It is not about that at all, heather. What it is about, is two big causes, number one, 60 of the time the failure is lack of communication and trust within the family. They are not getting along. They cant resolve conflicts, they dont like or trust each other. Another 25 is caused by what we call unprepared errors. The kids have no clue what is going to be expected of them after mom and dad are gone. So i want to go back to those numbers. I couldnt believe it when i was doing the research. 70 of estates do not survive the next generation and 90 the 3rd generation. What shall we to do to improve that. They need to do things that directly impact those causes of failure. So first and foremost. They got to be able to communicate effectively. Treat each other with respect and appreciation. Second, they need an agreed upon methodology that they will use, like a strategy to resolve conflicts. Some families have conflicts and most families have that, they go back for decades but have never been resolved and for sure they will have upsets in the future. So what they need is to be able to say okay, we all agree that the next time we have a beef we will do strategy and everybody agrees and they need to hold their feet to the fire and make sure it happens. That is super important. That is if you are going into this knowing what might happen meaning okay, if mom or dad passes here is what is going to be coming my way. What if you dont know and come up with a plan. Well, thats the thing. Most families dont know. The parents dont want to tell the kids how much money they have or what the estate plan looks like and i cant stress strongly enough that families should reconsider that. Avoid and deal with the discomfort and dont leave it to your attorney to find out what will happen with your estate plan. They will have these questions like why did dad put johnny as the executor instead of me and leave sally five dollars more than us. If they dont have answers from you, they will go after each other and so you have to be able to is it your kids down and explain the estate plan to them before you go. Thats really important. And you know richard, what i was thinking about the segment, i was thinking about those that are lottery winners and 70 of those people are broke within a few years and so this is very similar, right . A 12yearold boy and vacation starting and your parents, from out of town and here in san leandro and waiting with his relatives at the san leandro wells fargo when for no apparent reason, this woman, hammon makes a beeline for him and stabbed him several times. A 12yearold boy visiting from out of state was stabbed several times by a complete stranger at this wells fargo bank. The suspect 32yearold iona hammon stole monies from a customer. The woman walked into the bank at east 14th street. The police said surveillance shows hammon immediately walking to a customer lounge where the 12yearold boy was waiting for a relative. Without warning hammon pulled out scissors and stabbed the boy in his back and suffered two superficial wounds and one complete cut. It was unprovoked. He described to family and Law Enforcement officers that responded he thought he was punched in the back. And being punched in the back was the knife entering into his body.
