The beating death of Michael Tyree and charged with assaulting another inmate that same night. They did not enter any pleas today. Those who were supposed to protect Michael Tyree did not. Instead, they killed him. And we have charged them with murder. Reporter Authorities SayMichael Tyree did have Mental Health issues. Court records say the three deputies went to tyrees cell to search it, and then inmates could hear a loud thumping and banging. They could hear tyree yelling im sorry, im sorry. Stop. The next Court Appearance is next friday, and theres also some information in the Court Documents that indicate the three officers that same evening went to the cell of another inmate and beat him as well. Rob, any information come out about exactly why these deputies went into tyrees cell in the first place . Any more on the motive . Reporter they went to tyrees cell to search. Apparently its quite common. Some of the inmates squirrel awayextra clothing and maybe things theyre not supposed to have. It sounded like it was more of a routine search that certainly went south. Rob, you talked about family and friends of the three deputies. What about family members of the victim . Reporter it was packed. It was quiet. There were no outbursts of any nature and none of the family members of the inmates wanted to talk to the media. They were kind of polite, but they made it clear they did not want to speak with us. Are these going to be tried all together as one . Reporter the District Attorney would like to charge all three, but as this thing winds down perhaps the Defense Attorneys will want to split them up. Thats still yet to be determined. As of now, the three are together. I might add the three deputies are in custody. Theres no bail, but there will be a bail hearing next friday in about 10 days. Rob live for us this afternoon on this big case. Thank you. Before we get off topic here, the sheriff of santa clara put out a statement. I appreciate the decision to file murder charges against the three correctional deputies arrested for the murder of Michael Tyree. She says as the sheriff, i will redouble my departments efforts to root out any correctional staff that does not share and exhibit the high standards the public rightfully expects from us. That is the statement from sheriff smith. As rob said, september 18th is the next Court Appearance and we will be there. Accord together the protesters out there, that is needed cleaning house, making sure they are following proper protocol. Lets go to another story developing in california. Evacuations under way in toullinine count where i. They were reported about 1 30 this afternoon. You can see the airplane in the picture. They are burning about 5 miles east of the Historic Town of columbia. Crews are attacking that fire from the air and on the ground. A lot of structure protection going on. You can see flames pretty close to structures. Some residents, a camp, and a school have been evacuated. No word on how this fire started. Checking in over there in the weather center. A tough day to be out there fighting fires. Absolutely. When its that hot and it is that dry, that fire just burns that much hotter and that much faster. Thats what we have very hot and dry weather here in place. We reached into the triple digits as expected. 102 right now in livermore. 100 degrees in arvada. The only area holding in will the 70s this afternoon, 75 degrees in halfmoon bay. Temperatures are up by several degrees many most cases. Were looking at 5 degrees of warming from yesterday into today. Around the bay, 36 degrees warmer than where we were 24 hours ago. Today a hotter day, tomorrow even hotter. And as the anchors mentioned a little while ago, that means we have that heat advisory today as well as tomorrow. For today it lasts until about 7 00. Its really just a reminder to stay hydrated, to avoid or reduce that activity when it is very hot like it is today. Not sure if we actually broke records. Those numbers are still coming in. Well take a look at what you can expect for the rest of today, into tomorrow, and how long this heat up is going to last. Because of the weather in the south bay, officials arent taking any chances. As we report, theyre even closing a popular park all because of the hot weather. Reporter park rangers decided to close the park because of the high temperatures and extreme fire danger. They say letting people enjoy the park is just not worth the risk. Theres a lot of dry vegetation in the park that could act as fuel. Signs are up alerting people who enjoy hiking the trails, which is home to wildlife like these deer that we spotted. The closure took some visitors by surprise. Im disappointed. My plans were to follow toward the pavement ends and head for home. Thats about a 15mile ride. I understand with the heat and fire danger that sometimes this has to be done and the park will still be here for next time rather than having a fire. Reporter the National Weather service says temperatures are supposed to reach the 90s and over 100 in the bay area. Theyll be on the look out for people suffering from dehydration and heatrelated illness. We found people trying to beat the heat by hiking earlier in the morning. Most came prepared with Water Bottles and hats. If you want to avoid the sun all together and dont have air conditioning, head to any of the Community Centers in san jose that act as cooling centers. Searchers found a body today near a spot where a San Francisco man went missing over the weekend. They made the discovery just off angel island. The bod by was located in ayala cove. The marine county Coroners Office responded to the scene and has not released the identity of the person pulled from the water or confirmed if it is that man. Dr. Ben carson came to San Francisco today to answer questions about his platform, his policies, and his climb from poverty to the height of the medical profession. We are there to observe and ask a pointed question to dr. Ben carson. Reporter he is a brilliant surgeon, an accomplished businessman, a prolific author, and much respected philanthropist. Does that qualify him to be president . He rose from dire poverty in detroit to become a world renowned brain surgeon, Corporate Board member, and winner of the president ial medal of freedom. As a medical doctor who swore oath to do no harm, how could he square that to sending soldiers to their death in future conflicts. As a surgeon when somebody has a tumor thats compressing a vital area of the brain, i have to actually go in and cut them. That doesnt seem like a nice thing to do. I have to open their head up and to go in there. I have to expose them to danger. But the longterm goal is to preserve their life. And when we look at Something Like the global jihaddist movement and their goals, the sooner we eradicate them, the less damage they can do. If you leave that tumor there, its going to kill you. Reporter we will have much more on his specific answers to various critical policy issues on 5 and 6, but he is the most interesting man to say the least. As a man who has never been elected to Public Office before, what do you think dr. Ben carson would bring to the Republican Party . Reporter you look at a lot of people during our career over the years. You figure out how smart they are, how well intentioned they are, and all that comes up very positive. This is a very bright man who has a very, very good idea. A very smart man who understands how complex things work. The other thing thats important is he brings a new face to the Republican Party a face of diversity, a face of inclusion. Something thats been lacking for the republicans for a long time. Because hes so smart and so good at what he does, it appears hes the kind of person theyd really want. He has no intention of being just trotted out there. Well see you back here during the five and six. The kentucky county clerk who refused to issue marriage licenses to samesex couples was released today. Davis refused to issue licenses after the Supreme Court ruling in june that found a right to samesex marriage. She argued her religious beliefs would not allow it. Two samesex couples and two straight couples filed suit, and today davis was ordered not to interfere with marriage licensing but her lawyer wont say if shell comply. A plan to ease congestion for the evening commute on the Golden Gate Bridge. Well talk about the changes under way right now. Plus north bay craft beer business. Look at that. The company has decided to give up a 50 stake to someone else. Well tell you about the International Partner theyve now teamed up with. Hey let me help with that. Oh, thank you introducing the oneandonly Volkswagen Golf sportwagen. The sportier utility vehicle. Right now drivers traveling over the Golden Gate Bridge from San Francisco to marine county can expect to see some traffic relief. That is because just about 10 minutes ago bridge officials opened an extra northbound lane. We are joined now by the spokesperson for the Golden Gate Bridge district. Four lanes during an evening commute, where has this been . You know, we have done this at times in the past. About 2010, we saw a real surge of traffic coming from the south end. At that point, the bridge patrol decided it would be better to go three and three. Weve been waiting to see how traffic comes out postpresidio Parkway Construction and going into this heavier commute season. Taking a look at our metrics and having an idea of where traffic is headed, we feel going four north in the afternoons, two south is going to help people move out of the city and get across the bridge. Four lanes going southbound. Do we not think all the people going into San Francisco all those years, they have to come back. Thats absolutely true. What the difference is, mike, that over the years the southbound traffic coming into San Francisco has gotten much heavier in the evening. So yes, all those people need to go back northbound when theyre done with work. We understand that for the evening commute, but weve been seeing heavier traffic coming from the other end. We feel like at this point with the numbers were seeing, its best to go four north. Is this going to be a seasonal thing for the most part or come summertime, is it going to go back to three and three during the evening commute . At this point, we plan for it to be monday through friday. And were going to take a look at it in about 10 weeks after everybodys gotten used to the traffic change, folks coming south have had a chance to adjust their commute if they need to, and see if it works. Get a feel for the times going across the bridge. If everyones happy with it, it will continue. One important caveat is it could change based on what the changes like an accident. If theres a bad accident, you cant blame that on the four lanes. It could have been someone not driving attentively. Right. Or if theres a bad accident coming southbound and we need to open an extra lane southbound. A lot of times accidents happen and by the time you hit the bridge, you dont see anything but theres still triage thats been there for a while. Based on what bridge patrol sees, they will adjust the lanes accordingly. Were hoping this offers people a level of predictability. Since we have you, we get calls into the news room about the suicide barrier. Where are we with that . We just hired a consultant to help us through the bid process as were looking for a contractor. The bid for the contractor is going to go out next month. Were moving closer and were still on track to have that suicide deterrent in place by 2018. Good information there and great idea. I think its fantastic. Still to come, a Bay Area Company creating Cutting Edge Technology for sports. As we mentioned just a moment ago, even 90s around the bay. Low 90s in oakland right now. Upper 90s in mountain view, and theres the cool spot half moon bay. Chilling at 77. 100 degrees outside your door woodside. We shift to the south, we have 99 in morgan hill. 100 degrees in saratoga. Into the inner east bay where we have more triple digit heat. 104 pittsburg. 95 in lafayette. The heat just goes on and on. Into the evening hours, clear and mild. Tomorrow sunny and even hotter. Wednesday could be the hottest day. Looks like we may carry this all the way into thursday, but we do have a cooler weekend. When i say cooler, thats all relative because its not going to be cool by far. Its not just not going to be as hot as were experiencing over the next few days. 63 in oakland for tomorrow morning. 61 San Francisco. Low 60s near freemont. 64 san jose. 63 in antioch and over the north bay. 101 for napa tomorrow. Mid90s in berkley. Shifting along to the south bay, we have a hot one here as well. 99 san jose. 102 mountain view. 108 in gilroy. These temperatures anywhere from 1520 degrees above the seasonal average. Take a look as we get into thursday. Still very hot inland. Could see a Late Afternoon sea breeze by thursday. That will cool down the coast a little bit, perhaps inside the bay. It takes another day before inland communities begin to feel it. Only slightly better as we get into the last business day of the week. Temperatures will finally come back down. 90s for our inland cities, which is a very warm day. Very hot. The 90 on sunday seems pleasant compared to whats going on now. Thanks. After the break, well hear from bay area congressman eric swallwell. We have his thoughts on the refugee crisis going on in europe. That interview is coming up. Enjoy this Amazing Taste combination on freshly baked bread, toasted with melty provolone, tomatoes and oregano. The new italian hero wont be here long, so try one today. Subway. Eat fresh. Today in the four by four, we are taking four minutes to talk about why u. S. Forces remain in afghanistan. Congressman swallwell joins us now for this conversation. Thank you for taking the time and welcome back to washington. Thanks, mike. So here we are 14 years after 9 11. We still have troops in afghanistan. How many troops are there, and will they be back here in the United States by the end of 2016 . You know, the end of 2014 we drew down to just around 10,000 troops in afghanistan. You know, the goal is to continue to bring that number down. But to do it as afghanistan is able to stand up on its own. If you would have told me two years ago they would have had the first peaceful transfer of power ever in their history, that they would have signed a bilateral security agreement, and their elections would have been pulled off by any serious attacks by the taliban, i wouldnt have believed it. Its a positive work in progress. Last year president obama said we have to recognize afghanistan will not be a perfect place, and it is not americas responsibility to make it one. Do you agree with that . Is it not americas responsibility to make sure that the security situation there in afghanistan doesnt turn into what we see in iraq right now . You know, mike, i was an intern on capitol hill when september 11th happened. I think our responsibility in afghanistan is to make sure a day like that never happens again in the United States because a country was able to be a launching pad for terrorism. We certainly cant make it, you know, a perfect economy. But i think we do have a responsibility to people here in the United States to do what we can to root out terrorism over there so it doesnt reach our country again. Were much more in a support role now. I cant see why we would want to leave completely without having any presence there because i do believe that the taliban and these other terrorist groups, they would rise up again and in short order we would be hit again. Lets talk about the refugee crisis in syria, in western europe. The state Department Says it will admit 1800 refugees this year. 1800. Do you think thats enough . Could the United States not be doing more to help the refugees fleeing syria . I was over in turkey earlier this summer. I was in jordan. Ive seen the peril these refugees have been under. Its something that could happen to anyone. I think the United States certainly can step up and do a little bit more. I think other countries in the middle east, frankly, can do a little bit more. 1800 doesnt seem like a lot, but do you think the real reason were not allowing more here into the United States is the Security Threat . That there could be terrorists who could pose as refugees and make their way into the United States . We have a responsibility, i think just as a leader in the world, to work and take on refugees but we have to make sure anyone who comes to our country is screened and cleared because weve already seen isis saying theyre going to use this crisis as a way to take its fighters and dispatch them throughout the world. Were beginning to have to be pretty careful about how we do this. Are you still on the intelligence subcommittee . Yeah. Im a senior democrat for the cia subcommittee. This was an intelligence trip over to afghanistan. Can you share a little intelligence with us . Do we have u. S. Forces, cia in syria trying tagetes to the root cause of why all these individuals are fleeing the country . What we do know, mike, is their civil war which has been going on for years and you have a brutal dictator there, asad, i think other countries in the middle east could do a lot more about this. But its not our problem. We shouldnt have forces there in syria . The president asked congress and i voted against this last year to train and to help with Syrian Opposition fighters. My problem there was we dont really have a clear picture on just who these folks are and operations like this in the past whether its in vietnam or latin america havent worked out well for us. I think we need to put more pressure on our middle east partners to step up and play a bigger role. Congressman, thank you for your service, thank you for the conversation, and wishing you a great session. Thanks, mike. See you back here. Well see ya. Still ahead, Cutting Edge Technology from a Bay Area Company helping train stanford Football Teams. Another hot day over the bay area, and were not done just yet. A look at your current conditions. What you can expect for tomorrow and how long this pattern will last. Lets look at how the commute is setting up to be. Another long one. You still have 30 minutes on the clock, buddy. Eastbound 80 very slow. The four on 2 is back in just a bit. Babies who are talked to from the time theyre born are more likely to have a successful future. Learn more at first5california. Com parents ahead of apples highly anticipated event tomorrow, were looking at Cyber Security today. More and more devices around your home your thermostat, refrigerator, home alarms, even your Baby Monitors are likely controlled through various phone apps. How secure are those when it comes to hackers and cyber thieves . We are joined by ceo of malware bytes. Thanks for being here with us. Lets jump in and start with this phrase, the internet of things. Were hearing that more and more. Explain to us what exactly does that mean, internet of things . Thats basically just your connected devices at home connected to the internet. Your thermostat, your car, even your door locks are connected to the internet. Why are all these devices connected to the internet in the first place . With that connection, you have to talk about Security Threats. What are those threats . Absolutely. These devices are connected to the internet to make your life easier. For example, your thermostat might be connected to the internet so you can set your temperature before you get home. Or your car might add new features before you have to take it in for service, you can do all this automatically. Security is absolutely a concern. What happens when somebody uses that technique to take control of your car . When you talk about the Security Threat, what kind of attacks are possible when you have these sort of devices, all of them connected to the internet . Theres a couple that come to mind. The first is stealing some kind of private information. For example, listening into your baby monitor. Thats not really you cant do much with that, but thats a privacy concern. All the way to the other side of the spectrum, which is take control of your car and drive you off a cliff which is obviously the much more dangerous part of this. Weve heard that, right . Weve seen that in the news where hackers have checked in on a baby. You can hear the hacker talking to the baby in the crib, and that is scary. What can we do about it . How can we protect ourselves . Unfortunately, a lot of it is the manufacturers job to protect you. You cant do much with your jeep, its on the manufacturer to provide that security. What you can do is not buy these devices secondhand. You never know what the previous owner did with that device. You want to make sure you have the latest version of the firmware. When the jeep hack happened, they sent out usb sticks. What about our personal information we put out there just sometimes online . We have so much information out there. Any best practices or just were taking a risk . You have to be very careful with what information you give out, especially your Social Security number, your credit card information. If a website asks and you dont think they need it, be careful of that. They make our lives seemingly much easier but they also put us at risk. Thank you for being here with us. Thanks for having me. Tomorrow marks the five years of the deadly pge explosion. The powerful blast and fire killed eight people and destroyed 38 homes. Most of the victims have since moved back to the area and all but 10 of the homes have been rebuilt. The city is also working on repaving roads and sidewalks, adding a neighborhood park, and other improvements. All the families who suffered losses have agreed to settle for more than 500 million. More homes are being evacuated. 148 square miles have been burned. It has been weeks since homes had to be evacuated, but low humidity, a change in wind direction and high temperatures, have put two small communities at risk. A firefighter was injured but he is reported to be in good condition, which is great news. Back here in the bay area, i cant imagine it getting any hotter but it is. Youre right, sure. Once you get above 100102, whats 105 . Whats the difference, right . Its going to stick around for a while. Finally going to see a little bit of relief as we get into your bay area weekend. A look at plenty of blue skies over the bay area. All that sunshine and hot weather helping to create that poor air quality. Lets take a look at your numbers 88 degrees in San Francisco. 93 in oakland. 102 in livermore. 99 in fairfield. These numbers anywhere from 36 degrees warmer than where we were yesterday. Tomorrow well kick them up a little bit more. I have to point to halfmoon bay, 77 degrees at this hour. Giving you a look along the peninsula, upper 90s palo alto. One last move into the east bay where we have 103 in pittsburg. Mid90s in lafayette. Cxsgsufitis really hard to escape the heat this afternoon. And that heat advisory will go until about 7 00 for the entire bay area with the exception of fairfield as well as valejo and all these small communities in between. The National Weather service wants everybody to be aware of how hot it is out there. Its just above that level to where if youre very sensitive to the lowlevel ozone pollution as a result of the hot weather and emissions, this includes you. Tomorrow morning were going to start out relatively cool. Well have temperatures in the mid50s in areas like santa rosa. Low 60s for valejo. 64 redwood city. 61 as we slide a little bit farther south into morgan hill. Afternoon highs for tomorrow, were going to add a few more areas into the century mark. 101 for sonoma tomorrow. 101 expected for napa. Even around the water, another hot day. The inner east bay looking at 104 in danville. Hotter spots, 106 for livermore. 104 morgan hill. 108 in the forecast there. Along the peninsula, 99 expected for you. 99 redwood city. Back in the low 90s for San Francisco. 70s and 80s through pacifica and halfmoon bay. Slightly better on friday. That sea breeze will start to come back. Takes a day before inland communities get it. As we get into your bay area weekend, temperatures come down. I didnt use the air conditioning last night. I might have to switch it up tonight. It blows people away. Theyve never seen anything like it. Theres never been anything like it, at least not for this application. A tech start up uses Virtual Reality as an instructional tool for players. Youre able to look around as if you are right on the field. We use real video. Were not a goofy video game company. Theres Science Behind why we use real video its because it works. Thats the sales pitch he used on david shaw. Once i put the headset on and looked at it, i said wow. My mom started racing. This is a great way to cut down meeting times. This is a great way to get guys more reps without practice. As far as their brain is concerned, its a real rep. Youre standing there in the pocket. In three weeks, the cardinal blew out three opponents. Hogan looked like a different player. He had his best three games at the end of the year right after he started using this training device. I can see a bunch of different concepts against a bunch of different blitzes and coverages so when im in the decision, i can make decisions faster. We talk through, whatd you see . As hes recalling specific instances, im saying okay, this can work. Oh, its working all right. The company is exploding. Weve gone from three people to 15 people overnight. With a client list that now includes seven Major College programs and six nfl teams, including the 49ers. Great for the lab, less so for stanford football whose brief competitive advantage will inevitably take a hit. I had a heart to heart and said interest is strong and theres a lot of demand. I dont run the company. I dont make the rules. Weve tried to slow the dissemination of this product, but we cant stop it. At some point, its going to be everywhere. Every university will have it. It is business, and the reality is its going to happen eventually. If we dont get them, somebody else will. We want to be the best. Lets get everybody. And i dont think coach shaw has any problem with that at all. Maybe last week not the best example. But maybe in the coming weeks, right . Maybe in the coming weeks. It has been successful, as they said. Well see how far it can go this season. From football to music and movies. British star sam smith singing the latest theme song for the latest bond movie. His song called writings on the wall has been chosen for the film. The movie specter is going to come out in november. You know theres a big following for those james bond movies. Im a fan. What about a sam smith fan . No. Respect, though. Coming up after the break, a pretty big announcement for the pope. The major reform he just set today changing the process of how catholics dissolve their marriages when we return. Great change comes from doing the right thing. Like the radical idea that health isnt an industry. Its a cause. So we do things differently. We combine care and coverage. And believe prevention is the most powerful of cures. So forgive us for not going with the flow. We just think the flow should go with us. Which makes us rebels with one cause. Your health. Pope francis today rad i can cally radically changed the overhaulment of annulment. It can sometimes take years to get an annulment. The new rules will speed up and simplify the process. And the process will now be free free. An annulment is something they can get to say their marriage was not recognized by the church. To streamline it, getting rid of a lengthy process on all procedures that required an automatic review is giving local bishops is authority to step in and process very apparent that there was something wrong with the marriage to begin with. Practicing catholics must have their marriage annulled before they can get married in the church. They are considered to be living in sin. The decision by pope francis comes just after a week after he told this is further evidence of the pontiffs mission to make the church more accessible. A pretty big day in a courtroom in san jose. Yes, a very big day. Charges filed against 3 deputies after an inmate was beaten to death inside a jail in the south bend. We were inside the jail to see the deputies. Also a surprise charge stemming from another assault the same night. Good evening, everyone. Im heather homes. That Court Appearance for the 3 deputies was a quick one this afternoon. And robbalityroth was there. He is outside the courthouse. 3 deputies all appear understand court together. They were all charged with murder but in a strange twist they were also charged with assaulting another inmate that same evening. Those who were supposed to protect Michael Tyree did not. Instead they killed him and we have charged them with murder. The 3 stand accused of beating him to death.
