Members called police. Officers went to the scene. When officers approached the suspect, he was in a patio area police say he opened fire. The suspect fired at the officers from his residence. Fatally striking an officer. Now other officers immediately returned fire. Police believe that dunham may have been hit at that time. Because the scene is a very large apartment complex it took police several hours to evacuate the area. We do understand that the police chief is expected to make a statement about this case in the next few minutes. Ktvu fox 2 janine de la vega is trying to get that comment from the police chief right now. Were going to check in with her in a little bit. But when that happens, well bring that to you here. Were also learning about the background of the veteran officer that was killed. Officer Michael Johnson. San jose mayor sam liccardo tweeted a message of condolences saying johnson left behind a family. He was a 14 year veteran from the San Jose Police department. He was the 12th officer in the departments 166 year history to die in the line of duty. The messages of sympathy have been pouring in for officer johnsons family. This has been san joses darkest hour. Our hearts go out to the family, the friends and colleagues of the fallen officer. His fellow officers also the last San Jose Police officer who was killed in the line of duty was 24yearold rookie officer jeffrey fontana. He was shot and killed during a vehicle stop in south san jose in october of 2001. Investigators say he was ambushed, his gun was still in his holster when he was killed and in a sad twist fontana and johnson were in the same Academy Class. Officers johnsons colleagues are also offering condolences this morning. They issued this message. Police say search dogs picked up a scent in the water near highway 37 last night. Dive teams went into the water early this morning but report finding quoting here nothing of significance. On monday afternoon the boyfriend of Denise Huskins called police and said she was forcibly taken from his home hours earlier. The thing that peaks the curiosity the amount of time that elapsed between when it occurred and now. Recovery efforts resume this morning at the site of the plane crash in the french alps. Search crews have recovered a black box. The german wings jet liner crashed yesterday. Aviation experts say its unusual that the pilot did not make a distress call as the plane took an unexplained eight minute dive. They called because they couldnt. Because something happened to them. Whether or not they lost their oxygen. Somebody did something bad. Or c you know they were too busy but usually having a bit of you are never too busy when you have a major emergency like this. To make one radio call. Now as the investigation into the crash continues, thousands are mourning the victims in germany flowers and candles are piling up in front of a high school. Today state lawmakers will hear support for a right to die law from Brittany Maynard who died last november. Maynard is the bay area woman who moved to oregon so she could end her life after being diagnosed with brain cancer. Her family will release a video that she recorded. The bill would allow terminally ill patients to end their own lives with drugs and dosages recommended by a doctor. That is similar to laws already in place in five other states. Also in sacramento today a group of parents against mandatory childhood vaccinations plans to rally at the state capitol. The parents along with a doctor that is out spoken against the vaccines are hoping to stop legislatures from passing laws that would require children and the group wants lawmakers to decide if they want their children to be vaccinated and not punish unvaccinated students by keeping them out of school. Time is 4 37. We continue with our developing news in the south bay as a search for a suspect that is accused of shooting and killing a San Jose Police officer is now over. Again the stand off ended an hour ago when tactical teams rushed into an apartment and found the body of the suspect. Weve also learned that the officer was engaged to be married. He is waiting to gather all the media so he can say a final statement on this. Now were close to sort of where the Police Activity has been near center road. Officers say the man responsible for shooting and killing their officer was found dead on a second floor balcony. The merge unit had been camped out there all night trying to get him for hours. There was a massive response for San Jose Police. They were responding to a report of man with a gun that was threatening to kill himself when officers arrived they say he started shooting at the officers and one of them Michael Johnson was struck and killed by the gunshot. For hours officers did end up returning fire. The department swat team, the merge unit had a perimeter set up around the neighborhood. They evacuated residents. They didnt know if dunham had been hit. They used various tactics to get inside that apartment that dunham was in. When they did finally enter in the last hour and a half they did find dunham dead from a gunshot wound. Still a lot of investigation to be done but a very somber feeling out here. As i mentioned we are going to hear from police chief larryest cavel. I did speak to him off camera briefly about ten minutes ago and shook his hand. But again very dark time. We saw him rubbing his eyes. Its been a very long night for San Jose Police officers. Time now is 4 39. Swift action in the face of drought. We want to go straight to our developing news after a San Jose Police officer shot and killed. We are listening to a press conference. And were met with gunfire from that apartment and the individual there. [ technical difficulties ] at this time im not aware of any calls for service or contacts with this person or anybody at that address. I will take one more question and then i will leave it for our press information officers. [ inaudible ] the only thing i will say that he was part of that Academy Class with jeffrey fontana. And this is unfortunate for any of our officers to lose their life whether in that class or any class. But its something that we are aware of and something that we need to at least address at some point and understand what we can do especially with those officers in that specific Academy Class. Its important for us to do that. Thank you. One last question. Okay. I can answer any other questions you have. Just keep in mind chief esquivel is really broken upright now. He just addressed all the officers that were out here including those that assisted. Very, very difficult thing to do when youre the head of an organization and you have to tell your officers to continue to do a good job and protect the citizens of the community. Officers were obviously crying, grieving. They will do so for quite some time. As will many of us in the department. Our hearts, our prayers go out with the family of michael, our brother. And again we just hope that you keep them in their prayers along with this family. Again this is very, very difficult time right now. Ill answer some questions, but again, there is a lot of specifics that obviously we cant share. There is a lot of investigation that still has to be conducted. There is some witness statements that still have to be gone through. Obviously evidence that has to be collected at the scene. Witnesses, Family Members that need to be talked to as well. So again we will provide you guys with information as that becomes available soon. Again i know some of you have asked for a picture of officer johnson. Sometime today we can hopefully get that to you in hopes of allowing people to start the grieving process and remember him with a smile that he had on his face and with his bright eyes and somewhat full life who cared a lot about this job. So any other questions that you have . [ inaudible ] the initial information that we had was that he was disupon dent. That he had a gun and there was some mix of him wanting some mention of him wantology kill himself. That information we are going over with Family Members. This will take some time to work through. We will go ahead and get the information that we need. It will take some time. I dont know the exact number but there was at least four officers if memory serves me correctly and who knows what. Initially there were probably two. But as usual the case officers try to get to a call of this magnitude as quick as they can because lives hang in the balance. Especially when you get a call involved with someone with a gun and someone has a mental illness. [reporter] as the chief mentioned, his family has been notified. He did have a wife and she has been notified. And we are making every attempt to go ahead and she was not in the area at the time. So were making arrangements to make sure that, that happens. She is is aware of the situation. The department has reached out and we are doing everything we can to get her here as soon as possible. Other than that i dont think he had any kids. His family is local in the area. They were notified by a command officer, by our chaplain. Again a very, very tough thing to relay to a parent. Tough thing to relay to your fellow officers. We have to go out there and continue to do this job but rest assured we will keep them in our memories as we go out there and continue to do the job that we love to do. And im sure that he would love to do. You know, i dont recall. Slips my mind right now. Wife not a fiance. A wife. [ inaudible ] dont know exactly. It happened rather quickly. Were still going to have to go through all of that information and hopefully we can provide more clarity on this. [reporter question] its my understanding that he spent his years here training. I dont know if he worked any specialized units. Again we will be able to provide you with more information. [ inaudible ] that is something that we want to go ahead and do. To my knowledge has it happened yet . The procession . Yeah they still have to let the coroner do whatever it is that they need to do. Again that should happen pretty shortly. I havent heard anything. We were monitoring the radio up until we came up here. So yeah. Chief made reference to how the people responded in that neighborhood and the fact that they made sure they stayed out of the way. How soon might those folks be able to go back home . They are working on that right now. I know there was some mention that they want to get them in as soon as possible. Like the chief said we certainly appreciate the fact that they went out of their way to actually help us out and allow us to go ahead and do what we needed to do to get into that apartment. We understand that its an inconvenience for a lot of them and they were displaced temporarily. A lot of it was for their own safety until we realized that the suspect was in there and he was deceased. But we are working to get them back into their homes. Was any part of the response for the investigation hampered by the does the chief feel like he had to do something. We had a tremendous amount of resources. As the chief mentioned there were people from officers from palo alto. Just different agencies. The highway patrol. Federal government employees. People that were listening to the radio. Tons of people calmed in offering assistance at a moments notice. So again we had a lot of officers. More man we need more than we needed. We had officers that volunteered to take calls in the city. We are grateful to all of those that assisted. They go through cycles. If he had a recruit the last time, typically they may give him a break. There are recruits out there. It just so happens he didnt have one on this particular day. He could have had a recruit. It was a female Family Member and i think we just need to confirm some of the information. But i know that there was a couple females that called in. So again im not sure if it was a wife or another Family Member but it was a female Family Member. Its my understanding it wasnt from that location. And then we did get some calls later on. But we just have to go through a lot of the phone calls and find o out where people were. They are cooperating. Everybody thus far has been cooperative. I dont know whether he was by himself but like i said when we entered the residence, he was there alone on the balcony. They were in the process of allowing them back into their they just needed to go ahead and kind of render some of the area as they collect evidence and then they would allow people back in. So its still a crime scene. Its my understanding that that is correct and the coroner will try to expedite the process to get people back in their homes. We have staff on hand that are crisis intervention. There is tons of resources out in the community that we offer to our officers to both the families. The officers that were effected. Officers that may have been in the officers academy. Officers that were working on the same team. They were close friends. We have the chaplain who assists greatly. So there is a lot of help and we will be doing a lot of outreach within the department and also to the Family Members of officer johnson. You know what, i met him briefly here and there in passing. I dont know him all that well. But im sure that as the days go by there will be officers that will be able to speak very highly of him. Its my understanding any time youre an fto it means you have something to offer our recruits and teach them how to become a good officer. Again this is a very, very unfortunate situation and again our hearts are very heavy right now as we just work through this process. They were dressed in your common uniform.
