>> reporter: we're at the stadium site, and you can see that they are already calling it home, and they are ready to break ground here but at an emotional city council meeting last night, they made it clear that round two in the fight is coming up for the opponents. workers are doing what santa claire called clean-up work at the great america parking lot for a series of ground-breaking ceremonies starting on monday. it follows last night's city council meeting where the council rejected a referendum from the group "santa clara plays fair" to put the project back on the ballot. today, 49er boostersed they fear the project would get tied up in court. >> i hope we can move past this, and i implore people not to proceed with the court action. that will take more time and cost the city more money and delay potential new jobs for the stadium and cause more grief. >> reporter: santa plays faired it's considering suing the city to force another election saying it believes the city misled voters on innocencing when measure j passed in june of 2010 and spending money it doesn't have and may not collect in the future. >> there are all kinds of options available. i think they are foolish if they break ground on monday, but that's their vision. >> the courts may understand the jobs and the importance of that, and i know they'll fastrak this, and we're asking a narrow question which is is this referendumable? >> reporter: he said the judge could start reevaluating the case in a week, and he has no plans to postpone monday's groundbreaking. robert handa, ktvu, channel 2news. and an agreement was reached in court today after a bench was served in a at the tenant case. >> we never had to go as far to get a bench warrant to get the landlord to negotiate. >> the landlord was accused of failing to return deposits to seven tenants who once lived at 1717 euclid avenue in berkeley. the congressman said one of the tenants will receive her deposit by the end of the her month, and that the tenant had moved out a year and a half ago. was it worth the wait? many ski resorts in lake tahoe are finally open. ken pritchett is live in donner ski ranch. ken? >> reporter: this was the opening day, and you can see the snowplow getting ready for tomorrow. they did welcome skiers today, and that is because of the series of storms in the past week. it's not the latest opening in history, but it is late. donner ski ranch is a family- owned resort. it does not rely on man-made snow. >> it's a nail biter. the storms in alaska don't drop down. it's been rough. >> reporter: donner usually opens in early december, but it took a weekend storm and three feet of snow to open. >> it's really good for the first snow. i'm not disappointed. i got my board all ready and got on the snow gear. >> reporter: at sugar bowl, the same series of storms allowed it to go from 32 runs open to 62 today. >> got eight lifts open and eying a couple of more for later in the week. >> reporter: john monson from sugar bowl said there was a rush of skiers and no borders. >> the damage has been done as far as the holidays and martin luther king being significant revenue for the resorts but by no means are we out of it for snowfall. mother nature could very much turn it on. >> reporter: and if we have another series of storms like last week, we can expect the ski resorts to be fully open or at least very close. what we need now is the cold weather to keep the snow they have. ken pritchett, ktvu, channel 2news. the california department of water resourcessed that most northern california water reservoirs are at or above average levels because of the rain last year. lake shasta at 101%, and lake oroville at 108% and hetch hetchy reservoir is at 93%. new pollution control requirements for trucks at the port of oakland have cut emissions in half. in the eight months since truck owner list to either install exhaust filters retire their trucks, nitrogen oxide levels and black smoke were cut. experts expect the air quality to improve more. a research company released figures showing that apple had a 44% market share and android still has more users around the world. the federal reserve promised to keep low interest rates in place for another three years and sent stocks high or wall street. the dow jones rose 83 points and the nasdaq nearly 32. california universities are enroll -- more uc california universities are enrolling more students who don't meet the minimum tests for course requirements. there was a jump in admission by exception. in the cal state system, it's just the opposite, rolling fewer of those students due to budget cuts in 2010, csu admitted 5300 fewer admissions by exceptions students. dramatic testimony in the trial of a murder of a father and two sons. the governor's trying to fetch funds but there are concerns that animal euthanasia rates could go up. and we will have more fog and cooler daytime highs tomorrow. back in 10 minutes with the forecast. >> reporter: frank, we found out how it would affect shelters and pets up for adoption. this cute terrier was found wandering the streets yesterday. but just as he was turned into animal services came the call his owner had been found. >> she's been very upset the whole time wanting to keep the dog, and i said we have to give the owner a chance to pick it up. >> reporter: under a proposed budget cut, owners will have less time to claim pets before they face adoption or euthanasiaa. for the last two years, the state has limited reimbursement for stray dogs to three days instead of 5, and governor brown wants to make the temporary change permanent. >> they say save a few bucks. but the cost of that is to put countless dogs and cats to death. >> reporter: former state senator tom hayden posted a video of urging the governor to reconsider. the governor can still hold the dogs for the same five-day period but without reimbursement. >> in any case where we would think that an animal might be euthanized, we hold them for the longer period of time to give the owner a chance to come in and reclaim them. but animals that are adoptable, we might move them faster up to adoption. >> reporter: and there is worry that the city and county shelters won't have that choice. >> in the areas that are economically more challenged, you may see the euthanasiaa climb. >> reporter: make sure your pets have identification. blaze her has a microchip. or make sure it has tags. maureen naylor, ktvu, channel 2news. experts say it's just a matter of time before another rock slide happens on telegraph hill. the city allowed residents back into their homes yesterday but advised them not to sleep in rooms with windows that phase the slide. clean-up efforts continued today, and crews did what they could to shore up the cliff side. and three bay area cities made the list of the top solar cities. san diego was the number one solar city, and san jose, third, and san francisco plan and oakland rounded out the remaining top 10 cities. >> we have a tremendous amount of sunshine, and it creates electricity when we need it, hot summer days when the air pollution is at the worst. >> it's banked on solar installations on residential, commercial, and government buildings. and we have a few clouds out there tonight. high clouds and then the fog comes in late tonight and tomorrow morning, and we had fog this morning. a dense fog advisory in the central valley, and we didn't have one for the bay area proper. but look for valley fog in the morning hours again. high clouds as well, and sunshine tomorrow that will lead to a cooler day. the daytime highs today got into the mid and upper 60s. 67 in santa rose a the valley fog will start off cool in the north and east bay and the south bay. overnight lows, mild. you can remember a few weeks ago, temperatures in the 20s. so it's warmer at night and warmer during the day and just a general change met weather from what we saw over the weekend and the previous week. there is a weak weather system to the north. as that slides by, it will increase the clouds and give us an opportunity for a little bit of drizzle. january, pretty dry until we get to this point issue and then we have nice rain. and then we get dry through the rest of the month, so partly sunny and dry going into tomorrow and the bay area weekend. so here is how it breaks down with the computer model. it shows a chance of drizzle. -- you can pick out fog on the satellite. see how it falls to the low point?
