patrolling. >> to demean that is absurd because we've been in contact with police chiefs around the country to make sure we are not talking on the other side of a whim. >> reporter: chief gascon credits crime tracking technology and better community involvement in part to the drop in crime. the man convicted of stabbing a 15-year-old girl and a 60-year-old man in a san francisco bakery is heading toward a sentencing hearing. a judge today accepted scott thomas request to withdraw his insanity plea and set an august 6 date for sentencing. thomas was convicted for the murders. thomas faces life in prison with the possibility of parol. two marin county teenagers are facing charges tonight. nevado police say they arrested john phillip wrestler and a 17- year-old male who's name was not released because he was under age. the break-ins cost about $6,000 in damage. state lawmakers today joined bart officials to announce a new bart citizen oversight committee. sandra swanson authored the new law. it establishes an independent auditor to investigate citizen complaints against bart police officers and it creates an one member citizen review board to recommend any disciplinary action. >> it gives us another place to go when we need a check up how we're doing. what's going on, they look at our training, they look at our policies. they look at the investigation. >> reporter: the new law takes effect next january 1st, exactly two years after the death of oscar grant. some of the oakland police officers who lost their jobs this week may find new work not too far away. oakland schools say they are hiring. ktvu's john sasaki is live now with a look at what this job entails. >> just days after 80 oakland officers lost their jobs, an opportunity is presenting itself. for children, is there anything better than playing outside during summer vacation. in west oakland, an area plagued by violence, a new program allows kids to play with little concern for their safety. >> he does not like to miss it at all. he does not want to miss the program. he wants to go to this program. >> reporter: it's a summer camp hosted by oakland district police, staffed with officers with less to do because school is out. >> it means a lot that police officers are donating our time and committing to the children to show that they are here for us. >> reporter: with a funding source separate from the city, police had held three positions expecting that the lay offs were coming. >> it's an opportunity for us to hire police officers from oakland who know the city to come work for us. i'm truly pleased that we're able to hire three. >> they need more, more than three. how about make it 12, how about 12? >> reporter: district officials say all this is taking a proactive approach with students. >> in order to have an environment where children can learn, you need to provide security first. that's what we're trying to do to really have a community involved police force. >> i think it's awesome that he's hiring three of the officers and hopefully that this program be success. and that he can hire 76 more. chief shiner says he should have the new officers on board in about a month. he adds that next summer he plans to do the same day camps in several more locations in the city. john sasaki, ktvu news. the san jose police officer association has announced the ratification of a new contract with the city. a union spokesman said that they have come to an agreement. federal officials today joined for a terrorist drill in the east bay. about a dozen agencies took part in the drill this morning at the old concord building. the scenario was a mock attack at a bart station. the idea is to test response plans, procedures and capabilities for such an incident. >> that's the purpose of this exercise is to use information to help officers make good decisions, to use coordination and corporation in mutual training. to help work together in the event of a catastrophe. >> reporter: the drill was organized by the northern california regional intelligence center. authorities have identified a third victim of a boating accident this week off the marin county coast. the coroner's office says the body of 65-year-old ronald fuente washed ashore yesterday. puente was among three men on board. the bodies of two other men have been recovered. the fourth fishermen identified as jack taylor of the valley is still missing. state health officials say today two women from stanislaus county have the disease. and what makes it more strange is how they were identified. john fowler has the report. >> reporter: two women got a letter like this, each telling them routine screening of their blood donations turned up positive for west nile. west nile carrying mosquitoes in stanislaus county had apparently bitten the unidentified women. >> these cases are a reminder that the virus is getting active. >> reporter: the women had given blood and learned from blood center counselors they had been infected. they were not hospitalized and apparently recovering. less than 1% of cases cause serious illness. west nile is one of five routine tests including hiv, and syphilis. blood center doctors say because of all the tests for west nile virus and other diseases, and now even cholesterol, donors have yet another reason to do this. >> we might tell the donor that they are infected with something before they even know. and they can go to their doctor and get appropriately treated. >> reporter: dr. lynne says in san francisco the most common infection discovered is hepatitis. but in the central valley and in the delta this time of year it is west nile. >> donors can be coming up positive twice a week. i know of 12 positive donors in california. >> because the other two cases have not been confirmed, the count stands at two but expect it to rise shortly. this testing is free for everyone who donates blood and that the need now is for o negative donors. the santa clara vector control district says that it will fog for mosquitoes next week. the district says weather permitting ground fogging will take place in the cities of san jose and campbell in an area bordered by payne avenue to the north, san thomas on the west, highway 17 on the east, and rincon and bud avenue to the south. the fogging is scheduled for thursday july 22nd and could take several hours to complete. there was a scramble to adopt chickens at the marine human society. all of the hens were gone by yesterday afternoon. only 29 hours after word came that they were available. as we showed you earlier this week, they were part of a flock of 200 hens. but the farmer gave up the birds due to injuries from putting bands on their legs. bay area congresswoman has introduced a new bill aimed at protecting struggling homeowners. jackie spears says the law will shield borrows who get loan modifications. the credit scores of those homeowners suffer when they get a modification. along awaited new walnut creek library is set to open tomorrow. city officials are organizing a grand opening tomorrow. for a first look at that new facility, the new library is at 1644 north broadway. the same location as the old library, it has a children's area, 90 public computers as well as a business resource center and a technology center. there was a key decision today about whether 200,000 state workers will have their pay cut. also ahead -- >> reporter: is this the solution of the alleged problem with the new iphone, or is there even a problem at all? that question still ahead. and a long line of joyful fans turn out in honor of gospel music legend. find out what they were waiting for. slightly cooler today but there'll still be some heat. i'll have the details. a judge today ruled against governor arnold schwarzenegger in a fight to pay state workers minimum wage. the judge denied the governor's request issued a retaining order that would have forced the state comptroller to pay the rate of $7.25 an hour. >> obviously we are happy about everybody getting their pull paycheck for the work that they do. it doesn't look like this budget year is going to be an issue at this point. >> the judge did schedule another hearing on july 26 to sort out whether the comptroller will have to pay minimum wage in the future. we will take a look at the case and what will happen in the future. california's unemployment rate dropped slightly last month. the jobless numbers fell to 12.3 in june compared to 12.4 in may. the unemployment rate can fall everyone when there are job losses because people may stop looking for work or leave the work force. it's estimated there were more than 2 million californians without jobs in june. here is a break down of the unemployment numbers for the nine bay area county, marin county had the lowest jobless rate last month with 8.2%. solano county had the highest with just over 12. the bay area continues to fair better however than many other california counties. we are not perfect, that was the message today from apple ceo steve jobs as he addressed problems with the new iphone 4. now the tech company is trying to make things right for iphone users. ktvu consumer editor tom vacar is live in san francisco to explain. >> a little exasperated, a little bit critical, steve jobs tried to placate consumers and critics alike. >> we are not perfect, that is the first thing on my first line. we are just a band of people working our [ bleep ] off to try to surprise and please our customers >> reporter: he announced a customer satisfaction plan. first a new software update as well as a new case that seems to improve or eliminate the problem for all iphone users. those who paid for a case, will get reimbursed. finally, if all that's insufficient, jobs will buy the phones back. >> we waived any restocking fees, anything, full refund. >> apple should do that. they are big and they shouldn't nickel and dime anything. i think they are doing whatever they can to take care of their customers who have been really good to them. >> i don't think many people wanted to buy it are on the line about it. really, they think it's a great phone. i like mine and i wouldn't hesitate at all. >> the rest of the corporate world should probably follow apples lead and do more of the same. >> i think they are acting responsibly and they would take care of the problem. i would still get one, the advantages are so great. >> i'm not worried, i already lover my iphone. i've had it two years and i can't wait for mine to come in the mail. so i'm excited. i love all the new stuff on it. >> and jobs said that those news reports that he knew of and dismissed the antenna problem early on was quote, a crock, unquote. reporting live, consumer editor tom vacar, ktvu channel 2 news. and you will find more information about the iphone 4 problems and how to get one of those new bumpers for your phone on ktvu.com. just click on the iphone 4 tab. according to a company memo obtained by venture bee, hp will move out of stanford. moving it's workers to the palo alto campus will make better use of space. bp says they are not exactly sure what's going on with that new cap sealing that once gushing oil well. gaps on the gush were closed last night and that appeared to stop the leak. but today the commander said pressure readings from the cap are lower than hoped for. it's not yet known if that's because oil is leaking elsewhere or pressure estimates were simply too high. tests on the well cap could last another 24 hours. the weekend is here and boy is it looking nice outside. bill, are we still looking at 100 degrees temperatures this weekend?
