it start thed happening just -- it started happening just before 2:00 this morning when they came into occupy san francisco and tole them to come out of the area. they gave them five minutes to leave. after they left they came in. now you know last wednesday san francisco mayor ed lee told them they had a few hours to decide if they wanted to take the mission street spot or not. since that time they did not take that place. we are talking from wednesday to now. one week they have been warned about this situation that it's potentially happening. right now as you can see police have surrounding this area right now. this is a fluid situation. we will stay on top of this. i will tell you all i have seen right here is one arrest so far this morning. once again we will stay on top of this. the people standing out here in the middle of the street, they have their hands up. some are sitting down. there is basically complying with the police officers. but of course we will bring you is out there. the cleaning crew is working on that area right now. it's hard to see. i know it's it will in there. a lot of the tents were taken down. i can't get over there right now. police are surrounding that area. from the distance of what i can see right now, there is a cleans crew and they are working and cleaning up that part of the area. >> certainly a very big police presence there. tragedy in the east bay city of dublin. the myth busters crew fired a home made cannon ball but then the experiment went terribly wrong. it missed its target and caused it to shoot over the hillside. it flew about the length of seven football fields. right into the creek neighborhood. where children were returning home from school. fortunately no one was hurt. but last night the sheriffs office spoke with the discovery channel which airs myth busters. >> they are very sorry this occurred and they have safety measures that are in place. they did have a misfire. and that they are going to -- they have insurance for these kinds of things. >> the cannon ball blasted through a front door. and then a bedroom where a man, woman, and toddler were sleeping. then the cannon ball came to rest inside a mini van. amazingly no one was hurt. uc berkeley has answers about a shooting death on campus. in an e-mail the dean says an investigation is nearly complete. 32-year-old christopher travis was shot and killed after allegedly brandishing a gun in a computer lab. the e-mail states a suicide theory. business school plans to appoint a safety council to review security measures and voice student concerns. the girlfriend of a man suspected of mowing down a firefighter is scheduled to be arranged today. eduardo is accused of intentionally ramming albert bartal at a san francisco gas station wednesday morning. the two had been in a fight at a nearby jack in the box. they found the suv that was involved in the hit and run. investigators accused tim da of trying to cover up the crime. police have ordered the owners of the restaurant to reduce his hours for now. it's located at 11th avenue and geary boulevard. now the city wants the jack and the box to close at 2:00 a.m. until the owner applies for and receives the proper permit. >> we are clear and the owner is clear that they do not have a valid permit to go beyond 2:00 a.m.. so the expectation is that they cease operation immediately. >> restaurant manager tells us the ownerrer is out of -- the owner is out of town. we learned they changed ownership in 2008. the owner has worked to make the restaurant safer 50s. san francisco police moving in on the occupy camp hours ago. ktvu alex savage continues our coverage. >> reporter: the chief told us things went in his words went well this morning. things were generally peaceful with one exception. he says two police officers were assaulted with metal chairs. he says protestors threw those chairs at two police officers as they moved in on justin herman plaza. you take a live look beyond us here. you can see public works crews are cleaning up a lot of the items that were here. furniture and clothing. this all happened about 1:00 this morning according to the police chief. he says officers in riot gear moved in an the encampment. he says overall there were 50 plus arrests made. at least 50 people were arrested right now. police are guarding justin herman plaza to make sure protestors don't make their way in. chief explained to us why they took action overnight. >> the mayor has been really thoughtfully and patiently negotiating with occupy leadership. and as of about yesterday, director nuro was getting no e- mails. they looked over the site. it appeared all communication had broken off. after the aggress i have attack -- aggressive attack on the officers last thursday, it appears the group had deteriorated. it became a health hazard inside and a public safety hazard on the outside. >> reporter: the chief was referencing there a spot in the mission district. a potential spot where the occupy protestors would be relocated. in his words it didn't look like folks would be moving to that area. you can see a lot of activity here at justin herman plaza as public works crews clean up the occupy sf encampment. more than 50 people arrested here. and according to the police chief two san francisco police officers assaulted. >> we have heard a lot of the prolates tours kicked out of justin herman plaza may have already or they are making their way over to the other spot in front of the federal building. did the police chief comment about that? will they try to clean out that area? >> right now from what becan tell the group that is gathered beyond -- you can't see it from our advantage point. but if we move over maybe we can get a better look here. on the other side of the plaza that is where all the demonstrators and folks forced out of the occupy sf encampment have gathered. they're at the foot of market street. they are essentially in the middle of the street. they are cheering, dancing, doing other sorts of activities. not anyone anywhere close to the encampment here. will make their pitch to the board of education for a charter school. they are appealing after the mount diablo school board rejected their charter description last month. they will also hear from district officials. the board will make a recommendation next month. the public is invited to tonight's meeting. that will be at oak park boulevard starting at 5:30. the city of richmond is proposing a soda tax to deal with the obesity of childhood -- with the problem with childhood obesity. the health director presented a report to the city council last night. he said part of the problems is sugary drinks. they said they would support a tax but hope it would go toward youth tax. >> we would want it to go to build more fields in our community. so it goes to antiobesity programs. >> the proposed ballot measure would create a penny per ounce on sugary drinks. the 49ers are winning on and off the field. the santa clara city council met last night to discuss a proposed statement. the city and team have secured $850 million in loans. now the price tag of the stadium has risen from $987 million to more than $1 billion. other financing will come from the nfl, the 49ers, and naming rights. >> there is no exposure. the bondholders and loan is not looking to the city in any way shape or form. >> santa clara has soothed feelings with great america. the park owner is dropping a lawsuit against the city and the niners hope to open the new stadium by 2015. however, the city of san francisco is not throwing in the towel yet. city leaders have been working quietly on a new stadium plan of their own. a firm is designing a privately funded retractable roof stadium at hunters point. mayor ed lee is scheduled to meet with jed y tomorrow which could be the last attempt to persuade the team to stay. barry bonds will be sentenced on december 16th. while his lawyers are appealing the obstruction of justice they are asking the judge to sentence him to home confinement. they cite his charity work. prosecutors will present their sentencing recommendations by the end of the week. bonds could receive a year or more behind bars. afghan president cut short a european trip and returned to kabul today following the attacks that killed 60 shiite worshipers. the taliban claiming the attacks is condemning them. that has sparked fears of violence in afghanistan for the first time. the u.s. embassy in kabul says one american is among the dead. 4:49 is our time right now. republican presidential candidate mitt romney is the latest to say he will not take part in a debate later this month that will be moderated by donald trump. he called trump personally and said he would not be able to make it. he joins ron paul saying they will not make it. rick perry and michelle bachmann have not decided. in san francisco a plan to offer tax breaks to businesses that hire excons has been rejected. the board of supervisors voted against the proposal in a 6-5 vote. legislation was introduced as a way to prevent crime. under the plan businesses would have been eligible for a $10,000 tax break for each excon hired. contra costa county supervisors are stepping up a campaign for fire services. the fire protection district will pay a political consultant to try to get the public to support the tax. if voters approve it next year, the tax could raise more than $16 million for the struggling agency opinion the amount of the proposed tax has not been decided. antinuclear advocate wants california to shut down the two remaining nuclear power plants. ben davis junior helped engineer the shut down outside sacramento back in 1889. now he's waiting to get a measure on next november's ballot. now he says the nuclear disaster in japan should make more people realize the dangers of nuclear power. >> i think it's on the forefront of every californians minds that the risks of this power and the unknowns of the risks of this power just are not worth the benefits we they rated the sf -- they raided the sf camp. paul chambers is at the foot of market street. he tells us within the last ten minutes about a dozen protestors were led away in handcuffs. we also have ktvu alex savage that is near justin herman plaza. he spoke with the san francisco police chief a short time ago and he tells us at least 50 people possibly more arrest were made in the process overnight since that raid began. again, the tents are gone. they are broken down in justin herman plaza. this is a live look along market street where you can see a huge police presence. we have team
